95% of the employees in our eight County units received a salary increase of at least 3%!

These salary increases were negotiated by OCEA in 2007, when OCEA and the County reached two-year contracts for all eight of our County bargaining units.

Every employee in OCEA’s County bargaining units received a 2.5% base general wage increase on June 20, 2008. In addition, all employees in classifications other than the very highest paid classifications in the market (according to the County Compensation Survey) received an additional market increase on that day.

In short, all employees in our eight County units received a 2.5% general salary increase. For most employees, an additional market adjustment is added to that percentage!

(The foregoing applies only to our eight County units. In our three Court units, the 3% general salary increase negotiated by OCEA will go into effect on September 26, 2008.)

People who tell us “we’re okay financially” may have any number of basic premises which lead them to that conclusion. Usually, it all comes down to the person’s opinion, which isn’t really supported by anything other than their own personally-held beliefs. Fundamentally, these people are using faulty comparisons, which, in effect, tell us “things could be worse.”

I think we all understand that things could be worse. We get that. We are thankful for all the things we have. But for most of us, and for most of the middle class, we are not paid what we should be paid, when you consider our productivity.

People who say “we’re doing okay” tend to look at their own income, and they tend to say, “Look, I’m making more money each year! I’m even beating inflation!” Actually, the first part of that is true of a lot of people. But don’t jump on the bandwagon too quickly. In a vacuum, the fact that your pay is going up doesn’t mean much. That’s almost always been

the pattern. But this man here, and that woman there, claim that they are actually beating inflation!

But are they really? All they really say, usually, is that their pay level is growing faster than the rate of inflation.

There are several problems with this simplistic approach.

First, “beating inflation” doesn’t mean much, if you can’t afford childcare for your kids, if you’re putting off dental care, if you haven’t been to the movies in over a year, and if you only eat out once a month. It doesn’t mean much if you have to stint on Christmas presents again this year, you haven’t taken a trip in five years, and the dream of owning your own home is just that: a dream.

Secondly, you are not “beating inflation” if your increased pay is based on longer hours, higher-skilled work, or, in fact, anything other than the precise work you were formerly doing.

Are you getting paid more because you were promoted? Then it doesn’t matter if your salary doubled in one year because of that. You still are not beating inflation in any meaningful way. It’s like saying some distant cousin left you a bunch of money, and that allowed you to beat inflation, or that you sold a collection of rare books, and you added that money to your earnings, and (after that) you came out ahead of inflation.

Let’s keep it simple. As time goes on, you become more experienced, you gain more skills, and you develop smarter and

cheaper ways to accomplish more. Your wages have gone up because in essence you aren’t doing the same job! You are, in short, being more productive. You should be getting paid more, because you are producing more. When you ponder the job you are doing now, think about whether your increases in pay are commensurate with the increase in the benefit you provide to your employer. Of course, there are

exceptions, but this is often a pretty valid way of looking at things!

At OCEA, we are aware of all of this when we negotiate for salary increases. But remember, the negotiated salary increases are not “cost of living” increases. Bargaining is a complex process. The increases in the cost of living are a factor, of course, but many other factors play a part, including (for example) the salaries that are paid by competing jurisdictions, and even the fact that our MOUs are ultimately implemented only subject to approval by the public agency’s governing body.

When all the dust settles, we have always done the best we could for our members. But are you really beating inflation? Don’t be too quick to say, “Yes!”

Why Do Some People Keep Saying, “The Middle Class is Doing Great,” and “We’re Doing Better Than Ever”?

Alan Greenspan was chairman of the Board of Governors of the Federal Reserve of the United States, from 1987 to 2006. He is among the many who have made close studies of inflation and its causes. Directly or indirectly, he has influenced today’s economic thought. While some inflation may have a beneficial effect on the economy, that’s not the day-to-day experience of our OCEA members!

Have you received a merit increase lately?

They’re nice when they happen, but when you reach the top of your range, your main reliance is on the salary increases which OCEA negotiates periodically. That’s because, when you reach the top of your 12-step range, you have peaked out!

