Introduction to Greater Bunbury Region Scheme major amendments

The Greater Bunbury Region Scheme (GBRS) sets out the broad pattern of land use for thewhole Greater Bunbury region.

The Western Australian Planning Commission (WAPC) is responsible for keeping the GBRSunder review and initiating changes to best reflect regional planning and development needswhere they are seen as necessary.

An amendment proposal to change land use reservations and zones in the GBRS isregulated by the Planning and Development Act 2005. That legislation provides for publicsubmissions to be made on proposed amendments.

For a substantial amendment, often referred to as a major amendment (made under section41 of the Act), the WAPC considers all the submissions lodged, and publishes itsrecommendations in a report on submissions. This report is presented to the Minister forPlanning and to the Governor for approval. Both Houses of Parliament must then scrutinisethe amendment before it can take legal effect.

In the process of making a substantial amendment to the GBRS, information is published asa public record under the following titles:

Amendment reportThis document is available from the start of the public advertising period of the proposedamendment. It sets out the purpose and scope of the proposal, explains why theamendment is considered necessary, and informs people how they can comment throughthe submission process.

Environmental review reportThe Environmental Protection Authority must consider the environmental impact of anamendment to the GBRS before it can be advertised. Should it require formal assessment,an environmental review is undertaken and made available for information and comment atthe same time as the amendment report.

Report on submissionsThe planning rationale, determination of submissions and the WAPC's recommendations forfinal approval of the amendment, with or without modification, is documented in this report.

SubmissionsThis document contains a reproduction of all written submissions received by the WAPC onthe proposed amendment.

Transcript of hearingsA person who has made a written submission may also choose to appear before a hearingscommittee to express their views. Should a hearing be required, the hearings proceedingsare recorded and transcribed, and the transcripts of any public hearings are reproduced inthis volume.

AMENDMENT 0003/41 TO THE GREATER BUNBURY REGION SCHEME

WATERLOO BRICKWORKS

REPORT ON SUBMISSIONS

1. INTRODUCTION

At its meeting on 21 November 2008 the Western Australian Planning Commission (WAPC)resolved to proceed with Amendment 0003/41 to the Greater Bunbury Region Scheme(GBRS) in accordance with the provisions of Section 41 of the Planning and DevelopmentAct 2005.

2. THE PROPOSED AMENDMENT

Purpose

The purpose of the amendment is to transfer portions of Lot 25 Railway Road and Lot 26Waterloo Road, Waterloo, shown in Schedule 3 of this report from Rural zoning to Industrialzoning. The lots abut the existing Waterloo Brickworks, and the intent of the amendment isto facilitate the proposed upgrade and expansion of the brickworks.

The land area proposed to be rezoned is made up of a 24.45 ha portion of Lot 25 RailwayRoad and a 19.76 ha portion of Lot 26 Waterloo Road (total land area to be rezoned44.21ha).

Background

The subject land comprises portion of Lot 25 Railway Road and Lot 26 Waterloo Road,Waterloo and is located approximately 12 kilometres east of the Bunbury city centre and 4kilometres south-west of the Burekup townsite.

The land subject of the proposed amendment abuts the existing Waterloo Brickworks whichhas been operational for at least 40 years. Austral Bricks is seeking to replace the existingbrickworks located on Lot 1 Railway Road and Lots 3 and 4 Waterloo Road, Waterloo with amodern brick manufacturing plant.

The Shire of Dardanup resolved to initiate an amendment to Town Planning Scheme No. 3to implement the required rezoning to facilitate the replacement and expansion of theWaterloo Brickworks on 13 July 2006.

The Environmental Protection Authority (EPA) reviewed the proposed amendment and setthe level of assessment as "Scheme Amendment Not Assessed",

The amendment to the Shire of Dardanup Town Planning Scheme No. 3, was submitted tothe Western Australian Planning Commission (WAPC) for final approval on 1 November2007. The Greater Bunbury Region Scheme (GBRS) came into effect on 29 November2007. The requirements of the Planning and Development Act 2005 prevent the Ministerfrom approving an amendment to a local planning scheme that is inconsistent with a regionscheme, and as such an amendment to the GBRS is required.

Discussion

The Waterloo Brickworks, located on the corner of Waterloo and Railway Roads, Waterloo,has been in operation for more than 40 years. The existing brickworks provides buildingproducts for the local construction industry. Additionally clay is sourced from deposits thatexist in the area.

It is estimated that the population of the Greater Bunbury area will exceed 100,000 by 2031.This increase in population will result in a proportionate increase in the demand for housingconstruction and therefore building products.

An upgrade and expansion of the existing brickworks has been proposed. The key featuresof the proposed brick manufacturing plant are as follows:

o capacity to increase output from the current production levels of 4 million bricks peryear to 75 million bricks per year;

o reduced environmental impact compared with the existing plant, by using natural gasfiring and latest gas scrubber technology;

o replacement of the existing buildings and infrastructure; ando increasing the size of the existing product display yard and sales office/brickmart.

The proposal is subject to environmental assessment in respect to the amendment and aspart of the Works Approval required by the Environmental Protection Act 1986. Factorsconsidered in the environmental assessment include:

o flora and fauna;o wetlands;o acid sulfate soils;

noise;stormwater management;

o dust management;o air emission management; ando odour management.

The application for works approval has been lodged with the Department of Environmentand Conservation and is waiting approval.

An amendment to the GBRS is required to facilitate the expansion and upgrade of thebrickworks as the land subject of this amendment is currently zoned Rural under theprovisions of the GBRS, and as such an industrial use, such as a brickworks, would beinconsistent with the purpose of the rural zoning.

