[B] Tenders documents are in two bids system i.e. “Technical Bid “and “Price Bid (online only)”

[C] Bidders are requested to submit price – bid (Part-II) on-line only and not to submit the price bid

in physical form. This is mandatory. If price bid is submitted in physical form, same will not be

opened and only on-line submitted price bid will be considered for evaluation.

It is mandatory for all the bidders to submit their technical bid documents by both forms viz.

on – line (e-tendering) and physically in schedule time. Tender documents submitted in only

physical form will not be accepted and same will not be considered.

03 Tenders received late after prescribed due date & time will not be accepted. Any alternation /

modifications to the bids received after opening of the tender shall not be considered unless

called for by the GSECL in negotiation.

04 The offer of bidder may be ignored if penalty is recovered from him by competent authority of

any power station of GSECL for negligence of work or non compiling the requirement as per

Terms and Conditions of work order issued to him in past within last three years .

05 Before quoting the rates in the tender, Party can see the site for correct assessment of work.

No ignorance of rate quoted shall be entertained after opening of tender.

06 The offer should be valid for minimum 120 days from the date of opening of price bid.

Otherwise offer may be rejected.

07 Chief Engineer (GEN) GSECL-UKAI TPS reserves the right to either accept or reject any or all

tenders without assigning any reason any thereof.

08 If contractor’s bid does not meet the pre-qualification criteria, then his offer is likely to be

rejected without any reference. Decision regarding this will be taken by the C.E. (Gen.), UTPS

and binding to all.

09 Being a critical work, GSECL reserve right to give 06 months trial order to new party and during

this period if work performance is found satisfactory during trial period then full order will be

issued otherwise WO will be withdraw.

10 Tenderer should also certify that the tender submitted is unconditional tender and specifically

remark “ Unconditional tender” on cover itself

11 Subletting of Tender is not permitted.

12 Corpn. Reserves the right to split the contract.

BID PRE-QULIFICATION CONDITION FOR TECHNICAL BID

NAME OF WORK: Biennial Rate Contract for On-Line Preventive & Breakdown Maintenance of

Bowl mills XRP-763/783 of 200/210MW unit no.3, 4 &5 at Ukai TPS

The bidder must furnish the following certificates/documents with their technical bid for qualifying

technically

1. The bidder should produce certificate/document as evidence of having a work experience of on line, preventive and breakdown maintenance along with overhauling of similar (BHEL make XRP) type of mills/any higher capacity mills of any other make (Higher capacity than XRP 763/783) coal mills for minimum one continuous year during last Five years at any power station/government/semi government/state electricity board / corporation body. The experience certificate with order copy from such organization where the work has been carried out by the bidder should be submitted.

2. Details of minimum tools, tackles and equipments in possession relevant to the job.

3. Details of P.F. Code no. from appropriate authority.

4. Latest Bank Solvency Certificate of minimum 20% of estimated cost from any Nationalized Bank.

5. Certified copies of last three years audited annual account i.e. profit & loss account and Balance sheet if the estimated cost of the tender exceeds Rs.100 lacks (for 2 years ARC tender). If the party is a proprietary party and not required to get annual account audited under the law, a copy of Income tax return or certificate from practicing Chartered Accountant certifying the “Profit & Loss account” & copy of PAN card should be submitted.

6. Wherever applicable, as per stay order of the court of law, as may be in force from time to time, the bidder will have to consent and confirm that he will engage same labours and supervisory staff working with the present contractor without engaging new labours against the existing labours. However as per the prevailing site situation if more company staff is required than party has arranged the same without charging extra cost.

7. Copy of appropriate contract registration.

8. Details of registered partnership deed in case of partnership firm and activities of association and memorandum of association in case of company.

9. The tender shall be opened of the paid EMD only.

10. Conditional tender is liable to be rejected. Withdrawal or insertion of conditions unilaterally after opening of tenders will not be permitted unless it so desired by the GSECL.

11. Party should have to submit the details of the registration number regarding service Tax along with Technical Bid (i.e. Copy of Service Tax Registration). 12. TIN invoice to be raised in case of supply of materials if not full vat of prevailing rate will be

deducted & deposited to the authorities. .

SCHEDULE-A Technical Specification:-

NAME OF WORK: Biennial Rate Contract for On-Line Preventive & Breakdown Maintenance of Bowl

mills XRP-763/783 of 200/210MW unit no.3, 4 &5 at Ukai TPS

SCOPE OF WORK: 01 The work consists of online, preventive & breakdown maintenance of 200/ 210 MW unit Nos.

3, 4 & 5. Bowl mills type: XRP-763/ 783 (Total 06 mills, having capacity of 40/42 MW each per unit. All the mills, feeder, seal air fans and its auxiliaries are required to be kept in adequate available condition so as to avoid loss of generation and have maximum generation on units. The scope of work shall include all the maintenance works scheduled at Annexure- A & B to be undertaken in minimum time so that the mills remain available for maximum generation. The equipment scope is from bunker flange to boiler burner second bend with mill individual and common ducts.

02 The scope of work consist of and includes, dismantling/removal/refitting, transportation and handling of old/new mill components, equipment, its auxiliaries from any plant of boiler 1 to 5 for the purpose of keeping the mills of boiler Unit Nos. 3, 4 & 5 available in working condition so that generation loss is avoided. Therefore, to avoid generation loss of Unit Nos. 3, 4 & 5 it would be very essential to inter change the components of mills of Unit Nos. 3, 4 & 5 with components of mills of unit no.1 to 5 as a part of this contract without any extra cost as per instruction of Engineer In-charge.

The scope of work shall also include transportation, handling & re-crediting of old/new materials, equipment’s, lubricants, spares etc. from GSECL Store to mill bay of the units as directed by Engineer-in-charge. The dismantled items/equipment/spares shall have to be shifted immediately from working area to store or other department/areas, of Boiler unit no.1 to 5 as part of this contract without any extra cost and as directed by Engineer-in-charge.

After required repair/maintenance, the old spares should be removed immediately from the site and working area should be kept cleaned and cleared. Failing which appropriate amount shall be deducted from the contractor’s bill. The contractor shall have to provide necessary manpower whenever required for checking, grinding, testing of new spares/components of mills, seal air fans, coal feeders and its auxiliaries as part of this contract without any extra cost.

03 The contractor shall be equipped/mobilized/ready in all respects with required/sufficient skilled workmen and all necessary general tools tackles to take-up any type of maintenance job on mills, feeder, Seal air fans and its auxiliaries either online, preventive and/or breakdown of any one or more number of mills at a time at a short notice of one hour.

04 Contractor should be resourceful with sufficient skilled staff and labors every day round the clock from existing staff in such a way that breakdown work can be carried out within short time, otherwise appropriate amount of generation loss will be recovered from the bill if the down time of mill is more for each type of maintenance. Contractor has to furnish the list of persons engaged every day in the Unit Nos. 3, 4 & 5 in the form of attendance sheet to the Engineer-in-charge on demand.

05 Area of mills, Seal air fans, coal feeders & its auxiliaries shall be kept and maintained neat and clean free of debris, scrap/coal dust/lubricant all the times so that working is not held-up at any time. All old/worn out parts or new spares of mills, coal feeders seal air fans and its auxiliaries shall be immediately removed from working area and credited either to store or stacked properly in area as directed by Engineer-in-charge on completion of work. Failing which appropriate value old/new material will be recovered incase of loss/theft of material.

06 In case of planned preventive maintenance maximum 06 hours notice shall be given to the contractor.

07 In case of breakdown maintenance the contractor shall have to mobilize all his resources within one hour of notice and take-up the required jobs as directed by Engineer-in-charge on emergency basis and shall have to complete within least possible time.

