SECTIONS 7, 7A AND 78 OF THE HERALDRY ACT. 1962 (ACT NO. 18 OF 1962)

The undermentioned bodies and persons have applied in terms of section 7 of the

Heraldry Act. 1962 (Act No. 18 of 1962). for the registration of their heraldic

representations and a name. Anyone wishing to object to the registration of these heraldic

The International Trade Administration Commission (herein after referred to as ITAC or the

Commission) has received the following applications concerning the Customs Tariff. Any

objection to or comments on these representations should be submitted to the Chief

Commissioner, ITAC, Private Bag X753, Pretoria, 0001, within four (4) weeks of the date of

this notice. Attention is drawn to the fact that the rate of duty mentioned in these applications

is that requested by the applicant and that the Commission may, depending on its fmdings,

CONFIDENTIAL INFORMATION

The submission ofconfidential information to the Commission in connection with customs

tariffapplications is governed by section 3 ofthe TariffInvestigations Regulations, which

regulations can befound on ITAC's website at http://www.itac.org.za/documents/R.397.pd(.

These regulations require that ifany information is considered to be confidential, then a non­

confidential version ofthe infOrmation must be submitted, simultaneously with the

confidential version. In submitting a non-confidential version the regulations are strictly

applicable and require parties to indicate:

CJ Each instance where confidential information has been omitted and the reasons for

confidentiality;

CJ A summary ofthe confidential information which permits other interested parties a

reasonable understanding ofthe substance ofthe confidential information; and

CJ In exceptional cases, where information is not susceptible to summary, reasons must

be submitted to this effect.

This rule applies to all parties and to all correspondence with and submissions to the

Commission, which unless clearly indicated to be confidential, will be made available to

other interestedparties.

NOTICE OF INITIATION OF THE SUNSET REVIEW OF THE ANTI-DUMPING

DUTIES ON POLYETHYLENE TEREPHTHALATE (PET) ORIGINATING IN OR

IMPORTED FROM INDIA, SOUTH KOREA AND CHINESE TAIPEI

In accordance with the provisions in Article 11.3 of the World Trade Organisation

Agreement on Implementation of Article VI of the General Agreement on Tariffs and

Trade, and definitive anti-dumping duty shall be terminated on a date not later than five

years from the date of imposition, unless the authorities determine, in a review initiated

before that date on their own initiative or upon a duly substantiated request made by or

on behalf of the domestic industry, that the expiry of the duties would be likely to lead to

continuation or recurrence of dumping and injury.

On 26 June 2009 the International Trade Administration Commission of South Africa (the

Commission) notified the interested parties through Notice NO.902 of 2009 in

Government Gazette No. 32333, that unless a substantiated request is made indicating

that the expiry of the anti-dumping duty against imports of polyethylene terephthalate

originating in or imported from South Korea, Chinese Taipei and India would likely lead to

the continuation or recurrence of dumping and injury, the anti-dumping duty on

polyethylene terephthalate (PET) originating in or imported from India, South Korea and

Chinese Taipei will expire on 06 October 2010.

A response to the review questionnaire was received from the Applicant on 6 April

2010.

THE APPLICANT

The application was lodged by FC Dubbelman & Associates CC on behalf of Hosaf, a. '-

Division of Feltex Holdings (Pty) Ltd (Hosaf), being the only producer for the subject

product (PET) in the SACU. The Applicant alleges that the expiry of the duties would

likely lead to the continuance and recurrence of dumping and injury.

The Applicant submitted sufficient evidence and established a prima facie case to

enable the Commission to arrive at a reasonable conclusion that a sunset review

investigation should be initiated.

THE PRODUCT

The product allegedly being dumped is polyethylene terephthalate (PET), bottle-grade

resin having an intrinsic viscosity (IV) of greater that 0.68 deciliters per gram,

classifiable under tariff subheading 3907.60, originating in or imported from the India,

South Korea and Chinese Taipei.

