Moved by J. Reddy, seconded by B. Parrott, that the Vancouver Board of Education affirm the application of the United Nations Declaration on the Rights of Indigenous Peoples to its policies, procedures and decision-making and work to implement the Declaration with specific attention to Articles 14, 15, 17, and 21 of the Declaration.

2.2.2 Revised Colonial Audit Notice of Motion By October 2020, that VSB staff arrange a conversation with Indigenous leaders in order to inform development of a District plan to conduct a colonial audit of Board policies and staff procedures. The intended outcome of the audit would be the identification and removal of barriers, within policies and procedures, to the full participation of members of Indigenous communities within the VSB. The findings of the colonial audit will inform further actions as part of the District commitment to reconciliation.

The Board of Education of School District No. 39 (Vancouver) met in the Boardroom, VSB Education Centre, 1580 West Broadway, Vancouver, B.C. on Monday, February 24, 2020 at 7:00 pm. The meeting was live-streamed. Trustees Present:

1. CALL MEETING TO ORDER

1.1 Indigenous Land Acknowledgement

The Chairperson called the meeting to order and acknowledged that the meeting is being held in the traditional unceded territory of the Musqueam, Squamish and Tsleil-Waututh Nations. 1.2 Opening Remarks The Chairperson informed everyone the meeting is being live-streamed and the audio and visual recording will also be available to the public for viewing after the meeting. The footage of the meeting may be viewed inside and outside of Canada. She reviewed meeting decorum for respectful behaviour and announced that trustees and staff were wearing pink shirts in acknowledgment of February 26th Pink Shirt / Anti-bullying Day. She also acknowledged Black History Month concludes at the end of February.

2. PROGRAM HIGHLIGHTS

2.1 Youth Summit Mette Hamaguchi, Director of Instruction, introduced 6 student leaders who planned and participated in the Anti-Racism Youth Summit. The summit “What’s Your Move” was held on February 4, 2020. She acknowledged former District Principal Selma Smith and Nalda Callendar from the National Congress of Black Women for their inspiration and thanked Raman Gill and Beene Savage, Diversity Resource teachers, for their work on making the summit a reality. Students shared their experience of planning and participating in the event. A summative video, produced by Communications, was also shown. Feedback from the youth summit was presented to trustees.

3.2 Matters Arising from the Meeting of January 27, 2020

3.2.1 Field Expert (verbal) The Deputy Superintendent provided a verbal update on the field expert, Audrey Ackah, who has been engaged by the Board to implement the December 16, 2019 motion around board policies and procedures for anti-racism. 3.2.2 Advocacy Committee Trustee Wong reported on his request to be removed from the Advocacy Committee due to a conflict of meeting times.

Moved by C. Cho, seconded by O. Hanson, that the Board of Education approve a change in members of the Advocacy Committee to remove Allan Wong. Amendment Trustee Parrott proposed the motion be amended, adding at the end “and thank him for his work on this committee”. There was consensus to amend the motion. Main Motion A vote was taken on the amended motion that reads: That the Board of Education approve a change in members of the Advocacy Committee to remove Allan Wong and thank him for his work on this committee.

CARRIED UNANIMOUSLY 3.2.3 Audit Committee Moved by C. Cho, seconded by L. Chan-Pedley, that the Board of Education approve a change in the Chair of the Audit Committee from Janet Fraser to Barb Parrott.

CARRIED UNANIMOUSLY The Board Chair thanked Trustee Parrott for taking on the role of Chair of the Audit Committee.

3.3 Meeting of February 11, 2020 Moved by A. Wong, seconded by J. Reddy, that the minutes of the February 11, 2020 meeting be adopted.

CARRIED UNANIMOUSLY

3.4 Matters Arising from the Meeting of February 11, 2020 The Board Chair reported some questions raised at the meeting were answered at the February 19, 2020 Finance Committee meeting. Other questions raised will be addressed throughout the budget process.

4. SUPERINTENDENT’S UPDATE

The Superintendent provided a Prezi presentation, highlighting student voice as part of her ongoing presentation entitled Road Map for Student Success. She reported that the consideration of student voice emanates from the Deeper Learning work being done with 12 school districts across North America.

5. STUDENT TRUSTEE REPORT

The Student Trustee provided a verbal update on: • The Vancouver District Student Council (VDSC) meeting in February • Canley Cup initiative • VSB Sustainability Conference • Real Acts of Caring initiative • Another District wide survey for students, to understand the current needs of students and to

reach students of all different backgrounds

6. COMMITTEE REPORTS

The Chairperson reported work is being done on a draft procedure on how to deal with Notices of Motions as a board.

6.1 POLICY & GOVERNANCE COMMITTEE 6.1.1 Report: Meeting of February 5, 2020 The Chairperson of the Committee, F. Ballantyne, presented the report of the February 5, 2020 meeting, a copy of which is filed with these minutes. The report includes information on the following:

• Administrative Procedures Manual Updates • United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) • Revised Colonial Audit Notice of Motion • Naming and Renaming Working Group Update • Public Engagement at Board Meetings

Moved by F. Ballantyne, seconded by A. Wong, that the report of the February 5, 2020 meeting be received. In presenting the report, the Chairperson of the Committee clarified the item regarding United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) will be returning to Committee for further consideration. A trustee workshop is also scheduled for discussion of UNDRIP. A vote was taken on the motion.

CARRIED UNANIMOUSLY 6.1.2 Matters Arising from the Meeting of February 5, 2020

6.1.2.1 United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) Trustee Reddy requested the UNDRIP motion be considered at the meeting, prior to consideration of the revised Colonial Audit motion.

Moved by J. Reddy that the Vancouver Board of Education affirm the application of the

United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) to its policies, procedures and decision-making and work to implement the Declaration, with specific attention to Articles 14, 15, 17, and 21 of the Declaration.

Trustee Parrott seconded the motion, with the removal of “(UNDRIP)”. It was agreed by

consensus to amend the motion.

Moved by J. Reddy, seconded by B. Parrott, that the Vancouver Board of Education affirm

In discussing the motion, the Board Chair reported that the wording was different from the

motion moved and seconded at the October 28, 2019 Board meeting. This was acknowledged by Trustee Reddy and she confirmed this could replace the October 28, 2019 motion.

Discussion continued. Moved by L. Chan-Pedley, seconded by F. Ballantyne, that the motion be postponed to the

Board meeting of April 27, 2020. CARRIED

For: F. Ballantyne, L. Chan-Pedley, C. Cho, J. Fraser, E. Gonzalez, O. Hanson Against: B. Parrott, J. Reddy, A. Wong Trustee Parrott called a point of order that the postponement motion required a vote of more

than two thirds. The Chairperson called a recess at 8:16 pm. The meeting reconvened at 8:18 pm. The Board Chair ruled on the point of order and the motion remains carried.

6.1.2.2 Revised Colonial Audit Notice of Motion Trustee Chan-Pedley requested the following revised Notice of Motion be postponed to the Board meeting of April 27, 2020: By October 2020, that VSB staff arrange a conversation with Indigenous leaders in order to inform development of a District plan to conduct a colonial audit of Board policies and staff procedures. 6.2.2 Matter Arising from the Meeting of February 12, 2020 6.2.2.1 Notice of Motion – Vaping Moved by F. Ballantyne, seconded by L. Chan-Pedley, that the Trustees of the Vancouver

Board of Education direct the Superintendent of Schools to: 1. complete a District wide school Signage Audit (smoking/vaporizers); 2. ensure ‘no smoking’ signage is prominently displayed at all District facilities; and 3. that this signage clearly prohibits the use of vaporizers and e-cigarettes.

