1. Introduction

With this set of TOP applications, Vancouver cab companies are requesting TOPs to allow them to operate, collectively, 99 additional vehicles on: Friday and Saturday evenings from April 26th to September 26th ; peak cruise Ship days; July 1, 2015 (Canada Day) and Wednesday, July 29, 2015 (celebration of lights).

2. Statutory Authority Section 38(2) of the Passenger Transportation Act reads:

The Board may approve an application forwarded to it under subsection (1) if the Board considers that there is an urgent and temporary need for the licensee to increase the number of motor vehicles that are or may be operated under the licence. (emphasis added)

The onus is on the applicant to satisfy the Board that there is a need that is both urgent and temporary.

3. Procedural Matters

The four taxi companies have submitted TOP applications that are nearly identical. The significant difference between them is the number of TOPs that each applicant seeks. I am conducting these proceedings at the same time pursuant to section 14 of the Passenger Transportation Act. I am also issuing a single decision.

4. Reasons

On October 2, 2012 the Passenger Transportation Board issued its Licence Application Decisions on Peak Period Taxi Service in the City of Vancouver. This omnibus decision included decisions on 21 applications from 4 Vancouver taxi companies and 17 from suburban taxi companies to provide peak period taxi service in Vancouver. The Board approved 11 of 21 applications which provides for a combined increase in the available supply of taxis in the Vancouver area, from 588 to a maximum of 725 at peak times. In this omnibus decision, the Board found that a public need exists for 137 permanent peak period taxis. The four Vancouver taxi companies were approved for a combined total of 99 permanent peak period and special event taxis.

However, following the above approval, the Board was advised that the City of Vancouver must amend its bylaw with respect to the existing ceiling for 588 permanent vehicles and to allow permanent part-time taxis. The bylaw has not yet been amended.

The 4 Vancouver taxi companies are operating 99 weekend taxis under temporary operating permits. The current permits expire on April 25, 2015.

Carolyn Bauer, spokesperson for the Vancouver Taxi Association, in a letter dated March 13, 2015 states:

As of March 12, 2015, the City of Vancouver has not made the requisite changes to the Bylaw to permit the Vancouver Taxi Companies to operate under their current condition of licence (99 Peak Period Taxis) issued by the Board. The 99 TOPs requested by the Vancouver Taxi companies in these present applications are the same number the Board approved for permanent peak period taxis for the Vancouver Taxi companies.

Appendix II lists TOPs that the Board has approved for the Vancouver taxi companies since 2011. The 99 TOPs requested by the Vancouver taxi companies is the number the Board approved for permanent peak period taxis for the Vancouver taxi companies. The operation of 99 TOPs by the Vancouver taxi companies should ensure a continuation of peak period taxi service in downtown Vancouver. However, this increase falls short of the 137 permanent peak period vehicles identified by the Board to meet public need at peak weekend times . The City of Vancouver advised the Board on October 1, 2014 that the City was amending its Vehicles for Hire By-law to suspend the issuance of any new licences, with the exception of wheelchair accessible applications from the Vancouver taxis companies, for a period of six months. On March 25, 2015, Council approved an extension of the moratorium until October 31, 2015. The Board finds the current need for the Vancouver companies to operate 99 additional vehicles is urgent and temporary because TOPs represent the only regulatory option for operating peak period taxis until the City of Vancouver bylaw is amended. The operation of 99 TOPs by the Vancouver taxi companies should not only ensure a continued service, but provide additional capacity for peak period taxi service in downtown Vancouver

This authorization will expire earlier in the event the Registrar is able to issue permanent peak period identifiers to the Vancouver taxi companies prior to September 29, 2015. Temporary operating permits are considered individually on the basis of “urgent” and “temporary” need. TOPs are not a way to get authority for additional vehicles without making a formal application. Approval of further permits should not be expected.

5. Decision For the reasons cited above, the Board approves the TOP applications as follows:

Services

Originating Area: Transportation of passengers may originate from any point in the City of Vancouver.