08 Any deviation, omission, alternation, modification of mills, seal air fans, coal feeders, RC feeder and its auxiliaries that may be felt necessary by Engineer-in-charge to suit operation condition/to maintain generation and/or to suit site condition and or to improve performance of the plant and or suggested by original equipment manufacturer by M/s. BHEL for improvement/betterment of the plant shall be carried out by the contractor as part of this contract without any extra cost. The quantum of job/frequency of job to be carried out or to be attended on each mill/ RC Feeder /Seal air fans / gravimetric feeder and its auxiliaries can be increased as per operational conditions.

09 All the jobs shall be carried out as per instruction under direct supervision of the contractor /supervisor and to the entire satisfaction of Engineer-in-charge, or his representative and mills/ Seal air fans, coal feeders, and its auxiliaries under maintenance shall be brought back to operation within shortest period so that generation may not be affected. Contractor‘s supervisor has to take reading of mill temp., Amp, RPM etc. from control room/mill plant of respective Unit in the beginning of every shift & recorded in daily progress report.

10 The contractor shall have to carry out the work as and when required and the work started shall be carried out non-stop till completion of the job and safe commissioning of the mills /seal air fans/coal feeders and its auxiliaries in possible period to the entire satisfaction of Engineer I/c. Any negligence/disobedience and or delay on the part of the contractor would invite penalty for loss of generation and decision of the competent authority in this regard shall be final and binding upon the contractor.

11 The line clear/PTW shall be issued to the contractor or their authorized technical supervisor for maintenance work and work shall be treated as completed when the equipment is accepted by operational staff and put into service. Any defects/work request noticed on putting mills into operation after repair shall have to be rectified as part of this contract immediately.

12 The contractor shall be allowed to use chain pulley blocks provided in mill plant, on chargeable with Rs. 100/- per day per no. if available with GSECL. However, same shall be used without any damage. Any damage shall have to be repaired or replaced by the contractor and arrange new spares (like brgs, gears etc.) for the same if required otherwise recovery for the same shall be made. Chain pulley blocks are to be maintained in good condition by the contractor, such that it will not fail. Party has to arrange other chain pulley block/overhead trolley at his own cost if damaged till it is repaired.

13 During maintenance of the mills, the chequred plates/supporting channel/beams/grills etc. of mill floor area are removed and same should be replaced on its original place after completion of work. During the maintenance work/overhauling work, the damaged chequer plates/supporting channels/beams/grills etc. should be repaired immediately by the contractor.

14 Necessary scaffolding / juggar shall have to be prepared by the contractor for which materials like pullies, Kathies etc. shall be arranged by the contractor as part of this contract. After completion of work, contractor shall have to dismantle scaffolding / juggar etc. if required.

15 While unit is on bar, if any mill remains out of service due to any other reason for more than 15 days at a stretch during a month and if during that period no maintenance is required to be carried out, 70% payment shall be admissible for a particular mill for a period exceeding 15 days e.g. if a mill remains out of service for 25 days at a stretch for other reason and if no maintenance is required. Payment shall be made for first 15 days and 70% payment shall be made for remaining 10 days.

16 During major maintenance work of Boiler, Turbine, Generator, COH /AOH of unit:

16 a) if the unit remains out of bus bar due to above reasons and as per planned outage

schedule by GSECL, then for that period 100% payment per mill month of

order value will be admissible as per work order conditions. However

contractor has to carry out all the related works as per the instruction of EIC.

16 b) if unit remains out of bus bar for more than schedule of planned outage declared

by GSECL , for the extended period, only 70% per mill month of the ordered

rates payment will be admissible on pro rata basis. However, contractor has to

carry out preventive maintenance of all the auxiliaries covered under the contract

as per preventive maintenance schedule during this extended period and all

remaining pending works of above as per the instruction of EIC to keep all the

auxiliaries in healthy condition.

17 When the unit remains out of bus bar due to RSD or any other reasons and there

is no work as per EIC. 17 a)The commencement of RSD or Out of bus bar for any other reasons such period

shall be reckoned after 48 hrs of the machine declared for RSD or out off bar due

to any other reasons. [

17b) 70% payment per mill month of order rate shall be admissible on pro rata basis. However for such period contractor has to carry out preventive

maintenance of all auxiliaries covered under this contract as per preventive

maintenance schedule given in the work order and as per the instruction of EIC.

18 If machine is under RSD or out of bus bar due to any reasons and if any

maintenance (other than PM ) is required to be carried out in any mill / mills as

per EIC,

18a) 100% payment for that particular mill / mills per mill month of order rate shall be

admissible and

18b) For other mills having no work 70% payment per mill month of order rate shall be

admissible on pro rata basis.

19 The contractor shall submit monthly bill in triplicate regularly along-with material account & chargeable material list. The payment shall be made per mill basis per month.

20 In case of any work on motor side and if removal of motor coupling is required the contractor

has to carry out de-coupling/alignment and re-coupling etc. of the mill motor immediately, after putting the motor on plinth by other agency.

21 Consumables like kerosene, Rustolene, Hacksaw blades, foam seal sealer, Dum-Dum M-

seal, grinding wheels, cotton wastage, hold tight, gasket shellac compound, Diesel, Pen oil & Anabond, Weight instrument of ISI mark for the capacity of 0 Kg to 20 Kgs etc. shall have to be arranged by the contractor at his own cost. Also all welding consumables and accessories such as welding machine, cables, holder, gas regulator, gas cutter, heating torch, and portable hand grinder shall have to be arranged by the contractor. Along with the material account contractor has to submit the list of expenditure for afore said consumables utilized during each month with duly entry by the TPS main gate CISF.

However, if required, GSECL will issue gas cylinders, on chargeable basis if available. Electrical connection and consumption will be given free of cost as per requirement, looking to the site conditions as decided by Engineer-in-charge.

22 Small bearings, gears, rubber parts, nut-bolts, minor spares if not available with GSECL and

if instructed by Engineer I/c. contractor has to purchase and the payment of the same shall be reimbursed to contractor as per “PAKKA’ invoice from supplier in the name of GSECL.

23 To improve the efficiency of the mills, modifications as suggested by Engineer I/c. or M/s.

BHEL are to be carried out by the contractor within quoted rates.

24 Contractor will not be penalized for non-availability of mills during reduced generation due to system conditions or any other trouble elsewhere in the Plant only. Availability of mill should not be reduced at any time. During such period, preventive maintenance can be arranged as per instruction of Engineer-in-charge.

25 During the maintenance work, any damage to valuable parts of GSECL or damage to the

parts due to mishandling and excessive wastage of material will be considered seriously and appropriate amount will be deducted from the bill. The amount will be decided by Engineer-in-charge and binding to the contractor.

26 Mill discharge pipe-lines from mill top to burner if found chock up are to be cleaned

whenever required for establishing smooth coal flow within minimum time. 27 Contractor has to carry out repairing/welding of the Minor damaged/broken worn out spares,

however, if spares/components are felt beyond repair by Engineer-in-charge then same shall

be supplied by GSECL at free of cost to contractor for replacement. However, decision of Engineer I/c. shall be final and binding upon the contractor.

28 This is Biennial rate contract. However, work order against this work will be placed initially

for a period of six months on Trial basis, if required – If the work is found satisfactory, order will be extended for a total period two years at the same rates, terms & condition.

Corpn. reserves right to extend the contract for further period of One year on completion of contractual period and it will be binding to the contractor as per the same rate terms & condition of original order for extended period.

29 If required by the Corpn. due to operational requirement, the Corpn. shall discontinue the

contract. No claim/compensation shall be paid to the contractor. However, the Corporation shall give 3 months notice to the contractor. You will however not be entitled to any

compensation for such premature termination of the contract.

30 Towards repairing of vertical shaft, journal shaft worm shaft etc. if required special welding electrodes, namely L&T make 680 CGS/Diffusion make Unialloy 624, or equivalent will be issued by GSECL free of cost. In case such electrodes are not available & contractor will arrange for the electrodes, the contractor will have to deposit such electrodes to GSECL main store, for such repairs whatever quantity of these electrodes are required & shall submit ‘PAKKA’ invoice with supporting documents for reimbursement of the payment actually made.