If you are hired at Step 4, you’ll generally be at the top of your range in about 4 years or less, even with just standard performance.

Granted, this is a somewhat simplified discussion. But the point is that workers tend not to share in the wealth produced by their increased productivity. To a lot of us, that does not seem right or fair. It’s the same concept on which the union song “Solidarity Forever” was based. Here’s an excerpt:

It is we who plowed the prairies; built the cities where they trade;

Dug the mines and built the workshops; endless miles of railroad laid.

Now we stand outcast and starving, ’midst the wonders we have made;But the Union makes us strong.

This is powerful language, and it does not apply literally to many of us, but the principle certainly does. Per hour of toil and sweat, we are earning about the same as we did 40 years ago.

Why is this? Productivity per hour has skyrocted, but real wages have remained about the same! Why? Because a great deal of the wealth created by our work is going to a select few.

In Orange County, we tend to be very “free-enterprise”-oriented. We tend to identify with the wealthy people and say, “That could be me someday.” It’s definitely a good feeling, and it is in keeping with the fact that America is, indeed, “the land of the free, and the home of the brave,” and an incredible “land of opportunity.”

But what is often overlooked is the unfair advantage that the government gives to the rich people, the wealthy. I’m all for free

enterprise, competition, and building a better mousetrap. But the deck is stacked against the little guy, because big business supports the “system” as it now exists.

And I’m not focussing on Republicans in these statements. The Democrats, who overall have a better reputation for supporting labor than do the Republicans, also have at best an uneven record when it comes to supporting the working person. A lot of it, unfortunatley, has to do with the fact that both of the major parties, Republican and Democrat, rely on corporate America for their success—and even their survival.

Here in Orange County, we generally have Republicans in office, and this is certainly true of the Board of Supervisors. All of the Supervisors are doing their best to represent their constituents, and to act for the betterment of the County, according to their best judgment. I have had the opportunity to work with all five Board members. All of them are

intelligent, civil, and willing to speak with labor representatives. Yet for the most part they have deeply-ingrained political philosophies that often influence their decision-making, and which sometimes conflict with the needs of working families.

So, as you contemplate all of the political activity going on in this major election year, keep in mind that the problems facing you as a working man or woman are not easily solved, given the state of politics!

Your best course of action is to stay involved with OCEA. Unions are really the light at the end of the tunnel for all of working America, and not just for union members!

It’s that time again! This year, OCEA benefit plan open-enrollment will be September 22 through October 24, 2008. This is your annual opportunity to make changes to your Health and Welfare and supplemental benefit elections. Among other things, during OCEA open enrollment you may make a wide variety of permissible changes, such as adding or dropping dependents, changing option packages, and (for OCEA members) upgrading certain plans.

Watch for Open Enrollment Packets! In mid-September, OCEA will mail open-enrollment packets to eligible employees. If you want to make changes, follow the instructions in the packet, and be sure to mail or deliver your changes to OCEA on or before October 24. If you fail to make changes during the open enrollment period, with limited exceptions you will not be able to change your benefit elections until open enrollment in late 2009. (Remember, OCEA is not part of the County’s “pony” system.)

Open enrollment is a great time to review your benefit needs and those of your family, reassess your current benefits, and examine your many alternatives. For help, call an OCEA Benefits Administrator at (714) 835-3355.

On May 15, 2008, members of around thirty different California labor unions gathered in the Plaza of the Flags, at the Santa Ana Civic Center, for a rally to protest Governor Arnold Schwarzenegger’s proposed budget cuts. The rally lasted from 4:00 p.m. to 6:00 p.m., and was highlighted by brief speeches from about a dozen labor and community leaders.

Among the speakers were OCEA President Frank Eley and OCEA General Manager Nick Berardino.

Although the school budget cuts were a focus of the demonstration, the rally was in support of middle-class workers generally. Private-sector and public-sector unions were represented.

Union members from just about every major field were present, including teachers and other school personnel, laborers, home health workers, law enforcement, and many others. Some brought their entire families.

