Key Features and Benefits
CUA AFA2018 provides Buyers with a choice of services and contractors.
Contractors have quoted maximum hourly rates, which Buyers can reduce upon negotiation.
Exclusions
Services offered by the Western Australian Treasury Corporation (WATC) do not form part of this CUA; this means that Public Authorities can elect to engage the WATC to assist with their requirements.

Consider Contractor’s Offer/s. This is also your opportunity to negotiate Contractor’s below the maximum hourly rates.
If applicable, Customer prepares written justification as to why a particular Contractor was selected over other Contractors and make it available if required for review.
Step 6 Buy it
Email your Customer Acceptance of Offer Form to the Contractor to
confirm your order.

What’s on offer?
Category A – Audit Services For audit services (other than for forensics or probity) including internal audits, performance (operational) audits, compliance audits, financial audits, information systems audits and corporate governance reviews.
The Institute of Internal Auditors’ Professional Practice Framework (PPF) defines Internal Audit as “an independent, objective assurance and consulting activity designed to add value and improve an organisation’s operations. It helps an organisation accomplish its objectives by bringing a systematic, disciplined approach to evaluate and improve the effectiveness of risk management, control, and governance processes.”
Treasurers Instruction Part XII outlines the basic requirements for an effective internal audit function and stipulate that audit services shall be carried out in accordance with the most recent Standards for the Professional Practice of Internal Auditing issued by The Institute of Internal Auditors.
Contractors should provide feedback and advice to the Customer and/or audit committees on Best Practice in both the public and private sectors as part of the internal audit reporting function, as this will assist enhancement of the Customer’s efficiency and/or effectiveness and its controls.

Category B – Forensic Audit Services For investigations through forensic accounting to prevent and resolve commercial disputes, fraud, misconduct, and breaches of rules and regulations.

Category C – Probity Services For independent scrutiny of a process (including activities such as outsourcing, procurement, disposal of assets) to ascertain whether procedures followed are consistent with appropriate regulation, guidelines and best practice principles of openness and transparency. Probity Advisors and Probity Auditors should address:

Impartiality
Dealing with conflicts of interest
Accountability and transparency
Confidentiality.
Probity Audits Probity Audits will examine and evaluate whether a Customer is complying with a probity plan during the life of a project and also assesses whether the established criteria, standards and principles have been complied with at the completion of a project.
Probity Advice Probity advice and assistance will be provided before and during a process to improve the outcomes of a process and/or address unexpected probity issues that arise.

Category D - Risk Advisory Services For business/business unit, procurement, project, program or initiative risk reviews, assessments and facilitation services including advice and assistance in defining and assessing risk categories and treatments, workshops and training.
Treasurer’s Instruction 825 Risk Management and Security states:
“The accountable authority shall ensure that:
(i) there are procedures in place for the periodic assessment, identification, and treatment of risks inherent in the operations of the agency;
(ii) suitable risk management policies and practices are developed;
(iii) an appropriate level of security is maintained over money, public and other property of or under control of the agency, including information held and intellectual property developed and controlled by the agency; and
(iv) these procedures, policies and practices are documented in the financial management manual or other relevant policy manuals.”
The provision of risk advisory services will be in accordance with the existing Western Australian Government Risk Management Guidelines which adopt an enterprise-wide risk management approach.

Category E – Financial, Accounting and Taxation Advisory Services For advice on financial, accounting and taxation matters including:
Financial Modelling The development of financial models to support financial forecasting and analytics. This may include financial model reviews, advice and design.
Financial Statements Analysis
Support and advice on the interpretation of financial statements and related data that would assist Customers in their financial planning, resource management and decision-making
Development of Accounting Policies and Procedures
Advice on the formulation and implementation of accounting policies and procedures in accordance with the requirements of the FMA.
Preparation of Financial Statements and Annual Reports
Assistance with the preparation of financial statements and annual reports in compliance with the requirements of the FMA and International Financial Reporting Standards.
Accounting Advice Advice on the accounting treatment of large transactions, budget and cash flow management and advice on management models for facilities.
Taxation Advice Advice on State and Commonwealth tax legislation and its impact on the operation and performance of Customers, and related reporting requirements.