Any special welding electrodes other than MS – required for repair & maintenance e.g. Cast iron rod, Hard-facing electrodes etc. shall be issued by GSECL free of cost.

For welding/repairing of mills, general purpose/mild, steel electrodes will have to be arranged by the contractor in the quoted rates.

31 Authorized & technically qualified representative (Supervisor) must be available at site while the work is going-on. The technical qualification of supervisor shall be decided by C.E. (GEN) TPS Ukai.

32 In case of urgency, party shall have to procure required size of nuts & bolts, if asked by the Corpn. with the limit of 1000 kg/year. And such amount will be reimbursed after submitting of ‘PAKKA’ invoice with supporting documents approved by competent authority.

33 Contractor shall collect all dirty lub oil/unserviceable lub oil in empty drum and shall credit the same to Store.

34 Unit-wise Material account register, register showing the life of rollers and their worn out measurement, register showing the life of bearings and journal assly. should be maintained day to day properly and positively for record of material consumption and shown to Engineer In-charge daily.

35 The Unit-wise history register of inspection & replacement of bearings & other important mill spares, consumption of various lub oil shall be kept & maintained by the contractor &

submitted to Engineer-in-charge every week or as and when demanded by Engineer-in-charge.

36 Material account Performa, box file/clip file for R.A. bill should be getting printed as per Performa given by Engineer-in-charge at his own cost.

37 Contractor has to keep surrounding area clean (Removal of Coal dust debris etc.) before starting any welding work in mill area & shall take all precaution to avoid fire hazard in this area. After required repair/maintenance the old spares should be removed immediately from the site and working area should be kept clean and cleared failing which appropriate amount as decided & approved by C.E.(G) will be deducted from the contractor’s bill.

38 During monsoon or whenever the incidence of Bunker chokes up are more, the contractor has to arrange and keep the sufficient extra men power round the clock to carry out the Feeder/Bunker hopper bottom portion/Bunker to feeder pipe/Feeder to mill pipe choke up removal by manual hammering/water jetting / by pocking for 01 or more feeders simultaneously in each unit as per the instruction of EIC. Any delay resulted in generation loss/FO consumption due to non availability of manpower the appropriate amount as decided & approved by C.E.(G) will be deducted from the contractor’s bill.

39 For round the clock better communication and co – ordination the contractor has to provide mobile Telephone with site representative for 24 Hrs at site. No excuse will be entertained regarding the problem of mobile.

PENALTY CLAUSE:-

01 Prompt attending of the defects/ work is the essence of this contract. Generation loss purely on account of non-availability of mill will be considered very seriously and per MW/MWH loss Rs. 75=00 will be deducted. For this purpose, mill capacity will be considered as 40/42 /MW/hours i.e. Rs. 3000=00/3150=00 per mill per hour will be deducted. Five mills should be made available for maximum generation of 200/210 MW per unit.

02 To keep the mill in good condition, some preventive checks are prescribed. Non-implementation of such checks of running mill will result in deduction of Rs. 300/- per mill per each check as required. (Rs. 300=00 / check/mill)

03 The contractor has to carry out maintenance work very speedily to complete the work in a prescribed time, as per Annexure-D. Any delay in completion of such work will affect preventive maintenance of other mill and hence deduction will be implemented @ Rs. 1500/- per hour per mill and decision of Engineer-in-charge will be final & binding on the contractor.

04 It shall be the responsibility of the contractor to have minimum rejection & retention/sieve analysis through 50, 100, 200 mesh as per the design value from each mill. The party should analyze the cause of more rejection & retention and attend the same immediately. If the contractor is found negligent and irresponsible for higher rejection, then penalty will be imposed @ Rs. 500/- per Cu. M. on the excess quantity of rejection as decided by C.E. (GEN) TPS: UKAI. If the reject coal quantity per mill exceeds 4 CMT and density equal/below 1.10, then above penalty shall be imposed upon for quantity exceeding 4 CMT.

Contractor should report to operation staff In-charge Engineer/maintenance In-charge Engineer about cause of rejection and contractor has to send coal rejection samples of all running mills to chemical Laboratory every day.

05 Mill, Gravimetric coal feeders and other auxiliaries should be maintained neat and clean in such a way that there should not be any chance for fire inside or outside. In case fire takes place, immediately actions are to be taken to put out the same in consultation with shift charge Engineer and fire fighting crew. Mill top area. Mill platform/mill body/mill ducts (common & individual all mill) seal air pocket both side, Gravimetric coal feeders, coal discharge pipe line up to first bend of the boiler corner shall be cleaned daily by blowing service air or manually in the morning shift before 07=00 hours by service air available at nearest point Rs. 1000/- per unit shall be deducted for not carrying out the cleaning work & surrounding area underneath of

mill, cable trays, of mill area etc. are also to be cleaned as above before 07=00 hrs. Register of air blowing shall be maintained daily with signature of respective mill plant operator.

06 Any puncture/joint leakage/any coal dust leakage through mill parts & coal pipes will be viewed seriously and if it is not attended as per instruction of Engineer-in-charge during stipulated time Rs. 2000/- per mill per day will be deducted from the RA bills.

07 Oil leakage from worm shaft gland/bottom bearing cover/worm shaft cover will be viewed very seriously and if it is not attended during stipulated time Rs. 1000/- per mill per day will be deducted from the R.A. bill.

08 Contractor shall have to use proper tools tackles for the maintenance works. Removal of parts, bearings, shafts, gear by hammering is not allowed. If such occurrences are noticed, penalty of Rs. 5000/- per occurrence shall be deducted from the bill with the approval of competent authority.

09 Poor workmanship: Occurrence of poor workmanship, frequent repeated maintenance will be viewed seriously.

The amount of Rs. 5000/- per occurrence shall be deducted from the bill with the approval of competent authority.

10 If Generation loss occurs due to any reason, due to non-availability of mill or Gravimetric coal feeder under maintenance beyond prescribed time (Annexure-D) then recovery will be made as per respective penalty specified in clause. (Gen. Loss as per the Penalty cl. 01/ preventive maintenance as per penalty cl. No.03.)

11 If scrap material not removed from mill area even after instruction of Engr-In-Charge. The amount of RS.5000/- per day will be deducted from the bill after approval of competent authority.

GENERAL TERMS & CONDITIONS: 01 The contractor shall have to submit indemnity Bond for any injury and or damages that may

cause to his men or material. However, the contractor shall be fully responsible for any damages caused to the Corporation’s properties done by his men/materials while executing the work. The Corporation will be entitled to recover & the decision of Chief Engineer (G), GSECL, Ukai shall be final and binding to the contractor.

02 Party shall have to submit Sales Tax Registration number and the same should be quoted on all his bills.

03 Contractor will have to execute an indemnity bond on non-judicial stamp paper of Rs. 100/- and thereafter, only he can draw the materials from the Corporation’s store/godown that are to be used for the work. The cost of the same shall be borned by the contractor.

04 The contractor shall have to strictly observe all Safety rules. As per factory Act 1948 and whatever amendments made from time to time to avoid any chance of accident. The party shall strictly observe all instructions of Safety Officer to avoid any chance of accident.

05 ARBITRATION:- “All questions, disputed or differences whatsoever, which may at any time arise between the parties to this contract in connection with the contract or any matter arising out of or in relation thereto shall be referred to the Gujarat Public Work Contract Dispute arbitration as per the provision of the Gujarat Public Works Contracts Disputes Arbitration Tribunal Act-1992”.

06 During any strike if contractor fails to make alternative arrangement for carrying out the work, then the amount for generation loss and/or cost of the work carried out by the department will be recovered from the contractor as per Corp.’s rules.

07 Contractor’s has to report to EE (C/R) as well as Engineer-in-charge of maintenance in the

beginning of every shift to take instruction from him if any for smooth running of the plant.

08 Contractor’s supervisor must make himself available at all area so as to enable operation staff to contact immediately. Supervisor will not leave working place without informing EE (C/R)/Engineer-in-charge.