Amendment Moved by J. Reddy, seconded by C. Cho, the motion be amended to add at the end, “and

provides information and support for addiction.” There was consensus to amend the motion. Main Motion That the Trustees of the Vancouver Board of Education direct the Superintendent of

Schools to: 1. complete a District wide school Signage Audit (smoking/vaporizers); 2. ensure ‘no smoking’ signage is prominently displayed at all District facilities; and 3. that this signage clearly prohibits the use of vaporizers and e-cigarettes and provides

6.2.2.2 Notice of Motion – Endorsement of Coalition for Healthy School Food Moved by E. Gonzalez, seconded by B. Parrott, that the Vancouver Board of Education

(VBE) support the work of the Coalition for Healthy School Food by formally endorsing the organization and its call for the development of a universal cost-shared School Food program for Canada.

In Endorsing the Coalition, VBE would agree with the Coalition’s call for the development

of a National School Food Program and give permission to list VBE’s name, logo and description on the Coalition's website. There is no cost to the VBE to be an endorser.

Following discussion, trustees voted on the motion.

CARRIED UNANIMOUSLY 6.2.2.3 Notice of Motion – Supporting Lowering the Voting Age Trustees discussed the recommendation coming from Committee. Trustee Parrott moved

that the motion to support the Vote16 BC’s Campaign to reduce the voting age be resubmitted to the Vancouver District Students' Council for further discussion and debate.

There was no seconder on the motion. A vote was taken and there was agreement by

consensus.

Moved by J. Reddy, seconded by B. Parrott, that the Board approves the Grade 10-12 BAA courses as submitted.

6.2.2.5 Food Framework Ad Hoc Committee Terms of Reference (Attachment A)

The Board Chair reviewed the background on this item. She reported the updated Terms of Reference were provided to trustees on the day of the meeting.

The updated Terms of Reference were displayed on the boardroom screen. The Assistant

Secretary Treasurer-Financial Services reviewed changes made to the Food Framework Ad Hoc Committee Terms of Reference, incorporating feedback received to date.

Moved by J. Reddy, seconded by B. Parrott, that the Vancouver Board of Education approve

the revised Terms of Reference for the Food Framework Ad Hoc Committee. CARRIED UNANIMOUSLY

6.3 PERSONNEL COMMITTEE 6.3.1 Report: Meeting of February 5, 2020

The Chairperson of the Committee, E. Gonzalez, presented the report of the February 5, 2020 meeting, a copy of which is filed with these minutes. The report includes information on the following:

7.1 Meeting of February 24, 2020 The Chairperson reported that the Board of Education authorized the Board Chair to report to the Public Meeting that, at the Private Session of February 24, 2020 the Board discussed matters related to properties, personnel and legal matters and the Board approved:

That the Board Chair contact British Columbia Public School Employers’ Association (BCPSEA) to express dismay for the comment in the February 12, 2020 For the Record, which states: “One-third of the provinces 60 pubic school districts do not have class composition language – those districts have been better able to consistently provide a high level of services to students” and ask for a written clarification that this was an opinion and not a statement of fact; and ask that BCPSEA refrain from making comparisons between districts on this matter.

In reviewing his report from the February 18, 2020 VSB District Diversity Advisory Committee meeting, Trustee Wong highlighted a proposed amendment to Trustee Chan-Pedley’s Colonial Audit Notice of Motion. He referred this report to Trustee Chan-Pedley, for consideration.

10. NOTICES OF MOTION

10.1 Gas and Diesel Generator Pollution Eliminator Strategy Trustee Gonzalez presented a memorandum dated February 20, 2020 entitled Notice of Motion – Gas and Diesel Generator Pollution Elimination Strategy, which includes the following proposed motion: That the VBE develop a strategy to transition the Vancouver School Board and its facility users away from the use of gas and diesel-powered generators.

That the work would include:

• A review of current practices regarding the use of generators in relation to VSB operations, contracted partners and anyone working within the VSB system, with a particular focus on sites used by the film industry;

• That staff approach the City of Vancouver and Park Board who are in the process of reviewing this same strategy and to look at ways to work together and share data;

• That the strategy be inclusive of potential exceptions necessary for safety and emergency concerns;

• That staff develop a proposed timeline with relevant implementation and cost information on the transition, and

Food Framework Ad Hoc Committee

Terms of Reference

Attachment A

Rationale The Board of Education passed the following motion at the September 23, 2019 meeting:

That the VBE develop a holistic 10 Year Vision and Food Framework for the District and create a Food Working Group with stakeholders and external representatives to advise on this work.

The work would include:

• To develop a 10 year vision for the District that would include a Food Framework incorporating relevant key components including but not limited to: food programs, (including breakfast and lunch currently made by VSB staff and delivered to students around the district), food growing, production, distribution, nutrition, waste, security, donations, education, funding and lobbying that is in alignment with the District’s Strategic Plan and budgets, and

• Identifying the capital and operating costs associated with developing a Food Framework and its implementation.

And that next steps would be to begin the process as follows:

Duties

• After the presentation of the VSB Food Report to stakeholders in October 2019, stakeholder representatives would work with staff to develop a Terms of Reference for Board approval for the establishment of a Food Working Group (FWG).

• Targeting reporting to Trustees on the Terms of Reference by December 16, 2019, • Once the Terms of Reference are established and approved, asking staff and stakeholder

representatives to participate in the FWG and to identify additional FWG participants with relevant food experience. Possible candidates could include parents with food experience, subject matter experts in food growing (Fresh Roots, urban farmers), food production and distribution; nutritionist, Coastal Health dietician, Coalition for Healthy School Food Rep, Vancouver Food Policy reps, other relevant government representatives and city poverty groups;

• Targeting an inaugural meeting by March 2020 and to establish a meeting schedule for the group moving forward.

• The development of the Food Vision and 10-year Plan would include a focus on equity and establishing values, goals and targets with timelines and deliverables, and

• Staff would advise the Board of a delivery date for the above by June 2020.

Food Framework Ad Hoc Committee

Terms of Reference

Meeting Frequency The Ad Hoc Committee will meet one (minimum) to two times per month between March and June 2020 to create the Vision and Food Framework for consideration by the Vancouver Board of Education.

Meetings will be held Tuesday evenings at the VSB Education Centre at 1580 West Broadway, Vancouver, BC.

Members are expected to attend all meetings.

Term All members of the Ad Hoc Committee are appointed till June 30, 2020.

Membership and Criteria The membership is voluntary and will consist of VSB Trustees (2), VSB stakeholder representatives (up to 9) and at least 2 VSB student members along with public participation from individuals with relevant food experience and subject matter experts.

The Ad Hoc Committee will consist of up to a maximum of 20 members and will be chaired by a VSB Trustee, who will be appointed as per Board Policy 8. Members of the Ad Hoc Committee will go through an application process and be appointed by VSB Trustees and membership will be limited to one per group/organization. It is anticipated that VSB stakeholder representatives will choose their member to sit on the Ad Hoc Committee who will then be appointed by the VSB Trustees.

