Manila’s creaking train network means a miserable three-hour work commute for salesman Gerard Galang – just one example of major infrastructure woes that analysts say threaten to cool the Philip-pines’ red-hot economy.

Peak-hour hell comes in many forms in the city of 12 million people, with com-muters experiencing a sweaty, stinky crush on dilapidated trains and giant queues to buy tickets.

“I pity myself and my fellow commut-ers but I don’t have any other option than the train,” said Galang, 29, who inhales antiseptic rubbed on to his hands to help

negate the stench on the train.“It gets so crowded our faces get

pressed against each other and on doors and windows.”

Galang spends three hours commuting to work every day, half of which is spent in queues.

For other commuters on buses or in cars, daily gridlock worsens to a complete stand-still that can trap people for hours when even small rain storms trigger flash floods.

The Philippine economy has in recent years shed its reputation as one of Asia’s laggards, with growth of 6.4 percent in the second quarter maintaining its status as the region’s best performing after China.

MANILA, Oct 16 (Mabuhay) – Senator Antonio Trillanes IV accused on Thursday Vice President Jejomar Binay of coddling Gerry Limlingan, who had been described allegedly as Binay’s finance officer and supposed dummy in corporations.

“Si Gerry Limlingan ay itinatago ni Vice President Binay. Meron tayong informants sa kampo ni VP Binay. As late as few weeks ago, kasama pa sa meetings nila pero ngayon ibinaon na nila,” Trillanes said during a weekly forum in the Senate.

Asked what he meant by “ibinaon,” the senator said: “Napakalalim na pagkakata-go. Hopefully, hindi pa ibinaon sa lupa.”

“Alam nilang pag nakuha natin yan, yung buong kaluluwa ng kanilang sin-dikato ay lalabas. Pero as it is, alam na natin dahil si (former Makati Vice Mayor Ernesto) Mercado ay dating parte ng sin-dikato. It is in the interest of Vice President to hide Limlingan,” he said.

Asked how reliable his source was, Trillanes said: “Very reliable.”

Reached for their comment, the camp of Vice President Binay denied Trillanes’ allegation.

“Gerry Limlingan is a friend of the Vice President. To the furthest of my knowledge, they have had no contact [for] the longest time,” Cavite Gov. Jonvic Re-mulla, Binay’s spokesperson for political affairs, said in a text message to GMA News Online.

Turning the tables on Trillanes, Remulla said the former Navy officer should instead “answer the question on who really owns the vehicles the LTO (Land Transportation Office) said is registered in his (Trillanes) name but not registered in his SALN (Statement of Assets, Liabilities, and Net

Worth).”Trillanes had denied this accusation,

describing the same as an old issue al-ready dismissed by the Ombudsman and the court.

Limlingan was earlier tagged by Mer-cado as the supposed bagman of Binay when the latter was still Makati City mayor.

Mercado also claimed that Limlingan acted as a supposed dummy of Binay in businesses and properties that are not declared in Binay’s Statements of Assets and Liabilities. These allegedly include Agri-Fortuna Inc., the company that bought Binay’s piggery business in Rosa-rio, Batangas, and a real estate company in Makati. Despite repeated invitations and subpoenas by the Senate, Limlingan has yet to appear before the blue ribbon subcommittee which is looking into the alleged overpricing in the construction of the Makati City Hall Building II.

Records from the Bureau of Immigra-tion show Limlingan has not left the coun-try. Trillanes said they have already asked the help of the Philippine National Police and National Bureau of Investigation in locating Limlingan.

Meanwhile, it is possible for Congress to lead the impeachment proceedings against Vice President Jejomar Binay over alleged corruption even at the time he was not yet an impeachable officer, an admin-istration ally and veteran lawyer said.

In a statement, Cavite Representative Elpidio Barzaga of the National Unity Party said under Supreme Court juris-prudence, Congress has the authority to impeach an impeachable officer regardless of the period the alleged impeachable act was committed.

MANILA, Oct 14 (Mabuhay) – De-tained Senator Jose “Jinggoy” Estrada has asked the Sandiganbayan to allow him to visit his deceased family relatives and friends on All Saints’ Day.

In a motion filed before the anti-graft court, Estrada sought a five-hour pass on November 1 for him to visit his grandmoth-er Lola Mary, grandfather Lolo Emilio, father-in-law Reynaldo Vitug, uncles George and Paulino, sister Jessica, as well as his best friend, actor Rudy Fernandez, who died of cancer in 2008.

Estrada said he hoped to visit members of his family buried at the San Juan Cem-etery and his best friend at the Heritage Cemetery in Fort Bonifacio.

“Every year on All Saints’ Day, (Es-trada) has visited the places of interment of his relatives and friends to give respect, pay homage, and pray for them,” the mo-tion read.

Estrada sought a 4 p.m.-9 p.m. sched-

ule for him “to leave his present place of detention, under escort of the Philippine National Police (PNP) Custodial Center personnel, to be able to go to the San Juan City Cemetery and Heritage Park at Fort Bonifacio.”

Estrada, fellow senator Ramon Revilla Jr., and Revilla’s aide Richard Cambe are detained at the PNP Custodial Center for plunder over their alleged involvement in the pork barrel scam.

Senator Juan Ponce Enrile is under hospital arrest.

Accused mastermind Janet Lim-Na-poles is detained at the Camp Bagong Diwa in Taguig with Enrile’s co-accused and resigned chief of staff Jessica Lucila “Gigi” Reyes.

They are accused of participating in the alleged scheme of using lawmakers’ Priority Development Assistance Funds (PDAF) or pork barrel to ghost projects for kickbacks. (MNS)

credit card company and ask them to lower your payments for 90 days, and also give you a lower rate on finance charges. There is a great deal of competition between credit card companies and they want to keep you as a paying customer.

If your problem is more permanent or unsolvable, if your credit is already damaged, you should consider turning to professional help to find out which options are right for you. Often, just discussing your credit problems with a professional can relieve stress and help you come up with a plan that’s just right for your current situation. Without a plan, you are drifting. With a plan, you are back in control.

That’s where we come in – many of our clients do not file bankruptcy, they simply want a plan or strategy that will help them out of their mess, and back on their financial feet. Using an attorney to call your creditors is an excellent strategy, because there are no emotions involved. No collection pressure, simply a professional negotiator working on your behalf. When creditors realize they are talking with a bankruptcy lawyer, they usu-ally bend over backwards to accommodate our requests. Why? Because with bankruptcy lawyers, some money is better than no money, and they know that.

No debtors prisons! If you owe money, but have no job or assets,

you probably do not need the protection that bankruptcy gives you. There are no debtor pris-ons in America, and creditors cannot enforce a judgment, if you literally have nothing. It certainly isn’t necessary to file for bankruptcy just to get annoying collection agencies off your back either. Under the Federal Fair Col-lection Practices Act, you can legally force collection agencies to stop calling or harassing you, by writing to them and demanding that they stop, even if you owe them a bundle and can’t pay a cent.

However, these debts do not go away by itself, and even if you do not have a job now, you may find one later. Remember, old debts can trigger wage garnishments! In a situation like this, you may want to consider the merits of a bankruptcy. People who choose to file bankruptcy, usually do so, because they have something to protect. Money in the bank, a car, house or wages from their job. Even if you do not have current assets to protect, you can immediately begin the process of repair-ing your credit, since the bankruptcy prohibits creditors from continuing to report negative payment history.

Stop collectors’ callsThere is a federal law that protects you no

matter where you live in America. It’s called the Fair Debt Collection Practices Act and it regulates what a debt collector can do. You can stop the Collector from ever contacting you

again by sending a ”Cease all Communica-tions” letter. This law also applies to attorneys who collect debts. Don’t be hassled by a debt collector...use the letter. It works...it’s the law! This is a simple and effective letter:

Dear Collection agency, As per the Federal Fair Collection Practices

Act, I hereby demand that you cease and desist all future communications with me. Do not call or write to me, at home or my place of employment. Failure to stop your harassment will result in a complaint to State and Federal authorities.

Sincerely...When you owe money and have difficulty

in making payments, you have three choices:Declare bankruptcy, Enroll in a credit-

counseling program, or Disappear. Of these, bankruptcy is the only option that gives you a fresh start, and allows you to re-establish credit within a very reasonable period of time. You sometimes hear people say that it takes seven or ten years to regain your credit. Nothing is further from the truth. You can qualify for some credit cards within months of a bankruptcy dis-charge, and get a mortgage within three years. Until recently, some mortgage companies only required a year, but new regulations in the industry have tightened credit requirements.

There are two types of personal bankruptcy: Chapter 7 and Chapter 13. Chapter 7 bankrupt-cies erase all of your unsecured debts. You are not required to pay the erased debts, you can keep all of your “exempt assets” Chapter 13 bankruptcy is a repayment plan, often used to reinstate arrears on a mortgage over a three to five year period, or service outstanding taxes. It also stops IRS garnishments and levies.

So why do you need an attorney? Some paralegal services charge a minimal

fee to prepare and file the necessary paperwork to file a bankruptcy. While in some cases this may not be a major problem, it has been my personal experience that the risk is simply not worth it. Much of what goes into the petition comes from insight of a qualified bankruptcy attorney. Paralegals cannot see all the potential pitfalls and problems that may arise. They also cannot represent you in court. Further, if you list things incorrectly in your petition, or omit necessary items, it is your problem, not the paralegal’s. You sign all your bankruptcy papers under penalty of perjury. I know of sev-eral cases, where the debtor has had to appear in front of a judge, facing the complete denial of their discharge, pleading with the judge to help them because they didn’t have an attorney representing them. Ultimately, the debtor may have to spend several thousand dollars to rem-edy a situation that could have been prevented, or at least planned for, at the outset.

Call me today at 818-552-4500, and sleep better tonight.

In debt?If you’re in over your head and are struggling to keep up to date

on your credit cards, store cards, car payments and or mortgage, don’t lose hope. There are several strategies you can use, to make things more manageable, while still protecting your credit score. However, ignoring the situation will certainly make it worse.

If the problem is temporary, perhaps due to illness, but your credit rating is still good, call your

ZAMBOANGA, October 17, 2014 (AFP) – Two Germans held hostage by Islamic militants on remote southern Phil-ippine islands for six months were released on Friday, the Philippine military said.