THE ALLEGATION OF THE CONTINUATION OR RECURRENCE OF DUMPING

INDIA

The allegation of dumping is based on the comparison between the normal value in

India and the export price information supplied by the Applicant.

NORMAL VALUE

The normal value for the subject product was determined based on domestic price

information obtained by the Applicant from an international publication.

EXPORT PRICE

The Applicant indicated that as a result of the current anti-dumping duties, imports from

India have declined and the volumes are not a true reflection of the current situation.

It also stated that it believes that the SARS data might be distorted and different grades

of PET could be included in the import statistics, which might in turn lead to price

variation. The export price was, therefore, determined based on the information

of the anti-dumping duties on the subject product originating in or imported from India is

likely to lead to the continuation or recurrence dumping.

SOUTH KOREA

The allegation of dumping is based on the comparison between the normal value in

South Korea and the export price information supplied by the Applicant.

information obtained by the Applicant from an international publication.

The Applicant indicated that as a result of the current anti-dumping duties, imports from

Chinese Taipei have declined and the volumes are not a true reflection of the current

situation. It also stated that it believes that the SARS data might be distorted and

different grades of PET could be included in the import statistics, which might in turn

lead to price variation. The export price was, therefore, determined based on the

information supplied by the Applicant obtained from an international publication.

On this basis, the Commission found that there was prima facie evidence that the expiry

of the anti-dumping duties on the subject product originating in or imported from

Chinese Taipei is likely to lead to the recurrence of dumping.

THE ALLEGATION OF RECURRENCE OF MATERIAL INJURY

The Applicant alleges and submitted sufficient evidence to show that there will be price

undercutting and that the imports in question will be depressing and suppressing its

selling price, should anti-dumping duties expire. The Applicant's information further

indicated that it will experience a decline in sales volumes, profit, output, productivity,

capacity utilisation, decrease in employment and growth and a further increase in

inventories and return 011 investment.

On this basis, the Commission found that there was prima facie proof that the expiry of

the anti-dumping duties on the subject product originating in or imported from India,

South Korea and Chinese Taipei is likely to lead to the continuation or recurrence of

material injury.

PERIOD OF INVESTIGATION

The period of investigation for purposes of determining the dumping margins in the

respective exporting countries or countries of origin will be from 1 July 2009 to 31

January 2010. The period of investigation for purposes of determining injury will be

from 1 July 2006 to 31 January 2010. An estimate of what the situation will be, should

the anti-dumping expire, will also be considered by the Commission.

PROCEDURAL FRAMEWORK

Having decided that there is sufficient evidence and a prima facie case to justify the

initiation of an investigation, the Commission has begun an investigation in terms of

section 16 of the International Trade Administration Act, 2002 (the ITA Act). The

Commission will conduct its investigation in accordance with the relevant sections of the

ITA Act and the Anti-Dumping Regulations of the International Trade Administration

Commission of South Africa (ADR), with due regard to the provisions of the World Trade

Organisation Agreement on Implementation of Article VI of the GATT 1994 (the Anti­

Dumping Agreement). The ITA Act and the ADR are available on the Commission's

website (www.itac.org.za) or from the Trade Remedies section, on request.

In order to obtain the information it deems necessary for its investigation, the

Commission will send non-confidential versions of the petition and questionnaires to all

known importers and exporters, and known representative associations. The trade

representatives of the exporting countries have also been notified. Importers and other

interested parties are invited to contact the Commission as soon as possible in order to

determine whether they have been listed and were furnished with the relevant

documentation. If not, they should immediately ensure that they are sent copies. The

questionnaire has to be completed and any other representations must be made within

the time limit set out below.

Please note that if any information is considered to be confidential then a non:

confidential version of the information must be submitted for the public file,

simultaneously with the confidential version. In submitting a non-confidential version

Subsection 33{1) of the ITA Act provides that any person claiming confidentiality of

information should identify whether such information is confidential by nature or is

otherwise confidential and, any such claims must be supported by a written statement,

in each case, setting out how the information satisfies the requirements of the claim to

confidentiality. In the alternative, a sworn statement should be made setting out reasons

why it is impossible to comply with these requirements.

