ROAD AND TRAFFIC INFORMATION - RTIVolvo's navigation system is a traffic infor-mation and road navigation system devel-oped by Volvo. The system guides you to a

destination and gives information along the route.It informs of situations that can affect the drive,such as accidents, road works and shows alterna-tive routes.

It is possible to create an itinerary, search forfacilities along the route, store special places etc.The system displays the car's exact position andin event of a wrong turning always corrects toguide you to the destination.

You will see just how intuitive it is to use. Try itout. In order to get along with the system we rec-ommend that you familiarise yourself with theinformation in this manual.

By facilitating accessibility and shortening drivingdistances, Volvo's navigation system contributesto a better environment.

Activating the systemThe car's electrical system must first be acti-vated:

1. Press the remote control key into the igni-tion switch and activate key position I(see the owner's manual for the car).

2. If the navigation system does not startwithin a few seconds - press the centreconsole's NAV button.

• Press the OK button.

ControlsVolvo's GPS navigator can be operated inseveral ways:

• With the steering wheel's right-hand key-pad

• With the controls in the centre console

• With a remote control

Main commandsThe steering wheel keypad is used in the fol-lowing two examples to give guidance to anAddress or Facility.

• Scroll/select in the menus with theThumbwheel (1).

• Activate selections with a brief press onthe Thumbwheel (abbreviated in the fol-lowing example with "+ OK".

GeneralThe Volvo navigation system uses referencesystem WGS84, which gives longitude andlatitude positions.

The car's navigation system can be usedwithout a destination being selected.

Map positionUpon start-up, the navigation system showsan on-screen text message, which must beconfirmed by pressing the OK/MENU button.The text is as follows:

• This system provides routeinformation to help you reach yourdestination. Due to road conditions,some recommendations may not beaccurate. Obey all traffic laws anddrive based on your own goodjudgement. Always concentrate onyour driving by keeping your eyes andmind on the road.

Then a map of the current geographic area isshown where the car is symbolised by a bluetriangle.

SettingsThe system is supplied with default settings,but starts with the settings last used.

There is a function that resets all settings todefault settings simultaneously, seepage 58.

On/Off

On1. Push the remote control key into the igni-

tion switch.

2. The screen activates automatically in thekey position I (see the car's manual).

3. Press the centre console's button NAV ifthe navigation system does not startautomatically.

4. Press OK when the "Start up" textappears on-screen, see previous section"Map mode".

The system may need a few seconds in orderto detect the position and movement of thecar.

OffThe navigation system is shut down when theremote control key is removed from the igni-tion switch.

The Navigator cannot be switched off man-ually, but always works in the backgroundafter the "Start up" sequence. If the naviga-tion system is not to be switched on:

• Press EXIT at the "Start up" sequence,see section "Map mode".

NOTE

The navigation system is also availablewhen the engine is switched off. When thebattery level gets too low the systemswitches off.

Demo (simulated guidance)To see how the system works, guidance to anindicated destination can be simulated on-screen - see page 60.

Antenna for GPSThe antenna is integrated into the roofantenna.

Voice recognitionSome procedures in the Navigation systemcan also be voice controlled. The microphone(2a) is fitted in the ceiling and the activationbutton (2b) is located on the right-hand key-pad on the steering wheel. For more informa-tion, see page 22.

Main unitThe main unit is fitted in and behind the cen-tre console and includes the following func-tions:

• Calculating the position of the car

• Calculating the route to the specified des-tination

• Handling traffic information

• Voice guidance

• DVD player

Receiver for GPS and traffic information(TMC1) is integrated into the main unit.

PositioningThe car's speed sensor and a gyro calculatethe current position and the direction of travelof the car using signals from the GPS satellitesystem.

The advantage of this concept is that theNavigation system registers and calculatesthe route outline even if the GPS signal istemporarily lost, e.g. when driving through atunnel.

Traffic informationTMC1 is a standardised coding system fortraffic information. The receiver automaticallysearches for the correct frequency. Receptiontakes place via the FM antenna.

NOTE

TMC is not available in all areas/countries.The system's coverage area is under con-stant construction and updating maysometimes be necessary.

For information about updating map data andsoftware, see page 27.

