Auction Sale Rules (All cattle sold by Kivells are sold under the Livestock Auctioneers Association Conditions of Sale)

Maiden heifers stated to be sold for breeding purposes. The vendor warrants a maiden heifer stated in the catalogue or at the time of sale to be sold for breeding purposes to be free from any malformation which would render the animal incapable of breeding. The warranty is a 5 day warranty if the malformation is patent or a 6 month + 5 day warranty if the malformation is latent. If the purchaser proves a breach of warranty the purchaser may return the animal to the vendor. Notice of claim must be supported by a veterinary surgeon’s certificate.

Cows or heifers sold as being in milk and/or in calf. The vendor warrants a dairy cow or heifer in calf and/or in milk:

(a) To be correct in the udder and teats; (b) Not to be infected with clinical mastitis; (c) Not to suck any other animal or herself; and (d) To be quiet to milk.

The warranties in conditions (a) & (b) is an after sale warranty which shall run from the close of the day’s sale or until the animal is removed from the sale premises, whichever is sooner. The warranty in conditions (c) & (d) is a 5+5 day warranty.

Cleansing The vendor warrants that all newly calved cows and heifers have cleansed satisfactorily before the sale. This warranty is a 3 day warranty in which any claim made by the purchaser must be supported by a veterinary surgeon’s certificate. The vendor is obliged to pay for the cost of one wash out.

Cows or heifers sold as served or guaranteed in calf. When an animal stated to have been served less than 10 weeks prior to the sale and is pregnancy diagnosed positive, this is given as guidance only and carries no warranty. If a cow or heifer has been positively diagnosed as 10 weeks or more in calf at the time of sale and thereafter is proved to be not in-calf, and a Veterinary Surgeon’s certificate to that effect is produced there is a 38 + 5 day warranty.

Where a cow or heifer is sold as ‘having run with a bull’ no warranty as to the animal being in calf at the time of sale is given.

Breeding Stock bulls The vendor warrants that any bull 10 months or over sold as a stock bull is capable of and effective at natural service. This warranty is a 16 week warranty.

Antibiotics – Please would all vendors inform the Auctioneers if any animal has been treated with any antibiotics. There are serious penalties incurred to milk producers for antibiotic contamination.

** A REAL HERD OF BRITISH FRIESIANS**

Kivells are pleased to have been instructed to disperse the Herd of British Friesian Dairy Cattle on behalf of Mr PC Gill, Poltreworgye Farm, Trelill, Bodmin. The Herd will be removed to Holsworthy Livestock Market for convenience of sale on Wednesday 22nd November 2017, commencing at 11:30am. The Gill Family have been milking at Poltreworgye Farm since 1968. This Homebred and Closed Herd of British Friesians would have celebrated its 50th year next April. The Sale is a complete dispersal sale of 78 head including 38 In Milk and Dry cows, 11 In-Calf Heifers, 12 Bulling Heifers, 3 yearlings and 14 Heifer Calves. This Herd has been bred for almost 50 years to British Friesian genetics using Genus AI nominated British Friesian Sires. Current Sires and Service sires including Ben Loyal, Chad, Hylke, Quentin, Rancher & Topman. The cows are cubicle housed and abreast parlour milked. The Herd is fed on a simple feed system maximising grazing with grass silage fed in ring feeders during the winter months and cake in parlour. Although the cows are not milk recorded, they are estimated to average over 6000Kgs on this simple system with excellent Butterfat and Proteins as demonstrated on the milk sales statements with the latest Arla Milk cheque statement results showing;

An Individual NMR sampling test has occurred for the sale and these results are shown in the catalogue. The sale comprises 38 in milk/dry cows including 7 first calvers, 7 second calvers, 7 third calvers, 10 fourth/fifth calvers and 7 sixth + calvers demonstrating the longevity of this herd. The sale includes 16 freshly calved since September and 9 due to calf December to February. 11 In Calf Heifers due Late December onwards and 29 Youngstock mainly sired by the British Friesian sire Catlane Chad. The cows are all year round calving with an Autumn peak. The cows are a Closed herd with no known health issues and No known cases of Johnes. Cephaguard Dry Cow therapy is used at drying off. The Herd was TB tested on the 9th October. AUCTIONEERS COMMENT: On viewing the herd, this sale represents a unique opportunity to buy true British Friesian cattle from a closed homebred complete dispersal. Mr Gill and his family have maintained these bloodlines for almost 50 years and have bred efficient long lasting cows capable of converting grass to milk with excellent components on a low input system.