Section 2.3 of the ADR provides as follows:

"The following list indicates "information that is by nature confidential" as per section 33(1}(a) of the MainAct, read with section 36 of the Promotion ofAccess to Information Act (Act 2 of 2000):

PROCEDURES AND TIME LIMITS

All responses, including non-confidential copies of the responses, should be received by

the Senior Manager: Trade Remedies I not later than 30 days from the date hereof, or

from the date on which the letter accompanying the abovementioned questionnaire was

received. The said letter shall be deemed to have been received seven days after the

day of its dispatch.

Late submissions will not be accepted except with the prior written consent of the

Commission. The Commission will give due consideration to written requests for an

extension of not more than 14 days on good cause shown (properly motivated and

substantiated), if received prior to the expiry of the original 30-day period. Merely citing

insufficient time is not an acceptable reason for extension. Please note that the

Commission will not consider requests for extension by Embassies on behalf of

exporters.

The information submitted by any party may need to be verified by the Investigating

Officers in order for the Commission to take such information into consideration. The

Commission may verify the information at the premises of the party submitting the

information, within a short period after the submission of the information to the

Commission. Parties should therefore ensure that the information submitted will

subsequently be available for verification. It is planned to do the verification of the

information submitted by the exporters within three to five weeks subsequent to

submission of the information. This period will only be extended if it is not feasible for

the Commission to do it within this time period or upon good cause shown, and with the

prior written consent of the Commission, which should be requested at the time of the

submission. It should be noted that unavailability of, or inconvenience to consultants

will not be considered to be good cause.

Parties should also ensure when they engage consultants that they will be available at

the requisite times, to ensure compliance with the above time frames.

Parties should also ensure that all the information requested in the applicable

questionnaire is provided in the specified detail and format. The questionnaires are

designed to ensure that the Commission is provided with all the information required to

make a determination in accordance with the rules of the ITA Act and the ADR. The

Commission may therefore refuse to verify information that is incomplete or does not

comply with the format in the questionnaire, unless the Commission has agreed in

writing to a deviation from the required format. A failure to submit an adequate non­

confidential version of the response that complies with the rules set out above under the

heading Confidential Information may be regarded as an incomplete submission.

Parties, who experience difficulty in furnishing the information required, or submitting in

the format required, are therefore urged to make written applications to the Commission

at an early stage for permission to deviate from the questionnaire or provide the

information in an alternative format that can satisfy the Commission I s requirements.

The Commission will give due consideration to such a request on good cause shown.

Any interested party may request an oral hearing at any stage of the investigation in

accordance with Section 5 of the ADR, provided that the party indicates reasons for not

relying on written submission only. the Commission may refuse an oral hearing if

granting such hearing will unduly delay the finalisation of a determination. Parties

requesting an oral hearing shall provide the Commission with a detailed agenda for, and

a detailed version, including a non-confidential version, of the information to be

discussed at the oral hearing at the time of the request.

NATIONAL WASTE INFORMATION REGULATIONS IN TERMS OF THE

NATIONAL ENVIRONMENTAL MANAGEMENT: WASTE ACT, 2008

making the regulations under section 69(1)(y) and (ee) of the National

Environmental Management: Waste Act, 2008 (Act No. 59 of 2008), in the

Schedule hereto.

PART 1

INTERPRETATION AND PURPOSE OF REGULATIONS

1. Definitions

(1) In these regulations, unless the context indicates otherwise, a

word or expression that is defined in the Act bears the same

meaning in these regulations, and in addition -

"Department" means the national Department responsible for

management of the national waste information system, or

components thereof;

"South African Waste Information System" or "SAWIS"

means a web-based national waste information system

established in terms of section 60 of the Act;

"Provincial waste information system" means a web-based

provincial waste information system established in terms of

section 62 of the Act;

"Registered person" means a person who is the holder of a

registration certificate;

"Registration certificate" means a written proof issued by the

Department to a registered person to submit information to the

South African Waste Information System in terms of Part 3 of

the regulations;

"Reporting period" means the quarterly period of a year

calculated from January in respect of which information must be

reported;

"The Act" means the National Environmental Management:

Waste Act, 2008 (Act No. 59 of 2008);

"These regulations" include the Annexures to these

regulations;

"Type of waste" means the category of waste whether general

or hazardous;

"Volumetric survey" means the collection of data which is

performed for the purpose of obtaining measurements and

analysis of quantities; and

"Waste information registration number" or "WIR number"

means the unique number allocated by the Department to a

person in terms of these regulations.