ScreenThe screen displays maps and providesdetailed information on route type, distance,menus etc. For information screen care, seepage 28.

Keypad, centre consoleAs an alternative to the steering wheel key-pad, the centre console's numerical keypadcan be used in combination with buttons OK/MENU, TUNE and EXIT to scroll between dif-ferent menu options, confirm options or goback in menus, see page 19.

Volume control and IR receiverUse the audio unit's volume control duringongoing voice messages to adjust the vol-ume, see page 31. The volume can also beadjusted in the menu system.

Point the remote control towards the centreconsole during use - its IR receiver is locatedthere.

Keypad, steering wheelA keypad is located on the right-hand side ofthe steering wheel. Use it to scroll betweendifferent menu options, to confirm selectionsor to move back in menus, see page 19.

SpeakersNavigation system audio uses the front loud-speakers.

General information about controlsThe navigation system is operated by con-trols on the centre console, the steeringwheel keypad or using a remote control*. Thethree different control unit keypads havecommon functions but differ in appearanceand operation. The design may also varydepending on market.

The system can also be controlled by voicerecognition using specific commands - seepage 22.

Centre console

Centre console keypad.

NAV activates the GPS navigator on thedisplay screen. With GPS activated, aquick menu opens/closes, see page 32.

Numerical keys enter information foraddress and name search, and scroll onthe map, see pages 25 and 32.

Press OK/MENU once to confirm or acti-vate a selection. Described in this manualwith the "OK button" or "+ OK".

Turning TUNE scrolls between differentmenu options or zooms when the mapimage is shown. Described in this manualwith the "TUNE knob".

Press EXIT once to go back in the menustructure or undo a selection.

Steering wheelThe steering wheel's keypad is available inseveral versions depending on market andselection of audio system.

Remote controlThe remote control can be used to control/operate several different functions in the car -only the related navigation system is descri-bed here.

• Point the remote control at the centreconsole during use.

If the remote control does not work, tryreplacing with new AA/LR6 batteries firstof all.

WARNING

Store the remote control and other similarobjects in one of the storage compart-ments - in the event of sudden braking ora collision such objects could cause per-sonal injury or material damage.

General about Voice controlVoice control means that certain functions inthe navigation system can be activated by thespoken word.

The Voice commands offer comfort and helpthe driver to avoid distraction - instead thedriver can concentrate on driving and focusattention on the road and traffic situation.

WARNING

The driver always holds overall responsibil-ity for driving the vehicle in a safe mannerand complying with all applicable rules ofthe road.

The Voice control uses the common micro-phone of the hands-free system - the driverreceives responses to the Voice controlthrough the vehicle's loud speakers.

The microphone is positioned in the ceiling infront of the driver for optimal take-up of thedriver's speech - it can however be disturbedby/pick up loud voices from passengers.

Activating the system• A short press on the steering wheel but-

ton (1) activates the voice recognitionsystem - a voice command can be givenafter the tone.

Think of the following when using the voicerecognition system:

• For commands - Speak after the tonewith a normal voice at a normal tempo

• The car's doors, windows and sunroofmust be closed

• Avoid background noise in the passengercompartment.

NOTE

If the driver is unsure of which commandto use, he/she can say "Help" - the sys-tem then responds with several differentcommands which can be used in the cur-rent situation.

Voice commands can be disabled by:

• not speaking

• saying "Cancel"

• hold the steering wheel button forVoice recognition depressed for a cou-ple of seconds

• press EXIT

• press one of the centre console's but-tons NAV, RADIO, MEDIA, MY CARor CAM.

Use the voice commandEntering information in the navigation systemusing the voice command is very simplebecause the screen lists the frequently occur-ring commands to be used in the relevant sit-uation.

StartingA voice command is started as follows:

1. Press the steering wheel button for Voicecontrol - the display lists examples ofpossible commands.

2. For example, select "Navigation" - waitfor the tone and state the word clearlyand in normal conversational tone.

3. The screen shifts to the option "Repeatinstruction/Navigation go to address/Itinerary" - Select and say "Itinerary".

Note that greyed out text and text in bracketsis not included in the spoken command.

