It has been reported that incidents of denial of treatments, investigations, surgeries anddeliveries are occurring in different Medical College & Hospitals / District Hospitals / SubDivisional Hosptials / Rural Hospitals / B.P.H.C.s regularly in spite of the directives of HonbleSupreme Court that "No Doctor or Nurse shall refuse to treat a PLI-LA on account of his/herpositive status." A communication has already been sent to all concerned vide memoNo.ACS/l D-34 1-08/70 dated 20.01.2009 (Copy enclosed for ready reference).

The matter was taken with a serious note in the S,G.R.C. meeting in presence of Principal!Secretary on 14th

September, 2011. The meeting minutes is also attached for your readyreference.

In this regard you are directed to take necessary steps to communicate all concerned tostop such practices of denial of treatment and harassing the people living with HIV/AIDSattending at OPD / HID / ER / Labour room / Surgical 01 for tratrnent with immediate effect.

Department of Health & Family Welfare will not be responsible if any complaint ofcontempt of l-ion'ble Supreme Court is lodged in the Court of Law hence forth.

This has reference to the GO No. 7473 - FS/Sectt/Food/2N - 1/2011 dated 29.12.2011

regarding inclusion of all eligible BPL families of HP! infected persons in the Antyodaya Anna

Yojona scheme under Targeted Public Distribution System on priority basis.

You are requested to prepare a list of the HP! positive BPL families in consultation with the

District Level Network of the People living with HIV/AIDS (DLN) of your district and submit the

same to the District Controller, Food & Supplies Department (DCFS) of the district under your

signature. As per order no. 7473 - FS/Sectt/Food/2N - 1/2011 dated 29.12.2011 of the F&S

Department, Government of West Bengal. The DLNs are to submit the draft list of such BPL families

to you along with the documents in support of both BPL status and PLHA status.

In this regard, you are hereby requested to advise the DLN of your district to first submit to

you the name, father's name, address of the office bearer of DLN, authorized to send the names of

eligible PLHA families (BPL) to you, for forwarding it further to DCFS. Copy of the EPIC of the

authorized person should also be furnished by the DLN.

The list that will be furnished by the DI-Ns may please be verified at your end before sending

the same to the DCFS of your district with your recommendations.

An early action will be highly appreciated.

Sir (s),It is well-known to you that the free travel facility will be extended to the persons traveling

alone or with an escort in State Transport buses for the following category. "Persons sufferingfrom AIDS with adequate evidence."

In this context, It is bring to your knowledge that a list of persons suffering from AIDS whorequire treatment at the ART Centers could not be disclosed to maintain confidentiality as perNACO guidelines. Alternatively. In-charge of respective ART centers will issue necessary medicalcertificates to the patients suffering from AIDS attending the concerned ART centers atone or withan escort. Necessary format of the medical certificate to be used by the In-Charge of therespective ART centers is annexed for ready reference. It may be mentioned that following ARTcenters are functioning in West Bengal for treatment of AIDS.

So, I do request you to take necessary actions early so that AIDS patients may avail thenecessary Free Travel Facilities and to provide necessary PASS having medical certificate of theconcerned patients suffering from AIDS to be available from the concerned ART centers.

Actions taken may kindly be intimated to this end. A monthly progress report to be sentin each month to this end about the number of passes issued to such category of patients fromthe State Transport Corporation.