Prospective members must reside in the city of Vancouver or work for an organization they will be representing that is located in the city of Vancouver or serving its residents.

Applicants must be able to demonstrate relevant experience, knowledge or skills related to the mandate of the group. Members of equity seeking groups are encouraged to apply.

Committee members, who are not VSB stakeholder representatives, will be required to sign VSB’s Non- Disclosure and Confidentiality Agreement.

Resource personnel appointed to the Ad Hoc Committee by the Superintendent include the Associate Superintendent Learning Services, Director of Instruction, Assistant Secretary-Treasurer and a Recording Secretary.

(called the ''Board'') to adopt the Amended Annual Budget of the Board for the fiscal year 2019/2020 pursuant

to section 113 of the School Act , R.S.B.C., 1996, c. 412 as amended from time to time (called the "Act ").

1. Board has complied with the provisions of the Act respecting the Amended Annual Budget

adopted by this bylaw.

2. This bylaw may be cited as School District No. 39 (Vancouver)

Amended Annual Budget Bylaw for fiscal year 2019/2020.

3. The attached Statement 2 showing the estimated revenue and expense for the

2019/2020 fiscal year and the total budget bylaw amount of $646,841,150 for the 2019/2020 fiscal

year was prepared in accordance with the Act .

4. Statement 2, 4 and Schedules 1 to 4 are adopted as the Amended Annual Budget of the Board

for the fiscal year 2019/2020.

Reference to Strategic Plan:

Goal 3: Create a culture of care and shared social responsibility

• Increase Indigenous students’ sense of pride, self-esteem, belonging, place, acceptanceand caring in their schools

• Increase knowledge, awareness, appreciation of, and respect for Indigenous histories,traditions, cultures and contributions by all students through eliminating institutional,cultural and individual racism within the Vancouver school district learning communities

• Respect and celebrate all forms of diversity

Goal 4: Provide effective leadership, governance and stewardship

• Support effective communication, engagement and community partnerships

PROPOSED MOTION:

By October 2020, that VSB staff arrange a conversation with Indigenous leaders in order to inform development of a District plan to conduct a colonial audit of Board policies and staff procedures. The intended outcome of the audit would be the identification and removal of barriers, within policies and procedures, to the full participation of members of Indigenous communities within the VSB. The findings of the colonial audit will inform further actions as part of the District commitment to reconciliation.

Updated rationale:

I have updated the motion with feedback from the discussion at the last Policy and Governance Committee meeting and discussion with district staff. This updated rationale is intended to help explain the changes.

I clarified the scope to focus on district policies and procedures as I believe that there are systemic barriers contained therein which can be identified and removed with a Reconciliation

lens. The scope may seem narrow, but I believe it will already be a significant piece of work to undertake. Secondly, as there are many motions already addressing the district’s commitment to anti-racism, I have chosen to emphasize Reconciliation with Indigenous communities in this motion. Lastly, our desire that Indigenous communities are key voices of the audit process—and indeed, everywhere—and our urgency to take “Reconcili-Action” must be tempered by sincerely respecting their knowledge and time. As a meaningful colonial audit can only be carried out as quickly as members of the Indigenous communities are willing and able to participate, I would like the district to begin by connecting with Indigenous leaders.

1. CALL MEETING TO ORDER

1.1 INDIGENOUS LAND ACKNOWLEDGEMENT The Chairperson called the meeting to order and acknowledged that the meeting is being held on the traditional unceded territory of the Musqueam, Squamish and Tsleil-Waututh Nations. 1.2 OPENING REMARKS

The Chairperson informed everyone the meeting is being live-streamed and the audio and visual

recording will also be available to the public for viewing after the meeting. The footage of the meeting may be viewed inside and outside of Canada. She reviewed meeting decorum for respectful behavior.

2. NEW BUSINESS

2.1 Urgent Motion – Increasing Enrolling Educational Space Trustee Wong presented the following motion for consideration. It was agreed to consider the motion at the meeting as an urgent motion. Moved by A. Wong, seconded by B. Parrott, that the Vancouver Board of Education (VBE) authorizes staff to:

1. Develop and implement a plan to increase, where possible, enrolling educational space to address the challenge of having full schools where catchment Kindergarten students cannot attend, and

2. Report back to the VBE during the development of the 2020-2021 annual budget on the cost of the plan so that cost can be included in the budget as an allocation of the District’s unrestricted surplus.

The Secretary Treasurer gave a slide presentation in which he reviewed the remaining timeline for 2020-2021 budget development. In reviewing the timeline, he reported the Ministry of Education funding announcement will now be on March 12, 2020, rather than March 13, 2020. He also presented information on the Provincial Budget and the impact to educational funding over 3 years, from 2020-2022. There is an increase of $6,124 million for all public schools in 2020. In reviewing the breakdown of funding increases for 2020 he reported that, since teacher bargaining is not yet concluded, no extra funding will be in the status quo budget for teacher wage increases. Once teacher bargaining is completed, funding for teacher wage increases would be expected from the provincial government.

4. DELEGATIONS RE BUDGET PRIORITIES FOR DEVELOPMENT OF THE 2020-2021 OPERATING BUDGET

The Chairperson reviewed the Procedure for Delegations to the Board. The following delegations presented their views regarding budget priorities for development of the 2020-2021 operating budget. Written briefs were provided and retained for the Board's records.

1. Henry Hudson Parents’ Advisory Council (PAC) – Robert Ford, PAC Chair 2. Friends of School Libraries – Sandra Boutilier and Debbie Horkoff 3. Tara Gallen, Parent 4. During discussion, delegates answered questions from trustees on various points related to their presentations. The Superintendent reported staff could provide more information to trustees on:

• wifi and computer access in school libraries; and • historical data of flex time versus prep time for school librarians • rental costs for extracurricular programs at elementary schools • staffing for culinary arts at Templeton • secondary school cafeterias providing catering services

Trustee Gonzalez presented a notice of motion report dated February 20, 2020, entitled Notice of Motion – Gas and Diesel Generator Pollution Elimination Strategy, a copy of which is filed with the meeting agenda.

“That the VBE develop a strategy to transition the Vancouver School Board and its facility users away from the use of gas and diesel-powered generators. That the work would include:

• A review of current practices regarding the use of generators in relation to VSB operations, contracted partners and anyone working within the VSB system, with a particular focus on sites used by the film industry;

• That staff approach the City of Vancouver and Park Board who are in the process of reviewing this same strategy and to look at ways to work together and share data;

• That the strategy be inclusive of potential exceptions necessary for safety and emergency concerns;

• That staff develop a proposed timeline with relevant implementation and cost information on the transition, and

• That staff explore the provision of electrical infrastructure as an alternative to gas and diesel-powered generators.”

