CHALLENGES & PRIORITIES: M/WBE PROGRAMTAKING BOLD ACTION
AGC NYS filed Article 78 proceedings against the New York State Department of Environmental Conservation, Department of Transportation, Office of Temporary and Disability Assistance, Dormitory Authority and New York State Insurance Fund, demanding that they release documents they have refused to produce to justify how 30% M/WBE goals were legally and specifically established for individual contracts.
For two years, AGC NYS has mounted an extensive effort through the Freedom of Information Law (FOIL) to gain insight into the administration of the M/WBE program, issuing over 125 FOIL requests in total. The appearance of 30% goals on projects seemingly across the board in many state agencies calls into question compliance with Article 15A of the Executive Law, which governs the M/WBE program.
On October 4, 2017, the Albany County Supreme Court issued its decision on AGC’s case challenging five state agencies’ denial of FOIL requests seeking the contract-specific M/WBE goal analyses underlying goals set for five public contracts. The state agencies had either failed to certify that no documents existed in response to the demands or asserted that certain FOIL exceptions protected responsive documents. As a result, two agencies were required to provide documents to AGC. Moreover, two other agencies gave ambiguous responses to the FOIL demands, making the existence of relevant documents unclear, but later stated in affidavits filed with the Court that no such documents existed -- meaning that, as suspected, no analysis had been conducted as required by regulation. Our case proved that M/WBE contract goals are not being properly established in accordance with the law.
This is an important step forward in our effort to bring transparency to this process and ensure that the program is being administered in accordance with the law. We will continue to press those efforts relative to this case and beyond.

Governor Cuomo also introduced a radical M/WBE budget proposal, which was rejected by the legislature thanks to strong leadership from AGC NYS and other construction industry organizations. Some of the main points in the letter for improvement of the proposal included:
• Amend the present version of Executive Law Article 15A only to extend provisions presently sunsetting in December 2018 to December 2019 to permit the procurement of a new disparity study.
• Clarify that contract-specific goal setting analyses required by law must be available pre-bid and included in project specifications.
• Provide appropriation of $2 million for the re-establishment of the Alliance of Majority & Minority Contractors Mentor Program to grow and develop M/WBE capacity statewide.

Congressman John Faso introduced the “Infrastructure Expansion Act of 2017” (H.R. 3808), with AGC NYS working closely with the Congressman to develop the bill. Every New York taxpayer is paying billions more limiting our already scarce resources to rebuild our schools, hospitals, roads, bridges, affordable housing, and environmental infrastructure. AGC NYS looks forward to continuing the fight for Scaffold Law Reform.
