Dear Sen. Mikulski, Mr. Margolis, Mr. Rosenstein, and Chief Judge Traxler:

I am twice the movant-intervenor in the above case, once in 2009, and now presently.

On November 28, 2012, reporter Van Smith of the Baltimore City Paper published a news story about this case and my intervention titled: Zombie Litigator.

In essence, the allegations in this matter are that Maryland U.S. District Court Judge J. Frederick Motz has thrown this case twice now to protect his lawyer friends and cronies from reputational harm which would implode their law firms, from possible disbarment, and from having to pay financial restitution to the Office of the Maryland Federal Public Defender. Most troubling, there is evidence that Judge Motz’ ‘too-close’ friend, Maryland U.S. Circuit Judge Paul V. Niemeyer, is helping him to cover-up these matters on appeal, which was first heard in the Fourth Circuit as appeal no. 09-7572.

Of most note, the Maryland U.S. Attorney’s Office has filed papers both in the district and fourth circuit courts ‘not objecting’ to the relevant documents being unsealed. And most surprising, most of the allegations regarding judicial misconduct in this case were learned from two in-person meetings spanning some 6 hours between myself and Circuit Judge Paul V. Niemeyer in Summer 2010. The primary 2012 motion to unseal is attached. You all are directed to the allegations within the affidavit.

I am writing to you today to ask that one and/or all of you cause the U.S. Department of Justice to initiate an investigation of these matters by both the DOJ’s Criminal PIN and the DOJ’s independent Inspector General; and that you cause any and all findings of those investigations, including their initiation, to become public.

I also ask that Chief Judge Traxler begin an independent investigation of these matters as the head of the Fourth Circuit’s Judicial Council and/or initiate the judicial complaint process sua sponte.

I ask for immediate in-person meetings with Senator Mikulski, the appropriate DOJ investigators, and Chief Judge Traxler. Please contact me as soon as possible.