PROPOSED MOTION:

RATIONALE:

In June 2019 the Park Board passed the motion “Gas and Diesel Generator Pollution Elimination Strategy”* and in July 2019 the City of Vancouver passed the motion “Eliminating Generators: Greening Vancouver’s Film and Food Truck Industries”.** The intent of the City motion is to reduce carbon emissions generated by the film industry through their use of diesel generators. As the VBE provides film site locations and staff have identified the use of diesel generators in the district, it would make sense for VBE to work with the City and the film industry on this goal as well as support the VBE’s own sustainability initiatives. There is the potential opportunity to partner with the film industry to identify possible cost sharing opportunities. The following are highlights of the City’s motion relevant to VBE:

• The film industry is committed to a long-term goal of Vancouver becoming the most sustainable film production centre in the world;

• Vancouver’s supply of electricity is from BC Hydro, almost 97% of which is generated from renewable energy—a clean, green source of power compared to the diesel generators used by the film industry;

• In 2018 there were an estimated 2,350 filming days in Vancouver, with each filming day using at least one and an average of 2-3 diesel generators. Each generator uses, on average, 296 litres of diesel per filming day. Replacing diesel generators with electrical plug-ins and other zero emissions options means a potential reduction of 2,086,800 litres of diesel and associated GHG emissions—about 5,500 tonnes of CO2e per year;

• The City of Vancouver’s Greenest City Action Plan 2015-2020 and Renewable City plan aim to reduce Vancouver’s GHG emissions by 50%, from a 2007 baseline of 2,805,000 tCO2e by 2030 and eliminate dependence on fossil fuels before 2050, and

• Much of the filming activity and use of generators is concentrated around clusters of prime filming locations and “on location” parking lots, many of which are on or near city properties, and some of which are on School Board and Park Board properties.

In relation to schools, diesel generators could be replaced through tie-ins to school buildings or the use of electricity power drops, which can also be used as EV charging stations. Enterprise Risk Management (ERM) Project Update The Director of Enterprise Risk and Privacy Compliance presented and reviewed a memorandum

dated March 4, 2020 entitled Enterprise Risk Management (ERM) Project Status Update. The report outlines the current status of the ERM project and includes the KPMG Summary Report dated June 2018. The same report was taken to the Audit Committee of February 19, 2020. During his presentation he reported the ERM Administrative Procedure is now posted on the website.

This was provided for information. 2. Preparing for Asset Retirement Obligations The Secretary Treasurer presented and reviewed a memorandum dated March 4, 2020 entitled

Preparing for Asset Retirement Obligations. The report includes information on the new Public Sector Accounting Board (PSAB) Accounting Standard PS3280 (Asset Retirement Obligations), which will be adopted for the fiscal year 2021-2022.

The same report was taken to the Audit Committee of February 19, 2020. He reviewed information

in the attached KPMG article on preparing for asset retirement obligations and summarized the process that will be required. He reported there will be an impact on financial statements going forward.

Trustees and stakeholders provided feedback and staff provided clarification. During discussion, the Secretary Treasurer confirmed there may be opportunities to coordinate

training opportunities for staff with other districts in preparing for asset retirement obligations. This was provided for information. 3. February 19, 2020 Finance Committee Meeting Follow-up Information The Assistant Secretary Treasurer-Financial Services presented and reviewed a memorandum dated

March 4, 2020 entitled Follow up Information from February 19, 2020 Finance Committee. The report provides responses to questions asked at the February 19, 2020 Finance Committee meeting. In reviewing the responses, he highlighted that the request for head count in Adult Education was related to a Board motion which resulted in increased funds for promoting Adult Education for the 2019-2020 school year. He also highlighted that, in going forward, TTOC costs will be calculated on an annual basis.

• the student/teacher ration for Adult Education could be provided • the Adult Education enrolment numbers are based on early enrolment and further analysis

could be done to determine the results from promotion • some demographic information on Adult Education enrolment, such as the number of

Indigenous or Special Needs students, could be provided. This was provided for information. 4. Budget 2020-2021 Stakeholder Feedback and Further Discussion The Secretary Treasurer summarized meetings held to date regarding the 2020-2021 budget. He gave

a PowerPoint presentation entitled Trustees & Stakeholder Priorities – Budget 2020-2021. The presentation includes priorities identified by stakeholder groups and trustee comments. This was provided for information and to gather more feedback for developing the 2020-2021 status quo budget.

Trustees and stakeholders provided feedback and staff provided clarification. During discussion, staff confirmed further information could be provided on how many “failed to fill”

positions are covered by non-enrolling teachers. Also during discussion, staff reported the music review report will be brought to the April 15, 2020 Student Learning and Well-Being Committee meeting.

DPAC provided feedback on the public question period at public Board meetings: answers to questions are sometimes too vague, questions that are read aloud should be included in the minutes for transparency, questions could be asked by the individual using a microphone which would allow for more interaction, but it might also lead to confrontation.

Community Centres for All THAT the Urban Indigenous Peoples’ Advisory Committee requests that the Vancouver Park Board explore ways with which to incorporate Indigenous design principles, e.g. spaces for cultural practices and ceremony, and smudging policies, into future upgrades and forthcoming additions to the community centres network in the City of Vancouver.

Responses were that there was a good speed of response. Also needs to start thinking about the longer term and the transitioning to the City’s recovery. Ensure there is Indigenous Voice on, eg, Economic Recovery Committee.

The Heritage Commission had a presentation by the City’s Chinatown Transformation team. Not much was directly relevant to VSB other than there is no real childcare in Chinatown.

Presentation by City’s Chinatown Transformation team and the work they are doing on the Chinatown Heritage Asset Management Plan:

- Joint plan with City planners and members of Culture departments- After the apology in spring 2018 this task force was put together to work on this plan- Chinatown has heritage status and is a national historic site- Will look at a future possible UNESCO application, the first Chinatown to do so- This work is In line with Vancouver Heritage plan- Historic Urban Landscape approach (HUL), the first of its kind- Work includes: asset inventory, international best practices research, community

engagement, legacy stewardship, pilot projects, partnership with province,- Mapping Cultural assets: 24 building on Heritage register, but what is intangible? What makes

it special? Capturing both tangible and intangible important and now working withcommunity on this re public engagement ( ie Jun/Jul ’18) to fill gaps.

- Re boundary: have looked at 147 buildings,- Intangible: 5 categories to look at: oral traditions, performing arts, social practices,

2. As per the presentation in point 1 below, schools are NOT considered during the zoningand rezoning process, though there is communication between COV and VSB. The VSB isconsulted as part of new neighbourhood plans. This may be an area we need to work with theCity on?

1. Presentation by Rezoning Dept on rezoning process: Policies are supported by theregulatory structure ie zoning. Current zoning = city wide zoning. If you want tochange zoning to new land use or density then you go through re-zoning. Departmentthen evaluates against policies and the development/building permitting follows.Rezoning centre has 28 staff, and divided into 3 groups: housing priority (socialhousing), Metro-core (downtown, uptown areas) and Community plans (rest of thecity, 70% of area ie community plans). All communities have a plan or vision. PublicBenefits Strategy outlines needs for the various communities (at least in the newerplans ie Cambie, downtown). DCL’s and CAC’s come into play here as well re cashcontributions.

2. Councillor Bligh brought forth a motion to support the Coalition for Healthy SchoolFood to Council which passed with unanimous support. She will now take this samemotion to FCM and Councillor Fry will take it to UBCM.

3. A discussion was had on the current policy changes that take effect on April 1 at theFood Bank specifically related to income verification ie people need to demonstrateincome through the presentation of either a tax statement or 3 pay stubs. The FoodBank did not consult with stakeholders or the City on this change. The VFPC broughtforward a motion to express its concern on this change as it will exclude manyvulnerable citizens. More info to come on this.

