STAFF RECOMMENDATION:

1) Staff recommends that the Zoning Administrator adopt a resolution (Attachment 1) to: Find Project #EG-15-024 exempt from CEQA pursuant to Section 15301; and

PROJECT DESCRIPTION: A Minor Conditional Use Permit to utilize an existing tenant space in the Light Industrial (LI) zoning district for a 12,800 square-foot indoor practice facility for baseball. The facility would be used primarily by youth baseball teams to practice pitching, hitting, and fielding after school hours, as well as for personal instruction given to some players on a one-on-one training for baseball skills. The applicant has stated that the only modifications to the space would be installation of two restrooms and an approximately 750 square foot office/check-in area in front of the building, as well as installation of turf, nets, screens, and mats. vi. Professional, vocational, and trade schools of a non-industrial nature (e.g., culinary, cosmetology, arts and media, accounting and finance, health and dental including nursing, legal, psychology, and technology); and

vii. Studio-style facilities including, but not limited to, dance/ballet, art, photography, yoga, martial arts (e.g., karate, kung fu, judo, tae kwon do, jujitsu), and fitness studios other than “indoor fitness and sports facilities.”

This facility would be categorized as a “Specialized Education and Training/Studio” instead of a “Fitness and Sports Facility” because it is available for training purposes for youth sports by appointment only instead of being available to the public. Therefore, it will operate similar to a martial arts studio. By contrast, “Fitness and Sports Facilities” means predominantly participant sports, such as bowling alleys, billiard parlors, ice/roller skating rinks, soccer arenas, athletic clubs, etc., which would have more significant impacts to parking and various other factors. The majority of the players who will utilize the facility are ages 6-16. This program will be through cooperation with Laguna Youth Baseball and the Cal Ripken Baseball League and will also be available to the local school teams within the area. The facility will be open by appointment only through a youth membership program and will not be available for adult training. The facility will be open seven days per week with varying daily hours, depending on demand and school scheduling. According to the Applicant, the hours of operation are projected to be 3:30pm through 9:30pm Monday through Friday and 9:00am through 9:00pm Saturday and Sunday. The facility will typically not have more than two youth teams occupying it at a given time; typically 20-25 players. According to the Applicant, the majority of the players will be dropped off at the facility for the two-hour practice. Practices are generally operated by 2-3 coaches. In addition, the facility will have 1-2 employees who will maintain the business activities. Pursuant to the Elk Grove Municipal Code, “Specialized Education and Training/Studios” require one (1) parking space per 2 students, plus one (1) parking space/employee. Based on the occupancy numbers above, the use will require approximately 15-20 parking spaces. The industrial building contains a shared parking lot which is utilized by multiple tenants. Based on a project which was approved in Suite 900 of the same building in May 2015 (EG-15-006) there is currently a parking excess of approximately 38 spaces. Therefore, the Project need of 15-20 spaces would not exceed this surplus. Further, the Applicant has stated that they will stripe parking spaces along the north side of the building adjacent to the suite’s loading bay, which will be utilized primarily for employee and overflow parking if necessary. Based on this, the proposed Project would not have a significant impact on on-site parking. The Project was routed to all applicable departments on June 23, 2015. No comments were received from any departments. ENVIRONMENTAL DETERMINATION: The Project is exempt from CEQA pursuant to CEQA Guideline Section 15301 (Existing Facilities) of Title 14 of the California Code of Regulations. CEQA Guidelines Section 15301 applies to projects that consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures facilities, mechanical equipment, or topographical features, involving negligible or no expansion or use beyond that existing at the time of the lead agencies determination. The Project involves locating a “Specialized Education and Training/Studio” use into a suite within an existing industrial facility. There will be no expansion of the existing building. No special circumstances exist that granting a Minor Conditional Use Permit would create a significant adverse effect on the environment.

A RESOLUTION OF THE ZONING ADMINISTRATOR OF THE CITY OF ELK GROVE FINDING THE PROJECT EXEMPT FROM CEQA AND APPROVING

A MINOR CONDITIONAL USE PERMIT FOR THE

ELK GROVE BASEBALL CENTER

PROJECT NO. EG-15-024 3132 DWIGHT ROAD, STE. 600

APN: 119-1540-031

WHEREAS, the Planning Division of the City of Elk Grove received an application on June 19, 2015 from Elk Grove Baseball Center (the Applicant) requesting a Minor Conditional Use Permit to utilize a suite within an existing building zoned Light Industrial (LI) for a “School – Specialized Education and Training/Studio” use, (the Project); and

WHEREAS, the proposed Project is located on real property in the incorporated portions of the City of Elk Grove more particularly described as APN: 119-1540-031; and

