The Yolo County Workforce Investment Board convened in the offices of Yolo County Department of Employment and Social Services at 25 North Cottonwood Street, Woodland, CA, with the following persons in attendance:

Barbara Halsey thanked members for their time and dedication to the Workforce Investment Board and how important this board is. California Workforce Association (CWA) sponsors three conferences: Youth Conference, Long Beach, January 17-19, 2012; this year’s topic is joining together with youth serving organizations across the state. Discussions include:

• What are we doing to support youth toward employment goals • Some challenges youth are facing with all time high unemployment rates with

decreased opportunities and higher competition for jobs that they typically had access to • How engage in entrepreneurship • How to identify and market their skills • How to reconnect or connect to education and services they need

In the spring there is a Practitioner Conference in San Diego, CA. Each fall there is a Meeting of the Mind Conference. There are 49 Workforce Investment Boards throughout the State. Forty-eight of those boards are members of the association. Each year the association elects a board of directors for the executive committee, which is made up of leaders from the 48 local workforce investment board directors. There has been more interest in workforce development and public policy workforce development than there has been in a very long time.

4. Establish Quorum Meeting called to order at 8:05 a.m. by Chairperson Ann Gennuso-Newton with a quorum present. Michael Darling led members in the Pledge of Allegiance.

Strategic Planning January 25, 2012 Nancy O’Hara invited all members to the Strategic Planning meeting to provide input. c. Receive November 9, 2011 WIB Meeting Informational Nancy O’Hara informed members the informational minutes are to help keep track of what was discussed at the meetings although no decisions can be made without a quorum.

8. Conference and Training Updates a. CWA Youth Conference; January 17-19, 2012, Long Beach, CA DESS staff will be attending. b. Building Workforce Partnerships; March 14-15, 2012, Los Angeles, CA Three slots are set aside for members who are interested in attending.

Staff has been told that the company was to close a couple of times in the past few years and at the last minute it remained open. The HR staff suggested to us that many may still be in denial and so chose not attend. We left brochures, flyers and contact information with HR for those who did not attend can have access to our materials. Seventy-one employees are scheduled to be laid off between November 2011 and early January 2012 when the business closes.

b. WIB Business Member Recruitment – Steve Roberts, DESS Employment Specialist II Nancy O’Hara updated members on Steve Roberts’ latest recruitment work

• With the assistance of WIB member Scharlene Reid we will be working work with Buckhorn and Mariani Nut Company in Winters, CA

• Working with Ernesto Lucero of City of West Sacramento to help with staff support for a job fair • Assisting Assante Temporary Services on recruiting approximately 100 employees for a company in Dixon.

Jobs will include manufacturing, distribution, warehouse and merchandising. Our assistance in West Sacramento and possibly in Woodland will be in the form of site usage, staff support and event marketing

• UPS driver assistant recruitment in West Sacramento and Woodland. Reportedly 57 potential employees attended the West Sacramento event and 45 attended the Woodland event

• Assisted in marketing the Wicked West Pizza weekend job fair in West Sacramento • Created Dunnigan and Knights Landing business lists for potential members • Working with All Phase Security with recruitment of Security Officers and job creation of Electronics

c. Executive Committee – Ann Gennuso-Newton, Chair Ann Gennuso-Newton reminded members of the Strategic Planning Meeting January 25, 2012 and invited all members to attend. d. Economic Development – Wes Ervin, Yolo County Economic Development Manager Wes Ervin attended the Convergence Conference; Higher Education held at the Radisson Hotel in Sacramento. The Radisson Hotel in Sacramento has been renamed to Waterlake, it is uncertain whether or not the Convergence Conferences will be held at this same location. The conference panel was composed of the following:

• Chancellor Linda Katehi; UC Davis • Dr. Gonzalez; Sacramento State University • Chancellor Brice Harris; Los Rios Community College District

Wes informed members this conference has been an informative and valuable event each time.

Tim Paulson encouraged announced Volunteer Income Tax Assistance (VITA) is looking for volunteers and can be rewarding as a volunteer.

Ratify the Workforce Investment Board Executive Committee decision of February 22, 2012, for appointment of Michele N. Fadling to a three (3) year term on the Workforce Investment Board.