(2) When any particular number of days is prescribed for the doing

of any act, or for any other purpose, the same shall be reckoned

exclusively of the first and inclusively of the last day, unless the

last day happens to fall on a Sunday or on any public holiday, in

which case the time shall be reckoned exclusively of the first day

and exclusively also of every such Sunday or public holiday.

2. Purpose of Regulations

(1) The purpose of these regulations is to regulate the reporting on

waste information for the protection of the environment and the

management of waste.

3. Application of Regulations

(1) These regulations apply uniformly in all provinces of the

Republic of South Africa.

(2) Notwithstanding subregulation (1), where a province has

established a provincial waste information system in terms of

section 62(1) of the Act, the province may promulgate

regulations which may not be in conflict with these regulations.

PART 2

REGISTRATION

4. Application for registration

(1) A person conducting an existing waste management activity

listed in Annexure 1 must apply to the Department to be

registered on the SAWIS within ninety (90) days of the

promulgation of these regulations, and any person commencing

a waste management activity after the promulgation of the

regulations must apply to be registered on the SAWIS prior to

commencement with the activity.

(2) An application contemplated in sub-regulation (1) must be in a

form prescribed by the Department.

5. Consideration of applications for registration

(1) The Department must, within thirty (30) days of receiving an

application for registration, either:

(a) Register the applicant and issue a registration certificate

to the applicant which contains:

(i) Name of waste management activity

(ii) A WIR number; and

(iii) The date of registration; or

(b) Advise the applicant that the application for registration is

referred back for correction.

(2) An application for registration which has been referred back for

correction must be amended and resubmitted to the Department

within thirty (30) days of the applicant receiving notification.

(3) The provisions of subregulation (1 )(a) shall apply to an

application for registration which has been referred back,

corrected and resubmitted.

6. Changes to registration certificate

(1) A registered person must notify the Department, in the

prescribed form, of any change in respect of, that person's

registration certificate within thirty (30) days of such change

occurring.

(2) If a registered person transfers ownership of the business or no

longer undertakes the activity which caused that person to

register, the registered person must notify the Department in the

prescribed form, within thirty (30) days prior to the business

being transferred or the activity being discontinued.

(3) A new person to which the business is being transferred to in

Subregulation (2), must if necessary and within thirty (30) days

of taking ownership of the business, amend the registration

status of the business.

(4) On receipt of a notification in sub-regulations (1) and (2) and

after the amendment of the registration status of a registered

person in subregulation (3), The Department must withdraw the

registration certificate or change the registration status of a

registered person from the SAWIS and issue a new registration

certificate bearing the updated status within thirty (30) days.

(5) If a person intends to recommence with an activity for which the

registration was withdrawn, the person must reapply to be

registered as per regulation 4.

PART 3

REPORTING AND RECORD KEEPING

7. Reporting or submission of information

(1) A registered person conducting an activity listed in Annexure 1 must

submit a quarterly report containing the information as prescribed in

Annexure 2, within thirty (30) days of the end of a reporting period.

(2) Subregulation (1) does not apply to the registered hazardous waste

generators.

(3) The information must be submitted to the SAWIS.

(4) If a registered person is not able to submit the required information

to the SAWIS, a registered person must submit the required

information to the Department by facsimile, post or hand delivery

within thirty (30) days of the end of a reporting period.

8. Record keeping

(1) A registered person must keep a record of the information

submitted to the SAWIS.

