1. Call to Order The meeting was called to order at 6:05 p.m. by Mayor Bartels.

2. Roll Call

Present via Zoom: Bartels, Keppy, Engstrom, Stickell, Hoyt Rigg. Absent: Argo Establishment of a quorum.

3. Pledge of Allegiance. The Pledge of Allegiance was spoken by all.

Staff present via Zoom: Annette Ernst, Amber Dennis, Jamie Just, Chief Whitney

4. Reading and Approval of Minutes.

Trustee Keppy made a motion to approve the minutes from the Regular Board meeting held April 23, 2020. Trustee Hoyt gave a second to the motion. Ayes 5, motion carried.

5. Public Presentation/ Recognition and/or Public Comments

Mayor Bartels asked twice if there were any public comments to tonight’s meeting.

Trustee Argo signed into the zoom council meeting. Joel Anderson (Glenwood Acres) approached the Board and stated that he was not happy that Zimmerman went to the Planning and Zoning Board to change the zoning from R-1(residential) to A-1 (Agricultural). He also reported that a resident (Campbell’s) who purchased property in that addition is riding a BMX motocross bike for hours at a time and it’s disturbing the peace. Lori Barber (Glenwood Acres) stated that she has property on both sides of the Campbell’s and does not like the noise and is unhappy about the rezone. Mrs. Barber is concerned that a track is being built for professional motocross. Ms. Ernst stated that there was a public hearing that was published in the newspaper and on the village website in February for the rezone in that addition. Megan Bereskin (owner of horse farm in the area) stated that she has lessons, shows etc. and the noise from the motocross bikes are disturbing her horses and is afraid that it will ruin her business. Ms. Bereskin said that her business was there first. Cam Johnson (resident in the area) stated that the rules for a variance has a lot of shackles attached to it. Kelly Sandusky (Hwy 6) stated she agrees with all of her neighbors and hopes their thoughts are considered. Kim Campbell (Owner of lot) Stated that

they do not have a motorcross track, and that he son’s ride their personal bikes for fun and practice turns. They only ride up to 2 hours a week ( Mrs. Campbell asked what the decibel level is) Margarida Laub (resident in area) stated that she feels for Mr. Campbell and his family and that there is only one little motorcycle. Mrs. Laub asked why there was a rezone. Ms. Ernst stated that it was rezoned so that residents would be able to have animals if they wanted. Mrs. Laub stated that all intentions may be good, but not good for all the others. Joel Anderson stated that he also does not want any commercial businesses constructed in that area. Ms. Barber stated that the developer is getting special treatment from the Village and the residents are getting overlooked. Mr. Bartels ended the public comments and stated that he will meet with the Campbell’s to have a conversation. Stickell made a statement that there was concern when Zimmerman purchased the property that there was a collection of neighbors that have not been happy with any decisions on that property.

6. Reports from the President and Other Officers (on matters not otherwise appearing on the

Agenda).

A. President-Mayor Bartels had no report.

B. Trustees-Trustee Rigg asked about property maintenance letters that had been sent out and was concerned that only two were sent out in the last five months. Jamie Just stated that no property maintenance letters are currently going out as MUNICES Court service is closed for now. Mr. Just stated a new policy will state that letters will go out and court notice dates will be put in place once they open. Trustee Keppy stated that there is no face to face contact with violators and he wanted to know if Mr. Just could knock on doors. Mr. Just stated that he is allowed to go onto people’s properties and he has been busy doing multiple other inspections at the same time. Typically his protocol is going on the property and taking pictures of the violations and sending letters.

Trustee Engstrom mentioned that there are a lot of abandon cars in Coal Valley. Keppy asked if the meetings could go back to in person meetings with six feet of separation for social distance. Hoyt stated that he was concerned with the public being separated. Ernst stated that the public can join via Zoom.

C. Police, Public Works and Administration-

The Chief reported the Officer Castillo went back to the Acadamy to finish firearms training and will let the Board know when she is back at the academy full-time.

Ms. Ernst reported that MidAmerican hit a water lateral by Well #2 last week and five homes were without water. The boil order has since been lifted.

7. Unfinished Business - 2nd Reading. Consideration and Approval of Cannabis Zoning Ordinance

No discussion was held. Trustee Argo made a motion to approve the second reading in consideration of the Cannabis Zoning Ordinance. Hoyt seconded, ayes 5, abstain 1, motion passed.

