The Transportation Safety Board of Canada has launched a probe into an incident at a Vaughan rail-way yard that saw a train pulling dozens of railcars, including one loaded with dangerous goods, run-

away and travel several kilometres down a busy stretch of track.

A train with 74 rail cars — one of which contained hazardous goods identified in a CBC news report as “a load of an ethanol/gasoline mix-ture”— rolled away, uncontrolled, from CN Railway’s MacMillan Yard,

in the Keele and Langtsaff Road on June 17.

Chris Krepski, a Transportation Safety Board (TSB) spokesman, said in an interview that a CN yard crew was “performing a switch-ing operation” using a remote con-trolled system, known as a “belt

pack,” and while pulling it out onto the main track, in an attempt back into the yard, the train got away from them.

It travelled southbound for about five kilometres and reached speeds of up to 29 miles per hour

Vaughan councillors have reason for opti-mism, but admit they’ve never seen a public backlash such as meted out by Thornhill residents last week opposing redevelopment of the Sobeys plaza.

“Go back to the drawing board”.This was the message residents had for

RioCan at a public hearing at Vaughan City Hall June 21.

The hearing related to the redevelopment of Springfarm Marketplace, known as Sobeys plaza at the corner of Clark and Hilda Ave-nues in Thornhill.

RioCan Real Estate Investment Trust is the largest real estate investment trust (REIT) in Canada with ownership interests in more than 350 retail properties throughout North America.

RESIDENTS PACKED CITY HALL

Residents packed council chambers, with some having to sit on steps, stand in the aisles or gathered in an overflow room.

During deputations, residents were criti-cal of RioCan’s development application. They critiqued the suggested closing of the plaza’s Hilda Street entrance, the height of the proposed 20-storey condo building and what they said was a failure to abide by Vaughan’s official plan and existing bylaws.

They also lamented the conduct of Rio-Can, saying the company did not listen to public feedback on proposed changes to the plaza.

After presentations from the public, David McKay, a planning consultant for RioCan said “some aspects, we didn’t realize or look at. We will work together on the proposal,” adding “They (RioCan) are here to stay.”

Meanwhile, one resident complained Rio-Can does not appreciate the cultural unique-ness of the plaza, which has a kosher super-market, restaurants, a Jewish bookstore and gift shop and more.

“It has become essential for a way of life,” said Phil Weintraub, adding that this Sobeys is the only kosher supermarket in the chain

and the Second Cup is the only kosher one in that chain.

“RioCan has not taken the time or the effort to learn about the community,” he said. “The uniqueness of the plaza must be respected.”

“Reject the proposal. Send RioCan back to the drawing board,” he said to applause.

Sandra Zeggil has been a Thornhill resi-dent for 27 years and suggested zoning at the site does not allow for a 20-storey condo.

While she is not against re-development, the proposed condo would “overwhelm the plaza”, she said.

The development application violates bylaws and the city’s official plan with its height, density and how far back it is on the property, said Pamela Levy-Taraday, presi-dent of the SpringFarm Ratepayers Associa-tion.

She presented a petition, representing 2,500 residents who are against the current development application.

‘WITHIN OFFICIAL PLAN’

“The community will accept change. Development must be within official plan and bylaws,” she said.

Long-time resident Fred Winegust is con-cerned too many parking spots will be lost during construction.

He pointed to a parking survey that found 88 per cent of the people using the plaza take cars to get there.

If it’s inconvenient to shop, people will go elsewhere, he said.

Towards the end of the public hearing, Councillor Sandra Racco provided optimism: “There’s no reason RioCan won’t work with you. I believe they will,” she said.

Councillor Alan Shefman remarked on the passion of the residents, saying in the 12 years he has been councillor, “I’ve never seen reaction to any proposal like I’ve seen around this. The passion people express about what is being proposed is unique.”

McKay said “the application got a strong reaction,” adding, “I’ve got my work cut out for me.”

Neighbours form united front over condo at

Sobeys plaza RioCan wants to redevelop the Sobeys plaza and build a 20-storey condo project.

for the perfect home in Vaughan. At the top of the nature lover’s list of must-haves was that the house back onto a ravine.

So when a two-door-garage home in Maple came on the market in 2007, the mother of three jumped on the listing, and loved what she saw: a backyard that blended in with a thick forest behind it, the sounds and sights of rare birds flying overhead, and chipmunks peeking in from beyond a chain fence.