(2) The records contemplated in subregulation (1) must be:

(a) . retained for a period of at least 5 (five) years; and

(b) made available for inspection by a representative of the

Department

PART 4

VERIFICATION OF INFORMATION

9. 'Verification of information

(1) The Department may notify a registered person that verification

of information will be conducted within a period determined by

the Department.

(2) If the Department reasonably believes that the information

provided during the verification process is incorrect or

misleading, the Department must instruct a registered person

who the information belongs to, in writing, to:

(a) Submit an audit report by an independent auditor on the

accuracy of the information that has been submitted to

the Department; or

(b) Undertake a volumetric survey and submit a volumetrics

report by an independent person.

(3) An audit report or volumetrics report requested in terms of

subregulation (2) must be submitted within the period

determined by the Department.

(4) A registered person is liable for all costs in connection with

compliance with an instruction in terms of subregulation (2).

(5) If a registered person fails to submit an audit report or volumetric

survey report contemplated in subregulation (2) within the period

determined by the Department, the Department must:

(a) Appoint an independent auditor/person to perform the

audit or volumetric survey; and

(b) Recover the cost of the audit or VOlumetric survey from

the registered person.

PARTS

IMPLEMENTATION

10. Implementation

(1) For purposes of implementation of these regulations, in cases where

a registered person is not able to provide accurate information to the

SAWIS, a registered person submitting information on general waste

may submit information that is based on an estimation of quantities

for a period of five (5) years after promulgation of the regulations,

whereafter the information must be based on actual quantities.

(2) The five (5) year period referred to in subregulation (1) does not

apply to waste disposal sites receiving less than 150 tons of general

waste per day. Such sites may continue to report on estimations of

the quantities for as long as the site is in operation.

(3) The provision in sub regulation (1) regarding estimation of quantities

for a period of five (5) years does not apply to waste management

facilities installed with waste quantification equipments (i.e.

weighbridge, scales) in place.

(4) A person submitting information on hazardous waste must submit

the information based on actual quantities from the date of effect of

the regulations.

GENERAL

11. Offences and penalties

(1) A person is guilty of an offence if that person:

(a) provides incorrect or misleading information to the SAWIS;

or

(b) Fails to comply with regulations 4,5,6,7,8,9 and 10.

(2) A person who commits an offence in terms of subregulation (1)

is liable on conviction to:

(a) Imprisonment not exceeding fifteen (15) years;

(b) An appropriate fine; or

(c) Both a fine and imprisonment.

12. Short title and commencement

(1) These regulations are called the National Waste Information

Regulations, and take effect on the date of publication thereof.

ANNEXURE 1

LIST OF PERSONS CONDUCTING THE FOLLOWING ACTIVITIES MUST

REGISTER ON THE SOUTH AFRICAN WASTE INFORMATION SYSTEM

(SAWIS) IN TERMS OF REGULATION 4

1. Generators of waste

(a) Generators of hazardous waste in excess of 20kg per day.

2. Recycling of waste.

(a) Recycling or reuse of general waste of more than ten (10) tons per

month, which include paper, plastic, glass, beverage cans, tyres and

scrap metal.

(b) Recycling or reuse of hazardous waste.

(c) Recovery of general waste in excess of three (3) tons.

(d) Recovery of hazardous waste.

3. Treatment of waste

(a) Treatment of general waste in excess of 10 tons per day.

(b) Treatment of hazardous waste.

4. Disposal of waste

(a) Disposal of waste in excess of 150 tons of general waste per day.(b) Disposal of hazardous waste.

5. Exportation ofhazardous waste

Hazardous waste exported from the Republic of South Africa.

REPORTING REQUIREMENTS IN TERMS OF REGULATION 7(1)

The required information for reporting to the South African Waste Information

System, read with the Annexure 1 of these regulations must include -

(a) details of the company submitting the information;

(b) the month and year to which the information-applies;

(c) type of waste as detailed in Annexures 3 and 4;

(d) Source from which waste comes from;

(e) Waste management method as detailed in Annexure 5, and

(e) The quantity of waste reported in tons.

to extend the application of Chapter 4 to all provinces; to require the MEC's

Housing Tribunals to rescind any of its rulings; and to provide for matters

connected therewith.