REASON FOR RECOMMENDED ACTION Michele is recommended for membership to the Workforce Investment Board by Steve Roberts, DESS ESS II conducting WIB Business Outreach and Recruitment. BACKGROUND Michele is the Human Resource Manager of Mori Seiki which is a machine tool manufacturer located at 3805 Faraday Avenue in Davis. She has over 20 years of human resource management experience; graduated from Esparto High School; and lived within Yolo County for 10 years. A majority of the members of the local Workforce Investment Board as created by the Workforce Investment Act must be representatives of business in the local area. Member representing business must be individuals who are owners, chief executive officers, chief operating officers, or other individuals with optimum policymaking or hiring authority. The WIB By-laws state that “(ii) Subsequent to the initial terms specified, all terms shall be for three (3) years.” AGENCY COORDINATION The Yolo County Board of Supervisors approved the nomination for appointment on May 29, 2012. Chuck’s term expired on 1/27/12. BACKGROUND Chuck represents Road Sprinkler Filters U.A. Local Union No. 669. His reappointment will provide continuity for the Yolo County Workforce Investment Board as they focus on building a responsive system to meet the employment and training needs of the local area. Experienced dedicated members provide the board with stability and historical perspectives. Representatives of labor organizations are mandated members of the local Workforce Investment Board as created by the Workforce Investment Act. Per California Senate Bill No. 293 at least 15 percent of the local board members shall be representatives of labor organizations unless the local labor federation fails to nominate enough members. If this occurs, then at least 10 percent of the local board members shall be representatives of labor organizations. The WIB By-laws state that “(ii) Subsequent to the initial terms specified, all terms shall be for three (3) years.” AGENCY COORDINATION The Yolo County Board of Supervisors approved the nomination for reappointment on May 29, 2012.

REASON FOR RECOMMENDED ACTION Viola has been employed since 1999 at the Yolo County Office of Education and her experience includes School-to-Career liaison; Communities and Schools for Career Success; Faith-Based/Community Organization Network, Youth Career Fair’s; and Academic Decathlon. She is recommended for membership to the Yolo Youth Opportunity Council as a representative of local educational agency serving youth. BACKGROUND Per the Workforce Investment Act (WIA) the membership of each youth council must include representatives of local educational agencies serving youth. The WIB By-laws state that all terms for Youth Council members shall be for three (3) years from the date of appointment. FISCAL IMPACT

There is no fiscal impact to this action. AGENCY COORDINATION The Yolo County Board of Supervisors approved the nomination for appointment on June 19, 2012.

Experienced dedicated members give stability and historical perspective for this board. Per the Workforce Investment Act (WIA) the membership of each youth council must include members who represent organizations that have experience relating to youth activities. The WIB By-laws state that all terms for Youth Council members shall be for three (3) years from the date of appointment. BACKGROUND Juan is the Assistant Store Manager of Orchard Supply and Hardware which is located at 1350 E. Main Street in Woodland. His experience includes over 15 years in retail, 9 years as manager, and 6 years as HR/hiring/training manager. A majority of the members of the local Workforce Investment Board as created by the Workforce Investment Act must be representatives of business in the local area. Member representing business must be individuals who are owners, chief executive officers, chief operating officers, or other individuals with optimum policymaking or hiring authority. The WIB By-laws state that “(ii) Subsequent to the initial terms specified, all terms shall be for three (3) years.” AGENCY COORDINATION If recommended by the Workforce Investment Board, the nomination for appointment will be submitted to the Yolo County Board of Supervisors for approval. BACKGROUND

John Chamberlain facilitated the 2012 WIB Strategic Planning Session which was held on January 25, 2012. A total of 12 individuals attended providing representation from a broad sector of partners; Community Based Organizations, Economic Development, Educational Entity, Employment Development, Housing, Local Government, Private Sector Employers, and Workforce Investment Act Programs. The group validated the current Strategic Plan but recommended a few revisions. These recommendations/action items were provided to the WIB Executive Committee on March 28, 2012:

As a result of the WIB Executive Committees discussion the three actions items were reduced to one. It was decided that action item one (1) was not obtainable because the WIB does not have access to a tracking system that could provide the requested data; measure and increase the number of youth who get hired. Since the target group (employers) and resources (One-Stop Partners) where the same for both action item two (2) and three (3) they were combined. Thus, the action item was integrated into the previous strategic plan which had been validated at the strategic planning session in January 2012 to produce the PY 2012-13 WIB Strategic Goals and Initiatives as outlined in the table above.

AGENCY COORDINATION

Based on the individuals that attended the 2012 WIB Strategic Planning Session, agency coordination includes Community Based Organizations, Economic Development, Educational Entity, Employment Development, Housing, Local Government, Private Sector Employers, and Workforce Investment Act Programs as well as the WIB Executive Committee.

YOLO COUNTY WORKFORCE INVESTMENT BOARD

SUMMARY

Workforce Investment Board (WIB) membership composition is mandated by the Federal Workforce Investment Act (WIA) and must include members from a variety of community and business sectors of Yolo County (YC). The majority of members must be from the business sector.

The WIB has authority to make policy decisions for the YC One Stop Career Centers (One Stops). The Grand Jury determined that the WIB is often the passive recipient of information provided by the One Stop operators rather than the initiator of policy.