On April 11, 2008, OCEA hosted a meeting of the State Coalition of Probation Organizations (SCOPO), of which OCEA is a member. Our guest speakers included Colleene Preciado (Orange County Chief Probation Officer), Brian Brown (Senior Fiscal and Policy Analyst for Public Safety, California Legislative Analyst’s Office), and former-Assemblyman Tom Umberg.

It was a veritable “who’s who”! Sara Ruckle-Harms is retiring at the end of June 2008. We are happy for the fact that Sara will be able to pursue other interests, but sad, because she will no longer be such a significant part of our lives.

One thing, though, is certain. The impacts that Sara has made on our lives, and upon OCEA, will never go away. Sara’s work for OCEA was so intense, and lasted over such a long period of time, that in a sense she will always be with us.

Sara has been a member of OCEA for more than 30 years, and has distinguished herself

as one of the most outstanding leaders in OCEA’s history.

One of the chief areas of Sara’s contributions has been her service as a member of our Board of Directors. The OCEA offices she has held include President, First Vice President, Second Vice President, Treasurer, and Past President.

Sara, thank you for your service to OCEA and for your friendship! We won’t forget you, and we wish you many years of happiness in your retirement!

Our OCEA/County LMCs at Work: “Take Your Child to Work Day” in the District Attorney’s Office!The District Attorney’s “Take Your Child to Work Day” event took place on Thursday, April 24, 2008. The event was a huge success, as it is every year! Over 60 children attended with their parents. Once again, OCEA was happy to take part in this great event by donating lunch to all participants, as well as OCEA bags for the children’s activity packs. The Take Your Child to Work Committee is a sub-function of the OCEA/District Attorney Labor Management Committee and is the biggest project for the LMC on a yearly basis. OCEA members play a vital role in organizing this event, and perhaps some of the children will follow in their parents’ footsteps by not only working for the DA’s office, but also by being future leaders of OCEA!

Report for Meeting of April 9, 2008

The OCEA sponsor provided a report on the first meeting of the revived Best Practices Committee, and named the newest member.

HCA Human Resources provided the following new information and updates:

• Behavioral Health Services staff in the Fullerton Clinic were reassigned as part of the downsizing of that facility (which was originally scheduled for closure due to budget problems);

• The County’s “Supervisor Camp” is being scheduled again and information can be found on the Human Resources website;

• The Psychiatrists, Pharmacists, and Psychologists classifications are still being considered for the addition of layers;

• HCA is currently working with Programs to identify and address the needs of the Dual Diagnosis/AMHS clinic recruitment; and

• A wellness center has been approved for MHSA, along with staffing. Implementation has not yet been scheduled, and the possible development of a timeline will be referred to the Best Practices subcommittee.

Subcommittee Reports

Workplace Enhancement:

• CCS is continuing to have problems with the second layer of approval being required to process tuition reimbursement requests;

• Additional examples about issues with FTP servers have been received and will be forward to HCA IT;

• Work is in progress on the parking problems at the 17th Street clinic, based on the traffic survey that was conducted by the County at the Agency’s request; and

• A part was replaced in the 17th Street clinic’s air conditioning equipment in an attempt to better control the temperature (which had gone down to 50°). The situation is being monitored.

Communications/Project Development: The Team Excellence Awards project is in full swing, as scheduled, with publicity provided by both HCA and OCEA.

Subcommittee Reports

Workplace Enhancement:

• The issue of the storage of County records has been resolved.

• A project request for IT will be submitted for an FTP server.

• Contracts are being reviewed for the completion of the work still needed to improve the safety of the parking lot at the 17th Street facility.

Communications/Project Development:

• Seventeen applications have been received for the Team Excellence Awards. They will be screened and the finalists will be brought to the committee for review and a vote in the June meeting.

• The results of the HCA 2007 Employee Survey were reviewed and provided to the Workplace Enhancement subcommittee for the identification of possible workplace issues.