The hostages, a man in his 70s and his female partner, in her 50s, were released on Jolo island, armed forces chief General Gregorio Catapang told AFP.

A spokesman for the kidnappers, a no-torious band of militants with links to Al-Qaeda but who recently pledged allegiance to the Islamic State group, also announced on radio that they had been set free.

The Abu Sayyaf had given the German government until Friday to pay a $5.6-mil-lion ransom and withdraw its support for US offensives against jihadists in Syria and Iraq.

The group also threatened to behead one of the hostages unless the demands

were met.The group’s spokesman, Abu Rami, said

on radio the militants had collected “no more, no less” than their ransom demand.

Catapang said he had no information on the supposed ransom payment, while high-lighting that the military did not directly conduct negotiations over money.

“We do not negotiate with terrorists,” he said on DZMM radio.

Catapang said the couple were undergo-ing medical check-ups at a military clinic on Jolo island and would be transferred by boat to the southern port of Zamboanga, where they would catch a flight to the capital, Manila.

Snatched at sea -Philippine authorities said the two hos-

tages were snatched at sea in April as they sailed near the western Philippine island of Palawan.

MANILA, Oct 16 (Mabuhay) – Jose ‘Peping’ Cojuangco has officially stepped down as chairman and president of Central Azucarera de Tarlac, after 38 years at the helm.

He stepped down after the Cojuangco, Aquino, Lopa, Reyes and Teopaco fami-lies sold their shares in the company for a total of P1.8 billion in a deal announced in July. Cojuangco is the uncle of President Aquino.

He stepped down on Wednesday, and the change in leadership was disclosed by the firm this morning.

The buyers are Fernando C. Cojuangco, a first cousin of President Aquino, and businessman Martin P. Lorenzo, who recently sold his Pancake House business to the Max’s Group of restaurants for P3.9

billion. Peping Cojuangco’s dual role as chairman and president will be split.

Lorenzo takes over as chairman and chief executive while Fernando Cojuangco stays on as chief operating officer and takes over as president. Central Azucarera produces raw and refined sugar, molasses and alcohol. The sugar cane is sourced from Tarlac and Pampanga.

The controversial Hacienda Luisita, a sugar plantation, is also controlled by the Cojuangco family, but it is a separate entity from the Azucarera.

Central Azucarera also clarified this year that it does not buy any of its sugar cane from Hacienda Luisita, which became controversial owing to a Supreme Court case that forced the owners to subject it to in a “reduced” land reform value.(MNS)

German hostages freed; ransom paid

Peping Cojuangco resigns from Central Azucarera

Last week in another telephone inter-view by Abu Rami on a local station, the Abu Sayyaf spokesman had the couple speak into the phone to beg for their lives and recount their hardships while being held at gunpoint in remote island jungles of Mindanao.

Labelled a “terrorist” group by the United States and Philippine governments, the Abu Sayyaf is a loose band of a few hundred militants founded in the 1990s by Abdurajak Janjalani, an Islamic preacher and veteran of the Afghanistan war.

It was set up with seed money from Al-Qaeda leader Osama bin Laden’s brother-in-law.

It has kidnapped dozens of foreign aid workers, missionaries and tourists in the south.

By ransoming off its hostages for mil-lions of dollars the group was able to raise funds to buy more arms, and it cemented its brutal reputation by beheading some of its captives – including an American tourist seized in 2002.

The Abu Sayyaf claims it is fighting to establish an independent Islamic home-land in the Muslim populated south of the mainly Catholic Philippines.

In July, a video appeared on Youtube in which one of the Abu Sayyaf’s leaders, Isnilon Hapilon, pledged allegiance to the Islamic State extremists who have taken control of large parts of Iraq and Syria.

But Philippine authorities say the Abu Sayyaf is mainly a criminal gang interested in kidnappings-for-ransom and other lucra-tive illegal activities.

all Americans, FILAMs included. And, so, you’ll think that everyone is well versed on how the two works like they know the latest craze in cellphones and HDTVs?

Survey after survey show that most have scant knowledge or understanding of the two.

“What you don’t know won’t harm you” may NOT be true in this case.

Just consider: If you have Medicare A & B, and are not enrolled in a Medicare Supplement or Medicare Advantage Plan, you are exposed to a share of cost that may wipe out your savings if you meet a catastrophic illness. Or, you take a vacation outside the U.S., the Philippines perhaps, and you are not protected from possible medical expenses because you are not aware of MEDICARE health plans that provide “medical emergency” protection at no cost to you.

Just consider: If you are earning less than $16,000 per annum (as a single filer) or $22,000 (married) and you don’t have a health insurance because you cannot afford one (those incomes will allow you FREE coverage thru MediCal). Or, if you don’t get annual medical checkup despite being insured because you don’t know that preventive procedures come free under Obamacare.

You’re certainly missing a lot. And, yes, what you don’t know will certainly cost you.

At this point, I’d like to commend those who called and inquired. They were smart enough to find out what benefits they have and the peace of mind that understanding brings. This is a very good start. Changes in Medicare and Obamacare happen fre-quently, making the public confused and disoriented. But, this is not a good excuse

for not learning how the two works at all. Let’s continue to keep engaged, proving every doubt and explaining every misun-derstanding. It is in this manner that WE learn the benefits which the two pieces of legislation provide. The American could face life in prison if convicted in a Filipino court.

He remains in US custody on an Ameri-can warship anchored off Olongapo.

The Marine and the vessel had taken part in joint military exercises involving thousands of Filipino and US forces that ended last week.

Police blocked about 70 protesters marching on the US embassy in Manila on Thursday.

The protesters carried placards demand-ing that the mission “Surrender Pember-ton” and for Manila to cut US military ties.

Foreign department spokesman Charles Jose on Thursday rejected the criticisms.

“We will formally request custody once an arrest warrant is issued by the court,” Jose told reporters.

However, prosecutors have yet to decide whether to bring charges in court after the initial evidence hearings that could take

weeks.Jose said the government is sticking

to provisions of a 1998 treaty govern-ing the legal liability of US troops in the Philippines, a mutual defense partner of Washington.

Under the accord, the US government retains custody of American troops accused of a crime in the Philippines although the Philippines can ask Washington to waive custody.

Asked if the United States would turn over the suspect, the US embassy issued a statement saying: “Any offences covered by US service members would be handled in accordance with the applicable provi-sions” of the 1998 visiting forces treaty.

In 2006, a Philippine court sentenced US Marine Lance Corporal Daniel Smith to 40 years in jail for raping a Filipina near Olongapo a year earlier.

Smith walked free in 2009 after his ac-cuser recanted her statement, prompting the court to acquit him.

Deposits made In a testimony last week, lawyer and

Anti-Money Laundering Council (AMLC) investigator Leigh Vhon Santos revealed that Revilla closed some 20 bank accounts containing millions of pesos in June to September 2013 –the period when media was hot on the scandal.

Santos also revealed that sometime in 2007 to 2009, several deposits amounting P27 million were also made to the bank account of Nature Concepts Develop-ment and Realty Corporation, a company controlled by Revilla’s wife, Cavite Rep. Lanie Mercado.

Santos said the deposits were maid around the time that Atty. Richard Cambe allegedly received kickbacks on behalf of Revilla for the funneling, supposedly, of

the latter’s pork barrel fund to the bogus non-government organizations of Janet Lim-Napoles, the alleged brains of the scam.

Cambe was Revilla’s senior chief of staff.

Santos revealed that the AMLC came to the conclusion that Nature Concepts had no real operations since records from the Securities and Exchanges Commission showed no corporate as well as financial activities.

Mercado denied the allegation, main-taining that Nature Concepts is legitimate company.

“Hindi totoo ‘yung paratang na dummy corporation ‘yun. Maipapaliwanag namin ‘yan sa korte,” Mercado said.

“Everything is legal. Wala kaming tina-tago. Lahat ‘yan lalabas sa korte,” Revilla said. (MNS)

The country also recently gained its first investment grade scores from the big three global credit rating agencies.

Urban decay -Infrastructure development, however,

hasn’t moved at the same pace, and econo-mists warn the creaking systems that are of so much frustration to millions of people will also have a growing impact on eco-nomic growth.

“Our facilities are not built for an economy that is growing at seven percent every year,” Ronald Mendoza, a senior economist at the Asian Institute of Manage-ment, in Manila told AFP.

Mendoza said growth could have been faster had it not been for the ageing airports and road networks that turn off foreign investors and tourists, and limit the move-ment of local trade.

Manila already loses 2.4 billion pesos ($53 million) in potential income daily due to traffic jams, according to a study by the Japan International Cooperation Agency.

Among the other infrastructure prob-lems are power shortages that lead to brownouts, clogged drainage that exacer-bate frequent rainy season floods and an Internet network so slow that it sparked a parliamentary enquiry.

Millions of people in slums, and even some residents of middle class districts, do not have access to running water.

And Manila’s decades-old international airport, with malfunctioning air condition-ing and leaking toilets, has been cited by a travel website as the worst in the world.

No quick fix -President Benigno Aquino and his team

are acutely aware of the problems.

abandoned his LPR status.Under the immigration laws, an LPR

is generally not suppose to be outside of the US for more than 1 year. As well, even if an LPR returns to the US before 1 year, there is still a risk of being found to abandon permanent residency if the times in the US are for very short periods.

It is a common misconception that an LPR automatically loses their green card if they are outside the US for too long. Rather, in order for an individual’s green card to be cancelled or revoked, the DHS must take formal procedures to prove that an individual has abandoned his permanent residency.

Even if an LPR has been outside the US for more than 1 year, the DHS must allow an LPR to enter the US. If the DHS wishes

to seek cancellation of an individual’s green card, the DHS must then initiate removal proceedings against the individual since only an immigration judge can deter-mine whether an LPR has abandoned his permanent residency.