The Grand Jury found the following concerns:

• a lack of quorum at board meetings

• a deficit in the requisite number of business members

• business members may not have "optimum hiring authority or policy making authority"

REASONS FOR THE INVESTIGATION

Given the high level of local unemployment, the Grand Jury was interested in learning more about the current labor market and the County's effort to create jobs and provide employment services.

California Penal Code sections 925 and 925a allow the Grand Jury to investigate and report on the operations, accounts, and records of the officers, departments, or functions of the county, including special districts and any incorporated city or joint powers agency located in the county.

ACTIONS TAKEN

The Grand Jury attended three WIB general meetings, one executive committee meeting, and toured the One Stops, located in Woodland and West Sacramento.

• federal legislation • state regulations • state reeertification documents • local resolutions, protocols and policies • WlB orientation materials and by-laws • WlB minutes, agendas and marketing materials • job websites including the Virtual One Stop

WHAT THE JURY DETERMINED

The Workforce Investment Board

The WIA provides funds for local communities to assist job seekers, develop a work-ready labor force and to assist employers in understanding the local labor market, job creation and rapid response to downsizing. In Yolo County, this work is performed by the One Stops, operated by the DESS, with oversight by the WlB.

The WlB is a partnership of business, labor, education, non-profit, government and community leaders. The WlB is "to promote the participation of private sector employers in workforce investment activities." WlB membership composition is mandated by federal law (the WIA), as supplemented by state law. Board of Supervisors (BOS) Resolution 08-77 states membership must include:

• a majority from local private business • two educational entities • 10-15% from labor organizations • two community-based organizations • two economic development agencies • each ofYolo County's One Stop Partners

The number of members (listed on the WlB roster as 39) can vary according to the percent of labor (10-15%) and the number of One Stop partners. New members do not receive fonnal orientation to legislative mandates, program operations or One Stop tours.

WIB by-laws state that "Representatives of local business organizations and business trade organizations shall be nominated by local business organizations and business trade organizations. They shall include individuals with optimum policy making or hiring authority. They shall represent businesses that reflect employment opportunities in Yolo County." (Resolution 08-77 Section 2e (i» The WIB membership application form does not screen for "optimum policy making or hiring authority".

Certification olthe WIB

All WlB's in Califomia were subject to recertification in December 2010 by the Califomia WlB. Recertification depended on the achievement of perfonnance standards for emplo)1nent of adults, dislocated workers, and youth, a showing that the W lB had carried out its mandated functions and complied with the membership requirements of the WlB. The WlB was required to explain any vacant positions.

In October 2010, the Yolo County WIB responded to the State, reporting six members short of the required business member majority. In explanation, the YC WlB noted that the vacancy times "vary due to the downturn in the economy resulting in business closures, and the expiration of tenn dates". The need to recruit business members was recognized and a recruitment strategy including "current board members reaching out to their business association contacts with thc intent ofhaving a business majority by the end of fiscal year 2010" was indicated.

Thc YC WlB was recertified by the California Workforce Investment Board in December 20 I O. However, because a majority of business members was lacking, the WlB is subject to continued reporting requirements, including a recommendation to provide a "timeline for recruiting business members". To date, no timeline has been submitted.

Business Membership

Business member attendance at board meetings has been sporadic, with some members not attending at all, contributing to a lack of a quorum. WIB by-laws pennit removal of a member after three absences from the meetings, although this provision has never been used.

In July 2011, after limited success in recruiting private business representatives, the WIB assigned DESS staff, on a half-time basis, to recruit business members. The WlB is currently four members short of the required business member majority.

YC has a fann based economy. Testimony showed that no effort has been made to recruit members from agribusiness.

Quorum at Board Meetings

Due to a lack ofquorum at previous meetings, the January 2012 agenda packet was 62 pages, much of which was previously un-ratified business. Minutes are not immediately available due to lack of quorum to ratify minutes.

In 2010, the WlB lacked a quorum for two meetings out of six and in 20 II attendance fell short of a quorum four out of six meetings. The current Board has considered increasing the meetings from bi-monthly to monthly in the hope of increasing commitment among its members. However, monthly meetings in 2009 also fell short of a quorum half the time. One Stop Oversight

The WIB is bTfanted responsibilities for the One Stops. In its recertification request, the WIB certified that it perfonns mandated functions including "ProbTfam oversight: The WIB provides guidance and oversight by establishing local policies for the One Stops, with focus on responsiveness to community and changing economic conditions".

The Grand Jury detennined that the WIB is often the passive recipient of infonnation provided by the One Stop operators, rather than the initiator of policy.

DESS combines employment and social services at the One Stops. While the availability of these social services is a boon to the One Stops' job seekers, Board members acknowledge it does contribute to the misperception on the part of business that the One Stop has little to offer the business community.