Report for Meeting of May 1, 2008

The Probation Department LMC met on May 1, 2008. We welcomed Director Don Beezly as the new Chair of the committee, with Supervising Probation Officer Jim Arkyns stepping down after serving a year and a half as the Chair. Jim will remain as an LMC member, and we thank him for his service as Chair.

Workplace issues:

• Payroll adjustment delays continue to be a problem for many of our members who work overtime. Frederico Perez from payroll indicated that he needs concrete examples in order to track the delays.

• Mileage reimbursements are not being processed as quickly as our members would like. Frederico stated that the claims are the responsibility of the Auditor-Controller. He distributed a document on how to obtain information from the Auditor-Controller Intranet webpage.

• Parking at MOB/Juvenile Hall has been an ongoing problem for some time now as there appears to be a shortage of spaces. Brian Wayt will check on this issue.

• Regarding security at the SAO parking lot, Sheriff’s Special Officers checked the parking lot and the only reported issue was a hit and run. Frank Flavin will check with the Sheriff’s Department regarding possible reports.

• Director Dave Burnham has asked the committee for guidelines for the Memorial Wall at Juvenile Hall.

OCEA secures agreement from County for an effective review process, unique in the stateIn mid-April 2008, OCEA learned that the Orange County Register newspaper had (under the Public Records Act) requested names and salaries of all County employees. The California Supreme Court has stated that, in general, such requests must be complied with.

OCEA worked with the County to establish a procedure in which an impartial committee would rule on specific requests by employees that their names be excluded under limited exceptions. This arrangement is the only one of its kind in the state.

OCEA has been in contact with The Register in an effort to secure assurances from The Register that it will exercise restraint in determining how it will use the information it has received.

Community Public Health Nurses!OCEA and HCA were recently involved in a meet-and-confer process on a proposed new policy and Quality Assurance Tool. In our second meeting, on June 5, HCA agreed to withdraw its proposed survey in favor of developing a method to more accurately obtain the quality-of-care and services information needed. The three members of OCEA’s team who participated in the meeting—Paula Beau, Debbi Bennett, and My-Thuc Crisanto—will now

be part of a project committee to develop an instrument that would be more accurate and better received.

Kudos to our Nurses who did all of the hard work that was needed for the presentation and justification of our position!

Nurse Appreciation Day was on May 6, 2008. OCEA distributed red-and-black insulated lunch bags to all of its member Nurses in HCA, imprinted with the words, “OCEA Appreciates Our Nurses.” Many thanks to Denise Thomas, April Barrio, Pam Ickes, Paula Beau, Pauline Bui, Susan Johnson, Carmen Reynolds, and everyone else who helped with the distribution.

A special thanks to Maureen Robles, HCA Institutional Health Services Manager, who, with the HCA CMS Main Jail staff, was so helpful in making arrangements to take 150 of the lunch bags into the jail for distribution.

Our OCEA Professional Nurses Caucus continues its activities. In general, we meet monthly at OCEA for lunch. All professional Nurses are welcome to attend! Just notify Loretta van der Pol, OCEA Senior Labor Relations Representative, to help us plan for lunch.

On April 5, 2008, hundreds of OCEA leaders gathered at the Hilton Orange County/Costa Mesa for an ultra-special conference, our 2008 OCEA Leadership Conference. You could call it a “pre-2009 OCEA bargaining” conference. We had several topflight speakers who helped us place the County’s and State’s finances into perspective. We had excellent attendance and participation.

“2008 and Beyond – Goals of the Board of Supervisors” Mario Mainero, Chief of Staff for Supervisor John Moorlach

Mario gave us some insights into the accomplishments and attitudes of the Board of Supervisors, particularly as they relate to Board Chairman John Moorlach. Mario’s ideas (as to possible things that should be considered to reduce County costs) include “think harder about the size and frequency of pay increases” and “think again about departing from the defined-benefit mode of pension benefits and instead adopt the defined contribution mode.” Although OCEA disagrees with many of Mario’s views, he is very accessible, and he is not afraid to speak his mind.