Destination Area: Transportation of passengers may terminate at any point in British Columbia and beyond the British Columbia / United States border when engaged in an extra-provincial undertaking.

Return Trips: The same passengers may be returned from where their trip terminates in the destination area to any point in the originating area if the return trip is arranged by the time the originating trip terminates.

Reverse Trips: Transportation of passengers may originate in the destination area if the transportation terminates in the originating area and the cost of the trip is billed to an active account held by the licence holder that was established before the trip was arranged.

Other

Express authorizations:

(i) Vehicles must be equipped with a meter that calculates fares on a time and distance basis.

(ii) Vehicles may be equipped with a top light.

(iii) Vehicles may, from within the originating area only, pick up passengers who hail or flag the motor vehicle from the street.

Taxi Cameras: A digital taxi camera must be installed and operated in each of the permit holder’s vehicles in accordance with applicable rules and orders of the Passenger Transportation Board.

Taxi Identification Code:

Each vehicle operated by the licensee must have a unique taxi identification code (TIC) affixed to the inside and outside of vehicles in a manner that complies with applicable rules, specifications and orders of the Passenger Transportation Board.

Taxi Bill of Rights: a) A Taxi Bill of Rights issued by the Ministry of Transportation and Infrastructure (“Taxi Bill of Rights”) must be affixed to an interior rear-seat, side window of each taxicab operated under the permit.

b) The Taxi Bill of Rights must be displayed at all times in an upright position with the complete text intact and visible to passengers.

c) Permitees may only display a current Taxi Bill of Rights.

Permit Expiry: The permits will expire on September 29, 2015 at 6:01 p.m. or before if the licensee receives approval to operate peak period taxis on a permanent basis, thus giving effect to the Board’s decision on Peak Period Taxi service in the City of Vancouver, issued on October 2, 2012.

Rates: The Board Rule Respecting Lower Mainland Taxicab Rates, Effective November 6, 2014 and Standard Rules for Taxicab Rates, July 16, 2014 apply to vehicles operating under this permit.

Originating Area: Transportation of passengers may originate from any point in the City of Vancouver.

Destination Area: Transportation of passengers may terminate at any point in British Columbia and beyond the British Columbia / United States border when engaged in an extra-provincial undertaking.

Return Trips: The same passengers may be returned from where their trip terminates in the destination area to any point in the originating area if the return trip is arranged by the time the originating trip terminates.

Reverse Trips: Transportation of passengers may originate in the destination area if the transportation terminates in the originating area and the cost of the trip is billed to an active account held by the licence holder that was established before the trip was arranged.

(i) Vehicles must be equipped with a meter that calculates fares on a time and distance basis.

(ii) Vehicles may be equipped with a top light. (iii) Vehicles may, from within the originating area only, pick up

passengers who hail or flag the motor vehicle from the street.

Taxi Cameras: A digital taxi camera must be installed and operated in each of the permit holder’s vehicles in accordance with applicable rules and orders of the Passenger Transportation Board.

Taxi Identification Code:

Each vehicle operated by the licensee must have a unique taxi identification code (TIC) affixed to the inside and outside of vehicles in a manner that complies with applicable rules, specifications and orders of the Passenger Transportation Board.

Taxi Bill of Rights: a) A Taxi Bill of Rights issued by the Ministry of Transportation and Infrastructure (“Taxi Bill of Rights”) must be affixed to an interior rear-seat, side window of each taxicab operated under the permit.

b) The Taxi Bill of Rights must be displayed at all times in an upright position with the complete text intact and visible to passengers.

c) Permitees may only display a current Taxi Bill of Rights.

Permit Expiry: The permits will expire on September 29, 2015 at 6:01 p.m. or before if the licensee receives approval to operate peak period taxis on a permanent basis, thus giving effect to the Board’s decision on Peak Period Taxi service in the City of Vancouver, issued on October 2, 2012.

Rates: The Board Rule Respecting Lower Mainland Taxicab Rates, Effective November 6, 2014 and Standard Rules for Taxicab Rates, July 16, 2014 apply to vehicles operating under this permit.