On March 5, 2020, the Vancouver Board of Education (VBE) received a Capital Plan Response Letter from the Executive Director, Capital Management Branch of the Ministry of Education in response to the District’s 2020/21 Five-Year Capital Plan submission. The letter is attached as Appendix A. The accompanying Annual Programs Funding Agreement, outlining the respective responsibilities of the District and the Ministry associated with the Minor Capital Projects approved in the letter is attached as Appendix B.

Major Capital Projects As indicated in the letter the District has received no approvals for major capital expansion and seismic projects. Five seismic projects from previous approvals are identified as being in development. A new requirement with respect to major capital projects is to have a Concept Plan approved prior to a Project Definition Report being supported by the Ministry. While this will not be applicable to any current major capital projects as indicated in the letter, it will apply to future projects. Attached to this report as Appendix C is the Ministry document detailing what is required in a Concept Plan.

Minor Capital Projects Under the Carbon Neutral Capital Program, the District has received approval to proceed with two HVAC upgrades for Norquay Elementary and Lord Selkirk Elementary valued at $364,000 and $396,000, respectively as well as a control system HVAC upgrade at Eric Hamber Secondary valued at $20,000. Under the School Enhancement Program, the District has received approval for plumbing upgrades at five schools valued in total at $783,629 as well as Fire Suppression System upgrades at Lord Byng Secondary and Edith Cavell Elementary valued in total at $152,150. In addition, playground upgrades of $125,000 each have been approved at Queen Victoria Annex and Walter Moberly Elementary.

These Minor Capital Projects all indicate a required completion date of March 31, 2021, which would

be the normal expectation of the Ministry. The funding Certificate of Approval (COA) for these projects is normally held open until the end of the Provincial Government’s fiscal year for districts to draw down the funds to pay for projects. However due to possible delays resulting from the impact of Covid-19, the Ministry has indicated to districts that if delays are experienced the Capital Planning Officer responsible should be contacted to request an extension of the COA. The Ministry has also directed districts to conduct some market outreach before proceeding to tender to ensure there will be enough interest for competitive bidding.

Bylaw Requirement A Board of Education is required, under Section 143 of the School Act, to adopt a single Capital Bylaw for its approved Five-Year Capital Plan. The Bylaw must reference the Capital Plan Bylaw No. provided with the Capital Plan Response letter. Capital Plan Bylaw No. 2020/21-CPSD39-01 is attached for the Board’s approval.

ANNUAL PROGRAMS FUNDING AGREEMENT This Annual Programs Funding Agreement dated for reference the 1st day of March 2020, is in effect for the 2020/21 fiscal year period of April 1, 2020 to March 31, 2021.

BETWEEN: Her Majesty the Queen in Right of the Province of British Columbia, represented by the Minister of Education (the "Ministry")

OF THE FIRST PART

AND: the Board of Education of School District No. 39 (Vancouver) (the "Board")

OF THE SECOND PART.

The parties agree as follows:

1. DEFINITIONS

1.01 In this Agreement, unless the context otherwise requires:

"Agreement" means the Annual Programs Funding Agreement;

"Board" or "Board of Education" means a board of school trustees constituted under the School Act [RSBC 1996] c. 412 and any person designated by the Board to act with respect to a provision of this Agreement;

"Business Day" means a day, other than a Saturday or Sunday or Statutory Holiday, on which Provincial government offices are open for normal business in British Columbia;

"Capital Funding Grant" means a funding grant authorized by the Minister of Finance in accordance with section 56.1 of the Financial Administration Act [RSBC1996] c. 138;

"Certificate of Approval" means the Certificate of Approval described in paragraph 3.04;

“Eligible Expenditure(s)” means those expenditure(s) areas more particularly described in paragraph 3.01;

“Event of Force Majeure" means invasion, rebellion, hostilities, sabotage, government regulations or controls, acts of God, strikes, lockouts or labour disputes that are a major disabling event or circumstance in relation to the normal operations of the party concerned as a whole that is beyond the reasonable control of the party directly affected and results in a material delay, interruption or failure by such party in carrying out its duties, covenants or obligations under this Agreement;

"Minister" means the Minister of Education, and includes the Deputy Minister of Education and any person designated by either of them to act with respect to a provision of this Agreement;

"Ministry" means the Ministry of Education of the Province of British Columbia;

"Project" means the project(s) described in paragraph 3.01;

"Schools Protection Program" means the risk management program administered and delivered by the Risk Management Branch of the Ministry of Finance in conjunction with the Ministry of Education, and includes the "Schools Protection Program Reference Manual" and all amendments and updates to the program and manual;

"Treasury Board" means the Treasury Board established under the Financial Administration Act [RSBC 1996] c. 138.

3.02 The Ministry will, in no event, provide more than the amount listed above.

3.03 The Ministry will provide the capital funding in paragraph 3.01 in the form of a Capital Funding Grant.

3.04 Payment of a Capital Funding Grant is subject to the Ministry issuing a Certificate of Approval for the Project in paragraph 3.01 in accordance with Treasury Board policies and directives and to the following conditions:

a) in no case may the Board make a draw against funds available under a Certificate of Approval, unless the draw is reimbursement for Eligible Expenditure(s) properly incurred by the Board in connection with the Project;

b) the Ministry may modify or withhold a Capital Funding Grant and applicable Certificate of Approval, or any portion thereof, in the event the Board fails to observe, perform and comply with any provision of this Agreement or if, in the opinion of the Ministry, there has been a material change in the Project;

c) the Board will comply with all applicable policies and directives of the Treasury Board respecting Capital Funding Grants.

3.05 Notwithstanding any other provision of this Agreement, the payment of funds by the Ministry to the Board, pursuant to this Agreement, is subject to the provisions of the Financial Administration Act ("the Act"), which makes that payment obligation subject to:

a) there being sufficient monies available in an appropriation, as defined in the Act, to enable the Ministry, in any fiscal year or part thereof when any payment of money by the Ministry to the Board falls due pursuant to this Agreement, to make that payment;

b) Treasury Board, as defined in the Act, not having controlled or limited, pursuant to the Act, expenditure(s) under any appropriation referred to in this subparagraph a).

4. BOARD OBLIGATIONS

4.01 The Board will:

a) carry out the Project in a manner that ensures:

i) delivery within budget; ii) completion by March 31, 2021; iii) scope details are fully met upon completion; iv) accrued cost-savings realized from completed capital projects as approved

in this Agreement are reported to the Ministry and transferred into the school district’s Minister-Restricted Capital account, unless otherwise agreed to in writing by the Ministry.

b) comply with all policies and best practices related to Capital Project Procurement, as documented in the Capital Asset Management Framework and Capital Procurement Checklist published by the Ministry of Finance;

c) procure the Project in accordance with the Capital Asset Management Framework;

d) include in any contracts all standard insurance and indemnification clauses required by the Schools Protection Program;

e) all communication related to the Capital Project conforms to the “Communications Protocol Agreement on Capital Projects between the Ministry of Education and School Districts” (provided as Schedule A). Note this protocol may be amended from time to time by the Ministry, with the most current version of the protocol being used.

4.02 Provide written notice to the Ministry of Education immediately upon completion of each Project. (Note: the Ministry will be following up with school districts regarding delayed and/or incomplete projects in early January, at which time the Ministry may choose to reallocate associated funds depending on the status of the Project).

4.03 At the request of the Ministry, prepare additional reports relating to the Project.

4.04 Notify the Ministry immediately, in writing, should any Event of Force Majeure arise that could materially affect the scope, costs or schedule of the Project.

