This handbook is a guide for users of the YORhub construction frameworks - YORbuild2, YORcivil2 and YORconsult2.

The guide is intended to provide a comprehensive overview of the full suite of construction frameworks, and the many added benefits they offer for user organisations and their local communities.

All three frameworks have been developed to provide an efficient, value-adding procurement solution for use by the 22 Yorkshire and Humber

local authorities and other public sector and third sector organisations throughout this region. In addition they now include all or part of the Sheffield LEP area, North East England and Lincolnshire.

All frameworks are structured to complement the geography and diversity of demand across these areas.

The Frameworks have been designed to work with the Government recommended NEC3 form of contract which promotes partnering/collaborative working. Users benefit from access to NEC’s contract conditions online at www.yorhub.net. JCT contracts may also be used with the YORbuild2 framework, and various forms of contract may be used with YORconsult2.

YORhub Background

The YORhub suite of construction frameworks were originally procured as Yorkshire and Humber regional frameworks on behalf of, and funded by, the Department for Communities and Local Government’s former Beacon Peer Funding programme the Yorkshire and Humber Regional Improvement and Efficiency Partnership YoHrSpace. The frameworks provide public and third sector organisations with access to efficient, effective and intelligent collaborative procurement solutions for all their building, housing and civil engineering project requirements.

YORbuild was the first of these frameworks, being awarded in December 2009, and trail blazed in many aspects including the Employment and Skills Plan which led to YORbuild being the first framework in the country to be given Construction Skills Academy status. YORbuild’s sustainability credentials were also featured as one of eight international case studies on the impacts of sustainable public procurement at the Rio Earth Summit 2012. YORbuild expired in late 2015 and has now been replaced by YORbuild2.

YORcivil2 and YORconsult2 follow the YORbuild2 lotting structures and subregional framework model which has resulted in a large number of SMEs being appointed to the frameworks.

Management

Each framework has lead contracting authorities for each subregion. Overall management of the YORhub frameworks, including decisions on their future renewals and replacements is carried out by the YORhub Board which has representation from the following authorities:

• Leeds City Council

• Sheffield City Council

• East Riding of Yorkshire Council

• Rotherham Metropolitan Borough Council

• Scarborough Borough Council

The Frameworks

The YORbuild2 framework consists of four sub-regional frameworks each with up to five value banded lots and two social housing lots for dealing with all values of new build, refurbishment and design & build construction works. The North region is split into four further areas to suit its large geographical area.

The YORcivil2 framework consists of two sub-regional frameworks for the procurement of civil engineering contractors to deliver a wide range of civil engineering works and includes for works by design & build.

The YORconsult2 framework consists of two sub-regional frameworks for the procurement of construction related and specialist consultancy services.

If you are considering the use of one of the YORhub frameworks please contact the relevant programme manager (contact details at the end of this booklet) or alternatively complete a New Project Form.

An access agreement will be required for a user’s first call off from the framework.

• Providing a number of call-off methods, allowing for direct supplier selection as well as more traditional single and 2-stage mini competitions.

• Providing an area-specific Framework Manager available to answer your queries and to resolve any issues as they arise.

• Providing a fully EU compliant Framework Agreement that removes the need for OJEU adverts for call offs.

• Providing suppliers that have already passed through a competition involving a balance of cost and quality to attain places on the framework.

• Advising on supplier minimum standards e.g. current Health & Safety approvals.

• Submitting initial project information at an early stage of your project.

• Advising us when a scheme is changing in value, being delayed or accelerated, or changing in scope.

• Completing and returning an Access Agreement where required.

• Completing and returning pre-selection forms.

• Sharing your forward programme of work where appropriate.

• Establilshing tender lists for your project.

• Providing standard tender document templates on www.yorhub.net.

• Providing framework pricing information e.g.rates and percentages.

• For 2-stage mini competitions we also provide 1st stage selection templates and scoring regimes. In addition we advise on price/quality ratios and how to ensure value for money when developing a tender with one firm.

• Using the most recent tender documents from www.yorhub.net - we regularly improve the documentation and by reusing an old copy you may not receive the maximum benefit from the framework. Please note, these documents are sample versions only; users can use their own documents but must be careful to avoid fundamentally altering the framework Terms and Conditions.

• Informing us who the successful supplier is and what the tender value is when the project is awarded.

• Inviting alternative offers in addition to compliant bids wherever possible to encourage innovation in the supply chain.

• Ensuring suppliers are well aware of framework requirements through a mixture of audits, regular performance monitoring and face-to-face workshops.

• Intervening to resolve issues where they relate to the framework.

• Responding to requests for Red/ Amber/Green (RAG) reports, including letting us know of any efficiencies made on a scheme.

• Letting us know of any significant performance issues you may have with the Supplier.

• Promoting the framework (e.g.ensuring YOR branding is on site sign boards).