Before she sealed the deal, Dykhtan says she did her due diligence and asked the city about the likelihood of development on the neighbouring property, which she knew was privately owned. Dykhtan and other neighbours said they were told by the city’s planning department that such a notion was far-fetched. “It’s environmentally pro-tected land. It won’t be developed for 99 years,” Dykhtan said she was told.

A decade later, the 4.5-hectare environ-mentally sensitive property at 230 Grand Trunk is at the centre of a development saga that residents say has left them feeling “betrayed” by the city.

Developer Cam Milani is proposing

to build 105 townhomes on Oak Ridges Moraine land that is believed to contain a number of endangered and rare spe-cies. Earlier this year, an Ontario Munici-pal Board (OMB) settlement was struck between the developer, the city and the Toronto and Region Conservation Author-ity (TRCA) that allows some of the land to be developed based on further environ-mental studies.

The city says the details of the settlement can’t be made public because of confidenti-ality provisions. Milani did not respond to requests for comment about the develop-ment.

Residents say they feel misled by the city, and don’t know what to believe anymore. Dykhtan said she was “shocked” when she saw a sign for the development proposal on the property late last year. “For me, it’s like my whole belief was destroyed because . . . the only reason why we moved there was I, personally, wanted to be closer to nature and I wanted to see the trees and the birds,” she said.

The property was previously owned by landowner Eugenio Iacobelli, who spent much of his life trying to see the land devel-oped. He appealed the city’s designation of

Celebrate our unity, civilityn Friday, July 1, we Canadians pause to celebrate another year as just that: Canadians.

We have been able to do that for 149 years now, and let’s be honest: it feels good.

We’re a good country, after all. We look after each other, and try to extend that compassion abroad. We have bad days — who doesn’t? — but on balance we’ve lived our 149 years well, and we look pretty good for our age.

The same can’t be said for the rest of our family of nations, and it’s tempting to feel smug about that.

The United Kingdom, to whose Queen we still swear allegiance, is not doing well at all. In an ill-man-aged referendum, its people have voted to take it from the European Union, in the process throwing its economy, and the world’s econo-my, into turmoil.

The vote to leave was decisive but not universally so, and now the UK is on the verge of frag-mentation, with Scotland poised to hold another independence referendum, not two years after it narrowly voted to remain in the

UK. This time, with EU member-ship in the balance, polls indicate the Scots might well succeed.

We in Canada have flirted with this sort of thing in the past, through two nail-biting referen-dums in Quebec, each of which might have put us in a similar place: a country split at the seam, where nativism and nationalist intransigence make dissolution seem inevitable.

Good for us that we didn’t take the plunge. We’re still here, in one piece, with the capacity to engage ourselves and the world as proud Canadians.

Let’s be proud, then: proud, but not smug.

It is unlikely-to-impossible that separatists in Quebec could mar-shal support for another referen-dum any time soon — the Parti Quebecois has yet to find a leader, and in any case will not be in a position to govern until the fall of 2018, when the next provincial election is scheduled.

But it is a point for sober reflec-tion this Canada Day, just how precious is our unity and civility, and how easy it is for a nation — any nation, even our own — to allow that to slip away.

here should be a special punishment for people who perpetrate scams on the elderly, the same way we might dish out extra pun-

ishment to someone who committed a crime against a child.

For there is something uniquely cruel about stealing money from an older person, money they likely spent their whole life saving. Money they need, now that they are retired and don’t have the income afforded by a job.

Not that all older people are suscep-tible to this kind of thing. But some are.

Whether it’s a decline in their cog-nition, an inclination as they age to be trusting of authority figures, or an ease with which they can be bullied because physically they may feel frail, I’ll leave that to the experts.

My first experience with this phe-nomenon was in a newsroom, when a call came in from a man in Waterloo (I was in North York, where he’d lived 20 years earlier — he remembered the name of the paper and looked it up) telling me how he had been sold a

vacuum by a door-to-door salesman.His wife had passed away. He was

living on his own. He wasn’t thinking very clearly. He was also sad. He prob-ably should have been in a long-term care facility.

And that’s when the vacuum sales-man appeared at his door. Talked to

him. Did some dem-onstrations. Told him his old vacuum was no good. And sold him a new vacuum — for $3,600.

Unless it was a vacuum that also did dishes, cooked his meals, projected 400 TV channels in high-definition and he could fly around the neighbourhood in it,

like it was a helicopter, it was not worth $3,600.

“You know you can buy a vacuum at the department store for maybe $300,” I told him. “And that’s a really good one.”

He knew this. Or was remembering

this was the case. But the door-to-door salesman had caught him on a bad day.

It had taken him a couple of weeks to realize what had happened. That vacuums don’t cost $3,600. But he had not had a clear thinking day for a while and when he finally did, he was embarrassed.