4.05 Indemnify and save harmless the Province of British Columbia and its employees and agents from and against any losses, claims, damages, actions, causes of action, costs and expenses that the Province of British Columbia or any of its employees or agents may sustain, incur, suffer or be put to at any time, either before or after this agreement ends, which are based upon, arise out of or occur, directly or indirectly, by reason of, any act or

omission by the Board or by any of its agents, employees, officers, directors, or contractors with respect to the Project.

4.06 Purchase school buses through the Request for Standing Offer (RFSO) portal available through the Association of School Transportation Services of BC (ASTSBC).

4.07 Reserve two (2) percent of the Total Funding amount provided under the Bus Acquisition Program in paragraph 3.01 as fee payment for ASTSBC’s administration services. The ASTSBC will invoice the Board once buses have been ordered. This fee is included in the Capital Funding Grant and is not an additional cost to the Board.

5. EVENT OF FORCE MAJEURE

5.01 In the Event of Force Majeure:

a) the Board will immediately notify the Ministry, in writing, describing the Event of Force Majeure.

b) within five (5) Business Days of being notified of the Event of Force Majeure, the

Ministry will communicate with the Board to explore what steps are to be taken to mitigate the Event of Force Majeure, determine an appropriate course of action, and establish an estimated cost related to the Event of Force Majeure.

c) the course of action must be agreed to by the Ministry and the Board.

d) either party may request the assistance of an independent cost consultant appointed by mutual agreement of the parties.

e) the Ministry will not approve any expenditure(s) incurred prior to the agreed

course of action unless the costs were demonstrably incurred for the preservation of life and/or safety.

6. PUBLIC ANNOUNCEMENTS

6.01 Any public announcement relating to the Project will be in accordance with the “Communications Protocol Agreement on Capital Projects between the Ministry of Education and School Districts” (provided as Schedule A).

7. NOTICE

7.02 Any such notice or communication will be considered to have been received:

7.03 Delivery by mail will not be considered timely notice under this Agreement.

SCHEDULE A

COMMUNICATIONS PROTOCOL AGREEMENT ON CAPITAL PROJECTS BETWEEN THE MINISTRY OF EDUCATION AND SCHOOL DISTRICTS

PROJECT AGREEMENT STAGE News Release After the Minister or designate signs a funding agreement with the school district for a capital project the Ministry of Education may issue a news release. In all such news releases, the school district may have a quote from a designated representative. Signage All construction projects approved in the Ministry of Education’s Capital Plan must be identified by a construction sign prominently displayed at the site. Signs must conform to Government of B.C.’s Infrastructure Sign Specifications and be produced by Government Communications and Public Engagement (GCPE) graphics department. In addition to the BC logo, school districts and other funding partners will be identified with their logos on signage. They are to be installed as soon as possible after announcement of the project, and amended to include the amount of investment and date of completion after award of the construction contract and preferably before the start of work. The signs are to remain on the site until the work is completed and after any completion ceremonies where applicable. A digital picture of the sign is to be sent to GCPE after it has been installed. Cost of the sign is to be funded from the approved construction budget. School districts are responsible for installing the signs. Sign design and installation steps are included in the Ministry of Education’s School Construction Project Sign Protocol. GROUNDBREAKING STAGE Public Announcements, Official Events or Ceremonies An official ceremony may be held to commemorate the ground-breaking for a project. No public announcement of a project under this protocol shall be made by either party without the prior consent of the other party. The Ministry of Education shall receive at least four (4) weeks’ notice of any proposed public announcement or official ceremony related to the ground-breaking for a capital project. The Provincial Minister or designated representative shall participate in such announcements or ceremonies, to take place at a mutually agreed upon date and location. A ceremony may be held to commemorate the official opening of a project. No public announcement of a project under this protocol shall be made by either party without the prior consent of the other party. The Ministry of Education shall receive at least six (6) weeks’ notice of any proposed public announcement or official ceremony related to the opening of a capital project. The Provincial Minister or designated representative shall participate in such announcements or ceremonies, to take place at a mutually agreed date and location. The parties shall co-operate in the organization of announcements or ceremonies. Messages and public statements for such events should be mutually agreed upon. News Release On the day of an official opening ceremony, the Ministry of Education may issue a news release. In all such news releases, the school district may have a quote from a designated representative. Plaques The Ministry of Education may request the district provide and install, upon completion of major capital projects, a plaque bearing an appropriate inscription. The design, wording and specifications of such plaques must be approved by the Ministry of Education. Cost of the plaque is to be funded from the approved construction budget. SCHOOL CONSTRUCTION PROJECT SIGN PROTOCOL All construction projects approved in the Ministry of Education’s Capital Plan must be identified by a construction sign prominently displayed at the site. Signs must conform to Government of B.C.’s Infrastructure Sign Specifications and be produced by Government Communications and Public Engagement (GCPE) graphics department. In addition to the BC logo, school districts and other funding partners will be identified with their logos on signage. Sign production must only be handled by Queens Printer. Signs are to be installed as soon as possible after announcement of the project, and amended to include the amount of investment and date of completion after award of the construction contract and preferably before the start of work. The signs are to remain on the site until the work is completed and after any completion ceremonies where applicable. A digital picture of the sign is to be sent to GCPE after it has been installed. Cost of the sign is to be funded from the approved construction budget. These are the standard small sign size: 1951 mm x 1220 mm (C035_u_1951x1220). The school districts are responsible for installing the signs. The steps from design to installation are as follows:

5. GCPE will notify the district when the sign is ready to be ordered and provide them with the online requisition form: http://brokerage.qp.gov.bc.ca/submit-print/print-form.aspx ;

6. The school district orders, pays and arranges for the sign to be installed. (signs are to be post mounted in a visible location);

7. District will notify GCPE when the sign is installed and send photo as confirmation.

1. OVERVIEW

1.1 PURPOSE OF A CONCEPT PLAN The concept plan provides decision-makers with information regarding a capital need, as well as a preliminary analysis of potential options to meet that need. Decision-makers will consider the information contained in the concept plan and provide direction on project scope, schedule, budget and other priorities that will inform the option(s) to be developed in the Project Definition Report (PDR) for the project. The subject matter of the concept plan will be similar to that of a PDR, but at a higher level. The concept plan will provide a detailed assessment of Part A: Needs Rationale (justifying the need for the project) and a higher-level review of Part B: Options Analysis, Part C: Procurement Methods and Part D: Funding and Next Steps (options to meet the need, procurement options analysis and funding impacts). The PDR will update and expand on Part A: Needs Rationale and will provide a thorough analysis of Part B: Options Analysis, Part C: Procurement Methods and Part D: Funding and Next Steps. A concept plan typically includes:

IDENTIFIED NEED: • A definition of the problem, need for change, or opportunity, including

detailed data supporting the need for the project:

o For example, the school has high seismic risk and based on enrolment forecasts the facility is required over the long term, or the school has insufficient capacity to meet the enrolment forecasts for the area, etc.

PRELIMINARY OPTIONS ANALYSIS: • Preliminary review of approaches to address the problem or opportunity,

options, issues (e.g., build new, renovate, do nothing), resulting in a shortlist of options that will be examined in more detail during business case development. The concept plan can shortlist more than one option for further consideration in the PDR, in some cases only one option will proceed to a PDR.