The One Stops' current promotional packet advertises an "employer hot-line". Despite the WIB's stated intent to reach out to business, witnesses interviewed by the Grand Jury had no knowledge of what the "employer hotline" was or what it did.

FINDINGS

Fl The general public and some businesses may not be aware of the services of the WIB and One Stop Career Centers.

F2 The WIB has not actively recruited abrribusiness to the Board.

F3 The WIB business members are not screened for having "optimum policy making or hiring authority".

F4 New WIB members do not receive formal orientation to legislative mandates, program operations or One-Stop tours.

FS The business members of the WIB do not take an active role in establishing policy, but rather, are the recipients of infonnation provided by the One Stop Career Centers.

F6 Ratification of WIB actions have been delayed due to the lack of a quorum at many scheduled board meetings.

F7 The WlB has not recommended removal of any members for absences of three or more, as pennitted by their by-laws.

F8 Attracting business members to the Workforce Investment Board is a long standing issue in Yolo County. The WIB has not provided a timeline for recruiting business members nor have WIB members actively recruited from the business community.

RECOMMENDATIONS

Rl The WIB should create linkages with the business community and enlist aid fi'om cities, Chambers of Commerce and the Yolo County Board of Supervisors to support their marketing efforts to increase public and business awareness of the WlB while increasing the WlB's connection to the business community.

R2 WlB members should actively recruit members from businesses, including agribusiness.

R3 The WlB application for business membership should be revised to screen for "optimum policy making or hiring authority".

R4 WlB members should tour and receive an orientation to the One Stops in both Woodland and West Sacramento by December 31, 2012.

R5 The WIB should provide the State with a timeline for recruiting business members by December 31, 2012.

R6 Member absences from WlB meetings should be reviewed. Absent members should be contacted to detennine their interest in continuing with the WlB.

REASON FOR RECOMMENDED ACTION Elect officers for the Workforce Investment Board; subject to nominations from the floor. Candidates to be elected to serve one-year terms, each officer may be reelected for a second one year term.

FISCAL IMPACT There is no fiscal impact to this action. BACKGROUND Per the Section 2. 3. a. i. of the WIB By-laws, the officers of the Board shall consist of a Chair and a Vice-Chair, and such other officers as the WIB deems necessary. Officers shall be elected by the WIB from among its members for a one-year term, and shall serve no more than two consecutive years in each position. The Chair and Vice-Chair shall be elected from among local business representative.

The Chair is elected from among local business representatives to preside over the WIB meetings and the Executive Committee.

The Vice Chair is elected from among local business representatives and may fill-in for the Chair if unable to attend a scheduled meeting of the WIB. The Vice Chair may be assigned or requested to perform other duties as are necessary in-lieu of the Chair. The Vice Chair is appointed to the Executive Committee of the WIB.

The 2nd Vice-Chair, in coordination with WIB staff, assists in arranging and scheduling presentations and programs for WIB meetings and special events and is appointed to the Executive Committee of the WIB. They may fill-in for the Chair and Vice Chair if both are unable to attend a scheduled meeting.

Upon election, each officer will begin their term following this meeting. AGENCY COORDINATION No further agency coordination is required.

Presentation: 2-1-1 Yolo by Adelita Serena Wes Ervin introduced Adelita Serena to the WIB members The Yolo Link services was taken over by 2-1-1, these services have been available for the past 11 years. The 2-1-1 started in New York after 9/11. After 9/11 the 911 emergency phone system was inundated with calls for human resources such as shelter and food and not able to get to the life threating situations. Dialing 2-1-1 gives you free access to over 900 services nationwide. You will reach a live person in Sacramento, Ca at the call center. This service is a multi-lingual available 24 hours a day, year round, free and confidential. If it were an emergency the call center will be able to transfer the call to 911. The call center has 10 call specialists on staff 24 hours a day. Anything for Yolo County that is a human service can be accessed, some of the services include; shelter, emergency food, employment, volunteer opportunities, counseling, hobbies for free or on a sliding scale basis. You can also access 2-1-1 online at www.211yolo.org. Agencies listed on the data base

This is a service hosted by the Yolo County Library and funded by DESS, City of Davis, a grant by Kaiser Permanente Northern California and a small promotion from First Five.

Nancy O’Hara and Janis Holt shared the proposed updated Strategic Goals and Initiative John Chamberlain facilitated our January 2012 Strategic Planning session January 25, 2012. At the Executive Committee meeting some changes were made. It was determined that the One-Stop services and the Employer services were equally related, members agreed to combine Business Services/One

Stop Partnership in the same task. We were able to condense the initiatives that allow measureable outcomes. We determined the ways we could measure them. This is included in the Strategic Goals; Achieving successful outcomes in Youth WIA performance placements in employment and education. These goals are a lot more attainable and measurable. • Janis Holt added that the three action items were reduced to one item due to the WIB not able to

measure. Some of the youth initiatives are put into the job seekers and the One-Stop initiatives were integrated as well.

