Special Agenda Item No.1. Welcome to newly elected President
of the CCIM – regarding.
It was noted that Dr. (Smt.) Vanitha Muralikumar, Member CCIM has been declared
elected as President, Central Council of Indian Medicine on 11.07.2014.
The Executive Committee welcomed to the newly elected President of the
CCIM.
Agenda Item No.1. Confirmation of minutes of the 195th meeting of
Executive Committee held on 07.07.2014 at New
Delhi.
It was noted that 195th meeting of Executive Committee was held on 07.07.2014 at
New Delhi. The minutes of the same were sent to all the members of the Executive Committee on 16.07.2014 by email to suggest addition/deletion if any in respect of
correctness of the minutes.
The same were also placed before the Committee at the time of consideration of the
same. The members informed that no addition/deletion is required in the minutes.
Therefore, the Executive Committee confirmed the same.

Agenda Item No.2. Minutes of the meeting of Sub-Committee to examine the applications for the post of
Stenographer Grade – II – Hindi (OBC).
It was noted that a Sub-Committee meeting was held on 08.7.2014 at CCIM office to examine the applications received for one post of Stenographer Grade-II – Hindi
(O.B.C.).
The Sub-Committee comprising of Dr. Amitabh Kumar, V.P (Ayurved), Dr.
Shuhabuddin, Dr. V.G. Udayakumar and Dr. Umesh Shukla went through in details of
the applications received, documents related to the Recruitment Rules, Advertisement and list sponsored from the Directorate of Employment, Delhi.
The Sub-Committee was of the opinion that listing of the candidates shall be done as
per the essential qualifications prescribed in the Recruitment Rules sanctioned by
Government of India on aggregate 50% marks secured by the candidates in the 12th class and they can be called for the skill test as per norms.
However, contents of the minutes of the Sub-Committee are as under:-
“The Sub-Committee gone through in details the applications received for one post of Stenographer Grade-II-Hindi (O.B.C.), documents related to the Recruitment Rules, Advertisement and list sponsored against CCIM ID No.2011001541 received from Data Centre, Directorate of Employment, Delhi.
The Sub-Committee is of the opinion that listing of the candidates shall be done as per the essential qualification prescribed in the Recruitment Rules sanctioned by Government of India on aggregate 50% marks secured by the candidates in the 12th class and they can be called for the Skill Test as per norms.”
Executive Committee agreed to the same.
Agenda Item No.3. Special Leave Petition No. 16777/2014 titled as
The Secretary, CCIM Vs T. Retnapandian & Ors.
before the Supreme Court of India.
It was noted that the High Court of Madras Bench at Madurai had passed an order dated 13.06.2014 on W.P. No. 4713/2014. In the said order, the Court allowed the
Writ Petition and declared the nomination of Dr. Vanitha Muralikumar to CCIM as
illegal. The Court further directed to UOI to reconsider the nomination of Dr. Vanitha
Muralikumar within 04 weeks. Based on this order, CCIM was in receipt of two PIL, one at Delhi High Court and other at Madurai High Court challenging all the nominations
done by GOI and restrain such members from office. Thereafter, above mentioned
order of the Court has been assailed by filing an SLP No. 16777/2014 by the Council titled as The Secretary, CCIM Vs T. Retnapandian & Ors. As informed by Shri Shadan
Farasat, Advocate on Record, Supreme Court of India that the above SLP was listed on
11.07.2014 and upon hearing the parties, the Supreme Court stayed the operation of order dated 13.06.2014 of the High Court of Madras Bench at Madurai. Accordingly, an
Office Order dated 11.07.2014 was issued by the Council directing to Dr. P. R. Sharma,
Registrar-cum-Secretary & Returning Officer to declare the result of President, CCIM.
As per result declared, Dr. (Smt.) Vanitha Muralikumar, Member CCIM has been elected President, CCIM.
Executive Committee noted and approved the same.