Category F - Procurement Advisory Services For procurement advice including:
Business Case Development
Strategic analysis and advice at project and program level to support investment planning and decision-making. Preparation of business cases in accordance with project concepts and guidelines.
Procurement Strategy Development
Preparation of procurement strategies at project and program level including the assessment of procurement options (e.g. design and construct, alliance, public private partnership, lease versus buy or other arrangements). Validation of procurement strategy through market capability analysis and market soundings.
Procurement Process Support
Development of selection/project evaluation criteria, development of tender documentation and support for tender evaluations, including value for money, financial and commercial evaluations. Assist in tender negotiation phase.

Category G - Financial Assessment services For the assessment of the financial capacity of organisations including for pre-qualification, pre-contract award and post contract award monitoring of contracts. Financial assessment services provide a due diligence check to assess a contractor has the financial capacity to complete the work or supply the goods and services without becoming insolvent or experiencing financial distress.

Buying rules
Buying Direct Prices for this CUA are the maximum rates allowable so Public Authorities can pick and buy the specified services from the Contractors with the ability to negotiate a lower rate and without calling tenders.
Public Authorities should view Contractor Price Guide to obtain rates for the services they require. Where more than one contractor is selected from a category, Public Authorities can evaluate which contractor represents best value for money for their scope of work, and then contact the contractor to arrange the service.
If the estimated value of the work is greater than $250 000 (including GST), it is the Public Authorities’ responsibility to seek sufficient quotes from the panel of contractors and make a Value for Money decision. The justification behind why a particular supplier was selected should be documented and available for review.
Orders should be placed directly with contractors by e-mail using the Customer Quote/Order
Form.
If you are using a Contractor for the first time, you will probably need to establish a new account.
Pricing As maximum prices have been agreed with Contractors on this CUA, Public Authorities are encouraged to negotiate the prices quoted by the selected contractor(s) when purchasing services from this contract.
Payment for services purchased on this CUA can be made either by Purchasing Card, cheque or Electronic Funds Transfer (EFT) and should be paid within 30 days of receipt of an invoice from the Contractor unless a fee is disputed.
A comparison of prices is provided in the Contractor Price Guide for Audit Services and Financial Advice. These appendices will provide you with a guide to the maximum total cost of the audit services and/or financial advice based on your agency’s requirement.
Payment by Purchasing Card The Government Purchasing Card offers a quick and convenient method of payment allowing many goods and services to be efficiently purchased.
Always remember to inform the supplier that you will be paying by Government Purchasing Card, at the time of ordering the product or service, and ensure they clearly understand that they must send the tax invoice directly to you, the cardholder.

Other policy requirements Buyers should be aware of the following requirements under State Supply Commission policies and Treasurer’s Instruction 820, and whether or not they are applicable to purchases from this CUA.

Buyers must obtain approval from an authorised officer of the Department of Finance to purchase through an alternative arrangement to this mandatory CUA.
Yes, at all values, if the delivery location is in the Perth metropolitan region. Please note that public authorities are not required to request advice or approval from the Department of Finance, regardless of value, when seeking an exemption from the minimum requirements of the Open and Effective Competition Policy and the use of mandatory Common Use Arrangements for a purchase from an ADE or an Aboriginal Business.
Exemption from using this CUA Government Procurement is responsible for processing and approving all requests from public authorities seeking exemption from using a mandatory CUA. Requests for an exemption are considered on a case-by-case basis, and a requesting agency must be able to demonstrate that a business need cannot be adequately met by the relevant CUA.
Exemption requests should be directed to either the Director of Common Use Arrangements in the first instance. Requests for exemption may be received by posted letter or email, but must be in writing and provide sufficient explanation and background to enable the request to be considered. The requesting officer should be the Accountable Authority or delegate of the agency.