I gave him credit for calling in. Told him there must be consumer protec-tion legislation about selling some-thing for way, way more than it’s worth. And that there might be a cooling off period to get out of a contract.

I found him a couple of phone numbers. Asked him about his family and told him maybe he should think about calling his daughter to tell her what had happened. She could help.

And that it’s nothing to be ashamed of.

That these people are out there, preying on the elderly. He’s just a vic-tim. That the world had changed and that’s the way things are these days.

There have been appeals in Markham and elsewhere recently try-ing to stop door-to-door solicitation —

something that would require an army of bylaw officers and be difficult and costly to enforce, in my view.

Education is probably the key, for the elderly, their families, and for young people seeking work.

We’ve all seen the pushy twenty-something with the clipboard claiming there’s something wrong with our fur-nace or hot water tank. The caller who tells you there’s something wrong with your computer — send them a cheque, they’ll fix it. The guy trying to sign you up for snowplowing by a company that does not exist.

When you are young and healthy and have your wits about you, it’s not a problem to tell these people to get lost.

But not all of us will stay sharp into old age.

When these scammers are caught and convicted, I say they should do extra jail time because of the helpless-ness of their victims.

But then you wonder if any of these scammers is ever caught, or receives real punishment.

Another thing that has changed these days.

Senior crime? You should do extra time (although few do any)

the land as natural areas within the Oak Ridges Moraine to the OMB.

“The land had always been protected as open space,” said Councillor Sandra Racco, who added the city even considered buying the property to protect it, and had plans to defend the land at the OMB hearing.

That’s the city position the residents remember. “It was clear the city always told us they were on our side,” said resident Furio Liberatore.

Residents say that changed after April 2015, when Milani’s Dufferin Vistas bought the property from Iacobelli’s widow for nearly $4 million, according to land registry papers. According to a condition of the sale, the final payment would be made in the first week of October 2015, once the outstanding OMB hearing was over — and under the condition the land could be developed.

The hearing never happened. On Sept. 30,

residents were told in a letter from the city that the OMB settlement had been reached.

Residents were shocked when they received the notice of settlement — and have been searching for information ever since.

“I don’t know how we got to this,” said resident Codruta Papoi, speaking at a TRCA meeting. “Everything has changed since this developer took over.”

Residents wonder how a piece of land considered off-limits for decades managed to get a stamp of approval from the TRCA and the city.

The city says it “appeared at the OMB in support of a settlement,” with Milani. “We cannot specify the nature of the settlement negotiations with the appellant or discus-sions that took place in closed session in respect of the settlement as that would breach confidentiality requirements.”

The TRCA says it intervened on behalf of the environment. At a heated TRCA meet-ing last month, the conservation authority blasted Vaughan for leaving it “alone at the altar” to protect environmental features.

“TRCA was placed in a unique situation

of attending an OMB hearing in opposition to the proposed land use designation with-out the support of the provincial, municipal and regional partners,” said Kathy Stranks, a manager in the CEO’s office, in a letter about the development.

“The normal process is that the TRCA and the municipality work together . . . and in this situation we were on our own to make sure the environmental policies were implement-ed,” said Carolyn Woodland, senior director of planning, green space and communica-tions with the TRCA.

The OMB settlement divides the land into an eastern portion that contains significant wetland and endangered species that will not be developed, a middle portion that requires further study, and a western portion, where the woodlot once stood, which has been approved for lowrise development.

In a motion passed in May, the TRCA said

any further settlement would have to include the involvement of all levels of government and consider all environmental policies.

Extensive studies are needed before devel-opment be approved, Woodland said.

Racco says she has convened a working group of residents to sit down with Milani and find a mutually agreeable plan for how development takes shape. She wants to avoid the matter ending up at the OMB again, and the possibility of “losing control,” she said.

The property still needs to be rezoned. At a hearing this week, the TRCA said studies submitted by Milani were “incomplete” and “deficient.”

Liberatore says it’s the “responsibility of the municipality to protect and conserve environmentally sensitive lands. I feel that the municipality is failing in this respect,” he said. “I hope the city has the best interests of the residents moving forward.”

(47 km/h) before coming to a stop on an uphill grade, according to Krepski.

A CN crewmember was stranded on board at the time.

The runaway train rolled along the main track of the CN York Subdivision, part of one of the busiest rail lines in Canada. But the train did not derail, no injuries were reported and there were no other locomotives coming through the area at the time, Krepski said.

CN reported the incident to the TSB and is cooperating with the probe, he added.

