the truth ..... Section 10, Article II) and to value the dignity of every human person and guarantees full respect for human rights(Section 11, Ar· ticle II).
These solemn and sacred duties of serving and protecting the people are not exclusive to the government cons ider·ing the limited funds and the vast multi-dimensional develo:pment concern of the people.
Cognizant to this limitation, the Constitution provides that the State shall encourage non-governm.ental, community-based, or sectoralorganizations that promote the welfare of the nation (Section 23, Article m.
This is how Projekt Mariphil through its Mariphil Children' s Village AtongPinuy-anan, Inc comes in action at Panabo City in championing children' s rights.
Its partnership with Local Government Unit - PanaboCity stems from its social response to the provis ions on the United Nations Convention on the Rights of the Child (UNCRC) which was ratüied by the Philippines in August 21, 1990.
By ratifying the Convention (provisions), the Philippines became a state party which means that it is committed itself to undertake all appropriate measures to ensure that the child is pro-

Moreover, with the ratification, the country was entrusted with the mission to undertake all appropriate legislative, administrative, and other mea.sures for the implementation of the rights recognized in the Convention. With regard to economic, social and cultural rights, the Philippines shall undertake such measures to the maximum extent of their available resources and, where needed, within the framework of international co-operat i o n (~btgµ:.tam).
With the foregoing, appreciative of the situation of the margi.nalized children in Panabo City, then Mayor Atty. Jose Silvosa sought the assistance of the German Mariphil Association and the Filipino Mariphil Foundation in 2009 to have a collaborative development inter· vention to children in need of special protec-
tion whom without home· and parental care.
The German and Philippine MARIPHIL Foundations are both acknowledged as Nonprofit and Non-stock Organizations and cooperate successfully regarding development aid since 1998. The Association operates in the areas of Panabo City and Carmen in the region of Davao del No;rte, Mindanao. According to the slogan of the Association "Future for Children" it focuses on the help for children in need especially regarding the access to education (scholarships, school renovations, educational programs etc.) and health care (financing of Operations, provision of medicine etc.). Presently, it has more than 200 indigent scholars within the area of Panabo and Carmen.
Other programs of the MARIPHIL Association, for example a Rice Farmer's Cooperative, the provision of solar powered water tanks and the annual distribution of rice during Christmas season aim to improve the general living Situation of indigent peo-
ple in the prqject area. In September
2010, the Triparty Agreement regarding the .::onstruction and the operations of a children's village in Panabo City was inked. The Mariphil and the German Minis try of Economic Corporation and Dev e lopment funded .. the construction of
. the facility and other related expenses in the a.mount of Twenty One Million (P2 l Million) more or less in 2011. In return, the City of Panabo shall subsidized the taking over running expenses for 15 years.
The Mariphil Children's Village was opened in 2012 and it was licensed and accredited in 2013 by the Department of Social Welfare and Development Field Office RO XIto operate as a welfare and deve lopment agency implementing residential care services and programs to disadvantaged children, youth and children in conflict with the law.

This is now the issue Said unount was subjected to an Audit Observ, .tion Memo (AOM) dated December 28, 201'8 by the Commission on Audit.
The trends & time weekly newspaper in its February 12-18, 2016 publication bannered "Mariphil funds disallowedl written by Dennis D. Denora.
But prior to the AOM, the City of Pa.nabo through the incumbent Mayor James G. · Gamao pre-terminated its obligation and pulled out its support for 2015 to present.
The article quoted COA's observation say ing th.at the release of fund totaling toP4.44 M to the Mariphil Children's Village causes injury to the local government through loss and wastage of its money,
In deference to COA's observation, the Mariphil Children's Village posits that the subsidy of the City Government of Panabo does not constitute loss and wastage of money which caused injury to its coffer.
Said amount was utilized for public purpose - the provision of appropriate social services to children in need of special protection which is the pr~ordial role of the city government of Panabo concretized by the Mariphil Children's Village.
The personnel of the Mariphil Children's Village are instrumental to the fulfillment of the pubHc purpose. The social services will only be felt by the children beneficiaries through the human capital managing and facilitating the services.
This administrative cost as pointed out in the AOM is necessary or relevant in ad-vancing the public interest. ·