In determining whether an individual has abandoned his permanent residency, the judge will consider any and all factors regarding why the individual was outside the US for so long. The judge will consider whether the individual maintained “a con-tinuous, uninterrupted intention to return to the United States during the entirety of his visit.” Singh v. Reno, 113 F.3d 1512 (9th Cir. 1997). When assessing a matter, so long as an individual has a colorable claim as a returning resident, the burden is on the US government to prove that an

is the opportunity to become a lawful permanent resident (LPR) (“green card holder”) of the United States. As an LPR, the scope of opportunities is expansive and the path to US citizen-ship is paved. Because LPR status is so incredibly important, it is extremely problematic when situations arise that may lead to an assertion by the Depart-ment of Homeland Security (DHS) that an individual has

individual has abandoned his permanent residency with “clear, unequivocal, and convincing evidence.” Id.

Individuals must therefore be fully prepared to explain the reason(s) for their extended absence from the US. This is especially important when entering the US as statements made at the port of entry will be used in court proceedings. The explanation must effectively communicate the individual’s desire to return to the US despite the long absence. For example, if an LPR remained overseas for several years to complete his education, evidence of the studies together with any other facts that show his intention to return to the US upon completion of those studies should be presented. Another example is an individ-ual who could not return to the US due to health-related issues that prevented travel and/or required medical treatment abroad.

Even when an absence from the US is as long as 5 years, the courts have decided that an individual had not abandoned his permanent residency. Khoshfahm v. Holder, No. 10-71066 (9th Cir. 2011). The case involved an Iranian national who had entered the US in 2001 as an LPR with his parents when he was 13 years old. After only about 7 months, Mr. Khoshfam and his parents returned to Iran in order to sell off their property. However, the Septem-ber 2001 terrorist attacks prevented them

from returning. Then, in November 2001, Mr. Khoshfahm’s grandfather had a heart attack, so he and his parents had to stay in Iran in order to care for him. When Mr. Khoshfahm turned 18, he returned to the US and presented his green card, stating that he “always wanted” to return to the US. Although he had been in the US for only 7 months and outside the US for about 5 years, the judge ultimately allowed Mr. Khoshfahm to keep his green card.

Acquiring LPR status in the US is often a very difficult, lengthy and expensive process. As such, the threat of losing LPR status is a matter that must aggressively be guarded against. Situations arise that prevent an individual from returning to the US, despite having the intention and the desire to do so. It is therefore important that any individuals faced with the allega-tion of abandoning permanent residency vigorously defend themselves in order to maintain their opportunities of achieving their dreams in the United States.

MANILA, Oct 15 (Mabuhay) – Cash sent home by overseas Filipino workers (OFWs) climbed by a sixth in August.

In a report, the Bangko Sentral ng Pili-pinas (BSP) said cash remittances grew by 6 percent to $2.1 billion last August from $1.9 billion in the same month last year.

This brought the eight-month tally to $15.5 billion this year from $14.7 billion in 2013.

Including in-kind transfers, OFWs sent home $2.2 billion last August, slightly more than the $2.1 billion in the same month last year.

For the first eight months of this year, personal remittances climbed 6.5 percent to $17.2 billion from $16.1 billion in 2013.

The BSP ascribed the growth in remit-tances to transfers by both land- and sea-based OFWs, as the Philippines continued to enjoy strong demand abroad for its skilled labor.

Citing data from the Philippine Over-seas Employment Administration (POEA), the BSP said jobs orders reached 619,388 in the first eight months of this year, with more than a third of those meant for production, service and technical work in Saudi Arabia, United Arab Emirates, Taiwan, Qatar and Kuwait.

Remittances help fuel domestic con-sumer spending, which accounts for two-thirds of the Philippine economy. (MNS)

LOS ANGELES – (Oct. 16, 2013) – Gearing up for the first game of their regular season on Tuesday, Oct. 28, the Los Angeles Lakers made a preseason practice stop at the Pechanga Recreation Center on the Pechanga Indian Reserva-tion in Temecula, Calif. On Thursday, October 16 from 11 a.m. to 12:30, players and coaches participated in a shoot around at the Tribe’s recreation center with tribal youth and members following the action as spectators.

The Los Angeles Lakers have been traveling to many points across Southern California for exhibition games during the three-week preseason, and the shoot around in Temecula was a chance for the team to show gratitude for inland Southern California fans’ loyalty. The Lakers’ prac-tice in Temecula was not open to the public, though members of the media were invited to interview coaches and players following the shoot around.

“We deeply appreciate our partnership with the Lakers and their commitment to the broader Southern California commu-nity,” said Tribal Chairman Mark Macarro. “Our youth were ecstatic. Today, they witnessed a focused, structured practice with high intensity, and what it takes to be a champion.”

“It’s great to see the support we have

all over Southern California, not just in Los Angeles,” said Lakers Head Coach, Byron Scott. “The guys [players] love it and motivates them to even better.”

Pechanga has been a longtime donor to the Lakers Youth Foundation and sponsor of the Los Angeles Lakers. The team held a similar practice at Pechanga in 2010 at the newly-built recreation center. The team was impressed with Pechanga’s hospital-ity and returned in 2013 and 2014, and to raise money for charity. Many of the players and coaches took part in a casino night fundraiser at the Pechanga Resort & Casinoon Wednesday night benefiting the Lakers Youth Foundation.

Rancho Palos Verdes, CA – The book, America Is in the Heart: A Personal His-tory by Carlos Bulosan will be the center of the Filipino American History Month celebration on Saturday, October 25, 2014.

The event is sponsored by Philippine Expressions Bookshop and is free and open to the public. It will be held at Search to In-volve Filipino Americans (SIPA) from 2-5 p.m. SIPA is located at 3200 West Temple St., Historic Filipinotown in Los Angeles.

RSVP is requested via facebook of Friends of Philippine Expressions Book-shop or via email: linda@philippineex-pressionsbookshop or by phone: 310-514-9139. The 2014 republication of America Is in the Heart comes with a new Introduction by Marilyn C. Alquizola and Lane Ryo Hirabayashi.

At 2 p.m., Remembering our Manongs, a 56-minute documentary on Sonoma County’s Filipino history will be shown to open the program. The film was produced by the Filipino American Historical So-ciety (FANHS), Sonoma County Chapter and the California Council for Humanities

The film explores the history of the earliest Filipino immigrants in Sonoma County. Their story is one of tenacity and endurance coupled with an extraordinary sense of community. Mostly single young men, they began arriving in California

during the 1920’s. At 3:15pm, Marilyn C. Alquizola and

Lane Ryo Hirabayashi will share fresh insights on Bulosan’s classic memoir. First published in 1946, America is in the Heart has been described as the premier text on the Filipino American Experience.

The book describes Bulosan’s boyhood in the Philippines, his voyage to America, and his years of hardship and despair as an itinerant laborer following the harvest trail in the rural West. Carlos Bulosan (1913-1956) was an English-language Filipino novelist and poet.

He immigrated to the United States at age 17 and worked as a farmworker, dish-washer, and ultimately, as a labor organizer in both Washington and California. An au-tobiographical masterpiece, his book gives an unflinching account of the oppressive poverty that drove young men like Bulosan from their homeland and the brutality of life in America during the 1920s and 1930s.

In the new 2014 edition, Alquizola and Hirabayashi eloquently situate this clas-sic work within a contemporary context while also highlighting the book’s legacy in Filipino American literature as well as in labor and immigration history. Alquizola, formerly professor of Asian American Studies at the University of Colorado, Boulder, is an expert on Carlos Bulosan.

November Midterm Election Crucial for Immigration

Impatience has marked the relationship between Pres. Barack Obama and the im-migrant communities for him not keeping his promise to address the urgency of as-certaining their immigration future with his presidential action and was deferred until after the election. Immigration reform has always been a hot-botton issue with this year’s development and driven immigra-tion advocates to become ambivalent in their support of the present leadership.

Political pundits has it that Pres.Obama and his political party are headed into a midterm elections trouble with his job approval rating at 40 percent in one of the polls. The number is the lowest in his career and the Democratic Party where he belongs is at its weakest popularity in 30 years. For the first time, the political party that has been a staunch supporter of immi-gration reform, has more than half of those polled looking at it unfavorably.

One consolation, however, is the Re-public Party is even more unpopular but perceived to benefit from their supporters’ greater likelihood of voting and holds a 50-43 lead among likely voters for U.S. House seats in the Nov. 4 elections.

There are other issues contributing to the perceived growing unpopularity of Pres. Obama and do not augur well for issues affecting the Filipino community especially on matters of immigration.

A recent poll on the voting habits of Asian-Americans on elections showed fig-ures that do not favor immigrants because Asian-Americans, Filipino-Americans included, “do not care less because they are too busy” to go to the polls on elections. This voting attitude does not bode well to shift or maintain the balance of power in both houses. Reforms do not come by themselves. They require collective and deliberate actions like in an election. A matter of numbers game.

MANILA, Oct 17 (Mabuhay) – Speaker Feliciano Belmonte Jr. on Friday said calls for a review of the Visiting Forces Agree-ment between the Philippines and US are best addressed by the Senate, which ratified the defense pact.

“Foreign agreements are subject to review and ratification by Senate. Better that they (Senate) undertake (the review), instead of us, to avoid confusion. Suppose our conclusions are different?” he said when asked how the House of Represen-tatives plans to handle calls to review the VFA, which have again been raised fol-lowing the murder of transgender Filipino Jennifer Laude, whose legal name is Jef-frey, allegedly by US Marine Private First Class Joseph Scott Pemberton.

Laude’s family has failed a criminal complaint against Pemberton and de-manded that he be placed in the custody of Philippine authorities.

However, government officials have said that, while the VFA gives the Philip-pines criminal jurisdiction over the case, the US retains the right to custody over the serviceman.

On Wednesday, lawmakers from the Makabayn bloc in the House of Represen-tatives filed Joint Resolution No. 17 calling

for the abrogation of the VFA and urging President Benigno Aquino III to notify the US of the pact’s termination.

“It is a big slap on the face of the Fili-pino nation and downright revolting that the government failed to arrest and take custody of the suspected assailant Pem-berton and the US authority and custody prevailed over the American suspect of killing a Filipino on Philippine soil,” the resolution said.

“This incident proves once again the one-sided, pro-US and anti-Filipino char-acter of the VFA and highlighted the pa-tently onerous provisions of the VFA on the custody of the erring US troops, prescrip-tion of criminal prosecution and waiver of jurisdiction that essentially grants im-munity from prosecution of US military personnel who commit crimes against Filipinos effectively denying justice for the victims and all Filipinos,” it added.