09 Contractor has to repair/attend any punctures as well as coupling joint leakage of mills of Unit Nos. 3,4 & 5 i.e. leakage from mill body. Multipart outlet with coupling joint, MDV assly. straight pipe piece with coupling joints, mill outlet elbow and mill discharge pipe up to burner immediately round the clock as per instruction of Engineer-in-charge as part of this contract. The scope of leak sealing work shall be up to burner first bend.

10 During AOH / COH of Units or in short shutdown of units contractor have to replace worn out / punctured coal discharge pipe, coal mill suction pipes & PF bends as per the instruction of GSECL Engineer-In-Charge in the quoted rate only.

During AOH / COH contractor will have to replaced worn out pipes – bends as above if no

such work is undertaken / involved payment against this i.e. item 03 of schedule-B will not be given such list of replacements shall be given to party with time limit.

11 During short shutdown of unit for attending hot/cold air duct leakage, expansion bellow air leakage, contractor has to remove duct/bellows insulation for attending duct leakage & refitting of same after completion of work. Necessary insulation will be provided by GSECL free of cost. Binding wire, screws etc. to be arrange by the party.

12 Contractor has to repair/replace damaged instrument air line/service air line, isolating valves at mill area & RC feeder area.

13 Contractor has to provide “ELCB” switch on his every welding machine for safety point of view.

14 Crane/forklift facility for heavy material shifting shall be provided by GSECL (if available on chargeable basis.

15 Workshop facility for machining, repairing – feasible in Ukai TPS workshop shall be provided free of cost.

16 The contractor has to carry out the complete leak sealing of coal pipes right up to blr. burner, over & above the work specified in condition 06 as per the technical/General terms & conditions attached in Annexure-C as part of this contract without any extra cost.

17 The contractor’s has to work in synchrony with the EE (C/R) as well as the in-charge

Engineer of the maintenance Department. The technical decision for maintenance works are to be taken in consultation with the concern E.E. The supervisor of the contractor shall remain present at mill area so that he can be contacted immediately. The supervisor of the contractor shall not leave place of work under contract perform the administrative & managerial control over his staff. The supervisor must be qualified and able to exercise control over the staff.

18 During AOH/COH of unit’s contractor have to dismantle the mill outlet elbows of respective unit as per the instruction of GSECL Engineer-in-charge. If any minor repairing is required by special welding electrodes then GSECL will supply the same free of cost & the work involved will be carried out by the contractor without any extra cost. Minor repairing of mill discharge valve assembly and multiport assembly shall be carried out by the contractor in the quoted rates. Necessary repairing special type welding rods shall be supplied by GSECL free of cost.

19 Essence of this work order is that all mills should be always kept available by carrying out preventive and breakdown maintenance in consultation with EE (C/R) and/or Engineer-in-charge. Mills should be maintained in healthy-intact condition. If defect is found/booked in running mill, it should be attended immediately. Generation loss shall be deducted from party’s bill for not attending defects timely.

20 Any dispute arise regarding any problem towards contract labours work engaged by the contractor, the decision of the CHIEF ENGINEER, Ukai TPS will be solely bound and will have to obey the instructions and decision taken by CHIEF ENGINEER (GEN.) as the case may be.

21 Contractor has to submit the binding of their labourers that nobody will approach to any Court of Law for any dispute raised by any labour union/Association for their payment such as Gratuity, Bonus, C.P.F. Pension insurance, items for safety payment of wages and labour escalation under any labour laws applicable to them & contractor has to issue appointment letter to their workers engaged for the work with a copy to C.E. (Gen.) Ukai TPS and with the agreement on valid stamp papers with himself and condition that he has appointed the workers with the specific period for engagement on work. Contractor has to carry out the work on terms and conditions for exigency of work and as and when asked for to work at the time.

22 (i) The party should maintain minimum staff (Category - wise) round the clock for this Work to come up emergency work without loss of generation.

(ii) The party has to submit daily progress report at 8=15 AM of next day, if fail Rs.200/-, per day will be deducted from bill. Moreover presence & O.T. details shift wise also submitted to the concern S.E or section head.

(iii) The persons engaged for the one work MUST NOT are utilized elsewhere for other work if entrusted to same party /contractor at the same time. If the simultaneous utilization of same staff is noticed then proportionate amount with penalty deemed fit will be deducted from party’s bill.

23 The party shall have to issue identity card with photographs to their personal engaged for which will be the jobs endorsed by GSECL authority for temporary entry in TPS site with a prior permission of the concern Engineer In- charge.

24 The party shall have to maintain ‘PAKKA’ record for the attendance/overtime and pay bill of their staff engaged for every work separately and to be got checked through LWO/Section as & when it is ask for.

25 SPECIAL CLAUSE: You have to engage the separate required personnel for this contract as and when required

during shutdown period with the approval of competent authority & record to be maintained regarding their presence and actual payment made. Further, on completion of this contract the labor engaged for this job shall be retrenched and shall not be engaged on other running contract.

26 Payment shall be made through monthly R.A. bills after recording & submit the certificate duly certified by LWO/IRO/DGM, that contractor has complied with the provision of all labor laws applicable time to time.

II whenever involved/required oil shall be drained from the mill base washed and refitted after re-assembly. Oil shall be supplied by GSECL free of cost. III. Following adjustment/setting is to be carried out as and when require or as per instruction

of Engineer-in-charge to keep the mill efficiency running/performing, failing which appropriate amount will be recovered from the R.A. bill.

V. Emptying of mill by removal of left over feed coal and cleaning of the same prior to attending the internals of mills. VI. Wherever required, contractor shall submit Bar-Chart for the job to be carried out during shut-down well in advance for break-down maintenance. VII. R.C. feeder body maintenance including its gates and suction pipe leakage, liners & bearings. VIII. Seal air fan maintenance including duct leakage. IX. Any worn out spare if not available same is to be fitted after minor repair, party can not insist for new spares only if possible. X. In case of electrical motor failure, alignment of the same after repair and put in its original place by other agencies should be carried out. Coupling/de-coupling and alignment of the

motors should also be carried out. XI. Continuous coal flow to mill should be ensure, if pipes are choked-up the same should be removed by pocking/hammering or by any other means to have continuous coal flow to mills. XII. The party has to dismantle eroded orifices at 16 mtrs. elevation and refit new orifices as per instruction of Engineer-in-charge. XIII. During light load period, the contractor shall have to arrange to carry out preventive and scheduled maintenance as well as puncture work so that during Peak hours all mills are made available for operation. XIV. Service air connection shall be given at 4 mtrs. level between mill ‘B’ & ‘C’ in all units no.3,4&5 Contractor has to made his own arrangement by flexible hose pipe up to require working place to avoid mis-using of air. Contractor should maintain given tapping air connection to avoid mis-use of air failing which appropriates amount will be recovered from R.A. bill. XV. For the calibration activity carried out by the concern instrument section, party has to keep

available their skill supervisor and arrange for opening & closing of Gravimetric feeder any door as per the requirement. Also setting /re-setting required any feeder component for the calibration same has to be carried out in concurrence with concern instrument section. For doing work at any time if required to open the man holes & required to clean the feeder, party has to arrange the same.

Leak sealing of coal discharge pipes in Unit Nos. 3, 4 & 5 from mill to boiler burner. TECHNICAL/GENERAL TERMS & CONDITIONS. 01 For repairing work, Corpn. Shall provide M.S. plates, pipe collars, couplings, rubber gaskets

etc. free of cost. 02 Contractor shall have to bring his own welding machines and suitable welding electrodes.

Electrical connection at one mutually agreed point will be given free of cost and consumption will be given free of cost from the said point.

03 Oxygen/Acetylene gas if required will be issued on Chargeable basis from TPS main Store

Contractor has to submit unit-wise report for Hourly mill availability as well as preventive maintenance work in the sample proforma and any amendment given later on during contractual period by Engineer I/c. of GSECL stating reasons therein, if any for non-availability of mills. Subsequently, forms etc. should be got printed by the contractor. Report shall also cover maintenance work carried out by them and list of defect left out, stating reason for the same. Daily report shall be submitted before 10 AM on next working day.