3. ENVIRONMENTAL PROTECTION AUTHORITY ADVICE

The proposed amendment was referred to the Environmental Protection Authority (EPA) foradvice as to whether environmental assessment would be required.

The EPA has advised that the proposed amendment does not require formal assessmentunder Part IV of the Environmental Protection Act 1986. A copy of the notice from the EPA ispublished in the WAPC amendment report.

4. CALL FOR SUBMISSIONS

The proposed amendment was advertised in the Government Gazette and remained openfor public submissions from 27 March 2009 until 26 June 2009, a period exceeding threemonths.

The proposed amendment was made available for public inspection during ordinarybusiness hours at:

i) Department for Planning and Infrastructure, 469 Wellington Street, Perth.

ii) Department for Planning and Infrastructure, 61 Victoria Street, Bunbury.

iii) the municipal offices of the City of Bunbury, Shires of Capel, Dardanup andHarvey.

iv) State Reference Library, Northbridge.

During the public inspection period, notice of the amendment was published in The WestAustralian and The Sunday Times newspapers and relevant local newspapers circulating inthe locality of the amendment.

All of the owners of land, the subject of and surrounding the proposed amendment, wereforwarded a copy of the amendment report and advised of the opportunity and procedure formaking submissions.

5. SUBMISSIONS AND HEARINGS

Six submissions on the amendment were received. An alphabetical ndex of all the personsand organisations that lodged submissions is at Schedule 1.

All submissions supported or had no objections to the amendment.

A summary of each submission with WAPC comments and determinations is at Schedule 2A complete copy of all written submissions is also contained in this publication.

6. MAIN ISSUES RAISED IN SUBMISSIONS

All submissions received were from government agencies or infrastructure providers.Submissions of no objection or comment on the proposal were received from the WestNetEnergy (Submission 1) Main Roads Western Australia (Submission 2), Department ofEnvironment and Conservation (Submission 3), Department of Mines and Petroleum(Submission 4), Water Corporation (Submission 5) and Department of Agriculture and FoodWestern Australia (Submission 6).

The submissions are summarised in Schedule 2. Some of the submissions also provideadvice regarding matters which should be considered in the implementation phase.

Response

These comments have been noted and can be considered when more detailed planningprocesses are undertaken, at the time of any development applications.

7. HEARINGS

The Planning and Development Act 2005 provides that where a submission contains anobjection to an amendment, the WAPC is required to offer the person making thesubmission the opportunity of being heard by a committee formed by the WAPC for thatpurpose.

However in this case, as no objections were received, no hearings were requested and assuch were not required.

8. DETERMINATIONS

The determinations on the individual submissions are contained in Schedule 2.

9. CONCLUSION AND RECOMMENDATION

This report summarises the history and background to Amendment No. 0003/41 andexamines the various submissions made. The Western Australian Planning Commissionthanks all those who made submissions.

After considering the submissions, the Western Australian Planning Commission is satisfiedthat the amendment as shown generally on Figure 1 (Schedule 1) and in detail on GBRSAmendment Plan No. 3.2303 should be approved and finalised.

Having regard to the above, the WAPC recommends that the Minister for Planning presentthe amendment to His Excellency the Governor for his consideration and approval andsubsequently commend the amendment to both Houses of Parliament.

I refer to your letter of 30 March 2009 and advise that the Water Corporation has noobjection to the proposed amendment subject to the following.

A rural drain maintained by the Water Corporation exists within the land parcel. Thechange of land use will result in this drain no longer serving a rural land use for themost upstream portion of the drain which is within the development. As such theWater Corporation will no longer have a mandate to operate and maintain the drain.

The Corporation requests that a requirement of the proposed Amendment 0003/41 bethat the developer shall either

o Decommission the section of drain within the land parcel to the satisfaction ofthe Water Corporation or

o Modify or redevelop the drain for internal drainage purposes with any off sitedischarge to the Water Corporation rural drainage network requiring WaterCorporation written approval. Such discharge, should it be necessary, shall notexceed pre-development quantity and flow rate, nor will it cause deteriorationof pre-development water quality in any form.

COMMENT: GBRS AMENDMENT 3/41 WATERLOO RURAL TO INDUSTRIALPORTIONS OF LOT 25 RAILWAY RD AND LOT 26 WATERLOO RD, WATERLOO

Thank you for the opportunity to comment on the proposed rezoning of the abovementionedlots in the Shire of Dardanup from "Rural"to "Industrial".

The Department of Agriculture and Food (DAFWA) supports the proposed rezoning inprinciple, but recommends the following issues in relation to the rezoning should beconsidered:

o DAFWA recommends that the remainder of lots 25 and 26 he amalgamated into one lot.This will create a larger lot which is more appropriate for the "Rural"zoning and It will alsodiscourage the possibility of two small lifestyle lots between to the "Rural" and "Industrial'zone. If the remainder of the lots are not amalgamated and it is then primarily used aslifestyle lots it will significantly increase the potential for land use conflict with both theadjoining "Rural"and "Industrial' land.

o Any changed land use on agricultural land needs to include buffers on the re-zoned landto minimise land use conflict. To ensure agricultural operations on land next to re-zonedareas are not restricted, DAFWA recommends minimum setbacks/buffers of 500 metres,be incorporated into re-zoned areas in accordance with the EPA guidelines: SeparationDistances between Industrial and Sensitive Land Uses. These guidelines set outminimum separation distances for a range of agricultural activities including marketgardens, orchards and dairies and are available on the EPA's website atwww.epa.wa.gov.au/docs/1840 GS3.pdf