“The VFA is unmistakably an affront to the State’s sovereign power to enforce its laws within its territory and makes a mockery of our justice system,” the reso-lution said.

The members of the Makabayan bloc include Representatives Neri Colmenares and Carlos Zarate of Bayan Muna.

I remember client the first time I met her 15 years ago. At that time, she was only 30 years old and had just started working as a registered nurse after obtaining her graduate degree in nursing. I won’t tell you how old I was at that time but I certainly wish

Single mom seeks 2nd bankruptcy relief after 15 years

I were also 30. It’s enough that my beautiful wife, in all sense of the word, still looks 38 now. Client then had a 3-year-old son and a 4-year-old daughter. She had just di-vorced her husband and was seeking a new start in life with her two young children. Let’s just say that husband was not doing his share in providing for the family, and was prone to the good life where he doesn’t have to work. A little indiscretion here and there that client eventually found out about was the last straw that broke the marriage. Fortunately for client, she had a graduate degree in nursing, young, and at that time there was a big unmet demand for nurses. It was easy for her to get two or three jobs and provide for herself and her two kids without much difficulty except for a lot of hard work.

When you think about what a single mom has to do the raise a family all by herself, to discipline the kids and make sure they grow up with the right values and bring in the bacon every single day, that takes a lot of fortitude and determination on the single mom’s part. Most of the time, in situations like these, the ex-husband and father just disappears and does not contribute anything to the broken family.

Recently she sees me again and wants to file another Chapter 7. Her son is now 18 years old and starting college. Her daughter is 20 years old and also studying to be a nurse. With two children in college, her monthly budget is negative again. She has college expenses to provide for which could easily reach $1,000 a month for the next 4 years. She also has to send some

money abroad to her mother and sister since their family home was destroyed by the mega typhoon Haiyan last year. That’s another $500 a month to help rebuild the family home. She showed me pictures of the damage caused by the typhoon. The roof was completely blown away and the insides of the house were a mess. Contrac-tors have submitted quotes to tear down the house and rebuild a new one for $30,000. Believe it or not, client is negotiating with the contractors for installment payments on the construction but at $500 a month, con-tractors have to agree to a 5-year payment plan. It’s really not that bad considering that the entire locality has been destroyed by the typhoon and people living there have been reduced to living life as refugees.

With the local government aid in providing for financial aid to rebuild, a feasible repayment plan is established and construction on the family home has started. But since the $500 from client is an essential part of the payment plan, there is a lot of pressure on her to cover both the college expenses of her children and the rebuilding of the family home. For both endeavors, she must set aside $1,500 a month, otherwise, her children cannot get their college education in a timely manner, and her mother and sister will continue to live like refugees. Both weigh heavily on client who is a good mother and a good daughter as well.

Her income has also decreased by

$30,000 a year. Her first job gives her a gross of close to $6,000 a month. After deducting taxes and 401K contributions of $900 a month, her take home pay is about $3,700. Although her rent is quite reason-able at $1,300, a net of $3,700 simply won’t suffice. So, she has to sacrifice her own retirement contribution for the next 5 years. She won’t contribute anything to her 401K for the next 5 years, thus saving $900 a month to pay for college expenses and rebuilding of the family home. She has a car payment for the next two years for a Honda Civic of $375. She can’t sacrifice this expense because she needs a car to get around. Even if she returned this new car to get an older car, the older car will start breaking down and repair costs will mount. That’s an even worse drain on finances. She will discharge $40,000 of credit card debt, thus saving $1,200 a month of minimum payments immediately for a 2

fresh start in life at the age of 45. She’s on the right track, after 5 years, her children will have their own income, her mother and sister will have the family home, and she can start building up her 401K again at the age of 50.

“May the God of hope fill you with all joy and peace as you trust in him, so that you may overflow with hope by the power of the Holy Spirit.” Romans 15:13.

tions for his upcoming marriage to Princess Therese of Sachsen-Hildurghausen. The grand wedding was to take place on the 12th, right in the middle of the farmers’ harvestime. The wedding was to be held in a spectacular place alled ‘Wiese’ or meadow, which was just outside the gates of Munich. As the big event approached, the whole town of Bavaria though ex-hausted from their harvest work, planned on attending the grand wedding as this was their last chance of celebrating before the cold, winter days ahead. Thus, when the wedding took place, there were around 40,000 guests in attendance. It became the largest party in history which impressed the Prince, so he decided to treat his subjects with an impromptu horseracing in the great meadow,” which eventually was renamed “Theresewiese” or Therese’s meadow, in honor of Prince Ludwig’s bride. And to this day, the townspeople of Bavaria still celebrate this tradition. when Bavarians consume large quantities of Octoberfest Beer with “almost 7 million litres served.”

Visitors to the festival experience not only a variety of entertainment but also various amusement rides, games and delicious traditional food. includ-ing: Sauerkraut or Rotkol Blaukraut (red cabbage), Hendl (roast chicken), Sweinerbraten (roast pork), Sweinshaxe (grilled ham hock), Steckelrfiche ( grilled fish on a stick), Wurstl ( sausages) along with Brezen (pretzel), Knodel ( potato or bread dumplings), Kisseputzle ( cheese noodles), Reibersatschi (potato pan-cakes) and various other delicacies such as: Weisswurst (white sausage) or Obatzda (a spiced cheese butter spread).

In the Los Angeles area of South Bay, the Alpine Village in Torrance celebrate Octoberfest thorughout the month. How-ever, other Southern Californians have similar festivities by driving through the winding roads of the scenic Big Bear Lake area. This writer has experienced Octo-berfest celebrations in both venues and

they similarly offer the same beer flowing merriment along with additional hangovers later on.

A couple of weeks ago, this writer also attended the 56th Annual Greek Fest which was held at the Santa Anita Fair-grounds with some friends. Each year, we learn that the Greek community in San Gabriel Valley showcase their culture to benefit St. Anthony’s Greek Orthodox Church and we were priveleged to meet its Pasttor, the Reverend Fr. Peter Stratos.

Greek culture as we all know from history, has made “a lasting impact in ancient times,” from the alphabet to our spoken word,, to politics, philiosophy, to religion, to mathematics, to medicine and sports, as we have all learned about Plato, Socrates, Alexander the Great, Pythagoras and the Spartans.

During the festival, my friiends, Joanne, Frances, Pam and her husband Jerry and this writer, savored on various delectable Greek food such as: Gyros, Feta Fries, Souvlaki Kalamaki & Pita, Loukaniko, Keftedes, Dolmathes and Saganaki, along with delicacies such as Baklava, Galakto-bouriko, Koulourakia, Melomakarona and Kourambiethes, Music and entertainment was provided by a band called the Olym-pians, Bouzouki (Greek guitar) players were: Louis Skoby and Vasilis Spanos and vocalsts: Takis “Kokotas” Stahoulis and Aphrodite Wasserou. It was a lovely day of merrymaking which included the various Greek children’s folk dance groups whose mission is to “cultivate their cultural heri-tage through dance .”

Apparently, St. Anthony’s dance pro-grams began in 1984 and is “still going strong due to the dedication of parents, dancers and the many volunteers who help with handmade costumes whose fabrics and materials are all purchased in Greece.”

Cultural heritage festivals such as these, are always enlightening to go to and be a part of, in order to enable us to live har-moniously in a diverse community.

Southland Germans/Greek celebrate Octoberfest/Greekfest

It has long been known that Octoberfest is one of the world’s largest (if not the largest) funfairs held annually in Bavaria, the southern part of Germany. It is a 16-day festival which usually runs from late September to the first weekend in October, with around 6 million people world-wide participating in the event It has been a significant part of Bavarian culture, “having held it since 1810. Press, Inc., he signed an agree-ment stating that he would work 11 hours a day, six days a week, for a total of 66 hours per week. As a nonexempt employee, his work schedule entitled him to 26 hours of overtime pay each week. By

ployer alleging that his employment agree-ment violated the law. Arechiga argued that as a nonexempt employee, his overtime pay was to be calculated by dividing his regular hourly rate by 40. He said his salary of $880 per week only compensated him for a 40-hour work week, not his agreed-upon workweek of 66 hours (which included 26 hours of overtime). Therefore, Dolores Press owed him overtime pay.

The employer countered that the law authorized employers to enter into ex-plicit mutual wage agreements with their employees. The trial court ruled in favor of Dolores Press, finding that the wage agreement was valid and the fixed salary Arechiga received adequately compensated him for both overtime and regular pay. Arechiga appealed.

Unfortunately for Arechiga, the Califor-nia Court of Appeals upheld the trial court’s decision, finding that Dolores Press had an explicit mutual wage agreement with Arechiga. The law regarding overtime pay for nonexempt employees does not abolish this agreement.

California lawmakers expressed con-cern that the court’s ruling may allow employers to estimate overtime and include it in a fixed salary. This practice will open the door to workers being required to work additional overtime without being fairly compensated.

In response to the court decision, Cali-fornia passed a law providing that a fixed salary paid to a nonexempt employee will be considered compensation only for regu-lar, non-overtime hours, even though there may be a private agreement to the contrary.

Therefore, wage agreements that pur-port to pay a fixed salary to non-exempt employees to cover their overtime hours worked is illegal.

Wages are a product of negotiations and agreement between employers and employees. However, just because these

“agreements” are signed do not make them legal. With the help of an experienced employment attorney, employees should examine whether the amounts contained in their signed agreements correctly pay them for all their hours worked.

(AFP) - Nurses at the Texas hospital where a Liberian Ebola patient died last week complain they were given few rules and little guidance on how to treat the severely ill man, contrary to assertions by US health authorities. The head of the US Centers for Disease Control and Prevention (CDC), Thomas Frieden, said earlier this week that a “breach in protocol” by health workers led to a nurse becoming infected with the potentially fatal virus.

But a national union speaking late Tues-day on behalf of the Texas nurses rejected the assertion that protocols were breached.

They told reporters at a telephone news conference that clear treatment guidelines for Ebola were all but non-existent at the Texas hospital.