NOTE

Greyed-out menu bars and options on thescreen are temporarily not selectable.

The command can be given in severalwaysThe command "Navigation go to address"can be stated as:

• "Navigation > Go to… > Address" - Say"Navigation", wait for the systemresponse in the form of suitable on-screen options. Continue by saying, forexample, "Go to…" and conclude with"Address".

or

• Say the whole command in one sequence- "Navigation go to address".

TipsSome good advice:

• Give a command by first pressing thevoice button and then speaking naturallyafter the tone.

• To respond to the voice recognition sys-tem - speak after the tone at the end ofthe question.

• To interrupt the voice session - press andhold the voice button or press the EXITbutton.

• The driver can obtain help during a dia-logue by saying "Help" after a listeningtone.

• The dialogue with the system can bespeeded up - Interrupt the system'sspeech with a short press on the button'svoice button, wait for a tone and thenstart talking.

• The voice recognition system asks up to3 times for an answer. If no answer isgiven by the driver during this time thenthe session is concluded.

ExampleHere are some normal commands:

• Navigation go to address

• Navigation go to POI

• Navigation delete next waypoint

• Navigation cancel guidance.

NOTE

A complete list of quick commands isavailable in the MY CAR menu - Go toSettings Voice settings Voicecommand list Navigation commands.

Help functions and settingsIn the menu system MY CAR there are pro-grams where the driver can practice the dif-ferent functions in the voice recognition sys-tem. To describe the menu system MY CAR -see the car's normal instruction manual.

The better the driver knows the voice recog-nition system, the more comfortable thedriver will be using the functions. Practicingusing the integrated practice programs istherefore recommended.

NOTE

The exercise programs are only accessiblewhen the car is stationary with the parkingbrake applied.

Introduction to voice controlThe program Voice tutorial gives the driverstep by step instructions in the use of thevoice recognition system and is a simple way

of becoming familiar with the methods of giv-ing commands.

The program can be started in two ways:

• Press the steering wheel button for voicecontrol and say "Voice tutorial".

or

• Activate the program in MY CAR - Go toSettings Voice settings Voicetutorial.

Voice trainingThe program Voice training teaches thevoice recognition system to recognise thedriver's voice and speech pattern. It is alsopossible to create a second user profile - anadvantage if more than one person is likely touse the car/system regularly.

• The voice training is started in MY CAR -Go to Settings Voice settingsVoice training User 1 or User 2.

NOTE

Menu option Default setting can only bechanged to User 1 after a lesson on Voicetraining has been completed.

Language dependent user profileThe voice recognition system only under-stands the language set in System options.

Say that user profile User 1 is stored by aSwedish speaking driver with the system setin Swedish. If the driver changes the car lan-guage to English the user profile User 1 willno longer be selectable because the systemnow only understands, and expects Englishspeech - instead the option Default settingbecomes active.

To improve the system's understanding of thedriver's English speech the solution is toteach and store the driver's English speech inUser 2 with the system set to English (tohave both variants available) or to replace theSwedish language profile in User 1 with anEnglish profile.

Entering and selecting options

This navigation system uses a "daisy wheel"to enter specific information, e.g. type offacility, place/town, area/country, address,street or post code.

Activate an optionAfter marking a desired function/menu barusing the thumb wheel or the TUNE knob,press the thumb wheel/OK to see the nextlevel of functions/options.

• Stop using the cursor on the desiredcharacter to select it - the character isshown on the enter line.

• Delete/change using EXIT.

NOTE

Faded characters cannot be selected incombination with the currently input char-acters.

In the daisy wheel's inset menu there are fur-ther options that have more characters anddigits:

• More (More) + OK - alternative charac-ters appear in the wheel.

• 123 + OK - digits appear in the wheel.

• => + OK - the cursor moves to the list onthe right-hand side of the screen whereselections using OK can be made.

• Last 5 (Last 5) + OK - lists the mostrecent searches. Mark one of them + OK.

Updating the map dataWhen updating, DVDs are used to transfernew information to your car's navigation sys-tem. This is done using the car's regular DVDplayer.

NOTE

• A number of the Infotainment functionsare disabled or reduced during updat-ing.