• Tanya Provencher’s group is focusing on outreach to employers for services. In W. Sacramento, WIA staff

went out to let employers know about the layoff aversion services that are available to them. Another outreach will start here in Woodland, May 15th and another in Davis sometime in June for the employer outreach.

• Steve Roberts shared his team was able to have one on one with 31 Business associates.

d. Election of Workforce Investment Board (WIB) Officers Nominations were taken and extended to the next WIB meeting. Chair and Vice Chair will need to be from a private business entity and not labor; as to where a labor or government entities can serve as 2nd Vice Chair. Nancy O’Hara Our allocations came in a little higher than anticipated the down fall is when we estimated our allocations we were 300,000 over and had to make some cuts to the WIA program. With the cuts we came in at 100,000 and were still 200,000 in cuts. Based on our estimates these allocations will be manageable. We were able to a little more this year because the year before we had ARRA funds and the State held us harmless. The State allowed us to spend those funds and allowed us carry over from year 10-11 into 11-12. For the year 12-13 we will go back to our usual allocations. Allocations are as follows: PY 2012-13 Total Allocation Youth Program 838,920 Adult Program 597,731 Dislocated Worker Program 642,777 We have not received the Rapid Response but our allocation is used for the layoff aversion and that is usually 200,000 for the year.

• Steve has been in touch with Rite Aid and Chase Bank and will revisit them in December for their WIB

involvement.

• Steve has been working with Rush to hire individuals in W. Sacramento, they have hired 7 individuals.

• He also continues to send applications to NorCal.

• Clark Pacific did receive the contract for the 49er stadium. Aerotek will be managing the work here in

Woodland and W. Sacramento. Clark Pacific is looking for at least 100 employees at the end of 2

months and 23 individuals have already been interviewed.

• Steve and his team are currently getting the business license list for all the cities in Yolo County as an

outreach to the local businesses.

the results in the July meeting. Janis Holt reminded members of the four WIB’s in the regions are

13. Economic Development – Wes Ervin, Yolo County Economic Development Manager

• Clark Pacific got the job and are hiring. May 10th a proposal to get a small business approved at the

Spreckles location approved to have more businesses to come in.

• Board of Supervisors rejected an application to puck a truck stop in Dunnigan, the community

objected to the location on Road 6 and trying to keep project alive for Road 8.

• Bariani Olive Oil producer has a project to create an off track bicycle trail.

14. Yolo Youth Opportunity Council – Janis Holt, Chair

• Viola DeVita is busy recruiting individual in interviewing students which is part of the process

for the Work Ready Certificate and encouraged others to volunteer their time for interviews.

• Regional Youth efforts; in September having Youth Chairs coming in from each location and talk

about our missions and strategies.

• 2nd goal for Regional Youth; One day Regional Youth Practitioner conference to share best

practices. Come back and share information and ideas with others.

• Yolo County Office of Education reapplied for the Youth Bill Grant, To build more homes.

• Invited all members to the next Youth Council meeting May 22, 2012.

15. Other Business That May Come Before the Board Al Konuwa congratulated on the Work Ready Certificate. Participating student gave raving reviews.

SB 734 (Chapter 498, Statutes of 2011) added Section 14211 to the CUIC. This section imposes new training expenditure requirements on local boards carrying out WIA funded programs and details the actions that must be taken in the event that a local board does not meet the specified requirements. POLICY AND PROCEDURES:

Definition of Terms

Note: These definitions apply to this directive only and are independent of the definitions included in Workforce Services Directive WSD09-11, Quarterly and Monthly Financial Reporting Requirements. Cash Contributions - Federal and/or non-federal contributions of funds made available to the Subrecipient to be used for training services. Examples include federal and/or non-federal money received from employers, foundations, private entities, local governments, etc. In-Kind Contributions - Federal and/or non-federal contributions of non-cash resources used for training services. Examples include donated personnel, services, or use of equipment or space. Job Readiness Training- “Job readiness training includes services that teach skills needed to be successful in the workplace, rather than skills needed to get into the workplace. Following Section 663.508 of Title 20 of the Code of Federal Regulations, job readiness training should provide participants with specific occupational competencies needed to perform specific work tasks on the job. For example, job readiness training courses could teach WIA clients skills such as how to communicate in an office environment, how to function as part of a team, or how to work in a deadline driven workplace. In each of these instances, the focus of the training would be on competencies needed to succeed during the workday while on the job. The focus of job readiness training is not on the skills needed to find and apply for a job, for example, services that focus on the way one conducts a job search, or how to do an interview, or how to write a resume. Under the federal statute, these services are classified either as Core or Intensive services in WIA section 134. For example, job search assistance is defined as a core service, while group counseling or prevocational services focused on resume writing and interview skills are both classified as intensive services. These types of services do not qualify as training because they do not provide the client with competencies needed to perform specific tasks on the job. As such they do not qualify