CLASS D COST ESTIMATE: • Total capital cost for the options being considered including a Class D cost

estimate (+/- 25 per cent certainty).

2. What are the potential benefits of responding to the need? 3. What are the potential risks of not responding to the need (i.e., maintain status quo)? 4. What are the possible options? and, 5. What are the respective estimated costs, risks, and delivery timeframes to address the

need for each option under consideration?

Approval of a concept plan typically provides the following:

Agreement that the description of the need and potential solution are consistent with government’s strategic priorities;

A placeholder in the Ministry’s overall capital plan; and Approval to do a comprehensive PDR.

1.2 NEED FOR A CONCEPT PLAN The Ministry of Education will instruct school districts in the Capital Plan Response Letter to submit a concept plan for approval prior to investing in a PDR for all major projects. There are two types of concept plans the Ministry requires: a comprehensive concept plan and a basic concept plan. The requirements for each concept plan are very similar, however, the comprehensive plan should be more robust and includes the governance section. A comprehensive concept plan will be required for:

Projects with an estimated total capital cost over $50 million; High-profile projects with public interest sensitivities; and Large, complex projects with multiple stakeholders and funders.

A basic concept plan will be required for smaller, less complex projects. Including one or more of the following:

Projects smaller in size (typically, less than $50 million); Seismic mitigation where the school is not a candidate for replacement.

**Do not undertake a concept plan unless instructed to do so in the Capital Plan Response Letter.**

1.3 TIME REQUIRMENTS FOR PREPARING A CONCEPT PLAN Technical studies and consultation are required to support the concept plan and these studies may have a long lead-time to complete. Examples of these include:

Enrolment projections; Geotechnical and environmental analysis; Seismic Project Identification Reports; and Discussions with appropriate municipality or jurisdiction and analysis of municipal and

jurisdiction requirements. It could take the school district approximately six months to prepare the concept plan for submission; however, this will vary depending on the project’s complexity. It is recommended that school districts rely on recent experience (including recent engagements on similar projects) to support a concept plan for new projects.

2. PREPARING FOR CONCEPT PLAN DEVELOPMENT 2.1 GOVERNANCE

The first step in project planning is to develop a governance structure to guide decision making for the project. The governance structure needs to be flexible to accommodate different needs as the project moves through the planning, procurement, and implementation phases (e.g., concept plan, business case, funding approval, design, procurement, and construction). The concept plan should explain the current decision-making framework. Simple structures, such as a steering committee or project office, can be very effective in moving the project forward through concept plan development. If the school district has a Project Office in place, the concept plan for a new project should be developed under the oversight of that Project Office. 2.2 DEVELOP A WORK PLAN

The development of a work plan assists in the overall management of work. The team will identify and prioritize work and create a detailed schedule. Some tasks can be completed in parallel while others will be sequential. Clear identification of the tasks, their precedents, and duration will support estimates (funding and resources) required to complete the work. 2.3 IDENTIFY APPROVALS REQUIREMENT

It is helpful to fully understand the approvals process for the concept plan. Will approvals be required from boards of education, municipal approvals boards of directors, ministry executives (including Minister responsible), and Treasury Board/Cabinet? Approval meetings often need to be scheduled well in advance, and if an essential approval step is overlooked, the result can be a significant delay. School districts must work with Ministry of Education staff to complete this section.

2. CONCEPT PLAN CONTENTS The following reviews the elements of a concept plan and suggested content. A concept plan includes the following:

Executive Summary (the highlights of the concept plan) Part A: Needs Rationale Part B: Options Analysis Part C: Procurement Methods for Consideration Part D: Potential Sources of Funding Part E: Decision Request and Next Steps

For those projects with an estimated total capital cost over $50 million, the comprehensive concept plan must include a more detailed analysis of the project. Details required to be included in a comprehensive concept plan are included in the subsequent sections.

3.1 EXECUTIVE SUMMARY

The executive summary of the concept plan should include a high-level summary1 of the document’s key components, including a brief description of the preferred option(s)’ scope, budget and schedule. This information is broken down in the following sections:

General description of the concept plan’s purpose; Approach used to develop the concept plan including:

- detailed assessment of the need/demand for the asset solution; - summary of the preliminary options analysis, including a description of the

preferred option(s)2 (project scope, budget, and schedule); - what was used for costing purposes (e.g., unit rates or order of magnitude cost

estimate); and - description of the project team and organizational structure.

Funding requirements (e.g., total capital cost) and contributions if applicable; Next steps in the planning phase including project offices and project boards (if applicable), or

other consultants used for the remaining planning, procurement and delivery of the project; and Decision request.

For those projects with an estimated total capital cost over $50 million, the comprehensive concept plan must include a more detailed analysis of the expected asset condition, any related capacity constraints/risks, and proposed risk management arrangements for the status quo option over the next five to ten years. This will include identification and quantification, wherever possible, of the following:

Forecast asset condition over the next five to ten years, assuming regular/routine maintenance levels;

Key risks that may emerge over the forecast period (e.g. student/staff safety risks, non-compliance with municipal building codes and/or legal/policy standards for educational programming);

Proposed mitigation strategies (e.g. significant upgrades to building systems, site); and Residual / remaining risks.

3.2 PART A: NEEDS RATIONALE Planning future program delivery is the primary focus of the concept plan and this section sets the foundation for the project rationale. Part A: Needs Rational of the concept plan should be as detailed and developed as possible as it forms the basis for Section 1.0: Needs Rationale of the PDR, with appropriate updates.

A.1 Introduction This section provides a general introduction of the school district and its mandate for delivering educational programming to its domestic student population. A.2 Description of Status Quo The concept plan will include a description of the current state, or status quo, which identifies:

The asset(s) currently used to support program delivery, including when they were constructed and any subsequent changes in service demand/need or asset condition that have occurred;

Any significant risks or issues that have emerged with delivering education; and How the school district is managing these risks and any outstanding concerns (e.g., student/

staff safety, negative impacts on educational quality, over-crowding of facility space, etc.).

A.3 Provincial, Ministry and School District Strategic Plans This section discusses how the program fits into the strategic plans of the Province, ministry and school district, including the Long Range Facilities Plan. The section is intended to support the need to continue to provide the project and can also identify how the new services will support the agency, ministry and the Province’s strategic direction and priorities for investment.

The concept plan should address the wider impact on the strategic plan, including direct and indirect impacts on other services. For example, if a new school project will eliminate the need for 20 portables at a school, Part A: Needs Rationale of the concept plan should identify plans for the removal of the portables, and the relocation of these portables for other uses including childcare or other programming needs.

A.4 Establishing the Context Establishing or identifying the context and constraints of a project requires an understanding of the goals, objectives, values, policies, strategies and required results that may impact the project. This section deals with assumptions and constraints of the project. Examples include:

Critical decision points during the project schedule (planning, procurement, and construction); Program commitments that have already been publicly announced; and Other requirements that could impact the viability of the option.

A.5 Need/Opportunity for Investment This section summarizes the need for new infrastructure to support future demand using available data (e.g. physical status of existing asset, demographic pressure, changes in use of asset(s)). This section must include a comprehensive analysis justifying the need for an investment, for example:

Forecasted demand for the facility over a minimum of the next five to ten years.

- Describe the extent to which the capacity of the existing assets can or cannot meet the forecasted demand (e.g. forecast changes in facility space utilization rates, enrolment projections for the school and surrounding schools over the next ten years).