• Before an update begins - readthrough the instructions first.

In the event of any questions about updating- contact a Volvo dealer.

License codeTo be able to activate an update, a licencecode has to be entered first. This code canbe found on the Internet.

1. Open the website1 "Activate your naviga-tion system".

2. Enter your car's VIN number and theowner's e-mail address in the relevantentry fields, then click to close the web-site.

3. Note the licence code which is then dis-played on screen. This licence code isalso sent to the specified e-mail address.

UpdatingHow to update the navigation system:

1. Start the engine.2. Insert the first disc in the DVD player and

follow the instructions on screen. Anupdate is often distributed on severaldiscs2 - insert the discs in the logical/numerical order.

3. The screen shows New softwarefound - start the update by pressing OK.(Cancel by pressing EXIT).

4. The screen shows Please enter licencecode: - input the licence code using thenumeric keypad, see page 19.

5. Follow the instructions on screen, whichcontinuously show the progress of theupdate and the approximate time remain-ing.

• The update has to be enabled once allDVDs have been loaded. This is done byswitching off the engine and waiting5 minutes before restarting. The update isthen complete and the navigation systemcan be used again.

NOTE

In certain cases updating map data mayalso add new functions in the system,which are not described in this manual.

Continue an interrupted updateIf the update is not complete when the engineis switched off, the process continues fromwhere it left off the next time you start theengine. Proceed as follows to restart an inter-rupted update:

• If the disc is inserted into the DVD player:Start the engine - the update is resumedautomatically. Follow the instructions onscreen.

• If the disc is removed: Start the engineand insert the disc into the DVD player -the update is resumed automatically. Fol-low the instructions on screen.

Care of DVD discsHandle DVD discs with care.

When they are not in use they must be storedin their packaging. Avoid storing them indamp, high temperature, direct sunlight ordusty surroundings.

Screen careClean the screen with a soft, lint-free rag,lightly moistened with a mild window cleaningagent.

IMPORTANT

Do not place any objects in front of theGPS navigator's display screen - the sur-face could then be scratched. Mobilephones can also interfere with the displayscreen's function.

Map image of current positionThe appearance of the screen image dependson geographic position and the settingsmade, e.g. map scale, facilities selected fordisplay etc.

Explanations for the text, signs and symbolsthat may appear on the display are availableon the front of the cover.

Detailed junction map - the left-hand sec-tion of the display screen shows adetailed enlargement of the next junc-tion1. The situation is always supplemen-ted with a voice message, see next sec-tion.

Two maps can be selected as displaymode. The screen shows the same mapimage but in two different scales. 2D or3D display can also be selected - seepage 53.

Voice guidanceAfter a destination has been entered and thecar approaches a junction or exit, a voicemessage sounds stating distance and type ofthe next manoeuvre. At the same time adetailed map of the junction is displayed. Thevoice guidance message is repeated closer tothe junction.

The volume can be adjusted with the audiounit's volume button (during ongoing voicemessage).

To repeat a message:

• Press twice on the OK button.

NOTE

There is no voice guidance during a cur-rent call with a Bluetooth-connectedmobile phone.

To select male or female voice and language:

ShortcutsAfter pressing the NAV button to start thenavigation system, the next press on the NAVbutton will bring up the first menu for theuser, with shortcuts to the most frequentlyused functions.

The shortcuts are:

• Previous destinations – see also page44.

• Traffic info on the route – see also page68.

• Cancel guidance – deletes the currentitinerary. Also located there is the optionPause guidance, see page 33.

There are several different ways to program adestination.

It is sufficient to simply specify a district/cityand start the journey - it leads to the centre ofthe district/city.

If a destination's latitude and longitude areknown then these can be entered.

See page 25 for information on how charac-ters are written/entered into the system's var-ious text fields.

NOTE

The definition of city or area may vary fromcountry to country and even within thesame country. In some cases, it refers to amunicipality and in others it refers to a dis-trict.

The cursor first rests on Street.

How to search and locate a destination:

1. With the previous image view on the dis-play screen - Press OK to activate thepreset text box.

2. Enter the street's name Street: with the"daisy wheel" (see page 25) and thenselect a desired City:.

The following search criteria can be used:

• Area: - Enter a country.