“The CDC is saying that protocols were breached, but the nurses are saying there were no protocols,” said Roseann DeMoro, head of the group National Nurses United, in a phone conference from California.

The nurses’ union shared the revelations from workers at Presbyterian Hospital Dal-las without disclosing their names, because many were afraid that their candor could

cost them their jobs. The first time that the patient came to

the hospital he was sent back home, despite having told nurses that he had been in Ebola-stricken Liberia – information that authorities now say should have been a clear tip-off that he could be infected with the illness.

Duncan exposed ‘for hours’ -When the patient, Thomas Eric Duncan,

returned a few days later, feverish and vis-ibly ill, he was made to sit for hours in an emergency room waiting area, exposed to other patients.

The nurses said that after he was admit-ted, there were no guidelines on how to discard the Liberian patient’s soiled towels and linens.

During much of his hospital stay Dun-can was overcome with bouts of vomiting and diarrhea, and the nurses said they had received no clear-cut guidelines about how the toxic mess would be cleaned off the floor, or who would do it.

After Duncan’s death, authorities confirmed that Nina Pham, a nurse at the hospital who took care of him after he was admitted to the hospital, has been infected with Ebola.

told me: “I figured if I didn’t pay, that’s their loss because they refused to work with me.” Huh? Of course, now he’s in my office because his wages got garnished by a creditor just the day before so he can’t pay his mortgage this month.

Because money is a personal issue, I find that most people find it uncomfortable to tell others about their problems for fear of being judged. What would their friends and family think if they find out that they are having debt problems? Of course, some friends and family members are too quick to give their insensitive comments or opinions about other people’s problems…as if they have never had debt problems themselves at one time or another!

Debt problems can be suffocating. I see people all the time who have been trying to pay off their credit cards for years only to realize one day that truth be told, they will never get out of debt in their lifetime. The interest rates are outrageous and most people are living paycheck to paycheck so they can only afford to make the minimum payments, if that. So they think that as long as they are making the minimums, they are “OK”. But unless they see the reality of being indebted for as long as they live, they will not do anything about it.

And then there are those people who have just ignored their debt problems for so long that they think that somehow those debts have just magically disappeared. In California, the credit card companies have 4 years to sue from the time you stopped paying or otherwise they may be barred by law from suing. But what if they have got-ten a judgment against you? Judgments are good for 10 years and they are also renew-

able every 10 years. So a creditor who has obtained a judgment against you several years ago may not have contacted you recently but it doesn’t necessarily mean that you no longer owe. You may want to check your credit report to see what debts are still being reported and this may give you an idea of where you stand on the debts that you’ve ignored for so long.

Are your debts depriving you of good credit or a good financial future for your-self and your family? This realization should be a good enough reason for you to seek help and find out what your options are. Maybe you’ve tried very hard on your own to do the right thing and pay your debts but they have gotten to that point where they are no longer manageable. Bankruptcy may or may not be an option. Perhaps you can also call creditors and settle your debts once and for all so you can start building your credit and your finances again. Procrastination could be your worst enemy. But remember that nothing happens unless something moves! Take the first step. It’s all up to you.

Why do you need to get out of debt?People come to me every day with different reasons for

getting out of debt. Most of the time, I’m thinking that they would have been better off had they come to me sooner to get help. Had they done this, they’d be doing a lot better by now and could have avoided a lot of financial pain. But ev-eryone has their reasons- and their own story of why waited too long. Often the reasons are lame and don’t even make sense. For example, one client

10 misconceptions on personal injury claimsA motor vehicle accident is one of the

leading causes of personal injury in Cali-fornia. Yet, many individuals are unwilling to file an insurance claim because of com-mon misconceptions and challenges con-cerning personal injury claims procedure. As a result, they are not able to obtain the medical care and compensation that they rightfully deserve. Here are common 10 misconceptions when it comes to personal injury claims in California:

I am not a legal resident in this coun-try and putting a claim may cause me immigration issues. WRONG! Opening a claim with an insurance company has absolutely no relation to your immigration status. None whatsoever. Insurance com-panies do not share information with the Immigration and Naturalization Service.

Insurance company says they will fairly and fully compensate me. WRONG AGAIN! Insurance companies try to mini-mize the damages of an accident so they do not have to compensate you as much. Insurance companies are not charitable institutions and more often than not, you have to fight with them in order to be fully and promptly compensated.

I do not need an attorney to process my claim. Filing an insurance claim is just the first step. After that you have to fight to prove up your claim. The process is com-plex, frustrating, and confusing. You may not know the legal intricacies involved, and you are dealing with an insurance adjuster who is trained in the law, and is working to minimize or defeat your claim. Receiving compensation is never guaranteed, espe-cially if you do it on your own. Do yourself a favor. Hire an attorney that you like and trust. Don’t do it on your own.

My insurance rates will automati-cally go up because I made an insurance claim.

If you get into an accident through no fault of your own, your insurer may not

raise your rates. If, on the other hand, you were to blame for an accident, your insurer first considers many factors before decid-ing whether or not to adjust your rates. This includes your driving history. Nobody wants to be in an accident and if your cur-rent insurer automatically increases your rates, you can always shop for a better insurance company.

I will not get compensated because other driver did not have insurance or it was a hit & run accident. Sadly, it is a known fact that not all drivers or vehicle owners carry car insurance. If the at-fault driver or vehicle owner did not have insur-ance, you can still obtain compensation for your injuries if you carry Uninsured Motorist (UM) coverage in your policy. This protects you from uninsured drivers, uninsured vehicle owners, and hit & run drivers. However, not all policies have UM coverage and you need to look at your policy.

I was partially at fault for the accident so I am not entitled to compensation.

California is a comparative negligence state. This means that if you are partially at fault for the accident, you can still obtain compensation for your injuries. Compara-tive negligence, however, reduces your re-covery proportionately to your degree or percentage of fault. The more at fault you are, the less you can recover. It stands to reason that the other driver and his insur-ance company will try their best to put the most blame on you. A qualified attorney will know how to effectively argue for you.

No police report was made so it’s useless to make a claim. While a police report is helpful, it is not entirely necessary. It is good to have one because the names of the parties, their insurance information, names of witnesses, investigation of the accident and designation of fault are all in one document. Even if there is no police report, as long as you are able to get basic

marriage. With a dissolution action, there is

no issue as to whether a valid marriage exists. The objective in a dissolution action is to terminate the marital status. Conversely, with an action for nullity, the issue is whether or not the marital status ever existed (i.e. whether there was a valid marriage at all). With regard to dissolution, community property is di-vided equally. With an invalid marriage,

although no community property rights exist per se, property acquired during the void or voidable marriage, which would have been community property if not for the impediment to a valid marriage, may be considered “quasi-community” prop-erty and divided under the same rules as community property. One has a interest in “quasi-community” property only if there existed a good faith belief that the marriage was valid. (Family Code Sec. 2251).

Alternatively, through legal separation, marital rights and financial responsibilities can be adjudicated without dissolving the marriage. A judgment of legal separation does not terminate marital status. Legal separation may be a viable alternative for persons who, for some reason or another, would like to continue marital status, but would like adjudication of financial issues with his or her spouse. Typical reasons for choosing legal separation over dissolution include to retain eligibility for insurance benefits and to be in accordance with one’s religious beliefs. Like dissolution, an action for legal separation conclusively determines each spouse’s property rights and financial responsibilities to each other, including determination of support and di-vision of the community estate. Once the judgment for legal separation is entered, the parties acquire no more community property and no obligations are imposed on either spouse except for those obliga-tions as set forth in the judgment. Unlike dissolution, the marriage bond remains intact and neither spouse can remarry until the existing marriage is dissolved either by death or judgment. Residency requirements vary for dissolution, nullity, and legal separation. The foregoing is merely an overview of the various options for terminating or altering marital status, and accordingly, it is advised that you

consult with an experienced attorney to further explore which of the above options is best to pursue.

OPINIONMANILA, Oct 15 (Mabuhay) – The government

should terminate the Visiting Forces Agreement should the United States refuse to hand over US Marine Private First Class Joseph Scott Pemberton, the suspect in the killing of transgender Filipino Jeffrey “Jennifer” Laude, to local authorities, a nationalist group and a lawmaker said Wednesday.

“Any refusal by the United States government to turn over Private Pemberton to Philippine authori-ties should be considered a ground for terminating the VFA,” Bagong Alyansang Makabayan secre-tary general Renato Reyes Jr. said in a statement.

“The Philippine government must stand its ground and not be pushed around by the US, not when a Filipino was killed and the interest of jus-tice is at stake,” Reyes said.

At the same time, Reyes urged Filipinos to rally round the Laude family who, he said, “are facing an uphill battle for justice.”

In a related development, Gabriela party-list Representative Emmi De Jesus scored President Benigno Aquino III for signing with visiting US Pacific Command chief Samuel Locklear III this week agreements to engage in 426 joint military activities two days after the killing of Laude.

De Jesus said all joint activities and programs between the US and Philippine military should be suspended “until a just and dignified conclusion to all pending complaints, including Laude’s killing, is satisfactorily achieved.”

Gabriela is set to file a resolution mandating the House of Representatives’ defense and foreign affairs committees to initiate moves towards a uni-lateral termination of the VFA by the Philippines.

The party-list earlier filed a resolution seeking to end the VFA.

Reyes cited studies that showed “the odds do not look good for host countries” in demanding jurisdiction over American military personnel ac-cused of crimes. (MNS)

‘Terminate VFA if US won’t hand over Pemberton’: Bayan MANILA, Oct 15 (Mabuhay) – If Vice President

Jejomar Binay has truth to tell, what is he afraid of?This was the question asked by Senator Miriam

Defensor Santiago Wednesday as the Vice President continues to refuse to attend the Senate blue ribbon subcommittee hearings on the alleged overpricing in the construction of the Makati City Hall Building II.

Santiago said Binay appeared to be content in defending himself by delivering speeches accusing his critics of lying.

“That is not sufficient. He must present his own evidence because, if he continues to keep silent in the Senate hearing, then I will have to cite a 2002 Supreme Court ruling: To us, respondent is not at all interested in clearing his name or simply had nothing to say in his defense,” Santiago in her speech during the Women Celebration of Life and Faith event at the Philippine Christian University in Manila.

