I, Tito Titus Mboweni, Minister of Finance, in my capacity as the Minister of Finance, hereby publish, in accordance with section 19,20 and 21 of the Division of Revenue Act, 2019 (Act No. 16 of 2019) as amended by the Division of Revenue Amendment Act, 2019 (Act NO.30 of 2019), the attached Explanatory Memorandum and Schedules:

(a) The stopping and re-allocations of conditional grants to municipalities made in terms of sections 19 and 20 of the Division of Revenue Act, as amended; and

(b) Technical adjustments on conditional allocations to municipalities.

For ease of reference only and where applicable, the attached Schedules reflect the main allocations, adjustments, and total adjusted allocations.

Explanatory Memorandum to the AUocations set out in the attached Schedu~e

This Gazette is published in terms of Section 26 of the Division of Revenue Act, 2019 (Act No. 16 of 2019) (DoRA), as amended by the Division of Revenue Amendment Act, 2019 (Act No.30 of 2019). Section 26 provides that any transfers not listed in the Schedules may only be made in terms of Section 6(3) which provides that additional allocations to provinces or municipalities may only be made in an adjustments budget and must comply with such monitoring and reporting requirements determined by the National Treasury. Further, Section 26 also requires that the National Treasury must publish such allocations in the Gazette, prior to the transfer of any funds to a province or municipality.

LOCAL GOVERNMENT

Stopping and Re=allocation of funds between municipalities

1. The stopping is done in terms of section 19 of DoRA against municipalities that reported significant under-performance and non-compliance against conditional grants frameworks and the provisions of the Act, however in some instances stopping is done against those municipalities that have voluntarily surrendered their portions of uncommitted funds against the 2019120 allocations.

2. These funds are being re-allocated to municipalities that have fast tracked the implementation of their projects and have accelerated expenditure against their original allocations and have the capacity to fully spend by 30 June 2020.

3. Only capital grants are being affected by the stopping and re-allocation namely, the Water Services Infrastructure Grant (58 and 68), Regional 8ulk Infrastructure Grant (58 and 68), Urban Settlements Development Grant, Integrated National Electrification Programme (58 and 68) Public Transport Network Grant, and Neighbourhood Development Partnership Grant (58 and 68).

4. The stopping has affected 47 municipalities against 96 municipalities that reflected underspending as at second quarter of the financial year across all provinces in order to curb possible under-spending. The reasons for underspending are non-appointment or late appointment of service providers, unavailability of houses to electrify, technical capacity to implement the projects and legal objections against appointed contractors.

5. This stopping however, does not imply that projects should stop, rather municipalities should reprioritize in order to accelerate on their committed projects. Only projects that are not ready for implementation in the current year are affected as funds transferred could be misused.