• Proactively managing the contract.

• Gathering performance information and holding post-project reviews (where relevant) to ensure best practice and lessons learned are spread through the framework and beyond.

• Completing Key Performance Indicators (KPI) questionnaires and recording efficiency savings.

• Letting us know of anything that was particularly good or challenging about your project.

• Providing a specialist Employment & Skills (E&S) Manager to advise you what can be done on your project to maximise E&S outputs.

• Providing specialist advice on the Public Services (Social Value) Act 2012, in particular clause 1 (3) (a) ‘how what is proposed to be procured might improve the economic, social and environmental wellbeing of the relevant area’.

• Letting us know of any client requirements for employment and skills as well as discussing Employment and Skills (E&S) outputs well ahead of the tender stage.

• Ensuring that suppliers are recording their E&S outputs throughout the job. For example, E&S Plans can be a standard item on your site meeting agendas.

• Providing final E&S outputs to the E&S Manager.

• Requiring suppliers to reduce waste to landfill (where applicable) as required by our commitment to Halving Waste to Landfill and reducing carbon.

• Providing a Sustainability Co-ordinator to advise users and suppliers on how to deliver their environmental responsibilities.

• Providing information to suppliers at tender stage on the types of waste expected on a scheme.

• Ensuring suppliers are aware of the contractual requirement for them to report on waste management, using the (Waste and Resources Action Plan) WRAP portal.

YORhub Role Framework User Role

• Operating a YOR4Good Fund into which suppliers donate cash and/or resource to support local regeneration projects across the region. Contributions are made from the contractors’ Corporate Social Responsibility funds so there is no cost to clients for this initiative.

• Being aware of and supporting groups in your area that may wish to bid for YOR4Good Fund resources when applications are invited.

• Including latest tender document templates (which place a contractual requirement on suppliers to contribute towards the YOR4Good Fund).

• Operating the YORscep Supply Chain Engagement Programme to create visibility of work to subcontractors and suppliers.

• Ensuring suppliers publicise subcontractor work package opportunities on the YORhub.net site.

• Contributing information for your press releases.

• Covering news of your project and added value outcomes in the YORhub.com website’s news feed, social media feeds and directly to our network.

• Supplying imagery and photography of the project, including views of YORbuild2/YORcivil2/YORconsult2 branding and signage where possible.

• Alerting us to any news coverage of the project instigated by your Marketing and PR team.

• Informing us of any embargos on publicity for the project, and when any embargos are lifted.

• Supporting suppliers to ensure they have the capability and capacity to deliver BIM projects.

• Providing templates to assist users to include BIM within their projects.

• Considering the use of collaborative approaches which are necessary for BIM to work effectively, e.g. achieved by utilising direct selection or two stage call off methods.

Overview

The original YORbuild construction frameworks were awarded in December 2009 and expired at the end of November 2015. These have been replaced with new YORbuild2 frameworks.

Any size or type of building project can be procured through YORbuild2 including new build, refurbishment, contractor design, maintenance or term contracts.

The new YORbuild2 frameworks were launched in February 2016 and include enhancements as summarised below:

• the inclusion of specific lots for new Social Housing (lots 6 and 7);

• provision for JCT contracts in addition to NEC3 contracts;

• the option to utilise the New Models of Construction Procurement as recommended by Government, including Cost Led Procurement, Two Stage Open Book and Integrated Project Insurance;

• more streamlined project specific Employment & Skills requirements;

• contractors appointed to the frameworks have BIM capability and capacity;

• a wider geographical area is covered, extending beyond the Yorkshire & Humber boundaries to the north and south;

• extended user base;• the north area framework has been split

into four north sub-areas to suit its large geographical area;

• more firms appointed to the larger value lots;• prices tendered for the framework are capped

and can be improved upon;• an on-line framework management system to

streamline the collection of performance data;• a new live performance measurement

regime that includes the facility to sin bin underperforming firms.

Areas

The YORbuild2 Framework consists of four sub-regional frameworks dealing with all values of building construction works. The YORbuild2 Frameworks have been structured in this way so that the diverse requirements of the regional based Public Sector Bodies can be met by competent and performing Small and Medium Enterprises (SMEs) in addition to larger regional and national contractors.

Four regional Local Authorities collaborated as a Project Team to procure the YORbuild2 Frameworks, each representing one of the sub-regional frameworks:

• North Sub-region – Scarborough Borough Council

• East Sub-region – East Riding of Yorkshire Council

• South Sub-region – Rotherham Metropolitan Borough Council

• West Sub-region – Leeds City Council

Fees

Unlike the prevous YORbuild framework there is no separate fee to be paid for accessing the framework. However, a small charge is recovered directly from the contractors. This fee covers the cost of managing the framework and includes a contribution towards the cost of procuring a replacement framework.