“We’ve begun our investi-gation and we’re in the data gathering phases. There’s information to gather then we have to do analysis of it

and write the report,” Krepski said.

He couldn’t say how long it will take to complete its investigation and report any findings.

“Each case is a little dif-ferent, but we take the time necessary to do a thorough investigation,” Krepski said.

CN spokesman Patrick Waldron said the company has conducted its own review and “has taken corrective action to prevent such inci-dents in the future.”

But Eddy Aceti, who lives near the MacMillan Yard and has voiced concerns about incidents there in the past, said he’s worried about the safety of area residents.

“The rail companies will claim to take corrective action to prevent these types of inci-dents but the truth is derail-

ments and runaway trains continue to occur regularly,” he wrote in an email. “Not long ago it was reported in the news that (hundreds) of derailments occurred with-out even being reported to the TSB.”

He also noted that TSB’s website lists at least five pre-vious incidents at the Mac-Millan Yard.

“Imposing more strict regulation on our rail indus-try may slightly reduce profit margins but it will not bring the Canadian economy to a screeching halt, so I fail to see why the industry should risk another Lac-Megantic trag-edy,” he said.

Forty-seven people died in the Quebec town, back in 2013, when a runaway freight train carrying crude oil derailed and exploded.

Man dies after garbage truck, tractor trailer collide on Hwy. 427 extension

The driver of a garbage truck sustained fatal injuries Friday in a collision with a tractor trailer in Vaughan.

The collision took place just after 12:30 p.m. on Regional Road 99 (also known as the Hwy. 427 exten-sion), north of Hwy. 7.

The driver of the garbage truck, a 55-year-old Barrie man, was transported to hospital, where he later suc-cumbed to his injuries.

The other driver was taken to hospital with non-life-threatening injuries.

Regional Road 99 was closed in both directions from Hwy. 7 to Zenway Boulevard for several hours for the col-lision investigation, according to York Regional Police.

Any witnesses who have not yet spoken with police are asked to come forward.

The opening of Vaughan’s hospital is still a few years away, but at least you no longer have to pay long distance charges to call Mackenzie Health’s central switchboard.

That’s right, the local hospital corpora-tion launched a new local phone number - 905-832-4554 – to serve residents across Vaughan.

That’s because the existing number, 905-883-1212, is long distance in some parts of the city.

The new phone number doesn’t replace the existing one, but it does connect “seam-lessly” to Mackenzie Health’s switchboard, according to a news release.

In addition to Mackenzie Richmond Hill hospital, Mackenzie Health operates a number of services in Vaughan including an Urgent Care Centre (UCC), Chronic Kidney Disease Program (dialysis services) and an adult day program at 9401 Jane St., as well as Domestic Abuse Care and Resource Centre (DASA) and Diabetes Education Program and Chronic Disease Wellness Centre at 955 Major Mackenzie Dr. West.

Construction on the new Mackenzie Vaughan Hospital is slated to begin in the fall and could take three to four years to complete.

The study was conducted in accordance withthe requirements for Schedule “B” projects as prescribed in the Municipal Class EA (2010, asamended in 2007 and 2011) under the Ontario Environmental Assessment Act. Upon completionof the EA, the City of Vaughan was able to proceed to implementation of the preferred solutionto rahabilitate the bridge.In 2015, the City of Vaughan conducted a structural assessment of the existing bridge and alife cycle cost analysis of the bridge rehabilitation preferred alternative, as well as potentialalternatives for a new concrete bowstring arch bridge or structural steel girder bridge. Theresults of this assessment and analysis indicated that the preferred solution to rehabilitatethe bridge is not viable and the City of Vaughan identified a need to amend the 2013 EA inaccordance with Municipal Class EA requirements for revisions to Schedule ‘B’ projects.The Municipal Class EA acknowledges that it may be necessary to revise Schedule ‘B’ projects.A revision to the previously completed Project File has been prepared to summarize the planningprocess followed to evaluate and assess the Humber Trail Bridge alternative solutions. Followingthis revision, the preferred solution is to replace the existing bridge with a new structural steelgirder bridge.The revision to the schedule ‘B’ Project is available for public review from June 23, 2016 toJuly 22, 2016 during regular business hours (Monday-Friday, 8:30 a.m. to 4:30 p.m.) at thefollowing location:

hat ever happened to duct tape, patches and glue?

I remember a time when one of the most important rooms in our house was my dad’s workshop.

If an appliance or toy was broken then it was off to the basement to fix it so it could be used again.