Agenda Item No.4. Legal opinion on the letter of AYUSH Deptt. dated
29.01.2014 issued to CCIM on complaint made by Dr. Bhusunurmath against Dr. R. Ganiger for
corruption charges-regarding.
It was noted that the letter vide dated 29.01.2014 received from Deptt. of AYUSH to
this Council regarding misuse of the post as member of CCIM by Dr. R. Ganiger for which Legal opinion is sought from Legal Section. In the said letter, it has been
directed to CCIM to examine the matter and send a report to Deptt. of AYUSH. As per
previous notes so far in this matter Council has demanded an affidavit from the
complainant (Dr. Bhusunurmath) and in this regard the same has been received from Dr. Bhusunurmath on dated 01.02.2014. However legal section has no knowledge that
whether any action regarding such complaint has already been initiated by this Council
or not.
Legal opinion in respect of complaint letter of Dr. Bhusunurmath vide dated
30.11.2013 is as follows:-
a. In respect of point no. 1 of complaint letter, CCIM has no locus standi to
take any explanation/clarification from Dr. R. Ganiger as to why he has used
name in respect of mentioned workshop. b. In respect of point no. 2 it is stated that it is to be cleared whether CCIM
members are allowed to use CCIM’s logo and name or letterhead or not for
any personal correspondence. Further regarding the extension of co-sponsorship fund in favor of organizing Secretary, Taranath Ayurved Medical
College, Bellary, the locus standi is of the said College to seek explanation
from Dr. R. Ganiger.
c. In respect of point no. 3 it is stated that nothing is found malicious in letter dated 11.10.2013 regarding contribution of study material from 1st and 2nd
year’s teachers for BAMS syllabus.
d. In respect of point no. 4, it is stated that DD/ Amount in respect of Co-sponsorship for organizing a workshop was required in favor of “Organizing
Secretary, Taranath Ay. Medical College Bellary” therefore the locus standi is
of a said College further nothing malicious is found in generating fund for Organizing for workshop.
e. In respect of point no. 5 the code of conduct for members, CCIM is required
to ascertain whether the said action/ conduct of Dr. R. Ganiger is illegal
within the category of misconduct.
Further, organizing workshop in 3 star hotel is the Prerogative of the organizing body to choose the venue, regarding organizing workshop for syllabus in a hotel, needs
clarification that whether such an event requires prior permission from state Govt. or
CCIM. Here the name of University has been used therefore locus standi is of the University and not of CCIM to object the same.
Executive Committee decided that member should not use CCIM Logo and
letter head in the name of CCIM while making personal correspondence. The same may be intimated to all members of CCIM. EC further decided that Legal
Opinion be sent to Govt. of India, Deptt. of AYUSH in reference to their letter
dated 29.01.2014.

Agenda Item No.5. Recommendation of Jamia Tibbia Deoband Medical
College, Saharanpur, (UP) under Section 13C for the session 2014-15- regarding.
It was noted that the recommendation of Screening Committee was for 60 seats. But due to typographical error, it has been mentioned as 50 seats in the minutes of
Screening Committee and same was informed in 193rd EC held on 28.05.2014.
Therefore, the seats as reported to 193rd EC in respect of above may be read as 60
seats.
Further, it is informed that the recommendation of said college as per actual
sanctioned seats by GOI has been sent to GOI with the approval of President I/c, CCIM.
Executive Committee ratified the same.

in respect of Visitation report of Ganga
Education Society’s Ayurvedic Medical
College, Kolhapur, Maharashtra under
Section 13 C of the IMCC Act, 1970.
It was noted that in reference to the decision of 193th E.C. held on 28.05.2014 under
Addl. Agenda Item No.10 the visitation report of Ganga Education Society’s Ayurvedic
Medical College, Kolhapur, Maharashtra containing only Part-II was placed before Screening Committee and Screening Committee after detailed examination decided to
not to recommend to Govt. of India for BAMS course.
Executive Committee ratified the same.
Agenda Item No.12. Decision on recommendation of colleges for
issue of LOP for increase in intake within the slab – regarding.
The list of colleges for issue of LOP for increase in intake within the same slab was
noted.
Executive Committee decided that visitation for LOP will not be conducted for the same slab in respect of proposal received under Section 13A of IMCC Act,
1970. The recommendation may be sent for enhancement of seats in
accordance with the proposal, if it has been recommended by CCIM for permission for the session 2014-15/Govt. of India has granted the
permission for existing courses for the session 2014-15.
Agenda Item No.13. Implementation of medical facilities to the retired employees of the Council –
regarding.
It was noted that a representation has been received from Smt. Bimala Wadhwa, Ex-
Office Supdt. requesting to extend the medical facility to the retired employees of