GENERAL TERMS AND CONDITIONS OF CONTRACT

1. “Contract” means the documents forming tender and the subsequent agreement that may be

entered into.

2. “Works” or “Works” means (Name of Work): Biennial Rate Contract for ONLINE PREVENTIVE

& BREAK DOWN MAINT. of bowl mills type XRP- 763/783 of 210/200 MW unit no. 3,4&5 for

period of two (02) year.

3. “Contractor” means a firm or an individual undertaking these works or offers the rates for this

work.

4. The general rules and regulations of the board for tender and contract for works will apply to

the extent of the same and not modified herein. The contractor is deemed to have gone

through and considered to be fully aware of the conditions mentioned therein

5 EARNEST MONEY DEPOSIT

Tender should be submitted along with earnest money deposit (EMD) at the rate of one

percentage of estimated cost of the tender, without which tender is liable to be rejected

6. SCCURITY DEPOSIT:

Successful bidder shall have to pay security deposit (SD) equivalent to 5%of the ordered value

should be paid of scheduled bank payable at UTPS within seven days of acceptance of order

or Latter of intent . Failure to deposit the SD will entail forfeiture of EMD and the contract shall

be treated as terminated .the contractor shall not be allowed to start of work because of late

payment SD shall be contractors’ liability.

7. The amount of security Deposit will be refunded after the satisfactory completion of the

contract after certification by the concerned Superintending Engineer and after deducting any

dues of the GSECL.

8. To sublet of to transfer the contract without prior approval of the GSECL shall be treated, as

breach of contract and it shall be forfeiting the SD as well as termination of contract.

9. The GSECL reserve the right to forfeit the SD in case of any breach of contract and in dispute.

The decision of Chief Engineer, Ukai TPS shall be final, binding acceptable to the contractor. If

the contractor fails to start the work as stipulated, the EMD and the SD shall be forfeited.

10. The monthly payment to the labourers must be paid before 10th day of succeeding month in

the presence of Labour Welfare Officer, Ukai TPS. A copy of the same must be submitted

along with monthly RA Bill, duly certified by the Labour Welfare Officer. The certificate should

contain details of average no. of labours deployed, total wages/slaries paid and overtime

amount separately.

11. Submission of the bill by the contractor:

Bills shall be submitted by the contractor for each month on or before the date fixed by the site

–in-charge, for all works, executed in the previous month and the site-in-charge shall take or

cause to be taken the requisite measurement for the purpose or having the same verified and

the claim so far as it is admissible, shall be adjusted, if possible, within ten days from the

presentation of the bills. If the contractor does not submit the bill, within the time fixed, as

aforesaid, the site-in-charge may depute a subordinate to measure up the said work in the

measurement list shall be sufficient warrant and the site-in-charge may prepare a bill from

such list which shall be binding on the contractor in all respect.

Along with the R.A. Bill, the contractor should submit material Account wherever applicable,

proof of payment of provident fund and other statutory dues, certificate issued by IRO/Labour

Welfare Officer certifying average number of labours deployed during the month and total

amount of wages and salaries paid to labours

The R.A. Bills along with the supporting documents will be paid within 30 Days.

12. Income Tax : Income tax will be deducted at sources from each bill as per statutory

requirements.

13. The board will be entitled to deduct directly from the bills to be paid to the contractor any sum

or sums payable by the contractor and which sum/sums the board is required to pay as a

principle employer on account of contractor’s default in respect of all liabilities referred to in

above clauses.

14. (a) No sales tax, professional tax or any other taxes, cess or levy, excise duty, octroi, royalty or

other duties will be payable by the GSECL against this contract.

(b) Service tax at the rate prevalent during the period of execution of contract and if

applicable will be reimbursed on production of certified copy of registration number and

certified copy of paid challan for payment of service tax from time to time.

15. The quantities mentioned in the Schedule-B are approximate only and may vary widely. The

contractor shall be paid for the actual works carried out at the rates quoted by him.

16. Documents required to be submitted by the Bidders :

(a) Experience Certificate : At the time of submitting the tender, the contract shall attach

experience certificate(s) of having carried out such/similar type of work either in GSECL or in

any other organization.

(b) Special Tools & Tackles : The bidder shall have to submit along with the offer, the details

of minimum tools, tackles & equipments in possession relevant to the job,

(c ) Provident Fund Code Number : The contractor shall have submit along with the offer the

details of PF code Number from appropriate authorities, without which the offer is liable to be

ignored.

(d) Solvency : The contractor shall have to submit a copy of the solvency certificate minimum

20% of the estimated cost of the tender of any Schedule Bank / nationalized Bank. The Offer

without Solvency certificate is liable to be rejected.

(e) Audited Annual Account : The contractor shall have to attached along with the tender,

last three years audited annual accounts (i.e. profit and Loss account statement and Balance

sheet), the tender estimated value is Rs.50.00 lacs or more for one year contract and Rs. 1.00

Crore of more for two years contract, otherwise the offer will be liable to be rejected.

(f) Partnership Deed/Memorandum of Association & Articles Of Association : If the

contractor is not a sloe proprietor, then the contractor shall have to furnish a copy of the

partnership Deed along with the offer. In case of is likely to be ignored. The contractor shall

also submit power of Attorney.

(g) Labour License for Labour Contract : The contractor on getting the work order but

before starting the work shall have to furnish the copy of Labour License under the contact

Labour (R&A) from the appropriate authorities, without which the contract order is liable to be

terminated.

17. Compensation for the delay : The time allowed for carrying out the work as entered in the

tender shall be strictly observed by the contractor and shall be reckoned from the date on

which the order to commence work is given to the contractor. The work shall throughout the

stipulated period of contract be proceeded with all due diligence (time being deemed to be the

essence of contract) and the contract shall be pay, as compensation, an amount equal to one

percent or such smaller amounts, as the Competent Authority (whose decision in writing shall

be final) may decide of the amount of the contracted cost of whole work as shown by the

tender for every day that the work remains un-commenced or unfinished after the proper

dates.

Provided always that the total amount of compensation, to be paid under the provisions of the

clause, shall not exceed 10 percent of the contracted cost the work as shown in tender.

18. Wages to be paid, time of payment, etc. by the contractor : The payment shall be

disbursed in presence of the GSECL representative during the working hours in the factory

premises and the contractor shall get entries certified in the register of wages by the

representative of the GSECL. Any default will result in cancellation of contract forthwith or else

the contractor shall be punishable to the extent of RS. 100/- per day by way of fine. The

contractor shall give his telephone number, address to the GSECL, so that in case of labour

unrest etc., the contractor can be contacted. The contractor shall arrange to have his office

outside the factory premises and the contactor shall keep himself present throughout the

working hours. It is absolutely necessary that the contractor either himself and/or a fully

authorized representative having full power or authority concerning the contract shall have to

remain present at UKAI TPS. He must also contact Executive Engineer(BMD-II) daily at 8.00

hours, so that necessary instruction can be passed on him. Also, he must be available during

working hours (general shift) and during failure of any milling plant (equipment) at any time, so

that he can be immediately contacted for any emergency work. The contractor and/or his

authorized representative shall not leave Ukai TPS without specific permission from the

Executive Engineer (BMD-II). If the period of absence from Ukai TPS is more than three days,

an alternative arrangement shall be made and to be informed to the sectional head in writing.

19. Labour Laws: The labour laws applicable and amended from time to time have to be followed

scrupulously. A few of them for information are as under:

19.1 Person below the age of 18 years and above 60 years should not be employed for the work.

19.2 No female worker shall be employed in the night shift between 7.00 P.M. to 6.00 A.M.

19.3 Contractor shall maintain a valid labour license under the Contractor Labour(Regulation &

Abolition) Act for employing necessary manpower to be required by him. In the absence of

such license, the contract shall be liable to be terminated without assigning any reasons

thereof.