It wasn’t just about saving money. Things back then had a sentimental value that we want-ed to hold onto as well.

Today, we live in a throwaway society where it’s not only easier to replace things it’s actually cheaper and more practical to do so, and that sentimental value has diminished.

It’s not necessarily good or bad it’s just evolution. We tend to embrace the new more than the old now.

I wonder then why we haven’t evolved the same way with our thoughts?

We take our painful memories into that workshop we call our mind and try to fix them just like we used to do with our things.

We go over them again and again and patch them up with justifications and rea-sons without ever considering replacing them with new ones.

Maybe they have some sort of sentimen-tal value, too?

said: “Getting over a painful experience is much like crossing monkey bars. You have to let go at some point in order to move forward.”

Just like we have done with the physical objects in our lives, at some point we need to begin ask-ing ourselves what continu-ally trying to fix things in our mind is actually costing us.

Is holding on to the idea of what was or trying to repair in our minds what should have been actually helping us to move forward, or is it more practical and economical to begin throwing those broken thoughts away?

How is it possible to move forward and grab onto new

happiness while still clinging to your old pain?

Books, movies, workshops, yoga, medita-tion, therapists and coaches are in abun-dance and yes some of them have a cost associated with them.

aura Celli-Henriques still remembers the time she found her father, Leonard Celli, slumped over, face planted on a computer

keyboard, fast asleep.The president of the Maple

Minor Baseball League was in the midst of co-ordinating teams, organizing umpires and plan-ning tournaments. In essence, he was running the league he had founded in the early 1990s.

Sleeping on a keyboard rather than a pillow was pretty common for him in those days, Celli-Hen-riques says.

Ex-wife Pina Celli agrees.“You have no idea how many

hours he put into it,” she says. “He had a real passion for base-ball.”

Leonard Celli was born on Oct. 6, 1954 in Abruzzo, Italy.

While he ended up settling in Canada and raising his fam-ily here, most of his own family remained in Italy, save for one sister who lived in Canada.

Celli-Henriques remembers her father not only as a minor baseball league president, but also as a model TTC employee — never late for work and rarely taking vacation. He was a TTC operator, driving buses and sub-ways, working for more than 26 years.

Celli-Henriques can still remember her father’s gruelling routine, starting with his work shift, which began at 4:17 a.m. each day. He would finish at 1:06 p.m., come home, take a nap, then pick his two daughters up from school and then cook din-

Leonard Celli enjoyed spending time in his native Italy, almost as much as he enjoyed volunteering, coaching and managing in the Maple Minor Baseball League for many years. Other passions included football and his family.

Lner — always a gourmet meal, she says.

The minor baseball league became a family affair, with Celli working as president, his wife doing plenty of work for the league, too, and the children pitching in.

Celli-Henriques knows her parents’ motivation for starting up the league: “Let’s do it for our kids and everyone’s kids,” they had said.

Celli explains her ex-hus-band’s motivation: “He wanted to get children off the streets,” she said, keeping them out of trouble and helping them make friends.

Celli’s interest in his children’s activities extended beyond base-ball. Celli-Henriques remem-bers one of her favourite dad moments from when she was about eight years old.

She had finished dancing in a recital in a hall that was so jam-packed, the audience was seated three or four rows high. Her dad was seated way up at the top.

As she was leaving with her mother, she heard her father yell: “Hey squirt!” She looked up and her father threw down a big bou-quet of flowers.

Little Laura caught it.“I had the biggest smile on my

face,” she remembers.Today, she can also reflect on

how much her father enjoyed another important role — that of grandfather. While living at his daughter Jennifer’s house, he engaged in a special ritual with his granddaughter, Victoria. Each day, when Victoria went to school, he ran out and bought her a chocolate toy Kinder egg

so she could have it when she returned home.

The Celli family ran the Maple Minor Baseball League for about eight years, featuring 19 teams from T-ball to juvenile, plus an “old timers” division.

In 2012, Celli suffered a heart attack during a visit to Italy to see family. On Dec. 23, 2012, he died where he was born, in Italy.

When Celli-Henriques visited Italy after her father death, she made a point of gathering every memento of him she could, now stored in a special room in her Maple home as a kind of shrine to him.

It features his cellphone, his Marlboros, his camera and his Pittsburgh Steelers jacket, which reminds her of all of the Sundays

she spent watching football with him.

Her favourite item in the room is his pajamas — “In Italy, that’s what he wore all the time.”

There is also a physical represen-tation of his love for baseball. It is a plaque, which he earned for coach-ing a children’s team — her team.

“He left too early,” she said of his untimely death at age 58.
