APPLICABILITY

The following warranties apply only to U.S. and Canadian specification Fisker Karma vehicles registered and normally operated in the U.S. and Canada. This warranty is provided to the original and any subsequent owners of the vehicle during the warranty period.

START OF THE WARRANTY PERIOD

Warranty coverage begins on the in-service date, which is the earlier of (i) the date of delivery to the first retail purchaser or lessee or (ii) the date the vehicle is first placed in service, including as a demonstrator or company vehicle.

OBTAINING WARRANTY REPAIRS

To obtain service under this warranty for covered repairs, the vehicle must be brought to an authorized Fisker Retailer promptly upon discovery of a defect in material or workmanship. Only an authorized Fisker Retailer may perform warranty work. For covered repairs, Fisker will make required adjustments, repairs or replacements (at its sole option) free of charge for parts and labor, using genuine Fisker or Fisker-approved new, remanufactured or reconditioned parts. In the event the high voltage battery must be replaced under this warranty, Fisker will replace it with a new or factory reconditioned battery with an energy capacity (kWh storage) level at or above that of the original battery prior to the failure. The decision whether a part should be repaired or replaced will be made by the servicing Fisker Retailer. Parts scheduled to be replaced as required maintenance are warranted until their first replacement only.

All parts replaced under this warranty shall become property of Fisker. Any parts repaired or replaced under this warranty are covered only for the remainder of this warranty. Fisker remanufactured parts meet or exceed all factory standards for safety, quality and reliability. Fisker supports the capture, purification and reuse of automotive air conditioning refrigerant and cooling system fluids (coolant). As a result, any repairs performed that require the replacement of such fluids will be completed using recycled or reclaimed refrigerant and coolant where applicable.

LIMITATIONS AND DISCLAIMERS

THE WRITTEN WARRANTIES PROVIDED HEREIN ARE EXCLUSIVE AND ARE PROVIDED IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED. THE PERFORMANCE OF NECESSARY REPAIRS AND ADJUSTMENTS IS THE EXCLUSIVE REMEDY UNDER THESE WARRANTIES. FISKER DOES NOT ASSUME, AND DOES NOT AUTHORIZE ANY PERSON TO ASSUME ON ITS BEHALF, ANY OTHER WARRANTY, OBLIGATION OR LIABILITY.

THE DURATION OF ANY IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, IS LIMITED TO THE DURATION OF THE EXPRESS WARRANTIES HEREIN. FISKER HEREBY EXPRESSLY EXCLUDES AND DISCLAIMS INCIDENTAL, SPECIAL AND CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF TIME, INCONVENIENCE, LOST PROFITS OR EARNINGS, LOSS OF USE OF THE VEHICLE OR OUT-OF-POCKET EXPENSES FOR TRANSPORTATION OR LODGING, FOR ANY BREACH OF ANY EXPRESS OR IMPLIED WARRANTY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, APPLICABLE TO THIS PRODUCT.

Some states (or provinces) do not permit a limitation on how long an implied warranty lasts, or on the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to the owner. This warranty gives you specific legal rights, and you may also have other rights that vary from state to state (or province to province).

PAINT, TRIM AND GENERAL APPEARANCE ITEMS

Defects in paint, trim, upholstery or other appearance items are normally corrected during new vehicle preparation. If you find any paint or appearance concerns, you must advise an authorized Fisker Retailer as soon as possible. The Owner's Manual has instructions regarding the care of these items. This warranty does not cover damage caused by outside influence, such as stone chips, gravel, nicks, or dents; environmental influences such as acid rain, road salt, or industrial fallout; normal deterioration such as fading, discoloration, or loss of luster; or lack of maintenance, excessive rubbing, and use of improper cleaners, polishes or waxes.

Note: This warranty excludes the cost of painting the entire vehicle solely for paint matching.

What Is Covered

5

What Is CoveredBASIC NEW VEHICLE LIMITED WARRANTY

The Fisker Basic New Vehicle Limited Warranty covers repairs necessary to correct manufacturer defects in material or workmanship under normal use for a period of fifty (50) months from the in-service date or 50,000 miles (80,000 kilometers), whichever first occurs, except for items or exclusions listed under the heading What Is Not Covered.

GENUINE FISKER PARTS AND ACCESSORIES LIMITED WARRANTY

Fisker warrants that every new or remanufactured part (assembly or component) that is manufactured or distributed by Fisker and not originally factory-installed in a new Fisker vehicle, will be free from defects in material and workmanship under normal use for twenty four (24) months from the date of installation or purchase, whichever is earlier, regardless of mileage, except items listed under the heading What Is Not Covered.