8. New Business

A. Consideration and Approval of the recommendation from Planning and Zoning on a

variance request for the Size, of an accessory building, Title IV, Chapter 1, Section 5 RATIO OF BUILDING TO LENGTH TO WIDTH of the Zoning Ordinance of the Village of Coal Valley to build an accessory building that exceed 75% of the square footage of the principal building at the address of Lot 3 Glenwood Acres Subdivision NW, section 20, T17N, R1E, Lands incorporated, Coal Valley, Illinois. And Application for a variance on installation of solar light poles along the Village Right-of-way at ILCV Candle MHP LLC 1503 W 1st Ave Coal Valley, IL 61240. Requirements as listed in Title IX Streets Public Ways and Public Property, Chapter 7 Right-of-Way, Section 2 Encroachment of the Code of Ordinances of the Village of Coal Valley.

Administrator Ernst stated that January 24, 2018 Glen Rhome and Englebey were approved to build a Shouse/Villas at Creekside Villas in Coal Valley, IL. Now a new resident in Glenwood acres would like a similar variance as he wants to build a pole barn style home with the garage area being more than 75% of the square footage of the principal building. Ms. Ernst stated that it was approved by the Planning and Zoning Board. Jamie Just stated that the building meets all of the building codes and has a continuous footing. Discussion held. Engstrom made a motion to approve the variance recommended by Planning and Zoning to allow Lot 3 Gelnwood Acres to have a Shouse that’s accessory building exceeds 75% of the square footage of the principal building. Hoyt seconded, ayes - 6, nays – 0. Motion passed. Jamie Just stated that Candle Light Mobile Home Park purchased solar lights that they are wanting to install on the Village easement next to where their fence was installed. They are requesting a letter from their attorney to state that if the Village has to remove a light pole to get to a utility service that the Mobile Home Park is responsible for the repair to the light. Mayor Bartels stated that there are too many unknowns as there is no maps on where Candle Lights’ property ends and IDOT’s begins. Stickell stated that it could be a nuisance if the city employees had to get to the utility. Discussion held. Argo made a motion to table the variance. Keppy seconded, all trustees were in favor of tabling the item. B. Consideration and Approval to move forward with commitment of $100k

contribution funds for the REBUILD IL Competitive Public Infrastructure Grant for the Niabi Zoo Road Water Main extension and erection of a storage tank at Well #4.

Ms. Ernst stated that she is working on application for a 100% funding grant for REBUILD IL for the water main extension and erection of a storage tank at Well #4. If the grant is accepted and the Village provides $100,000 towards the project, it will help with our scoring points. If we do not get selected the funds will go back into a CD at Black Hawk Bank and Trust. Keppy and Engstrom think it’s a good idea. Mayor Bartels stated that he hopes it will bring new

development if it’s granted. Engstrom made a motion to approve moving forward with a commitment of $100,000 contribution of funds for the REBUILD IL Competitive Infrastructure Grant. Keppy seconded, ayes – 6, nays – 0. Motion passed.

C. Approval of Monthly Bills

Trustee Keppy asked what the charge for Cummins Well #4 generator repair was for. Ernst stated that a block heater went out. Keppy asked if she could look to see if there is a warranty on that. A motion was made by Trustee Stickell to approve the bills presented for payment. Trustee Hoyt offered a second to the motion. Roll Call: ayes-6, nays – 0. Motion passed.

9. Adjournment

Memorandum Village Administrator To: Mayor, Village Board Subject: 2020 Budgeted Squad Cars Date: May 15, 2020 The Village Board approved for the purchase of two squad cars in 2020. Unfortunately, we are in the midst of a pandemic and Ford Motor Company are not producing any police vehicles, meaning that we will not be receiving the 2020 model, and possibly their 2021 models. This will cause an increase in cost and put us behind on the vehicle rotations. Chief Whitney and Lieutenant Krebs reached out to Currie Motors in Frankfort IL and they have two, 2020 Police Interceptor AWD, one with a light bar and the other a slick top. Each squad is $45,312. One of the squads will be financed through Blackhawk Bank and Trust (2.5% for three years, but we will pay off in one year).. Recommendation It is recommended that the Village move forward with the purchase of the two Police Interceptor Squads ($45,312 each) from Currie Motors. One squad was budgeted for year 2020, with the understanding that we would finance the second one and pay off in 2021.. Vendor: Currie Motors Currie Commercial Center