BE IT ENACTED by the Parliament of the Republic of South Africa, as follows-

Amendment of section 1 of Act 50 of 1999

1. Section 1 of the Rental Housing Act, 1999 (hereinafter referred to as

the Principal Act), is hereby amended-

(a) by the substitution for the definition of "Minister" of the following definition:

" 'Minister" means the Minister of [Housing] Human Settlements;";

and

(b) by the substitution for the definition of "prescribed" of the following definition:

" 'prescribed" means prescribed by regulation [by the MEC, by

notice in the Gazette];".

Amendment of section 6 of Act 50 of 1999

2. The following section is hereby substituted for section 6 of the principal

Act:

"Application of Chapter

6. This Chapter applies to all Provinces in the Republic of South

Africa.".

Amendment of section 7 of Act 50 of 1999

3. The following section is hereby substituted for section 7 of the principal

Act:

"Establishment of Rental Housing Tribunals

7. [The] Every MEC [may] must by notice in the Gazette establish

a tribunal in the Province to be known as the Rental Housing Tribunal.".

Amendment of section 13 of Act 50 of 1999

4. Section 13 of the principal Act is hereby amended by the insertion after

subsection (12) of the following subsection:

"(12A) The Tribunal may, acting on its own accord or on

application by any affected person, rescind any of its rulings if such rulings­

(a) were erroneously sought or granted in the absence of the person

affected by it;

(b) contain an ambiguity or patent error or omission, but only to the extent of

clarifying that ambiguity or correcting that error or omission; or

(c) were granted as a result of a mistake common to all parties to the

proceedings.".

Amendment of section 14 of Act 50 of 1999

5. Section 14 of the principal Act is hereby amended by the substitution

for subsection (1) of the following subsection:

"(1) [A] Every local authority [may] must establish a

Rental Housing Information Office to advise tenants and landlords [in] with

regard to their rights and obligations in relation to dwellings within [the area of

such local authority's] their area of jurisdiction.".

Amendment of section 15 of Act 50 of 1999

6. Section 15 of the principal Act is hereby amended by the substitution in

subsection (1) for the words preceding paragraph (a) of the following words:

"The Minister must, after consultation with the [standing or portfolio on

housing] relevant parliamentary committees and every MEC, by notice in the

Gazette, make regulations relating to-".

Amendment of Chapters 4 and 5 of Act 50 of 1999

7. Chapters 4 and 5 of the principal Act are hereby amended by removing

section 15 from Chapter 4 and inserting it under Chapter 5 before section 16.

This Act is called the Rental Housing Amendment Act, 2010 and

comes into operation on a date determined by the President by Proclamation in the

Gazette.

MEMORANDUM ON THE OBJECTS OF THE RENTAL HOUSING AMENDMENTBILL,2010

1. BACKGROUND

1.1 Since the promulgation of the Rental Housing Amendment Act, 2007 (Act No.

43 of 2007), came into operation on 13 May 2008, the Department undertook a

monitoring and implementation process with regard to the Act. It was identified that

there is a need for each and every province to establish Rental Housing Tribunals.

All provinces are faced with similar Rental Housing challenges, whether formal or

backyard.

1.2 It was evident from the monitoring and implementation process that not all

provinces have established Rental Housing Tribunals. Some of the provinces have

only recently established their Rental Housing Tribunals and only after intervention

by the Department. Furthermore, there are currently several local authorities which

have not established Rental Housing Information Offices despite a dire need thereof.

1.3 In view of the above, the Bill seeks to amend sections 7 and 14(1) of the

Rental Housing Act, 1999 (Act No. 50 of 1999), (the principal Act) in order to render

the establishment of Rental Housing Tribunals in every province and the

establishment of Rental Housing Information Offices in every local authority

mandatory.