CCIM. In this connection, a copy of letter no. 2-8/14-CGHS/VC dated Nil of the
Additional Director (HQ), CGHS, R.K. Puram, New Delhi and a copy of O.M. No. S 11011/15/2013-CGHS(P) dated 10.06.2014 of the Ministry of Health & Family Welfare,
Nirman Bhawan, New Delhi has also been enclosed referring to a Contempt Petition
No. 89/2014- Hakim G.S. Reena Vs GOI & Anr.
Executive Committee agreed to the same and decided to extend the medical
facilities to retired employees of CCIM. EC also directed the office to take
necessary action in the matter.
Agenda Item No.14. Prescription of Ayurvedic Medicines by
Allopathic Doctors – reg.
It was noted that Govt. of India, Deptt. of AYUSH vide letter No. T.12016/02/2014-
DCC (AYUSH) dated 14.07.2014 has forwarded a representation from Himalaya Drug Company regarding prescription of Ayurvedic Medicines by Allopathic Doctors for
comments/views of the Council.
Executive Committee referred the matter to Legal Section for opinion.
Agenda Item No.15. AYUSH Doctors Recruitment (PSC) Scam- reg.
It was noted that a letter No. F. 6(8)/2014/DBCP/1455 dated 15.07.2014 is received
from Delhi Bharatiya Chikitsa Parishad, New Delhi forwarding therewith a
representation received from Mr. Ankit Yawad on the scam in recruitment of AYUSH
Doctors and distribution of scholarship to SC/ST students in some Ayurvedic college
and paramedical colleges of Madhya Pradesh. The said representation which is
addressed to state President of BJP (Bhopal).
Executive Committee noted that since matter does not pertain to the CCIM
therefore no action is required at the end of CCIM.
Agenda Item No.16. Revamping of website – regarding.
It was noted that the website of CCIM requires revamping which may be done by a
Sub-Committee to be formed for the same.
Executive Committee agreed to the same and decided that Vice-President (Ayurved) and Vice- President (Unani) will look after the matter. Dr. Praveen,
Ayurved Expert, Dr. Rasikh Javed, Unani Expert & Dr. Kumaran, Siddha Expert
from office will assist them.
It was also noted that the following Agenda Items at No. 17 & 18 were also
considered in the meeting of Education Committee (Ayurveda and Unani) held on 14.07.2014.

Agenda Item No.17. Creation of an Award for Best Teacher – reg.
It was noted that the best teacher’s award in each department in all the three Indian
Systems of Medicine may be conferred on 5th September every year. A modality on the
aspect may be brought out by forming a Sub-Committee, if agreed to.
Executive Committee decided that a prestigious award should be awarded to
an eminent personality of Ayurved, Unani and Siddha Systems of Medicine in the name of H.S. Kasture Memorial Award (for Ayurved), Hakim Ajmal Khan
Award (for Unani) and Dr. C.S. Uthamarayan Award (for Siddha). Rs. 1 Lakh
with silver salvar will be given. For this purpose, the award will be registered under the Society’s Registration Act, 1860. It was also decided that CCIM will
award a best teacher among all Ayurved, Unani and Siddha Colleges and
award to 5 teachers from Ayurved, 2 from Unani and 1 from Siddha stream
will be given each year. Modalities in this regard will be framed by a Sub-Committees constituted by President, CCIM.
Agenda Item No.18. Allotment of teachers’ code and development of teachers database–
regarding.
It was noted that it has been felt necessary to allot a code number to all the teachers
of all three Systems (Ayurved/Unani/Siddha) for which a modality/guidelines are to be formed.
Executive Committee principally agreed to the same and decided that the
online declaration may be asked from the colleges and code number will be
issued to eligible teacher at first instance and eligibility in respect of ineligible
teacher will be settled after obtaining the clarification from principal of
respective college and after satisfaction suitable action will be taken. It was
also decided that CCIM will issue the number only. The I-card with code No.
issued by CCIM will be issued by the college. EC further authorized President,
CCIM to take final decision in the matter.
Addl. Agenda Item No.1. Visitation report of Mayurbhanj Ayurved
Mahavidyalaya, Orissa under section 13C.
It was noted that Mayurbhanj Ayurved Mahavidyalaya, Baripada was visited on 10-11.03.2014 to assess the available facilities of teaching and practical training for
making admission in Ist year of Ayurvedacharya (BAMS) course. It was observed that
visitation report was duly signed by one visitor.
As per decision of EC at its meeting held on 04.04.2014, the clarification from two
members i.e. Dr.Prajapati Tripathi and Dr. Mantosh Kumar Jha were asked.
Dr.Prajapati Tripathi and Dr. Mantosh Kumar Jha have confirmed that due to the ill-