On Binay’s apprehension that his critics and ac-cusers will just use the Senate to humiliate him, San-tiago said they cannot do it because the Constitution requires senators to respect “the rights of persons appearing in, or affected, by such inquiries.”

“Hence, I do not approve of this curious tendency to be so taciturn, in the face of such damaging charges against his moral character,” she said.

She added that the SC ruled in 1998 that “silence gives consent.”

“The natural instinct of man compels him to resist an unfounded claim or imputation and defend himself. It is totally against our human nature to just remain reticent and say nothing in the face of false accusations. Hence, silence in such cases is always construed as implied admission of truth,” Santiago quoted an SC ruling.

She also said that it is public opinion and not the Senate subcommittee, that will make a find-ing on whether Binay is guilty of the accusations against him.

“A Senate committee does not promulgate find-ings of guilt or innocence. If a criminal charge is involved, all that the committee can do is endorse the case for preliminary investigation of the crimi-nal aspect of the case to the Ombudsman or to the Secretary of Justice,” she said.

“Hence, for me as a concerned citizen, it is es-sential, even vital for Binay to adduce evidence on his behalf at the Senate hearing,” said Santiago.

She further said that silence of Binay and his lawyer to present counter-evidence is alarming.

“So far, because of his repeated appearance in the Senate hearings, it is (former Vice Mayor Er-nesto) Mercado who should be credited for positive testimony. His statements are based on facts sup-ported by documents and replete with details-factors which, in jurisprudence, are considered as indicators of truth,” the senator said. (MNS)

Miriam: What is VP Binay afraid of?

MANILA, Oct 14 (Mabuhay) – The Liberal Party has already answered accusations of black propaganda against Vice President Jejomar Bi-nay, Malacañang said Tuesday when asked about “Oplan Stop Nognog 2016.”

“Tumugon na ang matataas na opisyal ng Liberal Party. Palagay ko naman nabigyan na nila ng angkop na pagtugon,” Communications Secretary Herminio “Sonny” Coloma Jr. told Palace reporters.

JV Bautista, interim secretary general of the United Nationalist Alliance (UNA) party, earlier claimed that Interior Secretary Mar Roxas and Senator Alan Cayetano were conniving to destroy Binay’s chances in the 2016 elections.

Roxas, Cayetano and Binay are all said to be interested in running for president.

He said the helicopter used to shoot footage of the 350-hectare alleged “Hacienda Binay” was owned by an associate of Roxas while the videog-rapher was an employee of Cayetano’s wife, Taguig Mayor Lani Cayetano. It was earlier believed that it was former Makati Vice Mayor Ernesto Mercado who paid for the ride.

Coloma insisted that they do not engage in par-tisan politics and are instead focused on supporting President Benigno Aquino III and his reforms.

He dismissed claims that Roxas, who is believed to be Aquino’s preferred successor, and Senator Franklin Drilon were involved in the alleged cam-paign to discredit Binay.

“Wala po akong impormasyon hinggil dyan. At wala na akong maidadagdag sa mga nabanggit,” he ended. (MNS)

MANILA, Oct 13 (Mabuhay) – A body has been formed to correct historical injustices and address the legitimate grievances of the Bangsamoro people.

The Transitional Justice and Reconciliation Commission, launched last Saturday, was created to ensure inclusivity in the peace process. The commission’s work is part of the normalization process under the Comprehensive Agreement on the Bangsamoro.

The commission will conduct public consulta-tions from now until June 2015 to come up with a report.

Presidential Adviser on the Peace Process Tere-sita Quintos Deles said, “we sometimes have a ten-dency to say ‘Huwag nang ungkatin pa and natapos na’ (‘Don’t try to dig up the past’). That’s why we

tend to repeat historical injustices and tragedies. I am so glad that we are deliberately doing this now to ensure that the wrongdoings in the past… will not be repeated.”

Mo Bleeker, Special Envoy of the Swiss Federal Department of Foreign Affairs, will head the com-mission. Members include Atty. Cecilia Jimenez (as GPH representative), Atty. Ishak Mastura (as MILF representative), and Jonathan Sisson as se-nior adviser.

“The work of the TJRC and its outcome must set off a process that does not control, formalize, bu-reaucratize nor narrow down the avenues, but rather generates, in addition to the state’s, people-driven initiatives to do transitional justice and reconcilia-tion,” GPH panel chair Miriam Coronel-Ferrer said.

MANILA, Oct 15 (Mabuhay) – Senator Miriam Defensor-Santiago is planning to investigate the murder of a Filipino transgender woman by an al-leged US Marine while renewing her call to abolish the Visiting Forces Agreement (VFA).

Santiago, who chairs the Senate foreign rela-tions committee, said the case of Jennifer Laude presents an opportunity to reevaluate the agree-ment.

“Paimbestigahan ko nga ‘yan,” she told report-ers on Wednesday.

“I can open it and I can start the hearing as long as I comply with the three-day notice rule. I have to give them notice in three days’ time.”

While the committee does not have the power to invite or subpoena foreign officials, Santiago said she may include witnesses and law enforcers

to the probe. She added, however, that she would consult

with government agencies first to make sure the Senate’s probe would not hamper their own inves-tigation. Santiago, who has always been against the VFA, believes Laude’s murder and a 2006 rape case involving an American soldier – whom the appellate court later acquitted – are enough reasons to scrap the agreement.

“These are no longer temporary but periodic irritants in RP-US relations,” she said.

The senator said that in the meantime, the gov-ernment must assert its jurisdiction over the case and fight for custody of the suspect, Private First Class Joseph Scott Pemberton.

She said Pemberton must be turned over to Fili-pino authorities and be detained in a Philippine jail.

with the deadly virus. She is the nurse that cared for the Liberian Ebola patient during his confinement at the hospital after being diagnosed with Ebola.

It is still unclear how many Filipino nurses and caregivers are employed at the Texas Health Presbyterian hospital.

As of this writing, the nurse, of Viet-namese decent, is getting the best care and treatment. Her family was quoted in the press saying that she is in good spirit and remain confident that she will survive the deadly virus.

Amid fears of the disease, President Obama recently gave assurance that the dangers of a serious outbreak in America is very minimal. He, however said that his administration is closely monitoring it’s progress and seriously taking it at the highest levels of government.

In an effort to further quell what appears to be a nationwide fears about the deadly virus outbreaks, he gave assurance that the U.S. Centers for Disease Control (CDC) would be sending rapid response teams to any site in America where an Ebola diagno-sis is established.

Ebola is one of the world’s most virulent diseases and is transmitted through direct contact with blood or other bodily fluids of infected people. Early symptoms of Ebola include sudden onset of fever, weakness, muscle and headaches and sore throat. The United Nations admitted recently that is falling behind in a desperate race to stop the

deadly Ebola outbreak in Africa. The UN even predicted that thousands of

new infections are possible before the end of this year. The World Health Organizations (WHO) said the Ebola infection rate could soon reach 10,000 a week, which is really bad. However, they said that the good news is that they know how to stop it. The ques-tion is how soon will they stop it to prevent it from spreading here in the U.S.

There are hundreds of thousands of Filipino nurses and caregivers working in hospitals and nursing homes all over the United States. The Philippines is the number one exporter of nurses all over the world. Filipino nurses are well known throughout the world for their work ethics and their compassion for their patients.

Because of the threat of the Ebola virus, Filipinos in Texas expressed apprehension over the safety of their relatives working not only at the Texas Health Presbyterian Hospital but also those working in various hospitals throughout the U.S. They also grumbled about whether hospitals in United States can effectively handle the Ebola virus disease to prevent it from becoming an epi-demic here in America. Worried, the nurses said there is a strong chance that their nurse relatives might get infected by the deadly Ebola virus since as medical workers, they are the first in line in the delivery of health care services to infected patients.

Meanwhile, the National Nurses United, who claims to be representing the interest of

health care workers in Texas, gave assur-ances that they are now closely monitoring the situation and are looking into how the nurse who treated the Liberian Ebola patient got infected.

The nurses union has criticized the hos-pital where the Liberian Ebola patient died and his nurse got infected, claiming that the protocols to protect hospital employees were not in place. They claimed that nurses were claiming of confusion in the days after the Ebola patient was diagnosed in the Dallas hospital, that put them at risk and that they were not given specific training on how to care for Ebola patients. They also claimed that no advance preparedness on what to do with Ebola patients were made, no protocol and there was also no system in place.

From what he have learned and read from newspaper accounts, the first time the Libe-rian patient came to the hospital complaining about muscle aches and fever, he was sent home by ER doctors despite the fact that he

told them that he had been recently in the Ebola stricken Liberia.

When he returned to the hospital days after he really got sick, he was even made to wait at the ER for hours, exposed to other patients. When confirmed that he Ebola, he was confined in isolation at the hospital. During his confinement, the Ebola infected patient suffered severe diarrhea and vomit-ing. Nurses however were claiming that there were no clear cut guidelines given to them on how to discard of the patient’s soiled linen and towels.

I will not be surprised if one of these days, nurses who will be infected with the deadly Ebola virus while caring for their infected patients, will sue for damages. Re-ports have it that some parents of medical workers are now talking with their lawyers and are now looking into issues involved in potential legal actions against hospitals that do not provide a safe environment for their medical workers.

Filipino nurses at risk of getting infected by Ebola virus

Nurses in a Dallas hospital in Texas where a Liberian Ebola patient died recently, expressed resentment that they were given few rules and limited guidance on how to treat patients who have contracted the deadly virus.

The nurses, some of them Filipinos, expressed their displeasure in a press conference after learning that they were being blamed for “breaching protocols” at the Texas Health Presbyterian hospital which led to a nurse becoming infected

ENTERTAINMENTActress Heart Evangelista is not count-

ing on her parents’ presence when she gets married to Sen. Francis “Chiz” Escudero on February 15 of next year.

Evangelista said that while her parents, Rey and Cecile Ongpauco, have given their blessing on the wedding, they still have no plans of attending the ceremony to be held in Balesin Island Club.

“Although ibinigay nila ‘yung bless-ing na magpakasal, hindi raw talaga nila

kayang makitang magpakasal ako,” she said. “Pero, the good news, pinayagan nila lahat ng mga kapatid ko [na pumunta].”

