    Variance three is a 144-ft. vari-ance in setback from the ordinaryhwy water level (OHWL) of BriggsCreek North to build the driveway(required setback is 200-ft.).

    Variance four is a 149.97-ft. vari-ance in setback from the (OHWL) ofBriggs Creek North to construct anew residence (required setback is200-ft.).

    Variance five is a 147.47-ft. vari-ance in setback from the (OHWL) ofBriggs Creek South to construct anew residence (required setback is200-ft.).

    The Palmer supervisors re-viewed an overhead that detailed theproposed area dimensions, placementand descriptions of the intent for thevariances. The property has twocreeks to the south and north of theproperty and Briggs Lake to the west.

    Chris Perkins said he has beenworking with surveyors, the DNRand contractors to finalize the plansand move towards construction andhoped the board would okay his vari-ances so he could bring the matter tothe county in the next step of theprocess.

    Supervisor Steve Demeules im-mediately stated he had major issueswith the whole plan and was con-cerned about the grade on the prop-erty which would cause certain runoffonto roads, into creeks and into thelake.

    The whole thing is non-con-forming, he said.

    Perkins argued that he got okaysfrom the DNR and county officials,saying they were 100% confident hewould be able to put a house on thatproperty.

    Demeules argued the last letterhe read from the DNR cautioned thetownship on moving forward. He also

    questioned Perkins on how he was toget the grading up in order to hinderobvious runoff into the creek.

    Perkins said he planned to bringin approximately 1,500 yards of cubicfill to achieve it.

    Demeules and the board balkedat that idea since that would mean theroads would take the brunt of thatprocedure with several truckloadsgoing in and out of the propertywould be necessary.

    The board opened the floor toconcerned neighbors who were inabundance at Mondays meeting tobend the boards ear.

    Charlene Langowski expressedher concerns including the realizationthat she once worked with the DNRand she said they were always warnedto never spray near the trout stream(Briggs Creek) because they werevery protective of the fish and theirhabitat there. So, Langowski said shewould be very surprised to hear theDNR was being lenient to thePerkinses and their encroachments.

    She also pointed out that all theareas around the lakes and streamssuffer from occasional flooding andshe wondered where all that runoffwill spill into and how much moreflooding it will cause.

    Rick Peyton said he is Perkinsnorthern neighbor and is concernedfor the flooding as well and cautionedthat he didnt think 1,500 not even5,000 yards of cubic fill will keepthe property and neighboring proper-ties from flooding.

    Margo Josewski said she may beone of those neighboring propertieswho will be affected by the proposedPerkins home. She stated that she andhe r husband followed the ruleswhen they built their property yearsago and she feels anyone who buildsin the area should abide by the rulestoo.

    After several others spoke inprotest of the new home build theboard supervisors gave their twocents all in opposition. AttorneyDavid Meyer pointed out variances

    are usually discussed and taken intoconsideration when there is a hard-ship associated with the situation.

    I dont really see this situationas a hardship, he said.

    The most important thing for usto do is to protect our waters and wet-lands, said Chairman Mike Ganz.These requests to me are not con-vincing hardships.

    With that, Demeules motioned todeny all six variances and the boardconcurred. Their comments and rea-sons for denial will now be sent to thecounty for them to take into consid-eration when they make reviewPerkins claim in March.

    Sheriffs ReportSgt. Andy Oakes of the Sher-

    burne County Sheriffs Dept. said 83calls for service came into their sta-tion in regards to Palmer Townshipactivity.A few were traffic, four werecrashes and there were also a coupleATV and snowmobile citationshanded out, he said.

    Fire Dept. ReportFire Chief Ron Koren said he re-

    ceived 16 calls for service includingthree medicals and one auto accidentsituation.

    The Clearwater City Council last week made its firstdecision under its new tree ordinance by voting to reim-burse a homeowner for trees that were removed during aroad project.

    Last summer, Walnut Street resident Dan Niehoff re-quested compensation for four trees that were cut downon his property during the Northeast Area Street and Util-ity Improvement Project.

    At the time, the city had no history of reimbursingproperty owners for trees, nor was there any written pol-icy to follow.

    The council discussed its options, including reim-bursement and setting monetary limits. Later in 2015 thecouncil adopted an ordinance covering how the city coulddeal with the issue.

    In that ordinance, the council could reimburse coststhe homeowner presented to the council; set its own costs;or do nothing at all to compensate the property owner.

    Last week the council chose to reimburse Niehoff,who had gotten quotes from two different tree specialists.

    Administrator Kevin Kress said the trees that hadbeen removed from Niehoffs property were ash trees. Hewas asking to replace them with two 8 diameter mapletrees, one 4 maple tree and one 2 maple tree.

    Hes asking for maple, which is more consistentwith the ordinance, which asks that we put somethingback thats a hearty species, said Kress.

    The two quotes were almost identical. Tri-Co TreeRemovers quoted $3,156.88, including tax. JK Landscap-ing quoted $3,160.

    Members of the council didnt dispute the cost.Mayor Pete Edmonson asked whether the council wanteda third quote, but they declined.

    Id like to get this over with, said Councilman Rol-

    lie Lange. Hes been waiting for months.Im comfortable with two quotes, said Councilman

    Chris Ritzer.Then the council had to decide whether to purchase

    the trees and save the sales tax, or have Niehoff buy thetrees and get reimbursed.

    Councilman Mike Ranum wanted Niehoff to be re-sponsible for the trees.

    If we pay for the trees and if one of the trees dies,then we have to deal with the warranty part of that, hesaid. If he buys them, he has to deal with that. Then ourliability is over. Were done.

    The council voted to reimburse Niehoff for purchas-ing the trees from Tri-Co Tree Removers.

    Computer UpgradesThe council approved a contract with Now IT Con-

    nects to improve the efficiency, security and storage ca-pacity of citys computer server at a cost of $1,010.50plus $125 per month in service.

    The council also voted to cancel the citys con-tract with Minco for similar services.

    Other BusinessIn other action the council:

    Appointed Richard Petty, Vern Scott and AndreaLawrence to the park commission and appointed Coun-cilman Kris Crandall as the councils non-voting liaison.

    Approved placing a portable toilet near the hickeyrink in Lions Park.

    Approved a step wage increase for James Kirchen-bauer of the maintenance department to $18.76 effectiveFeb. 10;

    Approved a transfer of $30,000 into the fire capitalequipment fund to increase the budget to $220,860 andkeep the fire contract consistent with prior years.