RESOLUTION #

SYSTEM (NIMS) FOR THE VILLAGE OF COAL VALLEY

WHEREAS, the Homeland Security President Directive/HSPD-5 established the National Incident Management System (NIMS); and WHEREAS, the NIMS establishes a single, comprehensive approach to domestic incident management to ensure that all levels of government across the Nation have the capability to work efficiently and effectively together using a national approach to domestic incident management; and WHEREAS, the NIMS provides a consistent nationwide approach for Federal, State and Local governments to work together to prepare for and respond to, and recover from domestic incidents regardless of the cause, size or complexity; and WHEREAS, beginning October 1, 2004, all Federal departments and agencies shall make adoption of the NIMS a requirement for providing Federal preparedness assistance through grants, contracts or other activities to local governments. NOW, THEREFORE, BE IT RESOLVED THAT: The Village of Coal Valley hereby adopts the National Incident Management System (NIMS) as its system of preparing for and responding to disaster incidents and the Village of Coal Valley hereby adopts the Rock Island County NIMS plan for its own use during such emergencies. Passed this day , 2020.

VILLAGE OF COAL VALLEY ORDINANCE NO.

AN ORDINANCE AMENDING SECTION 6 SEWER LINES OF CHAPTER 3 PLUMBING CODE OF TITLE IV – BUILDING REGULATIONS

NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND THE BOARD OF TRUSTEES OF THE VILLAGE OF COAL VALLEY, ILLINOIS, THAT THE FOLLOWING AMENDMENT BE ADOPTED:

TITLE IV – BUILDING REGULATIONS.

CHAPTER 3 – PLUMBING CODE

Section 1. ADOPTION.

Add 1.3 Sump Pump/Storm/Ground Water Drainage System

a. All existing, new construction/remodeling/room additions where the installation of drain tiling and/or sump pump that discharges/moves ground water/storm water from the structure will require installation of a drainage system that moves that water to a Village storm water main, or Village approved/platted drainage ditch/easement, or ensures such discharge remains on the property. Storm water and ground water discharge, however, cannot be directly discharged/drained on to Village streets, into Village street gutters, over Village sidewalks, or on to neighboring properties. Storm water and ground water discharge shall be discharged a minimum of 3’ and maximum 10’ from any principal building and/or structure. The storm/ground water discharge system installed by the contractor/owner must be inspected by the Village MS4 Manager or Plumbing Inspector. Tapping on to an existing storm water main will require a $250 tap on fee and must be inspected by the Village MS4 Manager or Plumbing Inspector. Under no circumstances will ground water or storm water be discharged into the Village’s sanitary sewer system. AN ORDINANCE ADOPTING A POLICY PROHIBITING SEXUAL HARASSMENT

FOR THE VILLAGE OF COAL VALLEY

WHEREAS, the Illinois General Assembly previously enacted Public Act 100-0554, an Act concerning government, which became effective November 16, 2017;

WHEREAS, pursuant to the Act, the Village of Coal Valley adopted an ordinance adopting its policy to prohibit sexual harassment;

WHEREAS, the Illinois General Assembly enacted Public Act 101-0221, an Act concerning employment, which became effective August 9, 2019, requiring the amendment of sexual harassment policies;

WHEREAS, all prior existing sexual harassment policies of the Village of Coal Valley shall be superseded by the Policy Prohibiting Sexual Harassment adopted by this ordinance; and

WHEREAS, should any section or provision of this ordinance or the adopted Policy Prohibiting Sexual Harassment be declared to be invalid, that decision shall not affect the validity of this ordinance or adopted Policy Prohibiting Sexual Harassment as a whole or any part thereof, other than the part so declared to be invalid;

NOW, THEREFORE, be it ordained by the corporate authorities of the Village of Coal Valley the following:

Section 1. The Policy Prohibiting Sexual Harassment, included as Exhibit A to this ordinance, is hereby adopted.

Section 2. This ordinance shall be in full force and effect on May 20, 2020.

EXHIBIT A

PROHIBITING SEXUAL HARASSMENT

I. PROHIBITION ON SEXUAL HARASSMENT

It is unlawful to harass a person because of that person’s sex. The courts have determined that sexual harassment is a form of discrimination under Title VII of the U.S. Civil Rights Act of 1964, as amended in 1991. All persons have a right to work in an environment free from sexual harassment. Sexual harassment is unacceptable misconduct which affects individuals of all genders and sexual orientations. It is a policy of the Village of Coal Valley to prohibit harassment of any person by any municipal official, municipal agent, municipal employee, municipal agency or municipal office on the basis of sex or gender. All municipal officials, municipal agents, municipal employees and municipal agencies or municipal offices are prohibited from sexually harassing any person, regardless of any employment relationship or lack thereof.