19.4 The contractor shall, at his own expense, comply with all labour laws and keep the GSECL

indemnified in respect thereof. Some of the major liabilities under various labour and industrial

laws, which the contractor shall comply with are as under :

(a) Payment of contribution of employees (contract labour) as well as employer’s (contractor’s)

contribution towards provident fund, family pension scheme, deposit linked insurance scheme,

administration charged, inspection, etc., at the rates applicable from time to time by the

Government of Gujarat/ Government of India or other statutory authorities.

(b) Payment of deposit in respect of each contract labour at the rate as revised by the

Government from time to time with the office of the Commissioner of Labour as per the

Contract Labour(R&A) Act.

(c ) License fee as prescribed under the Contract Labour(R&A) Act and rules framed therein,

depending upon the number of workers employed by the contractor.

(d) Paid leave facility and wages as per the provision of the Factories Act at the rate of one day for

every 20 Days of working.

(e) Identity cards as prescribed under the Factories Act or by the Thermal Power Station with

Photograph affixed thereon, for identification.

(f) Payment of retrenchment compensation, notice pay and other liabilities as per Industrial

Dispute Act-1947. Any payment to the contractor’s employees arising out of nay claim or

dispute under the Industrial Dispute Act-1947 or any other labour laws.

(g) Payment of compensation in case of accident injury, under Workmen’s Compensation Act.

(h) Provision of crèche if the female labour employed is more than 30.

(i) Maternity leave as per the provision of the Maternity Benefits Act.

(j) The contractor shall deposit 15 days salary at the rate of last drawn salary for every completed

one year of services for each liabilities of gratuity. (As per circular no:

GSECL/HRD/V/Gratuity/Con. Lab/260 dtd.2/05/2007)

(k) The out going contractor will have to deposit gratuity & comply leave & bonus payment.

The above are some of the major liabilities of the contractor in addition to other liabilities

prescribed under the various laws in force from time to time by the statutory authorities, like

Government/Government of India, which the contractor shall have to comply with.

20. PROVIDENT FUND & FAMILY PENSION SCHEME: The Contractor shall submit along with his bill (Month wise) a Statement regarding deductions

at the rate of 12% of the wages against employees Provident Fund & Family Pension Scheme in respect of each concerned employee. (or at the rates made applicable by the Government from time to time) of the wages.

The contractor’s contribution and his workers contribution towards Provident Fund and Family Pension Scheme shall be deposited by the contractor with Regional Provident Fund Commissioner, Ahmedabad or to the authority prescribed under the Act along with the other charges applicable. P.F chalan submit with R.A Bill.

21. Deposit Linked Insurance Scheme : The contractor shall have to deposit 0.50% (half

percent) or the rate applicable from time to time of the wages in respect of employees who are

members of the PF, as the contribution to the Deposit Linked Insurance Scheme, with the

Regional Provident Fund Commissioner, Ahmedabad or to the authority prescribed under the

Act

22. Minimum Wages Act : The contractor shall pay prevailing minimum wages as applicable

from time to time to the laborers engaged by him as per the minimum wages act, in presence

of the GSECL’s officer or representative. After completion of the contract work, the work

completion certificate is required to be produced before the Dy.G.M for in purpose of No due

Certificate and cancellation of the gate passes to the contractor worker at the time of execution

of the contract work.

23. E.S.I. Act : The contractor shall comply with the provisions of E.S.I. Act wherever applicable

as per the prevailing provisions of the Act and as amended from time to time.

24. Administrative Charges : Administrative charges for maintaining provident Fund account

shall be deposited by the contractor with the Regional Provident Fund Commissioner,

Ahmedabad, or to the authority prescribed under the Act at the rates applicable.

25. Paid Leave Facility : Paid leave facility at the rate of one day for every twenty days of actual

work by the contract labour shall be provided by the contractor to his workers. He shall

maintain leave records/verified and certified by the authorized officer of the GSECL.

26. Safety : The contractor shall have strictly observe all safety rules and provide safety

equipment to the contract labours as per the Factories Act,1948, and whatever amendment

made from time to time to avoid any chance of accident. The contractor shall strictly observe

all instruction of Safety Officer and Factory Inspector to avoid any chance of accident.

27. Workmen’s Compensation Fund and Employer’s Liability Insurance :

Insurance shall be affected for all the contract employees engaged in the performance of this

contract. If any of the work is sublet after due permission in writing from the GSECL, the

contractor shall require the sub contractor to provide workmen’s compensation and employer’s

liability insurance for the later employees, unless such employees are covered under the

contractor’s insurance. It shall be the liability of contractor for employee of his sub contractor.

28. Compliance to Security Matters : The power station being a restricted/prohibited area, all

the formalities as required by the Security and Vigilance staff of GSECL shuld be complied

with, to whom the contractor should contact.

29. Submission of Returns & Maintenance Of Records : The contractor shall submit the

returns under the Contract Labour Act, Payment of Bonus Act, Payment of Gratuity Act etc.

and shall have to maintain all up to date records/register in respect his employees as

prescribed under various Labour Laws and produce the same as and when demanded by

GSECL’s appropriate authorities.

30. Execution of Agreement : The successful bidder(contractor) will have to enter into an

agreement with the GSECL and the cost of the stamp paper will be borne by the contractor.

The contractor will also have to execute indemnity bond on required value of stamp paper as

GSECL’s rules. The cost of stamp paper for indemnity bond will be borne by the contractor.

31. Contractor to Indemnify the GSECL: The contractor shall indemnify and keep indemnified

the GSECL and every member, officer and employees of the GSECL, including Engineer-In-

charge and his staff, against all actions, proceeding, claims, demands , costs and expenses

whatsoever arising out of or in connection with the matters referred in above clauses and

elsewhere and against all action, claims, demands, costs and expenses which may be made

against the GSECL, by any workman/employee of the contractor or sub contractor of any other

person under any laws, rules or regulations having the force of law, including, but not limited to

, claims against the owner under Workmen’s Compensation Act,1970. The GSECL shall not

be liable for or in respect of or in consequence of any accident or injury to any workmen or

other person in the employment to the contractor. The contractor shall indemnify and keep

indemnified the GSECL against all such damages and compensation and against all claims,

demands, proceeding costs, charges and expenses whatsoever I respect thereof or in relation

thereto.

The contactor shall also indemnify GSECL in all respect any liability due to breach of legal

provisions contained in any of the Labours Laws.

32. As a contractor, the contractor shall be responsible and liable to pay deference in wages, if

any, and/or observe the revised service conditions that may be awarded by the Honorable

Industrial Tribunal effective from the date directed in the award.

33. The contractor must be maintaining regular labour record and should be paying all required

benefits to labour force contractor should obtain certificated to this effect from Labour

Commissioner.

34. Any other rules and regulation, conditions etc.. that are in force at present and that may be

framed by the GSECL from time to time in connection with the contract will be binding and

acceptable to the contractor.

35. (a) The successful bidder(contractor) has to engage the 44 Nos. of the labours of the

protected labours as I.T. ref. No. 11/98 & 873/2002 pending before industrial tribunal, Surat.

(b) Considering the recent trend of the court/Tribunal and High Court in respect of contract

labourers it is advisable to the contractor to engage the labourers, who have been doing this

work during the tenure of the last contract. The GSECL on demand will give the list o such

labourers to the contractor.

36. Because of this contract, the GSECL shall not accept any additional lablourer liabilities than

stated above.

37. The contractor will make arrangements at his own cost to insure all men, materials and

equipment employed for this work. The GSECL will not be responsible for any loss or damage

either to the contractor’s personnel or his equipment.

38. Dispute, if any, taking place between the contractor and labourers must be intimated to Labour

Welfare Officer, Ukai TPS, immediately.