WHEEL ALIGNMENT AND WHEEL BALANCING

Fisker will provide complimentary wheel alignment and wheel balancing once during the first twelve (12) months from the in-service date or 12,000 miles (20,000 kilometers), whichever first occurs, unless those adjustments are associated with a covered warranty repair.

CORROSION PERFORATION WARRANTY

The Fisker Basic New Vehicle Limited Warranty covers corrosion perforation of body sheet metal (i.e. corroded through from the inside out) for a period of six (6) years from the in-service date, regardless of mileage, except for items listed under the heading What Is Not Covered.

CHEMICAL PAINT SPOTTING

Some weather and atmospheric conditions can create chemical fallout. Airborne pollutants can fall upon and adhere to painted surfaces on your vehicle. This damage can take various forms, including blotchy, ring-shaped discolorations and small irregular dark spots etched into the paint surface. Although no defect in the factory applied paint causes this, Fisker will inspect and, if the fallout condition is determined (at Fisker's discretion) to be the result of normal fallout, Fisker will repair, free of charge, exterior painted surfaces damaged by this fallout condition within twelve (12) months from the in-service date or 12,000 miles (20,000 kilometers), whichever first occurs.

SAFETY BELTS - KANSAS

Generally, safety belts are covered for defects in material or workmanship by the Fisker Basic New Vehicle Limited Warranty Coverage. However, Fisker vehicles first sold or registered in Kansas and safety belts sold and installed in vehicles registered in Kansas are covered for defects in material and workmanship for ten (10) years from the in-service date, regardless of mileage with the exception of:

FEDERAL EMISSIONS PERFORMANCE WARRANTY

Under the Federal Emissions Performance Warranty, Fisker will repair, replace, or adjust, with no charge for labor, diagnosis, or parts, any emissions control device or system, if you meet all of the following conditions:

• Your vehicle fails to conform, during the warranty coverage period, to applicable emission inspection standards as determined by an EPA/CEPA Approved State Inspection and Maintenance Test (United States)/Smog Check inspection adopted by Environment Canada or any Canadian province (Canada); and

• The failure of the Inspection and Maintenance Test requires the vehicle owner to bear any penalty or other sanction, including the denial of the right to use the vehicle under local, state/provincial, or federal law; and

• The vehicle has been maintained and operated in accordance with Fisker Automotive instructions for proper maintenance and use; and

• Your vehicle has not been misused, abused, or tampered with.

The warranty coverage period for the Federal Emission Performance Warranty is eight (8) years from the in-service date or 80,000 miles (128,000 kilometers), whichever first occurs, for the catalytic converter, electronic emission control unit (ECU), transmission control module (TCM), and any other onboard emissions diagnostic module, and two (2) years from the in-service date or 24,000 miles (39,000 kilometers), whichever first occurs, for all other covered parts (see 2/24 Parts List).

PERFORMANCE WARRANTY CLAIMS PROCEDURE

You may make a claim under the Federal Emission Performance Warranty immediately after the failure of an EPA-approved emissions test. You must provide proof of this failure when making your claim. Fisker will advise you whether it will honor your claim within 30 days of the date you make the claim (unless a shorter time period is required by law). If your claim is denied, Fisker will notify you in writing of the reason. If Fisker does not notify you within this time period, Fisker will repair your vehicle under this warranty at no cost to you. The time period for notification will not apply if you request a delay or if a delay is caused by events not under the control of Fisker or Fisker Retailers.

No claim under the Performance Warranty will be denied solely on the basis of use of a properly installed EPA certified emission part for maintenance or repair. Fisker may deny a claim under this warranty on the basis of an uncertified replacement part used in maintenance or repair of a vehicle only if the vehicle manufacturer presents evidence that the uncertified replacement part is either defective in materials or workmanship or not equivalent from an emission standpoint to the original equipment part.

ADDITIONAL GENERAL WARRANTY INFORMATION

Proper maintenance and useInstructions for proper maintenance are contained within this Fisker Warranty and Service Booklet. If you perform the maintenance yourself, keep all documentation as proof you have performed the maintenance at the approximate time or mileage/kilometers intervals recommended, that you have used proper parts, and that you were able to perform the maintenance properly.

Failure to maintain your vehicle according to the instructions for proper maintenance may cause the vehicle to exceed applicable emissions standards and could result in denial of warranty coverage. However, Fisker will not deny a warranty claim solely on the basis of your failure to maintain the vehicle according to the instructions or failure to keep a record of maintenance. Instructions for proper maintenance of the vehicle are contained within this Fisker Warranty and Service Booklet.