under the definition of a training program outlined in Section 663.508 of Title 20 of the Code of Federal Regulations, and do not qualify as training expenditures under SB 734. Leveraged Resources - All federal and non-federal resources (cash contributions and in-kind contributions) used by the Subrecipient and/or Subrecipient Contractor for training services. Leveraged resources must be allowable and auditable under the WIA program, and meet the requirements included in the “Leveraged Resources” section of this directive. Match - Resources expended to support training services, if required as a condition of funding. Match resources can be cash match and/or in-kind contribution match. Match resources must meet the requirements included in the “Leveraged Resources” section of this directive. Subrecipient - An organization funded directly by the State. Subrecipient Contractor - An organization funded by the Subrecipient. Training Services – See the “Training Services” section of this directive. Required Training Expenditure Level

Beginning Program Year (PY) 2012-13, local boards are required to spend at least 25 percent of the combined total of their adult and dislocated worker WIA formula fund allocations on workforce training services. This minimum training expenditure requirement does not apply to the youth WIA formula fund allocation. A portion of the minimum training expenditure requirement (an amount of up to 10 percent of the combined total of the adult and dislocated worker formula fund allocation) may be met by applying designated leveraged resources used for training services. See the “Leveraged Resources” section on pages 6-7 of this directive. Example 1: Local Board meets the training requirement using adult and/or dislocated worker formula funds combined with leveraged resources. For PY 2012-13, a local board receives $1,000,000 in WIA adult formula funds and $2,000,000 in WIA dislocated worker formula funds. The following example displays how the training expenditure requirement would be calculated.

Total adult and dislocated worker formula fund allocations (Calculation: $1,000,000+$2,000,000) $3,000,000

Minimum training expenditure requirement (Calculation: $3,000,000 X 25%) $750,000

Leveraged resources applied to training expenditure requirement (Calculation: $3,000,000 X 10%) ($300,000)

Required formula fund training expenditure (Calculation: $750,000-$300,000) ($450,000)

In this example, the local board must spend at least $450,000 on training services using WIA adult and/or dislocated worker formula fund allocation dollars. There is no requirement that a specific amount be spent from each allocation (WIA adult vs. WIA

dislocated worker), therefore the $450,000 could be WIA adult funds, WIA dislocated worker funds, or a combination of both. Example 2: Local board meets the training expenditure requirement using WIA adult and/or dislocated worker formula funds only (no leveraged resources).

For PY 2012-13, a local board receives $1,000,000 in WIA adult formula funds and $2,000,000 in WIA dislocated worker formula funds. The following example displays how the training expenditure requirement would be calculated.

Total adult and dislocated worker formula fund allocations (Calculation: $1,000,000+$2,000,000 leveraged) $3,000,000

Minimum training expenditure requirement (Calculation: $3,000,000 X 25%) $750,000

In this example, the local board is not using any leveraged resources to meet the training expenditure requirement and therefore, must spend at least $750,000 on training services using WIA adult and/or dislocated worker formula fund allocation dollars. There is no requirement that a specified amount be spent from each allocation (WIA adult vs. WIA dislocated worker) therefore the $750,000 could be WIA adult funds, WIA dislocated worker funds, or a combination of both. Beginning PY 2016-17, the minimum training expenditure requirement will increase from 25 percent to 30 percent. Local boards will be required to spend at least 30 percent of their combined adult and dislocated worker WIA formula fund allocations on workforce training services. This minimum training expenditure requirement does not apply to the youth WIA formula fund allocations. A portion of the minimum training expenditure requirement (an amount up to 10 percent of the adult and dislocated worker formula fund allocation) may be met by applying designated leveraged resources used for training services. See the “Leveraged Resources” section on pages 6-7 of this directive. Training Services

In order to apply toward the minimum training expenditure requirement, formula funds and leveraged resources must be expended on WIA adult or dislocated worker participants enrolled in a training activity in the Employment Development Department (EDD) California Workforce Services Network (CWSN) system. Formula funds and leveraged resources spent on WIA core, WIA intensive services, and supportive services may not be applied toward the minimum training expenditure requirement. Training services may include:

• Occupational skills training, including training for nontraditional employment • On-the-job training • Programs that combine workplace training with related instruction, which may include

cooperative education programs • Training programs operated by the private sector • Skill upgrading and retraining • Entrepreneurial training

• Job readiness training

• Adult education and literacy activities provided in combination with one or more of the other training services listed above

• Customized training conducted with a commitment by an employer or group of employers to employ an individual upon successful completion of the training