• City: - Enter a district/city.

• Postcode: - Under City: the search canalso be made using a post code.

Select an address/street + OK - then the fol-lowing can be selected:

• Map - Shows where on the map the loca-tion can be found - sometimes with addi-tional information.

• Call1 - Calls the facility if a telephonenumber is given.

• Related POI - Lists the facilities associ-ated with the current/selected facility.

• Parking nearby - Lists parking whereappropriate around the selected location,with distance.

The system contains a large number ofsearchable facilities which can be specifiedas destinations. The list of desired facilitiescan be shortened by specifying which facility/facilities the current search relates to:

• Select Type: and specify which facilitiesshould be covered by the search (it is thesame approach as described on page54).

To select which facilities should be perma-nently visible on the map, go to the menuSettings POI on map - see page 54.

All searches are made in the manner descri-bed in the previous section City or street:

In addition to searching with main group,such as Restaurant, the company name ofthe facility can also be used, e.g. "PeppesBodega". The procedure is the same as whensearching with Address, see page 40.

When searching with Name: with e.g. "Lon-don Airport", all combinations with "London"will be shown when "Lo" is entered. The moreletters you input the more specific the reply.

A search with "Lo" also produces reply alter-natives such as "Restaurant Lou Trivalou" for

This function allows facilities that the user hasentered into the system - My POI2 - to besearched for in the area around the car's cur-rent position. The search is made within aradius of approx. 32 km.

The basic condition is a stored itinerary. If thedriver deviates from the proposed route andtakes a different route to the final destinationthan the system recommends, the systemmemorises the driver's choice.

If the same itinerary is used again 2 times andthe driver repeats the route choice, the sys-tem will instead show the path that the driverselected.

Ticked window means that a route that isdriven 3 times is stored as route instead ofthe original route.

Import/Edit My POI

Many companies offer POI files on their Inter-net pages. Using this function the user cansupplement Volvo's map database with facili-ties from other suppliers.

NOTE

• Adding POI files to the map databaserequires a certain amount of computerknowledge!

• File format for POI files and how thefiles are downloaded from the Internetare determined by the respective man-ufacturer/distributor. Consequentlythere is no standardised process fordownloading the POI files from theInternet - and for this reason thisowner's manual does not show anexact step-by-step description.

• If you have any questions - contact aVolvo dealer.

In order to show the principle for how todownload a POI file from the Internet, a sim-ple example follows here with the fictitiouscompany "Department Store" and its stores:

1. Go to the company's page on the Internetand search for the location with its POIfile.

2. Select a POI file with the "gpx" formatand download it to the computer - if theformat is not available then the POI filemust be converted to the gpx format4

after downloading.

3. Load the POI file "Department Store.gpx"onto a USB memory stick.

4. Then insert the USB memory stick intothe car's USB port (under the tunnel con-sole's armrest/hatch) and locate Settings

Import/edit MyPOI in the menu sys-tem.

5. Select Import + OK and follow theonscreen instructions.

When the import is complete, some settingscan be made for the new My POI group"Department Store":

• the name can be changed

• the map image My POI icon can bereplaced (if an icon is included in theimported POI file it automaticallybecomes the default)

• one of 3 sounds can be selected (to get awarning when the car approaches the MyPOI icon - see page 56)

• choose whether or not the My POI icon isto be shown on the map.

When all selections have been made, selectStore + OK to finish, or a new POI group canbe imported/edited.

All facilities added are grouped under theheading "My POI".

The type of information permissible forinclusion on the map is stipulated innational legislation. For current informa-tion, see www.volvocars.com/navi.

To avoid making the map image difficult toread, the number of facilities that can beviewed simultaneously on the screen is lim-ited - zooming into an area provides anopportunity to view several facilities.

The position of the car on the map iswrongThe Navigation system shows the position ofthe car to an accuracy of about 20 metres.

There is a greater chance of error when driv-ing on roads lying parallel to another road, onwinding roads, on roads on several levels andafter driving a long distance without makingany distinctive turns.

High mountains, buildings, tunnels, viaducts,over/underpasses etc. also have a negativeaffect on the reception of GPS signals, whichmeans that accuracy in calculating the posi-tion of the car may decrease.