39. The contractor must insure all the labourers before starting the works.

40. Any casualty will also have to be borne by the contractor for the period the contract continues.

41. The contractor shall not engage any sub contractor without written price permission of the

chief Engineer of the authorized office of the GSELC. In no case the GSECL will be liable in

any manner regarding any liability in respect of any contract labourer engage by the sub

contractor ant the liability of such contract labourer will solely rest with the principle contractor.

42. The contractor shall deploy with the adequate number of experienced staff at site for daily

supervision and for maintenance of various registers and records required under the law and

contract. No payment by the GSECL for supervision shall be admissible.

43. Staff Discipline: - It is the responsibility of the contractor to ensure that his employees

maintain strict discipline as regards security, methods of safe working etc. and not to cause

any hindrance to smooth running of power station or in execution of duties by GSECL staff.

Any lapse in this regard will be viewed seriously and contract is liable to terminated. If any of

his staff is found unsuitable or not behaving properly, the contractor shall have to remove him

the worksite on demanded by GSECL. The contractor shall have to strictly observe the rules

and conditions specified in the enclosed works contract bokklet of the GSWECL, which are not

modified hereunder. To keep harmonious Industrial Relations amongst contract labourers is

the sole responsibility of the contractor. Any breach of the same will be viewed seriously.

44. Arbitration : If at any time any question, dispute, difference, shall arise between the GSECL

or the Site-In-Charge and the contractor or any person claiming through him upon or in relation

to or in connection with the matter herein before stipulated and specified to be referred to

arbitration, either party may forthwith give to the other a month’s notice in writing of the

existence of such question, dispute or differences whatsoever, which may at any time arise

between the parities to this agreement, touching the agreement or subject matter thereof,

arising out or in relation thereto and whether as to construction or otherwise, shall be referred

to the decision of the sole Arbitrator appointed by the chairman of GSECL for the purpose,

who shall be retired High Court Judge or a retired District and Session Judge, and upon the

parties’ reference to the Arbitration Act,1940 as amended from time too time and the rules

therein. The Arbitration proceeding shall be conducted at GSECL’s head office , Baroda , or

such places as the sole arbitrator may determine. The award of the sole arbitrator (or umpire)

shall be final and binding upon the parties upon every or any such reference the costs of and

incidental to the reference and award respectively, shall be at the discretion of the arbitrator or

umpire who may determine the amount thereof of direct the same to be taxed as between

party, and the party shall direct by whom and what manner the same shall be borne and paid,

provide however, that either party to the dispute shall in respect of any monetary claim, be

entitled to receive from the other party by way of cost any time exceeding the percentage set

cut below, irrespective of the actual fees and expenses incurred by him. Work under contract

shall continue during the arbitration proceeding and no payment, other than for matters in

dispute due to or payable by the purchaser, shall be withheld on account of such proceedings.

The percentage above referred tot in this clause is five percent on any such menotary

award, which does not exec Rs. 10,000/-; three percent on the next or any part thereof; two

percent on the next Rs.50,000/-; or any thereof, and one percent on Rs.40,000/- or in case it

exceeds Rs. 1,00,000/-.

45. The GSECL reserve the right to terminate this contract at any time during its currency without

giving notice of termination or any reason thereof.

46. Time Limit : The time limit for completion of this contract works, if awarded, is Two years.

The GSECL can extend contract for further period of One year after expiry of time limit, if

desired by the GSECL, and quantity will be enhanced proportionately.

47. The contract will remain in effect for the period of 24 months from the date of commencement

of contract. GSECL at any time during the tenure of the contract may terminate the same at its

sole discretion without assigning any reason, if it is observed that obligation under this contract

are not performed up to the satisfaction of GSECL. The contractor will, however, not be

entitled for any compensation for such premature termination of contract.

48. In case of default, the work will be got done through other agency/agencies at the risk and cost

of the original contractor, and the GSECL shall be entitled to recover such expenses from

defaulting contractor by such methods as deemed fit. The contractor shall not, however, be

entitled to terminate the contract or stop works undertaken by him before expiry of the contract

period/extended period due to any reason whatsoever.

49. Under the contract, the contractor should either himself be present at the site or should

nominate person I writing, who must be available at the site and who should be authorized to

take decision about the works and receive the instructions from Engineer-in-Charge of the

work at any time. In absence of any responsible man of contractor at the time of any

emergency, adhoc decision of Site-In-Charge will be binding on the contractor.

50. The contractor is bound to execute the work for any item as per the instruction of the Site-In-

Charge. On refusal to do so, the work will be carried out at the risk and cost of contractor by

using the contractor’s tools and tackles, for which no compensation whatsoever shall be

payable to the contractor.

51. If any immovable articles/tools/equipment will be found stolen from the working place, the

contractor would be held responsible and cost will be recovered for his bill.

52. For any contract and ambiguity, the decision of the Chief Engineer(C&O) shall be final and

binding on the contractor.

53. Sealed tender should be super scribed as “Rate contract MILL MAINTENANCE STAGE-II” .

Technical Bid & Price Bid should be sent by R.P.A.D only so as to reach this office before last

date & time of acceptance of the tender. GSECL will not be responsible for any postal delay.

Tender received after last date and time of acceptance will not be considered.

54. The contractor shall quote only certain percentage of rates above or below the estimated

rates, i.e. contractor should quote either, say A% above the estimate or B% below the estimate

or all the items. The contractor should not quote different percentage for different items.

Tenders received with different percentage rates for different items shall be liable to be

rejected. The contractor should quote only percentage higher/lower in figures as well as in

words in Schedule-B. In case of not mentioning clearly above/below the estimate, the GSECL

shall consider the quoted percentage below the estimate and the contractor must have to

honour this, failing which suitable may be taken , considering this as dishonor and/or summary

rejection of offer without assigning any reason thereof as deemed fit by Chief Engineer. The

rate quoted should be inclusive of all taxes and expenses, if any. Nothing will be paid extra as

a part of contract unless & until it is specified in the tender documents by GSECL.

55. The rates quoted shall be firm and valid for 180 Days for acceptance from the date of opening.

56. The contractor, if desired, can see the plant and site on any working day and during working

hours with permission of the Chief Engineer.

57. Conditional tender is liable to be rejected withdrawal or insertion of conditions unilaterally after

opening of tenders will not be permitted unless it is so desired by the GSECL.

58. Chief Engineer, UKAI TPS , reserve the right to reject any of all tenders without assigning any

reasons thereof.

59. Before staring the work, the contractor should contract Industrial Relation Officer/Labour

Welfare Officer for all formalities and obtaining the gate passes of his labourers and for other

formalities.

60. Office correspondence will be carried out in English language, and if at any time to facilitate

the contractor , Gujarati translation may be furnished, if deemed fit. The English version will be

the correct one and the same only will held good for legal matters.

61 The contractor should intimate to the office the name and address of authorized

representative, so that our field officer can contact them when required in connection with the

execution of the said works.

“GENERAL SAFETY RULES TO BE OBSERVED BY THE CONTRACTORS”

(1) All the contractors working at Ukai thermal Power Station shall have to strictly observe following safety rules. The contractors shall be responsible for informing and observing these rules by their supervisors / employees /labours as well as the supervisors / employees / labours of their Sub-agencies / sub-contractors engaged, if any. Prior to commencement of the work, contractor shall have to submit a written assurance on their letterhead to the concerned Sectional Head / Engineer-in-charge that they have thoroughly gone through these rules, have educated their employees / employees of their sub contractor and will strictly observe the said rules while execution of work under work contract awarded to them. They will have to indemnify the corporation for any loss or damage / accident / injury to the corporation’s property / employee or employee of their own in default of non - observing these rules.(01)Persons to be employed for carrying out the work shall possess required qualification, be fully trained and conversant for works to be done. All persons should have gate pass. Register consisting the full details (i.e. address, phone no, details of nearest relative, etc.) of all persons is to be maintained during the work execution, one trained & competent supervisor should always remain present at site.