For an expenditure to be considered a training service and count toward the minimum training expenditure required by SB 734, the service must meet the definition of training contained in WIA Section 134(d)(4)(D), and Sections 663.300 and 663.508 of Title 20 of the Code of Federal Regulations. Section 663.300 of Title 20 establishes that the list in Section 134 (d)(4)(D) of WIA is not exhaustive. However Section 663.300 of Title 20 does not allow local boards to simply count anything and everything toward the minimum training expenditure requirement contained in SB 734. For a service to qualify as training it must also meet the definition of a training program in Section 663.508 of Title 20 of the Code of Federal Regulations which defines training in the following manner:

§ 663.508 What is a “program of training services”? A program of training services is one or more courses or classes, or a structured regimen, that upon successful completion, leads to:

(a) A certificate, an associate degree, baccalaureate degree, or (b) The skills or competencies needed for a specific job or jobs, an occupation,

occupational group, or generally, for many types of jobs or occupations, as recognized by employers and determined prior to training.

The conceptual emphasis in Section 663.508 of Title 20 of the Code of Federal Regulations is on structured learning leading to the attainment of competencies needed on the job to perform one’s job duties. The goal of training is for workers to attain specific occupational skill-sets needed to perform work tasks during the workday. There is a three-pronged test local boards can use to determine whether a service provided counts toward the minimum training expenditure required under SB 734.

1. Is the service defined as a core or intensive service under WIA? If so, the service cannot be counted toward the training minimum.

2. Is the service defined as training under WIA section 134(d)(4)(D)? If so, the service can be counted toward the training minimum.

3. If the service is not listed as training under WIA section 134(d)(4)(D) but does meet the definition of training in Section 663.508 of Title 20 of the Code of Federal Regulations, it may also be counted toward the training minimum. The determining factors are whether the services are provided through a structured learning process and whether this learning process leads to the attainment of skills or competencies needed to perform work duties during the course of the workday. In summary, the service should lead to greater labor productivity on the job.

As a reminder, customized training, on-the-job training, and incumbent worker training do not require ETPL eligibility or the use of individual training accounts (ITA). Local boards

are encouraged to invest in training programs customized for growth industry sectors and in training that directly leads to employment. Additionally, local boards are encouraged to seek cost savings in the provision of universal services through coordination and integration with other One-Stop partners. Leveraged Resources

Local boards may apply leveraged resources used for training services toward meeting a portion of their minimum training expenditure requirement (an amount of up to 10 percent of their adult and dislocated worker formula fund allocation). Local boards may apply only the following leveraged funds as part of the 10 percent credit:

• Federal Pell Grants established under Title IV of the Higher Education Act of 1965 • Public programs authorized by the Workforce Investment Act of 1998 (e.g., Job

Corps, Migrant Seasonal Farm Worker, Rapid Response, WIA Title II Adult Education and Literacy, national and state WIA discretionary grants, WIA youth program, etc.) Local boards are permitted to apply youth formula funds expended on training for individuals ages 18-21 as a leveraged resource if: (1) the individuals are co-enrolled in either the WIA adult or dislocated worker program, and (2) the training meets all requirements set forth in this directive.

• Trade adjustment assistance • Department of Labor National Emergency Grants • Match funds from employers, industry, and industry associations (including the

employer paid portion of on-the-job training and customized training) • Match funds from joint labor-management trusts • Employment training panel grants Local boards are not required to use leveraged resources toward meeting the minimum training expenditure requirement. However, if a local board does choose this option, they must report all leveraged resources applied as part of the 10 percent credit in Attachment 1, Summary of Leveraged Resources. Additionally, they must keep sufficient records of the leveraged resources which can be independently verified by the EDD. In order to allow local boards maximum flexibility in using leveraged resources, the EDD does not specifically define what would classify as sufficient records. However, some examples of documentation that could qualify as sufficient records would include: • A commitment letter or written agreement from an employer or training provider • A training agreement with an employer detailing the employer’s contribution • A copy of the Pell Grant award letter or relevant correspondence from the school • An executed worksite agreement and participant time record • A participant progress report and/or evidence of completion

This list is not all inclusive. Local boards have the discretion to determine what constitutes sufficient records. This determination may vary depending on the Local Workforce Investment Area.

Costs arising from the recordkeeping required to demonstrate compliance with leveraged resources requirements are the responsibility of the local board. Note: All leveraged resources reported under this directive must also be included in the amounts reported under Section VII, Miscellaneous Items, of the WIA Summary of Expenditures Report (see WSD09-11, Quarterly and Monthly Financial Reporting Requirements). Procedures

The EDD will calculate training expenditures for each local board within six months after the end of the second program year of the two-year period availability of funds (e.g., the EDD will calculate training expenditures for PY 2012-13 funds by December 31, 2014, and will provide to each local board).