The system does not always calculatethe fastest/shortest routeWhen calculating a route outline, distance,width of road, type of road, number of right orleft turns, roundabouts etc. are all taken intoaccount in order to produce the best theoreti-cal route. A more efficient selection of routemay be possible based on experience andknowledge of the area.

The system uses toll roads, motorwaysand ferries even though I chose to avoidthemFor technical reasons, the system can onlyuse major roads when calculating a route out-line extending over a long distance.

If you selected to avoid toll roads and motor-ways, then they are avoided to the greatestpossible extent and are only used if there isno other reasonable alternative available.

The position of the car on the map isincorrect after transportationIf the car is transported, for example by ferryor train, or in such a way as to impede thereception of GPS signals, it can take up to5 minutes before the position of the car iscorrectly calculated.

The position of the car on the map isincorrect after the car battery has beendisconnectedIf power has been cut from the GPS antenna,it can take more than 5 minutes for the GPSsignals to be received correctly and the posi-tion of the car to be calculated.

In addition to the GPS receiver, the car'sspeed sensor and a gyro assist in calculatingthe current position and direction of travel ofthe car. After fitting the spare wheel or chang-ing between summer and winter tyres thesystem needs to "learn" the size of the newwheels.

In order for the system to work optimally it isrecommended to turn the steering wheel to

full lock a few times while driving, in a suita-ble location.

The map image does not correspondwith the real situationFactors such as the constant expansion andrebuilding of the road network, new trafficregulations constantly being introduced etc.mean that the map database is not alwayscomplete.

Continuous development and updating ofmap data is underway - a Volvo dealer canprovide more information.

The scale of the map sometimeschangesThere is no detailed map information in cer-tain areas. The system then automaticallychanges the degree of magnification.

The expected menu option is missingCheck the settings that have been made.Select Reset navigation settings to restorethe original settings.

Switch off both the system and the engine.Start again, but remain stationary for a whilebefore starting to drive.

THIS IS A LICENSE AGREEMENT - AND NOTAN AGREEMENT FOR SALE – BETWEENYOU AND NAVTEQ EUROPE B.V. FOR YOURCOPY OF THE NAVTEQ NAVIGABLE MAPDATABASE, INCLUDING ASSOCIATEDCOMPUTER SOFTWARE, MEDIA ANDEXPLANATORY PRINTED DOCUMENTATIONPUBLISHED BY NAVTEQ (JOINTLY "THEDATABASE"). BY USING THE DATABASE,YOU ACCEPT AND AGREE TO ALL TERMSAND CONDITIONS OF THIS END USERLICENSE AGREEMENT ("AGREEMENT"). IFYOU DO NOT AGREE TO THE TERMS OFTHIS AGREEMENT, PROMPTLY RETURNTHE DATABASE, ALONG WITH ALL OTHERACCOMPANYING ITEMS, TO YOUR SUP-PLIER FOR A REFUND.

OWNERSHIPThe Database and the copyrights and intel-lectual property or neighbouring rights thereinare owned by NAVTEQ or its licensors. Own-ership of the media on which the Database iscontained is retained by NAVTEQ and/or yoursupplier until after you have paid in full anyamounts due to NAVTEQ and/or your supplierpursuant to this Agreement or similar agree-

ment(s) under which goods are provided toyou.

LICENSE GRANTNAVTEQ grants you a non-exclusive licenseto use the Database for your personal use or,if applicable, for use in your business' internaloperations. This license does not include theright to grant sub-licenses.

LIMITATIONS ON USEThe Database is restricted for use in the spe-cific system for which it was created. Exceptto the extent explicitly permitted by manda-tory laws (e.g. national laws based on theEuropean Software Directive (91/250) and theDatabase Directive (96/9)), you may notextract or reutilise substantial parts of thecontents of the Database nor reproduce,copy, modify, adapt, translate, disassemble,decompile, reverse engineer any portion ofthe Database. If you wish to obtain interoper-ability information as meant in (the nationallaws based on) the European Software Direc-tive, you shall grant NAVTEQ reasonableopportunity to provide said information onreasonable terms, including costs, to bedetermined by NAVTEQ.