She added: “Magkikita na lang kami pagdating ko sa Manila, pero sa kasal... Okay na siguro, kung nahihirapan sila. Ako lang naman siguro makakaintindi no’n, so okay lang sa akin. Video nalang ipapakita ko.”

Evangelista’s parents publicly disap-proved of the 29-year-old actress’ relation-

Escudero as her husband-to-be.Despite her parents’ absence on her

wedding day, Evangelista said she has much to look forward to after exchanging vows with Escudero.

“[I’m looking forward to] the everyday life lang. Finally, relaxed na kayo. Wala kayong pag-aawayan, dahil lahat nalang pinag-aawayan niyo dati. Siguro ngayon, mag-se-settle na kami. The consistency of a life together is what I look forward to,” she said. (MNS)

Pregnant actress Melissa Ricks admitted that she is now living in with the baby’s father, Charles Togesaki. “Right now he’s staying with me sa condo. My dad moved out na sa the Fort so it’s first time to be on my own,” Ricks said.

“After my mom leaves from the States, I’m gonna stay at his house naman sa Valle Verde house ng family niya while we are making ipon for our house,” Ricks said.

“Kasi ayaw namin biglain to buy a house, to splurge on everything. Mag-iipon muna kami,” the actress explained, saying they want to focus first on the baby. Asked when they are planning to get married, Ricks said:

“Napaguusapan pero wala pang pro-posal, pero siyempre ayaw ko namang mang-pressure, chill lang.” Ricks con-firmed her pregnancy last July 30.(MNS)

What’s the real score between Bangs Garcia and Phil Younghusband?

“We’re getting to know each other,” Bangs replied.

Asked if she sees Younghusband as a potential boyfriend, Garcia said: “Oo naman.”

In August, Garcia clarified that she and the football star are not a couple but admitted that they are “going out,” fol-lowing months of speculation triggered by public sightings of the two together.

She explained that they have known each other for over two years now, saying their respective ex-partners were in the same group of friends. (MNS)

ship with Escudero, who is 15 years her senior. In a March 2013 press conference, Mr. and Mrs. Ongpauco accused Escudero of being disrespectful and an alcoholic, and urged him to leave their daughter.

Defying her parents, Evangelista stood by Escudero, prompting her to live inde-pendently from her family. While Evange-lista and her father were on speaking terms by July 2013, the actress and her mother had still yet to mend ties in May 2014.

At the time, Evangelista told ABS-CBN News that “[her] mind kind of goes on shutdown” where her mother is concerned. “But, you know, she’ll always be my mom and I’ll always love her. Ganoon lang talaga. I guess that’s life. You can’t have everything,” she said, days before last Mother’s Day.

When Evangelista and Escudero got engaged, Mr. Ongpauco sent a congratula-tory message to his daughter. Days later, Evangelista finally mended ties with her mother. However, the couple, by Evange-lista’s admission, has yet to fully accept

HEALTH & BEAUTY(Relaxnews) – The Fall/Winter 2015

bridal shows that wrapped up in New York City this week required some seri-ously beautiful makeup and hair looks. We tracked down some of the best via Instagram.

New York Bridal beauty: Flawless skin, dark lips, loose braids

(Relaxnews) - Your wedding is around the corner, and you’ve bravely decided to do your own makeup. Chanel makeup artist Claire Blavet shares a few guidelines to follow and pitfalls to avoid.

1) Stick with your complexionWhether your skin tone is olive, dark,

mocha, porcelain or peaches and cream, your makeup should match your natural complexion as closely as possible. Paler brides may hit the tanning bed in modera-tion before the big day, but “the face, neck-line, arms and hands should all match,” Claire Blavet points out.

2) Don’t cake it on Too much powder is a guaranteed faux

pas, especially in the unforgiving outdoor lighting conditions likely to provide the backdrop for your wedding photos.

“The light is beginning to get colder in September. And the further along we go into winter, the colder the outdoor light becomes. You are going to be spending a lot of time outside. If there is already too much [makeup], the effect will be doubled.”

3) Foundation is not concealer A common mistake is attempting to

conceal flaws and even out skin tone with the same product. “Foundation is foundation and concealer is concealer,” the expert reminds us. “Conceal what there is to conceal on a case by case basis and set with a sheer powder.” When choosing a foundation, look for a fluid texture you can spread as thinly as possible between your hands. In terms of the quantity, a pea-sized amount should suffice. For the blush, choose pinks or rosewoods, which complement pale, tanned and dark complexions alike. One pitfall to avoid is wearing orange-tinted blush over a tanned complexion, as the result is too tone-on-tone.

4) Matte above all else When it comes to powder, choose a

transparent product that mattifies without adding extra pigments. Apply powder with a wide brush for normal to dry skin, or with a puff for oily skin. The advantage of working with powder sparingly, Blavet says, is that it allows you to mattify where necessary while maintaining just enough shine to capture the light on the cheek-bones, a small edge of the nose and the jawline. The makeup artist also suggests that brides use powdered blotting papers, which are easy to carry and come in handy

for absorbing excess oil.5) Clean your canvas After putting on concealer, foundation

and powder, take a moment to clean your lips and eyelids with a cotton swab and makeup remover. Lipstick and eyeshadow typically go on smoother and stay put longer when they are not on top of powder or foundation.

6) Keep the eyes subtleSmoky eyes may be trendy in other

circumstances, but you’ll most likely want to walk down the aisle with something more subtle. “Avoid creamy eyeshadows that may smudge, and choose colors in the same family as those found in the skin,” the expert says. “Everything that’s close to nude, rosewoods, brownish rosewoods, bronze, candied chestnut, slightly faded colors, eggshell shades to bring light to the eyes, very pale pinks to bring light and freshness.” To add depth to your gaze without weighing down the look, line the base of the lashes with a well-sharpened eyeliner pencil. Brides with shorter eye-lashes may want to use a curler to give the appearance of more open eyes. In terms of mascara, a product that adds volume and length at once is ideal. Falsies are out of the question: too risky on the big day.

7) Well-defined lips The perfect lip makeup starts with a

liner. “If your lips are not well-defined, draw the outline with a rosewood shade, which suits everyone,” says Blavet. To fill in the shape, there are several options.

If your pout is already rosy, keep it simple and just put on balm. On lips that are naturally pale, a little color goes a long way. “Tap with a wine-colored shade and spread with the finger to set the texture,” the makeup artist advises. Those with small lips can create the impression of greater volume with a gloss. Avoid bright red shades, which have a tendency to run and could ruin your entire look.

8) Careful how you set the look Every bride wants her makeup to last all

day, but Blavet warns against the dubious solution of setting a look with hairspray. “None of that on the face. Imagine if it gets in your eye and you have a reaction to it. Especially not on one’s wedding day!” What to do instead? Prepare your face ahead of time by moisturizing so that you only need a base layer, as this helps prevent the skin from producing too much oil throughout the day.

COMMUNITY

Los Angeles, 14 October 2014 – The Los Angeles City Council, led by Council-members Mitch O’Farrell and Jose Huizar, honored the Filipino American community in Los Angeles by presenting a Resolution proclaiming October 2014 as Filipino-American History/Heritage Month on 10 October 2014 at the John Ferraro Council Chamber of the City Hall of Los Angeles.

Members of the City Council praised the Filipino-American community for its achievements, contributions signifying the 427 years of historical presence in the United States when in 1587, the Manila-built galleon ship Nuestra Seňora de Es-peranza landed at Morro Bay California transporting the first Filipinos to visit the United States.

Consul General Herrera-Lim in his ad-dress to the City Council said that the His-tory Month is a celebration of the shared values between Americans and Filipinos.

The recognition of Fil-Am History Month serves to honor the unique relationship that the Philippines has with the US. The celebration of Fil-Am History month is important because it also recognizes the efforts of the thousands of Filipinos work-ing in the Greater Los Angeles Area, in particular the City Hall.

LOS ANGELES, CA, October 15, 2014 – When asked to describe in one word what ASAP Live in LA would be at the packed press conference that was livestreamed on TFC.tv and TFC20.com/ASAP last October 8 from the Los Angeles Memorial Sports Arena, the following cast members said:

Gerald Anderson: “Awesome!” Maja Salvador: “Spectacular!” YengConstantino: “Astig!” Bamboo: “Class Act.” Zsa Zsa Padilla: “Powerful.” Martin Nievera: “Unforgettable.” Enchong Dee: “Memorable.” Kathryn Bernardo: “Fun!” Daniel Padilla: “Intense!”

‘ASAP Live in LA’ brings Filipinos together to celebrate TFC’s 20th year of service By Nerissa M. Fernandez, ABS-CBN Global Head, Corporate Affairs & PR

Gary Valenciano: “I wanted to add on to what everyone said and it has to do with why ASAP is where it is today. You have a bunch of artists here and there are many more artists out there. But there is a reason why we are chosen to be part of this show. I think that God has a great plan for why we are a part of this show. So, the word I’m going to choose is ‘blessed’.”

Indeed, the words of TFC’s 20th An-niversary Ambassador Valenciano and his nine press con co-panelists were veritable harbingers of what ASAP Live in LA last October 11 turned out to be.

Not the power-packed joint concert of superstars Enrique Iglesias and Pitbull in Staples Center, or the multi-cultural, multi-act Super Sonico Festival brought by the teams of LAMC and Coachella to Shrine Auditorium, or the touring and local culinary stars of James Beard Foundation’s Taste Los Angeles in Vibiana could distract 12,000 Filipino fans from trooping to his-toric Los Angeles Memorial Sports Arena to take part in the day-long festivities climaxed by a one-of-a-kind three-hour, live, world-class Filipino entertainment.

Filipino and Fil-Am performers join hands

When ABS-CBN and TFC North America promised 40 stars would perform at ASAP Live in LA, they actually meant at least 40. Believing in always putting great value for the money that TFC subscribers and fans pay, ticket buyers did not only get a star-studded complement of talented cast members from the Philippines; they were treated to spectacular on-stage collaborations with U.S.-based Filipino singing greats like Jam Morales, Ella Mae Saison and Tootsie Guevarra, and in-ternational Fil-Am superstars like apl.de.ap of Black Eyed Peas and Jessica Sanchez of American Idol fame.

