Where tbe party or other person to be examined is confined in a prison or jail within tbe ctate, under a sentence f o r a felony, that fact must be slated in the affidavit, and bis deposition may be taken as prescribed in the foregoing sections, a s i f h e w a s not sa con- fined, except that iu such a case, the gtaatiug or refusing the order, and, if granted, the ap- pointment of a referee to take the testimony, is always in tbe discretion of the judge. SKCT10S 1. The Code of Civil Procedure, a s enacted on the second d a y of J u n e , e ighteen hundred and seventy s ix , and as amended b y subsequent statutes , is hereby further amend-i d in the several sections hereinafter respect­ive ly named as fal lows :

E x c e p t i ' a case where an order of ar­rest can be granted on ly b y tbe court, if the defeufiaut is in actual custody , b y virtue of a u Older of arrest in the acti n. or up m a surren­der in exonerat ion of his bail and tbe plaintiff neglects to enter judgment in tbe act ion, wi th­in one month after it is ia bis power to do s o ; or neglects to issue execut iou against the per­son of the defendant , within three months a t ter the entry of j u d g o j e o t ; or , if tbe surren­der w a s made after the judgment , within three months a' trr the bail are exonerated there upon : tbe defecdant m u s t , upon his appl ica­t ion, made upon notice to the plaintiff, be dis­charged from cus tody , b y the court iu whic' i tbe act ion w a s commenced, or b y a judge thereof, w i th in the county where the defend­a n t is in custody ; unless reasonable cause is s h e w n w h y the application should not be grunted.