TRANSFER OF LICENSEYou may not transfer the Database to thirdparties, except when installed in the systemfor which it was created or when you do not

retain any copy of the Database, and provi-ded that the transferee agrees to all termsand conditions of this Agreement and con-firms this in writing to NAVTEQ. Multi-discsets may only be transferred or sold as acomplete set as provided by NAVTEQ andnot as subset thereof.

LIMITED WARRANTYNAVTEQ warrants that, subject to the warn-ings set out below, for a period of 12 monthsafter acquisition of your copy of the Data-base, it will perform substantially in accord-ance with NAVTEQ's Criteria for Accuracyand Completeness existing on the date youacquired the Database; these criteria areavailable from NAVTEQ at your request. If theDatabase does not perform in accordancewith this limited warranty, NAVTEQ will usereasonable efforts to repair or replace yournon-conforming copy of the Database. Ifthese efforts do not lead to performance ofthe Database in accordance with the warran-ties set out herein, you will have the option toeither receive a reasonable refund of the priceyou paid for the Database or to rescind thisAgreement. This shall be NAVTEQ's entire lia-bility and your sole remedy against NAVTEQ.Except as expressly provided in this section,NAVTEQ does not warrant nor make any rep-resentations regarding the use of results ofthe use of the Database in terms of its cor-

rectness, accuracy, reliability, or otherwise.NAVTEQ does not warrant that the Databaseis or will be error free. No oral or written infor-mation or advice provided by NAVTEQ, yoursupplier or any other person shall create awarranty or in any way increase the scope ofthe limited warranty described above. Thelimited warranty set forth in this Agreementdoes not affect or prejudice any statutorylegal rights that you may have under the legalwarranty against hidden defects.

If you did not acquire the Database fromNAVTEQ directly, you may have statutoryrights against the person from whom youhave acquired the Database in addition to therights granted by NAVTEQ hereunder accord-ing to the law of your jurisdiction. The abovewarranty of NAVTEQ shall not affect suchstatutory rights and you may assert suchrights in addition to the warranty rights gran-ted herein.

LIMITATION OF LIABILITYThe price of the Database does not includeany consideration for assumption of risk ofconsequential, indirect or unlimited directdamages which may arise in connection withyour use of the Database. Accordingly, in noevent shall NAVTEQ be liable for any conse-quential or indirect damages, including with-out limitation, loss of revenue, data, or use,

incurred by you or any third party arising outof your use of the Database, whether in anaction in contract or tort or based on a war-ranty, even if NAVTEQ has been advised ofthe possibility of such damages. In any eventNAVTEQ's liability for direct damages is lim-ited to the price of your copy of the Database.

THE LIMITED WARRANTY AND LIMITATIONOF LIABILITY, SET FORTH IN THIS AGREE-MENT, DO NOT AFFECT OR PREJUDICEYOUR STATUTORY RIGHTS WHERE YOUHAVE ACQUIRED THE DATABASE OTHER-WISE THAN IN THE COURSE OF A BUSI-NESS.

WARNINGSThe Database may contain inaccurate orincomplete information due to the passage oftime, changing circumstances, sources usedand the nature of collecting comprehensivegeographic data, any of which may lead toincorrect results. The Database does notinclude or reflect information on - inter alia -neighbourhood safety; law enforcement;emergency assistance; construction work;road or lane closures; vehicle or speedrestrictions; road slope or grade; bridgeheight, weight or other limits; road or trafficconditions; special events; traffic congestion;or travel time.

GOVERNING LAWThis Agreement shall be governed by thelaws of the jurisdiction, in which you reside atthe date of acquisition of the Database.Should you at that moment reside outside theEuropean Union or Switzerland, the law of thejurisdiction within the European Union orSwitzerland where you acquired the Databaseshall apply. In all other cases, or if the juris-diction where you acquired the Databasecannot be defined, the laws of the Nether-lands shall apply. The courts competent atyour place of residence at the time youacquired the Database shall have jurisdictionover any dispute arising out of, or relating tothis Agreement, without prejudice to NAV-TEQ's right to bring claims at your then cur-rent place of residence.