WHEREAS, the Project qualifies as a project under the California Environmental

Quality Act (CEQA), Public Resource Code §§21000-21189.3 but is exempt; and WHEREAS, Section 15301 (Existing Facilities) of the California Code of Regulations, Title 14, (State CEQA Guidelines) applies to projects that consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures facilities, mechanical equipment, or topographical features, involving negligible or no expansion or use beyond that existing at the time of the lead agencies determination; and

WHEREAS, based on staff’s review of the Project, no special circumstances exist that would create a reasonable possibility that granting a Minor Conditional Use Permit for this Project will have a significant effect on the environment; and

WHEREAS, the Planning Department considered the Project request pursuant to the Elk Grove General Plan, the Elk Grove Municipal Code Title 23 (Zoning), and all other applicable State and local regulations; and

WHEREAS, the Zoning Administrator held a duly noticed public hearing as required by law to consider all of the information presented by staff, information presented by the Applicant, and public testimony presented in writing and at the meeting.

NOW, THEREFORE, BE IT RESOLVED that the Zoning Administrator of the City of Elk Grove finds the Project exempt from the provisions of CEQA under Section 15301 (Existing Facilities) of Title 14 of the California Code of Regulations based upon the following findings:

Finding: The Project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301 (Existing Facilities) of Title 14 of the California Resources Code of Regulations. Evidence: CEQA Guidelines Section 15301 applies to projects that consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures facilities, mechanical equipment, or topographical features, involving negligible or no expansion or use beyond that existing at the time of the lead agencies determination. The Project involves locating a “School – Specialized Education and Training/Studio” use into a suite within an existing industrial facility. There will be no expansion of the existing building. No special circumstances exist that granting a Minor Conditional Use Permit would create a significant adverse effect on the environment.

AND, BE IT FURTHER RESOLVED, that the Zoning Administrator of the City of Elk Grove

approves the Project as described in the Project Description provided in Exhibit A, incorporated herein by this reference, the Project Plans as illustrated in Exhibit B, incorporated herein by this reference, and subject to the Conditions of Approval as provided in Exhibit C, incorporated herein by this reference, based upon the following findings: Minor Conditional Use Permit

Finding #1: The proposed use is consistent with the General Plan and all applicable provisions of Title 23 of the Municipal Code (Zoning Code).

Evidence: The General Plan land use designation for the subject property is Light Industry and the zone district is Light Industrial (LI). The proposed “School – Specialized Education and Training/Studio” use is a conditionally allowed use in the LI zone. Thus, the issuance of a Minor Conditional Use Permit for the Indoor Amusement/Entertainment Facility would maintain consistency with the General Plan and Zoning Code. Finding #2: The establishment, maintenance, or operation of the use applied for will not, under the circumstances of the particular case (location, size, design, and operating characteristics), be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons residing or working in the neighborhood of such use, or the general welfare of the City.

Evidence: Surrounding uses in the immediate vicinity of the Project are light industrial to the north and south, industrial-office to the west and single-family residential to the east beyond the railroad tracks. The proposed use is compatible with the adjacent developments, which predominantly consist of a variety of industrial and indoor fitness uses, and would not introduce or create any conflicts by changing the nature of the existing development in any significant way. The operation would be completely screened from public view inside the existing

building. The project proposes parking spaces which exceed the amount which is required by the Municipal Code. The establishment of the proposed “School – Specialized Education and Training/Studio” use would not create any foreseeable hazards that would be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons working in the area.

The foregoing Resolution of the City of Elk Grove was passed and adopted by the Zoning Administrator on the 27th day of July, 2015.

PROVIDE TESTS AND INSPECTIONS AS REQUIRED BY THE BUILDING CODE AND THE APPROVED PERMIT SET OFDRAWINGS. THE CONTRACTOR SHALL NOTIFY THE BUILDING INSPECTOR A MINIMUM OF 24 HOURS PRIOR TO THETIME OF INSPECTIONS.

UNLESS OTHERWISE SHOWN OR NOTED, TYPICAL DETAILS SHALL BE USED WHERE APPLICABLE. IF CERTAINFEATURES OF THE CONSTRUCTION NOT FULLY SHOWN OR SPECIFIED, THEIR CONSTRUCTION SHALL BE THESAME AS FOR SIMILAR CONDITIONS THAT ARE CALLED FOR OR DETAILED. THE ARCHITECT AND ARCHITECTS' CONSULTANTS SHALL HAVE NO RESPONSIBILITY FOR THE DISCOVERY,PRESENCE, HANDLING, REMOVAL, OR DISPOSAL OF OR EXPOSURE OF PERSONS TO HAZARDOUS OR TOXICSUBSTANCES IN ANY FORM AT THE PROJECT SITE.

GENERAL CONTRACTOR SHALL VERIFY THE POINT OF CONNECTION FOR WATER, SEWER, AND OTHER UTILITIESPRIOR TO COMMENCEMENT OF SITE WORK.