health they could not proceed for visitation and same was informed to the office.
However, the same is not in the notice of Ayurved Section.
However, matter is again placed for consideration and decision please.
Executive Committee decided to give an opportunity of hearing by a sub-
committee comprising of Vice-President (Ayurved), Vice-President (Unani),
Secretary and Dr. Richa Sharma to these two members and till then these members will be suspended from assigning any work of Central Council. The
comments of third visitor may also be asked to clarify the matter. Considering
that college vide letter dated 08.03.2014 has informed that 12 more months are required to fulfill the shortcomings, therefore, college is not fulfilling the
criteria of MSR at the movement. Therefore, it may be recommended to GOI
for not granting the permission of the session 2014-15.
Addl. Agenda Item No.2. List of Ayurveda colleges not visited for the
session 2014-15 –Regarding.
It was noted that the following colleges have not been proposed for visitation for the session 2014-15 as the
Govt. of India while issuing an order for not granting permission to those colleges had asked the same to submit
the compliance on the shortcomings as mentioned in the order of respective colleges. Further, the Govt. of India had endorsed a copy to the Council requesting the CCIM to verify the compliance by means of an inspection
and submit the report to the Deptt. of AYUSH for considering the matter. It is informed that as per record
available, CCIM has not received any compliance from the colleges. Therefore, the said colleges have not been proposed for visitation, and also may not be granted permission for the session 2014-2015.

It was noted that as informed by Vice-President (Unani), some complaint/adverse comments have been posted in his Facebook against him which are abusive. As per
instruction of President, CCIM, the matter was placed before the E.C.
Executive Committee decided that complaint should be lodged in Police Station as cyber crime and to explore the possibility to file defamation suite in
the matter.
Addl. Agenda Item No.4. Change of Designation - regarding.
It was noted that as per instruction of President, CCIM, the designation of presently appointed/engaged Ayurved/ Unani/Siddha Experts was to be re-designated to
Technical Assistant(s), Ayurved/ Unani/Siddha.
Although, Executive Committee agreed to change the designation of experts
as Technical Assistant (Ayurved/Unani/Siddha), however, EC authorized the
President, CCIM to change the designation to any appropriate designation in place of Technical Assistant if President desires so.
Addl. Agenda Item No.5. Quotation for engaging new Legal Firm.
It was noted that as per instruction of President, CCIM, to look after the work of Court Cases and all legal affairs in various courts of law, a new law firm has to be engaged
for which quotations may be invited and the matter was placed before the E.C.
Executive Committee agreed to the same. It was also agreed that till new law
firm is engaged, Legal Axis will continue to work.
Addl. Agenda Item No.6. High Jacking of password of email of Legal
Section of CCIM – regarding.
It was informed to the EC about the high jacking of password of email of Legal Section
of CCIM without being in knowledge of office. A memo has been issued to two Legal
Consultants (Ms. Shagufta Bano and Ms. Banani Sikdar) on 18.07.2014 in this regard.
EC authorized President to take any appropriate decision in the matter after
identifying the person who changed the password.

It was informed to the EC that a number of Court cases are there wherein CCIM is a
party and whereas work of legal section is not satisfactory.
Executive Committee authorized Vice-President (Unani) to look after all the
court cases/legal affairs of CCIM.
Addl. Agenda Item No.8. Creation of new post in CCIM- regarding.
It was noted that the President, CCIM has expressed her views that the quantum of work in the office of CCIM has increased many fold and as per present requirement,
following posts are essentially required in the office:-

It was noted that a Bill dated 11.07.2014 of Attorney General of India, Mukul Rohatgi

President I/c, CCIM. The same have been examined and his presence has been verified

Section13C as per the decision of 193rd meeting of Executive Committee held on
28.05.2014.
Further it is submitted that a meeting of Screening Committee, under the convener