Contract

Any project called off the YORbuild2 framework can use the NEC3 or JCT suite of contract documentation. However the NEC3 suite has been endorsed by Central Government as the preferred contract type for construction projects.

The NEC3 suite of contracts have a numberof advantages. They:

• support a partnering ethos between the client and contractor;

• support project management through early warning and compensation events;

• offer flexibility through the number of options available: Main and Short forms, Term Service Contracts and Professional Service Contracts.

OJEU

The YORbuild2 framework has been procured through a fully compliant EU process under the 2006 Public Contract Regulations (as amended).

Four separate OJEU adverts (one for each geographical area) were published on 30th October

2014. An example of these for the East Area is reference number 2014/S 209-369522. This notice was amended on 14th July 2015, reference 2015/S 133-244655.

YORbuild2 has four different call-off methods which balance quality against cost:

Overview

YORcivil2 is a construction framework for the procurement of civil engineering contractors to carry out construction works within the civil estate in the Yorkshire and Humber Region.

The framework has been set up to deliver a wide range of civil engineering works, some building works and includes for works by contractor’s design for sectors including Local Authorities, public services, public order & safety, environment, regeneration, health, housing, education, recreation & culture.

YORcivil2 was awarded in August 2017.

Areas

The YORcivil2 Framework consists of two subregional frameworks each with separate lots dealing with different types or value of works.

By structuring YORcivil2 in this way the diverse requirements of the regional Local Authories and other regionally based Public Sector Bodies can be met by competent and performing Small and Medium Enterprises (SMEs) in addition to larger regional and national contractors.

Two regional Local Authorities collaborate to manage the YORcivil2 framework, each representing one of the sub-regions:

• North and East Sub-region – East Riding of Yorkshire Council

• South and West Sub-region – Sheffield City Council

Each area within the YORcivil2 framework agreement has a number of lots based upon project value and discipline. The table opposite shows the lotting structure and the number of contractors appointed to each lot.

Fees

Unlike the previous YORcivil framework there is no separate fee to be paid for accessing the framework. However, a nominal charge is recovered directly from the contractors. This charge covers the cost of managing the framework and includes a contribution towards the cost of procuring a replacement framework.

Contract

YORcivil2 is structured around the NEC3 suite of contracts, a contract endorsed by Central Government and the Institution of Civil Engineers. NEC4 can also be supported.

The NEC suite of contracts have a numberof advantages. They:

• support a partnering ethos between the client and contractor;

• support project management through early warning and compensation events;

• offer flexibility through the number of options available: Main and Short forms, Term Service Contracts and Professional Service Contracts.

OJEU

The YORcivil2 framework has been procured through a fully compliant EU process. Two separate OJEU adverts (one for each geographical area) were published on the 3rd December 2016, and amendments were published on 24th January 2017.

Overview

YORconsult2 is a framework for the procurement of consultancy services, principally for construction related services but also covering specialist areas such as estates. Categories of consultancy services available are shown in the table opposite.

YORconsult2 was awarded in November 2018.

Areas

The YORconsult2 framework consists of two sub- regional frameworks dealing with all values and types of consultancy services. By structuring the YORconsult2 framework in this way it ensures that the diverse requirements of the region’s local authorities and other public sector organisations can be met by a range of competent small and medium enterprises (SMEs) in addition to larger regional and national consultants.

Two regional local authorities collaborated as a project team to procure the YORconsult2 framework, each representing one of the sub-regional frameworks:

• North and East Sub-region – East Riding of Yorkshire Council

• South and West Sub-region – Sheffield City Council

Lotting Structure

The lotting structure for YORconsult2 varies slightly across the two areas. The North and East area has an additional lot 16 for Coastal Services, and lots 10 to 15 are covered by the South and West area framework.

The table opposite shows the lots and number of consultants appointed to each.

YORconsult2 is appropriate for commissions of all sizes.

Standard templates for contracts are available for use on projects called off from YORconsult2. YORconsult2 has been structured around the use of NEC Professional Services Contract although other services contracts can be used.

Employment & Skills

Employment and Skills is a key element of the whole ethos of the YORhub frameworks, which are designed to deliver not only efficiencies but also tangible opportunities for local people.

All of the frameworks have an employment and skills output plan contractually embedded in order to create a supply chain for skills and provide local opportunities for training and apprenticeships.

The Story So Far

Benchmarks for Employment and Skills outputs for typical projects in each lot/value band were introduced at the tender stage of all frameworks. Benchmarking is a key step in the project process. It ensures the clear communication of Employment and Skills requirements and enables open dialogue and active monitoring between client and contractor/consultant.

The benchmarks become a site reality at project specification stage, when they are adjusted to meet the client’s priorities, the type of work, duration, location and time of year.

Results from the frameworks have been exceptional.