II. DEFINITION OF SEXUAL HARASSMENT

This policy adopts the definition of sexual harassment as stated in the Illinois Human Rights Act, which currently defines sexual harassment as:

Any unwelcome sexual advances or requests for sexual favors or any conduct of a sexual nature when:

• Submission to such conduct is made a term or condition of an individual’s employment, either explicitly or implicitly; or

• Submission to or rejection of such conduct by an individual is used as the basis for employment decisions affecting such individual; or

• Such conduct has the purpose or effect of substantially interfering with an individual’s work performance or creating an intimidating, hostile or offensive working environment.

Conduct which may constitute sexual harassment includes, but is not limited to:

• Verbal Harassment: sexual innuendos, suggestive comments, insults, humor, jokes about: sex, anatomy or gender-specific traits, sexual propositions, threats, repeated requests for dates; or, statements of a sexual nature about other employees, even outside of their presence.

• Non-verbal Harassment: suggestive or insulting sounds (whistling), leering, obscene gestures, sexually suggestive bodily gestures, “catcalls,” “smacking” or “kissing” noises.

• Visual: posters, signs, pin-ups or slogans of a sexual nature, viewing pornographic material or websites.

• Physical Harassment: touching, unwelcome hugging or kissing, pinching, brushing the body, any coerced sexual act or actual assault.

• Textual/Electronic Harassment: “sexting” (electronically sending messages with sexual content, including pictures or video), the use of sexually explicit language, harassment, cyber stalking and threats via all forms of electronic communication

(email/text/picture/video messages, intranet/online postings, blogs, instant messages and posts on social network websites, like Facebook and Twitter).

The most severe and overt forms of sexual harassment are easier to determine. On the other end of the spectrum, some sexual harassment is more subtle and depends, to some extent, on individual perception and interpretation. The courts will assess sexual harassment by a standard of what would offend a “reasonable person.”

III. PROCEDURE FOR REPORTING AN ALLEGATION OF SEXUAL HARASSMENT

An employee who either observes sexual harassment or believes herself/himself to be the object of sexual harassment should deal with the incident(s) as directly and firmly as possible by clearly communicating her/his position to the offending employee, and her/his immediate supervisor. It is not necessary for sexual harassment to be directed at the person making the report.

Any employee may report conduct which is believed to be sexual harassment, including the following:

• Electronic/Direct Communication. If there is sexual harassment behavior in the workplace, the harassed employee should directly and clearly express her/his objection that the conduct is unwelcome and request that the offending behavior stop. The initial message may be verbal. If subsequent messages are needed, they should be put in writing in a note or a memo.

• Contact with Supervisory Personnel. At the same time direct communication is undertaken, or in the event the employee feels threatened or intimidated by the situation, the problem must be promptly reported to the immediate supervisor of the person making the report, a department head, a director of human resources, an ethics officer, the city manager or administrator or the chief elected official of the municipality. The employee experiencing what she/he believes to be sexual harassment must not assume that the employer is aware of the conduct. If there are no witnesses and the victim fails to notify a supervisor or other responsible officer, the municipality will not be presumed to have knowledge of the harassment.

• Resolution Outside Municipality. The purpose of this policy is to establish prompt, thorough and effective procedures for responding to every report and incident so that problems can be identified and remedied by the municipality. However, all municipal employees have the right to contact the Illinois Department of Human Rights (IDHR) or the Equal Employment Opportunity Commission (EEOC) for information regarding filing a formal complaint with those entities. An IDHR complaint must be filed within 300 days of the alleged incident(s) unless it is a continuing offense. A complaint with the EEOC must also be filed within 300 days.

• Allegations of Sexual Harassment made against an elected official of the governmental

unit by another elected official of a governmental unit. In addition to the methods of reporting included above, an elected official may request an independent review of a complaint of sexual harassment by another elected official. The request shall be made to the human resources director, the city manager or administrator or the chief elected official of the municipality. The official receiving the request shall take immediate action in keeping with the procurement process of the municipality to retain a qualified individual or entity for the independent review of the allegations of sexual harassment in violation of this policy. The outcome of the independent review shall be reported to the corporate authorities.

Documentation of any incident may be submitted with any report (what was said or done, the date, the time and the location), including, but not limited to, written records such as letters, notes, memos and telephone messages.

All allegations, including anonymous reports, will be accepted and investigated regardless of how the matter comes to the attention of the municipality. However, because of the serious implications of sexual harassment charges and the difficulties associated with their investigation and the questions of credibility involved, the claimant’s willing cooperation is a vital component of an effective inquiry and an appropriate outcome.