the truth ..... _· -----------------The Supreme Court of the
Philippines in the case of Ramon R. Yap vs. Commission Audit, GR No. 158562, April 23, 2010 elaborates the nature and meaning of the term public purpose, in relation to disbursement of public funds, to wit:
"As understood in the tra.ditional sense, public purpose or public use means any purpose or use directly available to the general public as a matter of right. Thus, it has also been defined as an activity as will serve as benefit to [the) community as a body and which at the same time is directly related function of government. However, the concept of public use is not limited to traditional purposes. Here as elsewhere, the idea that public use is strictly limtted to clear cases of use by the public has been discarded. In "fact, this Court has already categorically stated that the term public purpose is not defined, since it is an elastic copcept that can be hammered to fit modern Standards. It should be given a broad interpretation; therefore, it does not only pertain to those purposes that which are traditionally viewed as essentially government functions, such as build-
ing roads and delivery of basic services, but also includes those purposes designed to promote socialjustice.
Thus, public money may now be used for the relocation of illegal settlers, low-cost housing and urban or agrarian reform. In short, public use is now equated with public interest, and that it is not unconstitutional merely because it incidentally benefits a 1imited number of persons."
Here, Mariphil Children's Village fulfills the mandate of the government which is to aid those children in need of special protection. The village was able to provide shelter, psychosocial support, education, basic needs (Le clothing, food, medicine, etc) and nurturing environment to more than 100 physically / sexually abused, neglected, orphan and children in conflict of the law, among others. These services are impressed with public interest, thus, fall within the ambit of public service ..

lt must be noted that the subsidy of the City Government represents approximately 30% of the total yearly expenses. lt is the German Mariphil Association and the Filipino Mariphil Association that share the most. In this partnership, the obligation of the City Government of Panabo under the Triparty Agreement is advantageous and economical to the government.
As recipient of public funds, Mariphil Children's Village is mindful and conscious of this fundamental principle: "Public funds are the property of the people and must be used prudently . at all times with a view to prevent dissipation and waste".
Mariphil Children's Village hopes to shed light to the ongoing issues pertaining to this undertaking entered into by the City Government of Panabo through its late Mayor Jose Silvosa.
lt belieyes that the City Government of Panabo shall continue the partnership. It must act as parenspatriae to protect the children, who because of their circumstances, are being prejudiced and discriminated. It is called upon to manifest an attitude of caring for the welfare of the marginalized children.
As to Mariphil Children's Village, its existence is meant to bring the marginalized youth into the folds as it affirms the vital role of the youth in nation building (RA 8044).
Premises considered, it is undeniable that the funds from the City Government of Panaboreleased to Mariphil Children's Village were spent for public purpose. (Shyanne Halub, Director. Mariphil Children's Village). a press release
turning point .... ___ _ One glaring exam.ple is the latest ges
ture of former Davao City 1st district congressman Prospero "Boy" Nograles .who is now supportirig the presiden.tial aspiration of Mayor Rodrigo, a political nemesis for almost three decades.
But the political wind it seems is now blowing in the same direction. Nograles who is likewise endorsing party-list group Puwersa ng Bayaning Atleta (PBA) where another son Koko is a candidate, is determined to join the political battle against the ruling Liberal Party CLP) in the forthcoming May presi<iential elections, or until a permanent leader will be elected to succeed the wa.ning President Noynoy Aquino.
The first thing to know about "Boy Nogie" Nogra.les aside from being the polittcal archenemy of Duterte for severa.l yea.rs was his close association with the previous Arroyo administration.
The second thing to know is he served the Lower House for severa.l terms until elected as Speaker of the House, the first from Mindanao who a.chieved the fate - a Job which seemed better match to his political temperament.
According to trends a.nd time publisher-editor Kuya. Dennis Denora, Nograles just recently spoke to different groups in Sto tomas town and a. herd of reporters in Davao del Norte and enc;iorsed the candidacy of Duterte and the party-list PBA.
Rightly or wrongly, Boy Nogie who also has a. previous shabby reputation in dealing with his rivals seems now more · considerate by telling the people around him "to forget the past political spat" with Digong in order to fulfill the people's clamor for total change.
Nograles confidently believe that be~ cause of Duterte's tough and stringent stance against drugs, criminality, corruption and extreme pove.rty and confrontational approach to politics, will make a nice contrast with his opponents' views notably LP standard bearer Mar Roxas, a power-obsessed and desperate pretender. ,~ ., ~~ii~::c:~~!{s!~~:~:::::"