Also acknowledged at the show were well-known Fil-Ams from the Holly-wood industry like Tia Carrere, Reggie Lee, Mark Nicolas and Fritz Friedman.

Carrere told Balitang America: “ASAP was amazing. What a monster concert! I mean, Apl being here, Charice, Jessica Sanchez, and all these stars from the Philip-pines, I’m so happy to be able to be intro-duced to them. It’s three hours of non-stop energy here. I can’t wait to see it on TV.”

More than just entertainment While ASAP director Johnny Manahan,

ASAP Business Unit Head Joyce Liqui-cia and their Manila team in collaboration with TFC North America production team led by John-D Lazatin made sure that ev-erything from the production numbers to the costumes to the technical set-up.

World-class Filipino and Fil-Am talents collaborate to deliver epic show before 12,000 fans at historic LA Memorial Sports Arena. Photo collage by Andy Z. Edralin, Andy Tecson, Bobby Crisostomo, Lauro Tecson Jr, Mar Arcena, Marc Pijuan, Ricky Resurreccion, and Sthanlee Mirador.

MOTORING

Refreshed CR-V chosen for its fuel economy, driving dynamics, long list of new safety features and overall refinement

The Honda CR-V has won Motor Trend Sport/Utility of the Year for 2015.

The CR-V claims the title with a long list of vehicle enhancements for 2015, including its improved fuel economy and uncom-promised driving dynamics, thanks to the inclusion of Honda’s Earth Dreams Technol-ogy™ powertrain, the launch of an all-new Touring trim, the debut of Honda Sensing™ safety and driver assistive technologies and the CR-V’s excellent value for money para-digm. Motor Trend editor-in-chief Ed Loh, said, “The 2015 Honda CR-V impressed our judges with its extensive list of delightful design and thoughtful engineering improve-ments. Our editors were especially im-pressed by Honda’s responsive and efficient continuously-variable transmission and so-phisticated safety systems – particularly the

smart and seamlessly integrated Lane Keep-ing Assist system. Efficient, practical, and a joy to drive; the 2015 Honda CR-V does virtually everything well.” “It is an honor to receive such a prestigious award from the expert staff at Motor Trend,” said Jeff Conrad, SVP & General Manager of Honda Division, American Honda Motor Co, Inc. “Our engineers, planners, and dealers work hard to deliver class leading products to our customers, and it’s extremely rewarding to be recognized for that hard work. This award fromMotor Trend reaffirms for us that we’re meeting that goal.”Although a Honda is a Honda wherever you see one, Filipinos flock to Carson Honda because of the friendly Filipino staff at the dealership and of course because of the service our kababayans pro-vide. BEIJING, October 17, 2014 (AFP) – German automaker Volkswagen will recall more than a million cars in China and the United States due to a defect in the rear axles, a company spokesman said.

The company’s US unit informed the National Highway Transport Safety Ad-ministration that it would recall more than 400,000 Jetta sedan models and nearly 42,000 Beetle cars manufactured between 2011 and 2013, the spokesman told AFP.

“In case of an accident, the axle could be damaged. The axle is secure but we are recalling the vehicles because we cannot be absolutely sure that all our customers will go to a repair shop if an axle is dam-aged,” he said.

Meanwhile the firm’s Chinese joint venture will recall more than 500,000 cars in the country, state media said.

The German automaker, which has op-erated in China since the 1980s, will recall a total of 581,090 cars, the official Xinhua news agency said, citing a statement from China’s General Administration of Quality Supervision, Inspection and Quarantine.

“The administration said it launched an investigation into the cars in August and the recall is the outcome of months of work on customer feedback and expert analysis,” Xinhua reported.

Volkswagen – which operates a joint venture with China FAW Group Corp – has offered to “place a metal plate in the trailing arm of the rear axles to ensure the proper operation of the vehicles in case of a rupture”, it added.

Last week, among agreements signed during a visit by Chinese Premier Li Keq-iang to Germany, Volkswagen extended its joint venture with FAW until 2041.

TORRANCE, Calif. (Oct. 13, 2014) – Toyota Motor Corporation announced today global hybrid sales surpassed the 7 million unit mark in September. Toyota achieved this latest million-unit hybrid milestone at the record pace of nine months.

“Hitting the 7 million mark represents our customers’ recognition of the benefits of Toyota and Lexus hybrid vehicles,” said Bob Carter, Toyota senior vice president of automotive operations.

“The appeal of excellent fuel economy, driving dynamics and the quality of our ve-hicles combined with our dealers’ dedica-tion to customer service makes Toyota the undeniable leader in hybrid technology.”

Interbrand’s 2014 Best Global Brands rankings, published Thursday, deem the Japanese company the world’s most powerful and valuable car brand and the eighth most important brand across all business categories.

The latest rankings, announced on Thursday, are based on three criteria: the financial performance of the branded product or service; how that brand influ-ences consumer choice; and how able the brand is to demand a premium price. All of which gives Toyota a brand value of $42.39 billion, significantly more than Mercedes-Benz, ranked in second place.

The third most valuable automobile brand is BMW, with Honda and Volk-swagen making up the top 5.

It is the tenth year in a row that Toyota has come top in the rankings, and Interbrand puts this sterling per-formance down in part to its perceived dominance in greener technology. The Prius has become the environmentally friendly personal mobility status symbol of choice among a growing number of motorists, particularly in the USA.

The company that has risen the most in this year’s rankings is Audi, now in

eight place. The company has had back-to-back record years for sales but it is also capturing people’s imaginations with its very impressive demonstrations of autonomous driving technology.

Self-driving cars are generating a huge buzz at the moment, even if they won’t become a reality for some years to come.

And Audi is one of the company’s generating the most attention and ex-citement in this area, boosting its brand.

Interbrand claims that this association with autonomous driving technology has had a similar positive effect on BMW, Volkswagen and Nissan and their brands.

Value of the Nissan brand increases by 23% to $7.623 billion

YOKOHAMA, Japan, Oct. 9, 2014 – Nis-san has been named one of the world’s most valuable brands for 2014, according to Inter-brand, the world-leading brand consultancy. In the Best Global Brands Study, released today by Interbrand, Nissan ranked 56, up from 65 in 2013. The study cited the strength of Nissan’s financial performance, product portfolio and leadership position in electric vehicles among the drivers of the company’s brand health. The value of the Nissan brand was estimated at $7.623 billion, an increase from last year’s estimated value of nearly $6.2 billion.

In June Nissan was named one of the world’s greenest brands for 2014 in Inter-brand’s Best Global Green Brands report.

Nissan moved up one spot to fourth overall powered by the Nissan LEAF, the world’s best-selling 100% electric vehicle and mak-ing the company the global leader in Zero Emissions mobility.

“Brand power is a key indicator of the health of the Nissan business and a major driver of the company’s growth,” said Roel de Vries, Nissan Corporate Vice President and global head of Marketing and Brand Strategy. “We are pleased to see a 23 percent increase in brand value from last year – nearly doubling Nissan’s brand value since its inaugural appear-ance on the list in 2011 – and recognition as a “top” riser in the study.”

The Best Global Brands study is In-terbrand’s annual report on the world’s most valuable brands. Interbrand’s meth-od looks at the ongoing investment and

management of the brand as a business asset, taking into account financial performance, the role of brand in the purchase decision process, and the strength of the brand.

The study noted Nissan’s recent launches

for the Qashqai, Murano and Rogue as a demonstration of the brand’s “Innovation and Excitement for Everyone” positioning. The company’s leadership in electric vehicles and investment in future mobility, like au-tonomous vehicles and fuel cell technology, were recognized for addressing emerging customer needs in a rapidly changing auto-motive market.

If you want to find out more about Nissan Altima, Rogue or Nissan Quest, get in touch with our kababayans Augusto Montemayor and Mariefe Alipio of Nissan of Van Nuys, each of whom are experts in helping custom-ers choose the best Nissan vehicle for their use. Drivers using hands-free virtual as-sistants like Apple’s Siri can be distracted by the technology, creating safety hazards, according to a study released Tuesday.

The study produced for the AAA Foun-dation for Traffic Safety found that some systems offering hands-free communica-tions for tasks such as navigation or chang-ing radio stations can create “cognitive distractions” which compromise safety.

The research comes amid growing use of hands-free technology which aims to get drivers to avoid the dangerous use of hand-held phones behind the wheel.

But with the technology offering more complex functions – such as making din-ner reservations or updating social media profiles – these virtual assistants have their own perils.

“Technologies used in the car that rely on voice communications may have unin-tended consequences that adversely affect road safety,” said Peter Kissinger, president and chief executive of the foundation.

“The level of distraction and the impact on safety can vary tremendously based on the task or the system the driver is using.”

The study by researchers at the Univer-sity of Utah found that Siri was particularly distracting when it was used for certain tasks such as updating Facebook or Twit-ter feeds.

The study found that when perform-ing commonly used tasks, Siri generated a “category 4” level of distraction on a five-point scale, which was the highest in the research.

By contrast, some automakers’ virtual assistants performed better. Measuring the most common voice-based interactions – changing radio stations and voice dial-ing – the researcher gave Toyota’s Entune system a low distraction rating of 1.7.

Other systems tested included the Hyundai Blue Link (rating 2.2), the Chrys-ler Uconnect (rating 2.7), Ford Sync (rating 3.0), the Mercedes Ccommand (rating 3.1) and Chevrolet MyLink (rating 3.7).

One factor affecting the rate of distrac-tion was the accuracy of voice detection. Systems with low accuracy and reliability generated a high level of distraction.

“It is clear that not all voice systems are created equal, and today’s imperfect systems can lead to the perfect storm for

driver distraction,” said Beth Mosher of AAA, which is also known as the Ameri-can Automobile Association.

“We already know that drivers can miss stop signs, pedestrians and other cars while using voice technologies because their mind is not fully focused on the road ahead.

We now understand that current shortcom-ings in these products, intended as safety features, may unintentionally cause greater levels of cognitive distraction.”

AAA said it urges vehicle and device manufacturers to use the study to improve their voice systems to promote road safety.
