Application for the Vacation of Public Right of Way or Easement

Commission, please provide a check made payable to "City of Lawrence, Kansas" in the amount of $200.00. This check should accompany the completed application, and is non-refundable. The application fee covers staff work and publication costs for the notices.
Section 1. Property Owner Information. Provide information on property owner(s) adjoining proposed vacation requesting the vacation:

Background Information. A) Describe the legal description of the proposed vacation. What is proposed to
be vacated? (e.g. Right-of-way, utility easement, drainage easement). Right-of-Way vacation for the easternmost 10' of the Colorado Street Right-of-Way that abuts Lots 13, 14 & 15 of the Olmstead Subdivision of the East Half of Block 47, West Lawrence B) Describe the purpose or reason for seeking the proposed vacation:
For more than sixty years, this property has been occupied by a loosely defined gravel sales lot for used car sales with unrestricted continuous access from Colorado Street. The new owner wishes to continue with the same use & to make improvements to the property making it compliant to the current 2006 Land Development Code. These improvements will require extensive curbing & landscaping to the lot that will formalize the interior vehicle circulation while at the same time create restrictions to that circulation on what is a rather small parcel that historically worked well in its unrestricted form but will not be optimal when the new improvements are completed. Adding an additional 10' to this property will allow interior circulation to flow more safely & functionally not only for the owner but the customers of this business by restricting the access from Colorado to one point & relieving internal circulation restrictions were it not added.
C) Attach a copy of the legal description for the portion of the easement or right-of-way which is to be vacated.

Section 3. City Staff Review. The following items will be reviewed by City staff in the Public Works, Utilities and Planning Departments, as applicable. A) Will the proposed vacation impair access to a public street by any adjoining
property owners? Yes or No, explain: This property abuts West Sixth Street on the South boundary & no request will be made for direct access to West Sixth Street. The abutting property owners to the North, from Colorado Street, currently have access points approximately 185' North of the North property line of the applicants property. This request would not change or restrict those access points nor reduce the width of the current City street.
B) Are utilities currently located in the easement or right-of-way? Water Yes No Would continue to be located within the public right-of-way

C) Will the proposed vacation impair the ability of utilities to deliver services to the adjoining property and surrounding area? All existing utilities that can be identified from the City's Interactive Map appear to be located outside this right -of-way vacation.
D) Should the vacation reserve any City rights? The site plan that will be filed will show the abandoned right-of-way as green space. The Owner would voluntarily grant an access/utility easement over that area if required.
E) City staff recommendation for the proposed vacation:
Section 4. After City staff approval, the property owner must execute a Petition for Vacation which will be prepared by City staff. Once a petition has been received, notice of the hearing on vacation will be published. The City Commission will consider the proposed vacation at the hearing, and if appropriate, authorize the Mayor to execute the Order of Vacation which vacates the easement or right-of-way.