OCEA Senior Employee Relations Manager Jim Riley and OCEA Operations Manager (Cities and Districts) Larry Lykins were involved in a confrontation with a member of OCEA’s Communications Division. Jim seems to be saying, “There better not be film in that camera.” There wasn’t—it’s a digital camera.

Speaker Highlights

“2008 and Beyond - Challenges Facing the County and Its Employees”Tom Mauk, County Executive Officer, County of Orange

Tom “tells it like it is” and sticks to his guns. Tom has always been a “straight shooter” with OCEA, and his remarks were helpful in understanding the attitudes of the Board of Supervisors as they are applied in the trenches.

Boiled down, he sees the 2009 negotiations problems of OCEA and the County as being a matter of setting priorities—of allocating scarce resources.

Don Drozd, OCEA’s General Counsel, made a fantastic presentation entitled “The Middle-Class Squeeze: Some Facts, Some History, and Some Hope.” Don threw a great deal of light on how the middle class first appeared in America and what has been bringing about its downfall.

Our final speaker of the morning was Steve Baker. Steve is one of OCEA’s lobbyists in Sacramento, and he and Aaron Read have vigorously represented OCEA for many years. Steve gave an excellent presentation regarding what is going on in Sacramento, and how it is impacting us in Orange County.

The members of the first-ever OCEA Steward Advisory Committee are as follows:

The OCEA Steward Advisory Committee is comprised of OCEA Stewards employed by the County of Orange, the Orange County Sanitation District, the Orange County Fire Authority, and the Orange County Superior Court, along with OCEA staff.

It is expected that the OCEA Steward Advisory Committee will meet during lunch breaks, after work, or sometimes on the weekend, and will explore ideas and assist with the development of OCEA Steward policies and guidelines. The committee will be charged with developing, analyzing, and recommending for possible implementation, potential improvements to the OCEA Steward Program.

All new OCEA Stewards are required to attend our Steward training, and it is highly recommended that current Stewards attend the training as well.

Session 1 of the training covers such topics as the History of Organized Labor, Governing Laws, and the Memorandum of Understanding. Session 2 covers Roles and Responsibilities of a Steward, Handling Workplace Issues, and Grievance Handling. The subject matter is intended to provide OCEA Stewards with the tools and knowledge they require to be effective workplace leaders.

Each session of the OCEA Steward Training Program will be an all-day training and will be held at OCEA Headquarters. Upcoming training dates are as follows:

July 17, 2008 - Session 1

August 21, 2008 - Session 2

September 18, 2008 - Session 1

October 16, 2008 - Session 2

OCEA Board Approves Six-Cent Dues Increase

Our OCEA Board of Directors has voted to increase OCEA dues by six cents per pay period. This small increase is effective June 20, 2008. It will be reflected on your paystub beginning with the July 11, 2008, payday.

County Loses Former Supervisor “Battling” Bob Battin

Bob Battin passed away on April 29, 2008, at the age of 78. He served on the Board of Supervisors as First District Supervisor from 1969 to 1976. After his service on the Board, Bob practiced law in Santa Ana, and his office was right across the street from OCEA.

Bob’s objectives and OCEA’s often clashed. (In an OCEA tribute to our Board of Supervisors which we published in 2005, we ran a photo of Bob, and reproduced a letter he sent to his constituents in which “Battling Bob” took a “swing” at OCEA.)

Bob had a reputation for being a supporter of the cause of “the little guy,” and while on the Board had a progressive agenda.

During his campaign for re-election, Bob personally walked 25% of his District, and he attributed his come-from-behind victory to this personal contact with voters.

As many of our OCEA members are aware, OCEA represents employees in many agencies in addition to the County of Orange and the Orange County Superior Court. We also represent employees in many OCEA Affiliates and OCEA Chapters.

OCEA Affiliates are organizations which have contracted with OCEA so that OCEA provides various services, including representation services. OCEA Chapters are organizations for which OCEA is the exclusively-recognized bargaining representative.

