Note: I was in las Vegas and suckered into a traffic set up. I took pictures and presente

argument as a 6th amendment attorney, that police cannot use political chicanery for profit.

I won my action!

Carrollton; however, is ridiculous! Deaf, dumb and illogically and intensely stubborn fo

political reasons! Stubbornness wins at law by hyping attorney's wages until someone runs

out of money. [Obviously not the prosecution who's boss can tax Citizens for more!!]

Hard Time for Chalk Crime; The new incentives for police abuse!

It may or may not be true that, as some seem to believe, not a single cop in the history

of the Las Vegas Metropolitan Police Department (MPD) has been criminally charged after

shooting someone, even if that person was unarmed and/or innocent. What is true, is that

making this statement in writing may land you in prison, and brand you as a criminal. Even i

that statement is written in washable chalk.

Thats what four protesters affiliated with Nevada "Cop Block and Occupy" Las Vegas

found out when they scrawled that accusation, along with some profanity, on the sidewalk

outside MPD headquarters. Days after being cited, they tagged the pavement in front of the

Regional Justice Center [crime scene?]. They now face multiple gross misdemeanor counts of

placing graffiti or defacing property, and conspiracy to commit placing graffiti.

To be sure, the protesters deliberately vandalized public property. Perhaps they should

have been fined for doing soit purportedly cost the citys graffiti abatement team over $1,50

to clean up the crime scenes with power washers; one wonders whether a hose or a mop and

bucket would have been more cost effective. [Or waiting for a rain. obviously it's a crime to us

mother nature (no profit)] Thats not to say, however, that they should be facing jail time?

First, the protesters did not use oil-based chalk; they used washable chalk that kids use

on sidewalks every day. If it is true, as officials have said, that this chalk will do long-term

damage to the sidewalk, consistency would seem to demand that a six-year-old who sketches

on a sidewalk should be equally subject to sanction. [Hmmm]

Steve Wolfson, Las Vegass district attorney, has tried to justify the charges by

explaining, This is not a kid drawing with a piece of chalk on the sidewalk. These are adults

who used chalk to draw profanity. And there is a law on the books that make it a crime to

engage in this activity.

Wolfsons statements are misleading at best. Nevada law defines graffiti as any

unauthorized inscription, word, figure or design that is marked, etched, scratched, drawn,

painted on or affixed to the public or private property, real or personal, of another, which

defaces the property. Nothing in the laws the violation of which the protesters were charged

speaks to profanity, and their statements was not in fact profane, merely critical of police.

Further, theres no basis for distinguishing profane chalk writing from any other kind.

The U.S. Supreme Court, in 1971s Cohen v. California, held that the First Amendment allow

someone to wear a jacket with the message Fk the Draft, even in a public building. One

might call such speech tasteless or indicative of a limited vocabulary, but the Constitution

doesnt make exceptions for unpleasant or offensive speech. And, the "profane" sentences were

added to the sidewalk after being charged.

Put simply, this criminalization of chalk commentary is viewpoint-based discriminationagainst speech that the city does not like, masquerading as a vandalism charge. The same ha

happened in other citiesthe city of San Diego prosecuted a man for writing anti-bank

statements, also using washable chalk, on the pavement outside Bank of America. Its difficul

to imagine that San Diego would have prosecuted an adult who scrawled, I Respect and

Admire Bank of America. Its almost inconceivable that Las Vegas would prosecute sidewalk

scribblers who opined that the police were doing an excellent job. When the government picks

and chooses in this way, it erodes and abridges the notion of equality before the law.

The prime problem here is the publics ignorance of one small legal term; the one word i

OF. It stands for civil and Constitutional law. I am an educated Attorney OF law; Whereas,

the municipal courts in America have been converted totally to equity law by dedicating

themselves to the word AT instead. Attorneys AT law are outside the limits of Civil law

because of the equity of bilateral contracts, and that is Civilly legal with corporations. Becaus

of President Eisenhower in 1958 who enlisted the law of the flag, no contracts now needs to

exist for martial law courts AT law. This makes the wealthy lawless, and above civil law. So

attorney's can pick and chose, use ipso facto law, and today also invent color of law to appease

their employer - since municipal judges are only attorney magistrates AT law, employed by

the city and not Civilly legal elected officials [politics instead of law]. In civil law, this is a

Because attorney's now have greater status then educated professionals; professors,

engineers, doctors, PhD s, mathematicians, CEO, CFO, CIO [Who's salary is limited for

growth, and is not gouging the corporations they belong to]. Insanity has now won over justiceMy view of current Republican authoritarians is that they are the equivalent of a 6 year old

Above Law! We sit in a universe where all mater itself is simply compressed energy - yet we

concentrate upon crude resources of chemical energy for the short term need to murder

humans. If the murder is inefficient, and survivors exist, we then concentrate state of art

medical engineering to repair damage done. In my point of view mankind reached his mental

peak about 1936, and is now downgrading due to the drag of organized religion, and

subservience, [slavery] to accomplish their dreams. Individual incentives to do good for society

is destroyed, i.e. if wealth is not involved that interferes with educated theology! Basically,

Christ was right, and the world was wrong - - and still is; over his officially dead body giving

his spirit no peace!

So far, with Carrollton cops playing the old keystone cops of the 1920s, but with all themunicipal paradigm following suite; so we have a different situation that is demonstrating fantasticwaste of taxpayer funds by politicians.

My attorney fees $75, ticket fee $100.To collect $100, it cost Carrollton (taxpayers) way over $10,000.

5 high dollar attorney fees, 6 officers wage's for arresting, and maintaining a crippled old manin jail (while stealing his wheelchair),* with all his medical needs administered. Several hours of legalresearch to create perjury for the prosecutor to employ ipso facto law (thus raising her insurance ratesbecause it is illegal). If I continue to ride my bike like Pee Wee Herman, I could single handedlybankrupt the city of Carrollton! :D

Carrollton's only recourse is to blame the indigent biker as a transfer of liability, insisting hetoo joins the maniacal mob of drivers, with a customized SUV to transfer himself, and wheel chair,instead of innocuously following the laws for street bicycles - that this conservative 6th AmendmentAttorney is dedicated to.

Unfortunately loyalty to honesty is betrayed by loyalty to dollars in America today. Tocompensate the waste demonstrated, the taxes aimed at the poor (the majority) are increased for morefunds to be wasted by the stupidity of fighting a new 'Jessey James' (Sugar) spirit.

This is why Mayor Merchant belongs in New York, instead of Texas. You see, anything ofpolicies to create gentle recessions [also known as negative inflation that improves prosperity for thepoor] is so hated by the Republican party, they will martyr or murder proponents of justice withoverpowering massive force. Now a crash that the wealthy prematurely are aware of; is alwayswelcome. [A cornucopia of cheap slavery]