Use of Fisker genuine partsFisker recommends that Fisker Genuine Parts be used as replacement parts for the maintenance, repair or replacement of emission control systems. Use of replacement parts that are not equivalent to Fisker Genuine Parts in emission performance and durability may impair the effectiveness of emission control systems. Although use of parts other than Fisker Genuine Parts does not invalidate these warranties, Fisker assumes no liability under these warranties for failure of such parts and damage to other parts caused by such failure.

United States EPA certified replacement partsMaintenance, repair, or replacement of emission control devices and systems may be performed by any automotive service and repair establishment or qualified individual using U.S. Environmental Protection Agency certified replacement parts.

Maintenance and repairs performed by independent service shopsWithout invalidating these warranties, you may choose to have maintenance, repair or replacement of emission control components performed by any automotive service establishment or individual qualified to perform such services. However, the cost of such services is not covered by these warranties except in emergencies. If the independent service establishment finds a warrantable defect, you may deliver the vehicle to an authorized Fisker Retailer and have the defect corrected free of charge. Fisker will not be liable for any expenses, which you have incurred at the independent service establishment, except for emergency repairs. See EMERGENCY REPAIRS for further details.

13

EMERGENCY REPAIRS

Emergency repairs performed by a non-authorized service facility will be reimbursed if the repair work was needed and correctly performed, and it was impossible or unreasonable under the circumstances to tow or drive your Fisker to the nearest authorized Fisker Retailer. The maximum reimbursement allowable is an amount equal to the cost if your authorized Fisker Retailer had completed the repair(s). Reimbursement will be considered when you submit the following items to your authorized Fisker Retailer:

• A statement explaining the circumstances that prevented you from getting to an authorized Fisker Retailer

• Paid receipt(s)

• Repair order(s)

• Part(s) removed from your Fisker

IF YOUR VEHICLE FAILS AN EMISSIONS TEST

If your vehicle fails an EPA-approved emissions test, you may make a claim under the Emission Performance Warranty. To do so, take your vehicle to an authorized Fisker Retailer and present a copy of the emissions test report. Also, take your maintenance records in case they are needed. If your claim qualifies for coverage, the Fisker Retailer will repair your vehicle within 30 days (unless a shorter period is required by law). If your claim is denied, the Fisker Retailer will notify you in writing of the reason within the same period. The only exceptions allowed are when you request or agree to a delay, or when a delay is caused by factors beyond the control of Fisker or the Fisker Retailer.

California Vehicle Emission Control Warranties

California Vehicle Emission Control WarrantiesYOUR RIGHTS AND OBLIGATIONS

The California Air Resources Board and Fisker Automotive, Inc. are pleased to explain the emission control system warranty on your Fisker vehicle. In California, new motor vehicles must be designed, built, and equipped to meet the state's stringent anti-smog standards. Fisker must warrant the emission control system on your vehicle for the periods of time listed, provided there has been no abuse, neglect or improper maintenance of your vehicle.

Your emission control system may include parts such as the fuel-injection system, the ignition system, catalytic converter, and engine computer. Also included may be hoses, belts, connectors and other emission-related assemblies. Where a warrantable condition exits, Fisker will repair your vehicle at no cost to you, including diagnosis, parts, and labor.

MANUFACTURER'S WARRANTY COVERAGE

For three (3) years or 50,000 miles, whichever first occurs:

• If your vehicle fails a Smog Check inspection, all necessary repairs and adjustments will be made by Fisker to ensure that your vehicle passes the inspection. This is your Emission Control System Performance Warranty.

• If any emission-related part on your vehicle is defective, the part will be repaired or replaced by Fisker. This is your short-term Emission Control System Defects Warranty.

For seven (7) years or 70,000 miles, whichever first occurs:

• If an emissions-related part listed under the heading 7 year/70,000 mile California long-term defect parts list is defective, the part will be repaired or replaced by Fisker.

This is your long-term Emission Control System Defects Warranty.

OWNER'S WARRANTY RESPONSIBILITIES

As the vehicle owner, you are responsible for the performance of the required maintenance listed in the service section of the Warranty and Service Booklet. Fisker recommends that you retain all receipts covering maintenance on your vehicle, but Fisker cannot deny warranty coverage solely for the lack of receipts or for your failure to ensure the performance of all scheduled maintenance.

You are responsible for presenting your vehicle to an authorized Fisker Retailer as soon as a problem exists. The warranty repairs should be completed in a reasonable amount of time, not to exceed 30 days.

As the vehicle owner, you should also be aware that Fisker may deny you warranty coverage if your vehicle or a part has failed due to abuse, neglect, improper maintenance or unapproved modifications.