YORfuture Shared Apprenticeship Scheme

The YORfuture Shared Apprenticeship Scheme is an innovative collaboration with EN:Able Futures, established in response to industry demand, to provide construction contractors with a solution to meeting their training obligations and to maximise opportunities for apprentices.

YORfuture is demand led and only employs apprentices in order for them to complete a full level 2 apprenticeship together with the optioin to complete level 3. The apprentices all attend local providers to complete the technical study and are placed with host contractors in order to complete their experiential learning.

YORfuture allows the sector to recruit and employ apprentices where this would be impractical due to specific project factors, but does not replace traditional apprenticeship recruitment.

The three YORhub frameworks share a commitment not only to deliver expenditure and process efficiencies but also offer contractually embedded social value measures with the aim of delivering employment and skills opportunities, funding to support local social and economic regeneration, supply chain opportunities and carbon and site waste reduction. These social value elements assist users to comply with the Public Services (Social Value) Act 2012, and meet the aims set out in the Government Construction Strategy 2016-2020 and Industrial Strategy: Construction 2025.

BIM can also be utilised on YORhub projects where required.

The YOR4Good Fund

As part of the integrated management strategy of the frameworks, YORhub aims to support Economic Regeneration across the region. In order to achieve this aim the YOR4Good Fund has been created with funding pots made up from contributions, either in cash or benefit in kind, from the frameworks’ contractors and consultants.

The YOR4Good Fund contributes to YORhub’s Economic Regeneration aim through the provision of grants, supporting local regeneration projects across the region. Grants of up to a £10,000 can be provided per project.

The YOR4Good Fund Panel

The YOR4Good Fund Panel is the scrutiny and approval body for the application of the YOR4Good Fund and works to agreed terms of reference. The panel includes contractors appointed to the frameworks.

Who can apply?

The YOR4Good Fund has been created to support projects which will benefit local communities within the region. YORhub only accepts applications from groups sponsored by organisations who are users of the frameworks or by framework contractors.

The maximum amount that can be applied for is £10,000 per project. Only one application can be made per project; however a user can submit bids for multiple projects at any one time.

Grant levels may vary depending on the available funding.

Previous recipients of a grant from the YOR4Good Fund are still eligible to submit applications, however they may receive a lower priority, ensuring the grant funding is distributed evenly.

When to apply

Applications are invited at any time and must be for projects within the area covered by the YORhub frameworks.

The YOR4Good Fund has awarded over 130 grants to community groups totalling over £900,000

Waste and Carbon Reduction

One of the YORhub strategy themes focuses on the frameworks’ commitment to reduce site waste and carbon. YORbuild2 and YORcivil2 have signed up to the Halving Waste to Landfill commitment led by WRAP, as have many of the contractors on the frameworks.

At the end of every project our contractors are required to return the following data:

• Project name and value

• Start and end date

• Waste arising (in tonnes)

• Waste to landfill (in tonnes)

This data is fed into the Waste Reporting Portal (www.wrap.org.uk) and ultimately into the overall contractor performance statistics, affecting the amount of work a contractor may receive.

YORhub also plans to measure projects’ carbon performance, as well as measuring and monitoring the locality of spend in relation to the construction project.

Environmental Performance

Contractors’ performance scores include two environmental criteria:

• the waste arising sent to landfill, with information gathered by the YORhub management team from the WRAP portal;

What is BIM?

Building Information Modelling is a process for managing the information produced during a construction project. HM Government requires all Government Departments to have implemented fully collaborative 3D BIM (with all project and asset information, documentation and data being electronic) as a minimum by 2016, with the target of up to 20% saving with the adoption of the strategy. BIM isn’t mandatory for Local Government but is strongly recommended.

BIM is an array of construction design, delivery and maintenance programmes including those relating to facilities management and lifecycle costing. BIM will improve efficiency, accuracy and programming of the design and construction process reducing waste through collaborative working, reducing the capital cost of projects.

BIM can be used on any project of any size and value, both new build and refurb.

The Supply Chain Engagement Programme (YORscep)

YORscep has been created primarily to provide local construction related companies with access to business opportunities and visibility of opportunities within the framework. Membership is for all trades and associated service providers to the construction industry. Membership is free and is obtained by signing up via the link on the YORhub website, www.yorhub.com.

Sub-Contracting Opportunities

YORscep provides members with access to the framework demand pipelines and sub-contract packages of work to enable members to tender for work. Subcontractors in YORscep have exclusive access to detailed information on upcoming projects and opportunities 24/7 which are posted on the YORhub members’ site www.yorhub.net by the frameworks’ main contractors.

Businesses who have registered are emailed opportunities as they are uploaded by the main contractors.

YORscep Events

YORscep hosts Meet The Buyer events for members throughout the year as specific project opportunities arise.

Reducing Barriers

Contractors appointed to the YORhub frameworks are required to make tendering for sub-contract packages as straightforward as possible and not make the selection process too onerous.