Condition of the existing asset(s) using established measures (e.g. facility condition index, seismic risk) and whether the condition of the asset(s) is expected to be adequate to meet future need.

- If not, is it cost effective to renovate the existing asset(s) to address future demand?

For those projects with an estimated total capital cost over $50 million, the project objectives must be measurable and outcomes-based since they will form the basis of the performance management framework3 for the project that monitors and reports on outcomes during the project’s post-completion period. Project objectives that are qualitative in nature (i.e. not measurable or outcome based) could be presented as Guiding Principles in the concept plan. Examples of measurable and outcomes-based objectives are reduced Facility Condition Index, mitigating high seismic risk, reducing portables, etc.

3.3 PART B: OPTIONS

B. 1 Project Objectives

This section provides a comprehensive description of what the project is expected to achieve and any relevant linkages to the ministry’s or district’s long-range plans and directives. Project objectives will be used to assess the options analysis during the planning phase (including concept plan and business case) and be incorporated into future post-completion evaluations. B.2 Preliminary Options Analysis This section will include an initial analysis of alternative (non-capital) strategies to address the needs identified in Part A: Needs Rationale, such as demand management (e.g. portables), program redesign/relocation, and reconfiguring existing infrastructure and program arrangements (e.g. adjusting catchment boundaries or moving French immersion). If the non-capital strategies do not meet the need identified in Part A: Needs Rationale, then capital strategies (e.g. renovate, build new) can be considered. The probable options (capital and non-capital), including the status quo option, should proceed to a Multiple Criteria Analysis (MCA). The assessment of various options should include the use of the MCA approach. The MCA methodology involves compiling quantitative and qualitative information for a decision, including advantages and disadvantages of each option under consideration. _______________________ 3 This framework will be developed and provided in the business case.

This section should respond to the following questions:

What broad educational programming options are available? - Capital and non-capital strategies

Are there any alternative (non-capital) strategies that can address the need such as demand management (e.g. portables, time-table modifications), program redesign or relocation, or reconfiguring existing infrastructure and educational programming arrangements? What evidence is available that would support one option over another? What are the direct and indirect implications of a new option? e.g., if a school is expanded, there may be ancillary requirements for improved access, parking, playground development, childcare or school bus services.

This section could also summarize the review of current delivery models, relevant technologies, and experiences in other jurisdictions. For example, the existing infrastructure could be outdated and not providing the program at the current standards or may not be meeting current safety standards.

The school district is encouraged to initiate preliminary consultation with key stakeholders around the current delivery model, opportunities for improvement, future needs, and models for service delivery that are under consideration. Public consultation should be in accordance with the board of education’s policies.

B.3 Option Information The following information is required for the capital options under consideration. Preliminary Project Scope The scope description should be as comprehensive as possible to support a Class D (+/-25%) cost estimate.

Expansion projects – supported by enrolment projection data, a description of the general size of the new building, the required programs, and site implications (e.g. build on existing site or new).

- If the school district plans to build on the existing site, the concept plan should include a description of the new construction’s potential impact on the existing facility’s operations.

Seismic Mitigation Projects - supported by SPIRs, describe the scope of mitigation work and swing space requirements.

Rural District Projects – supported by historic data (how long has the school been closed?), enrolment projections data (will the asset be required in the future?), environmental implications and HAZMAT disposal. For small additions, project scope would align with an expansion project.

Projects that exceed a total capital cost of $50 million must include a high-level quantification of key risks, mitigation strategies, and residual / remaining risk for each of the options under consideration; teams can base this information on recently completed projects if information is available to the school district.

Preliminary Project Schedule Project duration has a significant impact on cost and students, and a general understanding of the schedule will be helpful, even at a preliminary stage. The schedule must also confirm the key assumptions or factors important to the schedule, such as program delivery constraints, seasonal/weather impacts, permitting, re-zoning (if required), coordination with other projects or initiatives, and government approvals. The cost estimate must be consistent with the preliminary project schedule. At this stage, base the procurement schedule on a design-bid-build approach for expansion projects and construction management for seismic mitigation projects.

Preliminary Project Budget (Total Capital Costs) This early estimate of total capital costs will establish the initial financial baseline for the project. The total capital cost should include:

Construction cost estimate3 utilizing the Ministry of Education Costing Factors and assuming the appropriate delivery method based for the project.

Estimate of the school district’s procurement and implementation costs; Allowances for risk, equipment and economic adjustment to the mid-point of construction or

tender award; and A project contingency or reserve.

The cost estimates should be justified by documented underlying assumptions (e.g., specific inflation/deflation assumptions, project schedule, and a description of the assumptions/risks, underlying capital contingencies). A Schedule B should be completed for each option. Risk Assessment This high-level risk identification includes an initial analysis of mitigation strategies for key risks (e.g., geotechnical) relating to the planning, procurement, and implementation of the capital project. The risk assessment should not be “operations” focused.

B.4 Preferred Option Depending on the project type, complexity, and cost the concept plan may recommend multiple options for further consideration in the business case. Some projects may have one recommended option.

3.4 PART C: PROCUREMENT

This section should identify and describe suitable procurement methods for each option for the project, including their relative strengths and weaknesses. The procurement method will undergo further analysis during the development of the PDR.

3.5 PART D: FUNDING AND NEXT STEPS D.1 Funding Sources Based on the preliminary total capital cost estimate, a description of potential sources of capital funding must be included, including the dollar amounts and timing of contributions from each source. Funding sources will be confirmed during the development of the PDR. D.2 Governance The concept plan will include a general description of the proposed project oversight structure and processes that are commensurate with the project’s size, complexity, and risk. D.3 Next Steps This section should explain the next phase in the process; e.g., preparation of the PDR. Agreement that the high-level description of the need and potential solution are consistent with government’s strategic priorities;

A placeholder in the overall capital plan, based on a high-level cost estimate; Approval to proceed to develop a PDR; and Approval of governance structure and confirmation of future approval requirements.

CAPITAL PLAN BYLAW NO. 2020/21-CPSD39-01

A BYLAW by the Board of Education of School District No. 39 (Vancouver) (hereinafter called the "Board") to adopt a Capital Plan of the Board pursuant to sections 143 (2) and 144 (1) of the School Act.

WHEREAS in accordance with provisions of the School Act, the Minister of Education (hereinafter called the "Minister") has approved the Capital Plan of the Board.

NOW THEREFORE the Board agrees to do the following:

(a) Authorize the Secretary-Treasurer to execute Project Agreement(s) related to the expenditurescontemplated by the Capital Plan;

(b) Upon ministerial approval to proceed, commence the Project(s) and proceed diligently and useits best efforts to complete each Project substantially as directed by the Minister;

(c) Observe and comply with any order, regulation, or policy of the Minister as may be applicable tothe Board or the Project(s); and,

(d) Maintain proper books of account, and other information and documents with respect to theaffairs of the Project(s), as may be prescribed by the Minister.

NOW THEREFORE the Board enacts as follows:

1. The Capital Bylaw of the Board for the 2020/21 Capital Plan as approved by the Minister, toinclude the supported project(s) specified in the letter addressed to the Secretary-Treasurer andSuperintendent dated March 5, 2020, is hereby adopted.

2. This Bylaw may be cited as Capital Plan Bylaw No. 2020/21-CPSD39-01.