Appendix 1: Frequently Asked Questions Do I have the ability to negotiate a better price?
Yes. The prices stated in Contractor Price Guide are the maximum hourly rates for the provision of audit services and financial advice. Agencies have the ability to negotiate a lower price with contractors.
Am I required to use the Contractor’s terms and conditions?
No. The Contractor has agreed to the Department of Finance’s Request Conditions and General Conditions of Contract (December 2016). Do not agree or sign any alternative terms and conditions.
If you are engaging the services of Deloitte Touche Tohmatsu, EY, GHD Advisory, Infosys Portland, JLT, KPMG, Lazard, PwC Partnership, PwC Securities or Ubique, please note that there are departures to the standard terms and conditions in place for this CUA. Please contact the contract manager for a copy of the amendments.
Who has ownership of the Intellectual Property Rights under this CUA?
For this CUA, the Intellectual Property Rights in the New Material may be owned by the Contractor.
Note that for arrangements whereby the Intellectual Property Rights in New Material are owned by the Contractor, the Contractor grants to the Customer an irrevocable, perpetual, royalty-free, non-exclusive licence to exercise any or all of the rights of an owner of Intellectual Property Rights in the New Material during the remainder of the duration of the Intellectual Property Rights in that New Material.
If you wish to retain the Intellectual Property Rights in the New Material, please specify this in the Order/Customer Contract.
I have not used audit services and/or financial advice in the past, how do I know whether this contract is suitable for my requirements?
The ‘Definitions’ section provides an easy reference on the types of services available under this CUA. If you are still unsure whether your requirements are included, please contact the Contract Manager.
How do I know if the Contractor will provide good services?
All Contractors will meet or exceed, as a minimum, the quality of service specified in the CUA AFA2018 terms and conditions. It is recommended that you discuss with your potential Contractors and make an assessment as to which best meets your needs.
Do I have to obtain approval from an authorised officer of the Department of Finance to purchase through an alternative arrangement to this CUA?
Yes (with the exception of Category H), at all values, if the delivery location is in the Perth metropolitan region.
Please note that public authorities are not required to request advice or approval from the Department of Finance, regardless of value, when seeking an exemption from the minimum requirements of the Open and Effective Competition Policy and the use of mandatory Common Use Arrangements for a purchase from an Australian Disability Enterprise or an Aboriginal Business.

Do I have to buy from this contract if I am purchasing from a regional location?
No. This CUA is only mandatory for Public Authorities in the Perth Region.
Do I need to get quotes?
Simply contact the Contractor for the services you wish to order and complete the Customer Quote/Order form. Note that this CUA offers fixed maximum prices which can be negotiated with the contractor. It is acceptable to contact more than one contractor in order to compare prices.
What happens if I need to purchase services that are not available on this arrangement?
You will need to source such services via an agency specific contract in accordance with the State Supply Commission policies.
Can I use this CUA for Gateway Reviews?
No. The Gateway Review Process (Gateway) is available to agencies to support the effective development, planning, management and delivery of major projects and programs. In using CUA AFA2018 please note:
Gateway reviews do not form part of the CUA. Agencies who require reviews should contact the Gateway Unit at [email protected]
Panel Contractors may prepare documentation relevant to projects selected for Gateway review. Agencies may find it useful to note the lessons learnt by other Public Authorities where contractors on this panel are involved in the preparation of financial information, risk management plans or governance structures for major projects or programs. How does Finance manage the contract?
The Contractor, at the end of every quarter, reports to the Department of Finance on the range of services provided to Public Authorities. This enables the Department of Finance to monitor the performance of the contract against the key performance indicators and Contractor compliance with the terms and conditions of the contract.
What do I do if I am unhappy with the service of a Contractor?

Appendix 2: Accessing CUA information online The options available to you to access CUA information including contracted prices, contractor details and order forms will depend on the procurement system used in your agency. Systems available to you could include Oracle or SAP.