2. OBJECTS OF BILL

The objects the Bill are therefore to-

2.1 substitute certain definitions;

2.2 extend the application of Chapter 4 to all the provinces;

2.3 require the MECs and local authorities to establish Rental Housing Tribunals

and Rental Housing Information Offices, respectively; and

2.4 extend the powers of the Rental Housing Tribunals to rescind any of its

rulings.

3. PERSONS OR BODIES CONSULTED

Representations were requested from the Head of Legal Services in the Provincial

Departments and from the various Rental Housing Tribunals. Written and verbal

presentations were received in this regard.

4. IMPLICATIONS FOR PROVINCES

It will be obligatory for each province to establish a fully operational Rental Housing

Tribunal.

5. IMPLICATIONS FOR LOCAL SPHERE OF GOVERNMENT

It will be mandatory for every local authority to establish Rental Housing Information

Office to advise tenants and landlords with regard to their rights and obligations in

relation to dwellings within their area of jurisdiction.

6. FINANCIAL IMPLICATIONS TO STATE

6.1 The costs involved will be for the establishment and operations of the

provincial Rental Housing Tribunals. However, in this regard, it should be mentioned

that all the Provinces already have partly or fully operational Rental Housing

Tribunals.

6.2 The other costs involved will be for the establishment and operations of the

Rental Housing Information Offices in every local authority.

6.3 The Department will incur the costs associated with the implementation of the

legislation. The Department will furthermore incur the cost for the pubucation of the

Bill for public comments, information sessions, translations and other incidental costs

in relation to the Bill. The said costs will be defrayed from the Department's budget.

7. PARLIAMENTARY PROCEDURE

7.1 The State Law Advisers and the Department of Human Settlements are of the

opinion that this Bill must be dealt with in accordance with the procedure established

by section 76(1) or (2) of the Constitution of the Republic of South Africa, 1996, since

it falls within a functional area listed in Schedule 4 of the Constitution, namely

"Housing".

7.2 The State Law Advisers are of the opinion that it is not necessary to refer this

Bill to the National House of Traditional Leaders in terms of section 18(1)(8) of the

Traditional Leadership and Governance Framework Act, 2003 (Act No. 41 of 2003),

since it does not contain provisions pertaining to customary law or customs of

traditional communities.

3 CSD PARTICIPATION

3.14 In order for Its Securities to be deposited In the CSD, an Issuer ofEligible Securities must be admittedbv the Controlling Body interms ofthe Rules,

3,15 The Issuer shall make an application for admission to the Controlling Body on a prescribed form. andthe application shall be accompanied by payment ofa prescribed fee as stipulated bvDirective.

3.16 In order to remain admitted. an Issuer must comply with the Act. Rules. Directives and otherconditions imposed by the Controlling Body.

3.17 Where an Issuer has breached the Rules or Directives. the Controlling Body may suspend theprovision of services by the CSD to the Issuer, or impose conditions or take any other action it maydeem fit inregard tothat Issuer. .

3.18 Where the Controlling Body is considering suspending the provision of services by the CSD to anIssuer, the Controlling Body must:

3.19 Where the Controlling Body has exercised itsdiscretion to suspend the provision of services by theCSD in terms of Rules 3.17 and 3.18, the Controlling Body must notify the Exchange, whereapplicable, inwriting ofitsdecision.

9 FEES AND CHARGES

9.1 The Controlling Body may from time to time determine fees and charges tobepaid byParticipants,Issuers and other persons.

9.2 The Controlling Body must, within a reasonable time. prior to their imposition, notify Participants,Issuers and other persons ofthe applicable fees and charges.

9.3

9.5 If the arrears are not paid by the Participant, Issuer or other persons within 14 (fourteen) calendardays of the expiry of the period referred to in Rule 9.3, or any extended period granted by theControlling Body, the Controlling Body may suspend or terminate participation of the Participant, theprovision of services bythe CSD tothe Issuer orother person, or take any other [disciplinary] actiondeemed appropriate bythe Controlling Body.