If you have any questions regarding your warranty rights and responsibilities, or if you want to report what you believe to be violations of the terms of this warranty, you may contact;

CALIFORNIA EMISSIONS CONTROL SYSTEM DEFECT WARRANTY

For three (3) years or 50,000 miles, whichever first occurs, Fisker warrants that the vehicle:

• Is designed, built and equipped to conform with all applicable California Air Resources Board (CARB) emissions standards, and

• Is free from defects in material and workmanship which may cause any part that can affect emissions to fail to conform with applicable CARB requirements or to fail a California Inspection and Maintenance (Smog Check) test for a period of three (3) years or 50,000 miles, whichever first occurs.

A warranted part is any part installed on a motor vehicle or motor vehicle engine by the vehicle or engine manufacturer, or installed in a warranty repair, which affects any regulated emission from a motor vehicle or engine that is subject to California emission standards.

The obligation of Fisker under this warranty is limited to the following: If within this period a defect in material or workmanship causes the vehicle to fail to conform with California regulations and the vehicle is brought to the workshop of any authorized Fisker Retailer in the United States, the Retailer will make repairs as may be required by these regulations free of charge.

This coverage may also be included in the fifty (50) months or 50,000 mile Fisker Basic New Vehicle Limited Warranty.

CALIFORNIA EMISSIONS PERFORMANCE WARRANTY

California maintains mandatory emissions Inspection and Maintenance (I/M) Program requiring motor vehicles to be tested at regular intervals. If your vehicle fails to pass an I/M test performed by a licensed I/M station pursuant to the California I/M Program within three (3) years or 50,000 miles, whichever first occurs, any authorized Fisker Retailer in the United States will perform free of charge any repairs necessary for the vehicle to pass the smog test.

After the three (3) year or 50,000 mile performance warranty has expired, an I/M test failure due to a defect in a part which is warranted for seven (7) years or 70,000 miles, whichever first occurs, is covered. Refer to 7 year/70,000 mile California long-term defect parts list for a list of covered components. These repairs include diagnosis, replacement, repair, and adjustments.

PERFORMANCE WARRANTY CLAIMS PROCEDURE

You may raise a claim under this warranty immediately after your vehicle has failed a California I/M test, if as a result of that failure you are required by law to repair the vehicle to avoid imposition of a penalty or cancellation of your right to use the vehicle. You need not actually suffer the loss or lose the right to use your vehicle or pay for the repair before presenting your claim.

Claims may be presented only by bringing your vehicle to any authorized Fisker Retailer in the United States. The Retailer will honor or deny your claim within a reasonable time, not to exceed 30 days, from the time at which your vehicle is presented for repair or within any time period specified by local, state, or federal law, whichever is shorter, except when a delay is caused by events not attributable to Fisker or the Retailer. If the Retailer denies your claim, you will be notified in writing of the reasons for rejecting the claim. If you do not receive notice of denial of your claim within the above time period, Fisker is required by law to honor the claim.

Under certain circumstances, your claim may be denied because you have failed to comply with instructions for scheduled maintenance contained in your Fisker Warranty and Service Booklet. In determining whether you have complied with the instructions for scheduled maintenance and proper use, Fisker may require you to furnish proof of compliance only with those maintenance instructions which Fisker has reason to believe were not performed and which could be the cause of the I/M Test failure.

Fisker may deny an emission performance warranty claim on the basis that a non-EPA certified replacement part was used in the maintenance or repair of the vehicle if Fisker can prove that the non-certified part is either defective in materials or workmanship, or not equivalent from an emission standpoint to the original part, and you are not able to offer information that the part is either not defective or equivalent to the original part with respect to its emission performance.

Fisker will not deny a claim relating to:

• Warranty work or pre-delivery service performed by an authorized Fisker Retailer, or

• Work performed in an emergency to rectify an unsafe condition attributable to Fisker, provided you have taken steps in a timely manner to put the vehicle back into a conforming condition, or

• The use of an uncertified part or to noncompliance with the instructions for proper maintenance and use, which is not related to the I/M Test failure.

Instructions for proper maintenance of the vehicle are contained within this Warranty and Service Booklet.

IF YOUR VEHICLE FAILS A SMOG-CHECK TEST

If your vehicle fails a smog-check test, you may make a claim under the Emission Performance Warranty.

State Warranty Enforcement Laws

19

State Warranty Enforcement Laws STATE WARRANTY ENFORCEMENT LAWS ("Lemon Laws")

State warranty enforcement laws, sometimes called lemon laws, allow owners to receive a replacement vehicle or a refund of the purchase price, under certain circumstances. The laws vary from state to state.

To the extent your state law allows, Fisker requires that you first send us a written notification of any defects or non-conformities that you have experienced with your vehicle. This will give us the opportunity to make any needed repairs before you pursue the remedies provided by your state's law.

In states where not specifically required by state law, Fisker requests that you give us the written notice.