IV. PROHIBITION ON RETALIATION FOR REPORTING SEXUAL HARASSMENT

ALLEGATIONS

No municipal official, municipal agency, municipal employee or municipal office shall take any retaliatory action against any municipal employee or official due to a municipal employee’s or official’s:

• Disclosure or threatened disclosure of any violation of this policy; or • Providing information related to an investigation or testimony before any public body

conducting an investigation, hearing or inquiry into any violation of this policy; or • Assistance with or participation in a proceeding to enforce the provisions of this policy.

For purposes of this policy, retaliatory action means the reprimand, discharge, suspension, demotion, denial of promotion or transfer or change in the terms or conditions of employment of any municipal employee that is taken in retaliation for a municipal employee’s or official’s involvement in protected activity pursuant to this policy.

No individual making a report will be retaliated against, even if a report made in good faith is not substantiated. In addition, any witness will be protected from retaliation.

Similar to the prohibition against retaliation contained herein, the State Officials and Employees Ethics Act (5 ILCS 430/15-10) provides whistleblower protection from retaliatory action, and this policy prohibits retaliatory action such as reprimand, discharge, suspension, demotion, or denial of promotion or transfer that occurs in retaliation for an employee who does any of the following:

• Discloses or threatens to disclose to a supervisor or to a public body an activity, policy or practice of any officer, member, agency or other employee that the employee reasonably believes is in violation of a law, rule or regulation; or

• Provides information to or testifies before any public body conducting an investigation, hearing or inquiry into any violation of a law, rule or regulation by any officer, member, agency or other employee; or

• Assists or participates in a proceeding to enforce the provisions of the State Officials and Employees Ethics Act or this policy.

Pursuant to the Whistleblower Act (740 ILCS 174/15(a)), an employer may not retaliate against an employee who discloses information in a court, an administrative hearing, before a legislative commission or committee or in any other proceeding, where the employee has reasonable cause to believe that the information discloses a violation of a state or federal law, rule or regulation. In addition, an employer may not retaliate against an employee for disclosing information to a government or law enforcement agency, where the employee has reasonable cause to believe that the information discloses a violation of a state or federal law, rule or regulation. (740 ILCS 174/15(b)).

According to the Illinois Human Rights Act (775 ILCS 5/6-101), it is a civil rights violation for a person, or for two or more people to conspire to retaliate against a person because she/he has opposed that which she/he reasonably and in good faith believes to be sexual harassment in employment, because she/he has made a charge, filed a complaint, testified, assisted or participated in an investigation, proceeding or hearing under the Illinois Human Rights Act.

An employee who is suddenly transferred to a lower paying job or passed over for a promotion after filing a complaint with IDHR or EEOC, may file a retaliation charge within 300 days of the alleged retaliation.

V. CONSEQUENCES OF A VIOLATION OF THE PROHIBITION ON SEXUAL

HARASSMENT

In addition to any and all other discipline that may be applicable pursuant to municipal policies, employment agreements, procedures, employee handbooks and/or collective bargaining agreements, any person who violates this policy or the Prohibition on Sexual Harassment contained in 5 ILCS 430/5-65, may be subject to a fine of up to $5,000 per offense, applicable disciplinary actions or discharge by the municipality and any applicable fines and penalties established pursuant to local ordinance, state law or federal law. Each violation may constitute a separate offense. Any discipline imposed by the municipality shall be separate and distinct from any penalty imposed by an ethics commission and any fines or penalties imposed by a court of law or a state or federal agency.

VI. CONSEQUENCES FOR KNOWINGLY MAKING A FALSE REPORT

A false report is a report of sexual harassment made by an accuser to accomplish an outcome other than stopping sexual harassment or stopping retaliation for reporting sexual harassment. A false report is not a report made in good faith which cannot be proven. Given the seriousness of

the consequences for the accused, a false or frivolous report is a severe offense that can itself result in disciplinary action. Any person who intentionally makes a false report alleging a violation of any provision of this policy shall be subject to disciplinary action or discharge pursuant to applicable municipal policies, employment agreements, procedures, employee handbooks and/or collective bargaining agreements.

In addition, any person who intentionally makes a false report alleging a violation of any provision of the State Officials and Employees Ethics Act to an ethics commission, an inspector general, the Illinois State Police, a State’s Attorney, the Attorney General or any other law enforcement official is guilty of a Class A misdemeanor. An ethics commission may levy an administrative fine of up to $5,000 against any person who intentionally makes a false, frivolous or bad faith allegation.