(02) The contractor shall all the required safety measures prior to commencement of work on

dangerous substances, machineries or area at which cautionary notice is displayed and

obtain “line clear” or “work permit” through the concerned Department / Section.

(03) Prior to carrying out welding, gas cutting, furnace heating or any other hot work job, the

contractor shall remove all the inflammable material lying at nearby worksite or cover it

properly by suitable protective covrin. Also, special care shall be taken before carrying out

such job & see that all possible contributing factors to set fire shall be removed / vanished

prior to commencement of the work. Advance intimation shall be given to concerned section /

fire section to commence the work in fire prone areas. they should also keep ready all the first

aid fire extinguishers / equipments & fire extinguishing media / material like sand / water

buckets or other appropriate equipment at such place.

(04) While carrying out work in confined space or inside vessel, the contractor shall obtain necessary “confined space / vessel entry permit” from concerned department prior to commencement of the work. For lighting in such areas, 24 volt (ISI certified & with proper guard) hand lamp shall be used.

For taking care of the persons working inside the confined space / vessel, a supervisor / person capable to keep continuous watch on person(s) working inside, assist them incase of emergency or arrange to get immediate outside help. Shall remain present at entry point shall remain present at entry point and shall use full body safety belt without fail.

While working inside sewage, trench or in-depth, a person to warn outsiders / entrants/ passers etc shall remain available near entry point or the entry point shall be cordoned by a barricaded tape with a cautionary notice. After completion of the works, all the lids / covers / grills / grits opened, shall be re-fixed / re- placed in the original position as it were prior shall be re- fixed / re-fixed / re-placed in the original position as it were prior to commencement of the work and leave the work place in safe condition in all respect, so as to prevent accident to fellow workers.

(05) The contractor shall see that he / his persons do not block (by stacking material, spare parts, tolls-tackles, equipments etc), any passages / walkways / gangways / aisles / staircases / ladders / lift or any other approaches / roads leading to plants or its auxiliaries, on which there is a traffic movements in case of emergency . if it is utmost necessary to carry out work in such area with blocking of passage, prior permission of competent authority or the engineer- in- charge shall be obtained. To demarcate /declare the area as UNSAFE, cordon it using barricading type & display suitable caution notice or keep a person to restrict / divert the traffic route through other safe passage.

(06) Prior to use power / electrically operated hand tools / equipments / machines / gadgets like

welding machine, hand grinder , hand drill etc, ensure its safe operation & use it only if it is

found safe to use . do not use defective, unsafe or improperly maintained equipments.

The electrical power supply required to run such equipments shall not to be taken

directly at their own but shall be obtained through concerned electrical maintenance

departments or their authorized persons or under their observations / guidance only. The

electrical section shall provide temporary electrical connection up to contractor’s mains board

on which it is compulsory to install mains switch, ELCB & fuses of adequate capacity. all such

equipments shall invariably be earthed adequately to prevent electrical shock, sparking, short

circuit etc. power cord to be used shall be of adequate capacity, without any joint & shall

consist of earth wire also. Hence, it is necessary to use adequate capacity 3-wire power cord

for single & 5-wire power cord for three phase power connections. The plugs, receptacles,

pins, holders etc shall be of adequate capacity & safe to use.

All electrical & mechanical equipments / tools-tackles viz. welding machine, cutting

machine, grinder drill, chain pulley blocks, hook chooks etc required to be used during work

execution shall be of standard make & bear ISI certification mark on it. The consumables like

welding electrodes, grinding wheels / discs etc which has specific prescribed life span shall

not be used in any case if its expiry date is over.

(07) It is compulsory to use standard make personal protective equipments (P.P.Es.) as per the

job requirement. Do not work without use of required P.P.Es contractor is responsible to

provide standard make (ISI approved) personal protective equipments / safety gadgets

suitable to give sufficient protection against hazards involved in their work / job to their staff,

as per the job to their staff, as per the job requirement and insist / enforce their work / job to

their staff, as per the job requirement and insist / enforce their staff to put on the same while

at works.

The Ongoing work is liable to be stopped at any time if the contractors’ staff is found working

without P.P.Es. Following is the list of various P.P.Es. To be used for various works /

(08) Before using lifting machines / tackles (like C.P. Bs., Hook chooks, winch, forklift, mobile

crane, EOT crane etc.) & its attachments (like D-shackles, slings, U-clamps, Eye bolts or any

fixtures), it shall be checked and used only if found safe to use. Also, ensure that these are

tested, examined & certified in form no.9 / 10 by competent person as per the Factory act-

1948 and its validity is not expired. Further, it shall be fixed properly and firmly prior to lifting

the weight.

(09) Scaffoldings to be used for working at height shall be adequate size & capacity. Obtain the

work permit when working at height. While climbing on such scaffolding or working on any

structure at height, use of full body safety belt & helmet is compulsory. It is also necessary to

fasten chinstraps of the helmet.

(10) Contractor or their employee shall not interfere in day-today routine plant activities / works

except the work assigned to them, shall not loiter in the areas other than their work

jurisdictions, as well as shall not temper / operate / touch the machineries / equipments /

auxiliaries with which they are not concerned. Also, the contractor shall strictly instruct their

staff not to sit or take rest at / near / below running plants, auxiliaries, systems or any place

which is risky, hazardous & prone to accident.

(11) The cylinders containing poisonous / toxic or inflammable / explosive gas like oxygen,

acetylene, LPG, hydrogen, ammonia, chlorine, co2 shall be handled safety taking due care. To

handle / shift such cylinders a special trolley / cage meant for it must be used but in no case it

should be rolled. Domestic LPG cylinder shall not be used / permitted.

(12) On completion of the work, cotton waste, spilled oil / grease, pieces of welding rod & other

waste material shall be removed from work site and the area shall be left safe, neat & clean.

(13) In case of any injury / accident while working, it shall immediately be reported to safety

department through concerned sectional head / Engineer. The prescribed from no.21 may be

obtained from concerned section or safety officer.

For any incident occurred but have no injury to any persons should also be informed to safety

officer as “Near Miss Incident.”

(14) In all risky jobs, before starting work, contractor should obtain general safety work permit from

concerned section well in advance.

(15) In case of notising smoke or fire during their work execution, they shall make immediate efforts

to extinguish / control it and simultaneously inform the fire brigade on phone no.4444 or 4344

or 5555 or 02624-290049,shall shift the casualty to nearby hospital after rendering first aid in

case of accident.

(16) Over & above these, contractor shall have to follow all the safety requirements / rules &

regulation / norms and legal provisions laid down in various statues, particularly the provisions

of The factories act-1948 & The Gujarat states factories rules-1963 (Amended up to

date)shall be followed strictly. The contractor shall also obey the rules / regulations /

instructions of the local competent authority for safety requirements.

(17) No women or young person shall be allowed to clean, lubricate or adjust any part of a prime

mover or of any transmission machinery while the prime mover or any transmission

machinery is in motion. Examination or operation of motion machinery shall be made or

carried out only by a specially trained adult male worker wearing tight fitting clothing as per

section 22 of factories act 1948.

(18) No women or young person shall be employed or permitted to work in lead-compound area

like battery room etc.as per schedule VI of GFR 1963.

(19) All the relevant labour and industrial laws shall also be followed compulsorily.

(20) It is felt necessary to deploy safety officers / safety supervisors by contractors / agencies

involved in carrying out hazardous activities / operations inside TPS to have better and

constant supervision in terms of health safety and environment activities.

(21) in case, it comes to the notice of GSECL UTPS management that the safety guidelines /

safety rules / safety norms are not being followed then a minimum sum of ropes one thousand

shall be penalized on the contractor / Agency and for subsequent such violation, a server

penalty / action as deemed fit shall be imposed, which may please be noted.

(22) The above rules shall be scrupulously followed and where required, they may contact the

safety officer for any ambiguity / further guidance in this regard.

(23) For performance evolution of contractor, safety factors of work accident, fire incident & near

miss accident will be considered. Steps can be taken to review the job assignment up to

cancellation for negligence.