Pursuant to state law, the County of Orange and the Orange County Employees Association are parties to a “modified agency shop” agreement in all County bargaining units represented by OCEA.

This “modified agency shop” agreement is an arrangement that requires an employee, as a condition of continued employment, either to join OCEA, or pay to OCEA an “agency” or “service” fee in an amount determined by OCEA (not exceeding dues paid by OCEA members). This fee helps cover OCEA’s costs for negotiations, contract administration, and related activities in which it engages on behalf of you and all other employees in your bargaining unit.

The modified agency shop agreement between the County and OCEA does not apply to continuous employees hired prior to January 11, 2002. That is, if you were hired by the County prior to January 11, 2002, and have been continuously employed by the County since your hire date, the requirements listed below do not apply to you and you are not required to pay an agency fee, even if you do not belong to OCEA.

New employees hired on or after January 11, 2002, are required as a condition of employment to do one of the following:

• Join and pay dues to OCEA (currently $10.12 per pay period), or

• Have mandatory paycheck deductions of the agency fees set by OCEA each year (currently $7.72 per pay period), or

• Apply for conscientious objector status (see below).

Note that an election is not irrevocable. An employee may change status from OCEA member to fee payer or from fee payer to OCEA member upon written notice to OCEA. However, although the payment of agency fees entitles an employee to certain basic representation services, only an OCEA member is entitled:

• To vote on proposed collective bargaining agreements

• To vote for OCEA officers or run for OCEA office

• To participate on OCEA Labor Management Committees

• To be a member of a bargaining team

• To purchase upgraded dental, vision,

long-term disability, and other supplemental employee benefits

• To participate in the OCEA discount program which offers a wide array of local merchant discounts

• To purchase tickets through OCEA for special events (such as Edwards Cinemas, Disneyland, and Universal Studios) at reduced prices.

These and other privileges belong only to OCEA members. Such privileges are not available to non-members (including those paying agency fees).

The modified agency shop agreement permits an employee “who is a member of a bona fide religion, body or sect that has historically held conscientious objections to joining or financially supporting public employee organizations” to instead pay an amount equivalent to the agency fee to a “nonreligious, nonlabor charitable fund.” As authorized under state law, the County and OCEA have designated charitable funds to which qualified conscientious objectors must direct such contributions. If an employee belongs to such a bona fide religion, body or sect, and wishes to conscientiously object to the payment of the agency fee, the employee should immediately contact County Employee Relations at 714-834-2857 for further information.

If an employee does not act to become exempt as a conscientious objector, the employee must either immediately join OCEA or automatically become subject to the agency fee. Information is set forth on this page regarding the basis for the calculation of the agency fee and an explanation of the procedure for appealing the fee. For information regarding OCEA membership, call OCEA at 714-835-3355.

Agency Fee Appeal Procedure

If an agency fee payer disagrees with OCEA’s determination of the agency fee amount for any year the employee may institute an appeal by filing an agency fee objection as set forth below.

1. An agency fee objection shall be initiated in writing and shall be filed with the General Manager of OCEA at 830 N. Ross St., Santa Ana, CA 92701. The objection shall include the name, home address and telephone number, and representation unit of the agency fee objector.

2. An agency fee objection must be filed

within thirty (30) days of the distribution date of the legally required annual written notice by OCEA or, if the objector becomes subject to the agency fee subsequent to such date, within thirty (30) days of receipt of the information required to be included in that notice.

3. In the event OCEA receives a valid agency fee objection, within forty-five (45) days of the last day for filing an objection OCEA shall request a prompt hearing regarding the agency fee before an impartial decision-maker. OCEA shall select one entity from among the Public Employees Retirement Board, the American Arbitration Association, or the California State Mediation and Conciliation Service, and the entity selected by OCEA shall select the impartial decision-maker.

4. The agency fee objector or OCEA may make a request to the impartial decision-maker for a consolidated hearing of multiple agency fee objections based on case similarities, including but not limited to, hearing location. At any time prior to the start of a hearing, any party may make a motion to the impartial decision-maker challenging any consolidation of the hearing.