Formula Funds

The EDD will use the information provided in Section V, line 4 of the WIA Summary of Expenditures Report to calculate training expenditures of formula funds. Leveraged Resources

Local boards applying leveraged resources toward the minimum training requirement should submit a signed copy of Attachment 1, Summary of Leveraged Resources, to the EDD no later than the October 1st following the end of the two-year period of fund availability. Local boards may mail, hand deliver, or fax the completed summary as follows:

Any local board that does not meet the minimum training expenditure requirement will be required to submit a corrective action plan to the EDD that provides reasons for not meeting the requirement and actions the local board will take to address the training expenditure deficiencies. If required, the corrective action plan will be due within 90 days

In addition, WIA Section 136(c)(2) states that the Local Workforce Investment Board (LWIB), chief elected official, and the Governor shall negotiate and reach agreement on the local levels of performance. Working in collaboration with the California Workforce Investment Board, the Employment Development Department’s Workforce Services Division has been delegated the responsibility for the negotiation of the State and local performance. POLICY AND PROCEDURES:

This directive provides the final LWIA performance goals for the Adult, Dislocated Worker, and Youth Programs for PY 2011-12. The LWIA’s Youth performance goals are the same as the State levels. The Youth goals were not negotiated for PY 2011-12 at the individual LWIA’s level. ACTION:

Existing Program Year (PY) 2011-12 plans have been approved by the CWIB for the PY 2012-13. A copy of the letter is attached and is also available online (Extension of WIA Local Plan for PY 2012-13). In order to meet current and future challenges facing the workforce system, the CWIB is providing a framework for regional cooperation and investment and is responding to the policy direction of the workforce legislation enacted by Governor Brown by initiating a comprehensive review and realignment of California’s five-year WIA State Strategic Plan. To accomplish this, the CWIB has received authorization from the U.S. Department of Labor (DOL) to submit the State Plan by September 15, 2012. Local planning guidance will follow submission of the state plan to DOL. The PY 2013-14 local plans will be due to the CWIB on April 1, 2013, and will be effective July 1, 2013. June 5, 2012 DEAR LOCAL WORKFORCE INVESTMENT BOARD DIRECTORS AND CHAIRPERSONS, Re: EXTENSION OF WORKFORCE INVESTMENT ACT (WIA) LOCAL PLAN FOR PROGRAM YEAR (PY) 2012-2013 The purpose of this letter is to inform you that your WIA local plan has been extended through June 30, 2013. Please accept this letter as the State Board’s formal approval of your local plan for the Program Year (PY) 2012-13.

The State Board, with the participation of State-level directors of partner agencies, has initiated a comprehensive review and realignment of the vision, goals and priorities of the state WIA Strategic Plan. On May 14th and May 30th, State Board staff led informal working

group meetings of State directors to brainstorm ideas for the “Governor’s Vision” for Section I of the State Plan. Our intent is to ultimately get 1) consensus on common goals for the system that are both actionable and achievable and 2) commitment on specific actions from each State partner. Participants included EDD, Labor Agency, Community College Chancellor’s Office, Employment Training Panel, Division of Apprenticeship Standards, Department of Education, Health and Human Services, and the Governor’s Office of Business and Economic Development (GO-Biz). To ensure this strategic plan addresses the most salient workforce goals and priorities of our state, we will be seeking engagement and suggestions from you and other workforce system champions in this planning effort. This July, we will convene at least three regional focus group meetings to solicit input and recommendations. Hosted by LWIBs, each focus group will consist of around 25 invitees representing broad regional partnerships -- LWIBs, public colleges, K-12 adult education and career tech providers, CBOs, unions, and business leaders. Targeted invitees will be folks with deep experience building multi-partner, sector-based programs and career pathways. The regional focus groups are not for the necessary broad stakeholder input and public comment. Rather they will provide the opportunity to verify what comes out from the State partners – i.e. do the goals represent real system improvement, and can we operationalize at the regional level?

The new 5-year state strategic plan will be submitted to the Department of Labor by September 15, 2012. We are committed to developing a plan that responds to the current and foreseen challenges faced by the entire workforce system, provides a framework for regional cooperation and investment, encourages continuous improvement of services to

The new CalJOBS portion of CWSN was scheduled for implementation on July 2, 2012, but now will not go live until later this summer. A number of issues have contributed to this decision including the need to resolve reporting and data conversion issues, continue testing of the interfaces with other programs, and make final arrangements for some of the supporting services being provided by the department. The current CalJOBS and Job Training Automation systems will be maintained and remain in operational status until the new system is implemented and in full use by jobseekers, employers, partner staff, and Employment Development Department staff. At this time we do not have a revised implementation date; however, we expect to go live before the end of August. As soon as a specific date is established, we will advise the specifics along with the planned system down time and any other requirements.