5. OCEA shall bear the burden of establishing the reasonableness of the amount of the agency fee.

6. Agency fee objection hearings shall be fair, informal proceedings conducted in conformance with the basic precepts of due process.

7. All decisions of the impartial decision-maker shall be in writing and shall be rendered no later than thirty (30) days after the close of the hearing.

8. All hearing costs shall be borne by OCEA, unless OCEA and the objector agree otherwise.

This procedure does not preclude any other legal remedies available to an objector.

Agency Fee Policy

1. Any person:

a. who is not a member of OCEA,

b. who is employed in a representation unit represented by OCEA, and

c. whose continued employment by the County is conditioned on the payment of member dues or an agency fee to OCEA,

has the right to object to OCEA expenditures not related to collective bargaining, contract administration, grievance processing, or other legally chargeable expenses in the manner set forth below.

2. During the month of June each year, an annual written notice shall be published in the OCEA Employee which shall set forth:

a. the amount of the agency fee expressed as a percentage of the annual dues for an OCEA individual member,

b. the basis for the calculation of the agency fee, and

c. a description of the procedure for appealing all or any part of the agency fee.

In the same issue of the OCEA Employee, OCEA shall publish this policy to provide notice to OCEA-represented employees of their right to object and the procedure for objecting. OCEA shall also send a copy of this policy to each person who objected the previous year to inform the person of his or her right to renew the objection for the current year, unless that person is a member of OCEA.

3. An agency fee objector must notify the General Manager of OCEA in writing of his or her individual objection by mail postmarked within thirty (30) days of the distribution of the annual notice in the OCEA Employee. An employee who only becomes subject to the member dues or agency fee payment condition of employment subsequent to the publishing of the annual notice in the OCEA Employee must notify the OCEA General Manager in writing within thirty (30) days of becoming subject to such condition and receiving the information required to be included in such notice. Any objection must be signed by the individual agency fee objector and shall contain the agency fee objector’s job classification, home address and home and work telephone numbers. An objection may only be made by an individual employee. No petition objections are permitted and any objection submitted other than by one individual employee shall be invalid. No continuing objections are permitted. An employee must file a new objection for each year he or she wishes to object to the calculation of expenditures.

4. The following categories of expenditures are chargeable to the extent permitted by law:

• Expenses related to the negotiation of agreements, practices and working conditions.

• Expenses concerning the administration of agreements, practices and working conditions, including without limitation grievance handling, arbitration, and communications with employees and the County regarding contract rights, practices, working conditions, and employee benefits.

• Conferences, retreats and other normal Association internal governance and management expenses related to the above.

• Publication expenses to the extent coverage is related to chargeable activities.

• Expenses of litigation before courts, administrative agencies and impartial third parties related to contract administration, collective bargaining rights and internal governance.

• Expenses for the education of members, board members, officers, and staff intended to prepare the participants to better perform chargeable activities.

• Expenses for group cohesion and economic actions, such as demonstrations, strike activity, and informational picketing.

• Overhead and administrative expenses to the extent related to chargeable activities.

5. OCEA shall retain an independent auditor who shall submit an annual report for the purpose of verifying the percentage of expenditures chargeable as an agency fee. The report of the independent auditor shall be completed within sixty (60) days after the end of OCEA’s fiscal year. The report shall include verification of the major categories of OCEA expenses attributable to chargeable and non-chargeable activities. The report shall include the amount of membership dues and agency fees paid by employees and shall identify the expenditures that constitute the basis for the amount of the agency fee. The result of the audit shall be published in the OCEA Employee in the first issue possible following completion of the audit, and that issue shall be distributed to all nonmembers in OCEA-represented units.

6. OCEA shall open an account in an independent financial institution to hold agency fees to be collected from nonmembers who have timely filed valid agency fee objections.

7. Escrowed agency fees that are being challenged shall not be released until, (a) mutual agreement between OCEA and the agency fee objector on the proper amount of the agency fee, or (b) the decision of the impartial decision-maker, whichever first occurs.
