THE STATE OF FLORIDA COUNTY OF ORANGE

BEFORE 1IE the undersigned Judge appeared Senior Inspector Mark A Garcia a sworn Law Enforcement Officer for the Office of Inspector General Florida Department of Corrections who via sworn affidavit said that from December 31st 2017 through February 20th 2018 in Orange County Florida the Defendant former Correctional Officer Lexen Leonard Barrington did in violation of section(s) 838016 (1) 934215 and 838022 (l)(c) - Florida Statutes commit the felony crimes of Unlawful compensation or reward for official behavior (6 CNTS) Unlawful use of a two-way communication device (a cellular phone) to facilitate a felony offense and Official Misconduct - by delaying the reporting of a felony which directly affected the government agency he worked for as a Correctional Officer

Specifically

The defendant Lexen Leonard Barrington (Officer Barrington) was hired by the Florida Department of Corrections (FDC) May 19th 2017 to a position as a sworn Correctional Officer at the Central Florida Reception Center a state correctional institution He was sponsored by the FDC to the corrections academy trained and certified by the Criminal Justice Standards and Training Commission to perform his duties as an officer and his oath of office Shortly after his graduation from the corrections academy and during his employment with the FDC fellow correctional officers received and reported information from numerous inmates concerning Officer Barrington The inmates and staff members reported to the Office of Inspector General that Officer Barrington was involved in the introduction of contraband items (tobacco products cell phones and Synthetic Cannabinoids) into the institution in exchange for monetary compensation He received payments via Western Union and Money Gram mone transfers Furthermore it was re orted that Officer Barrin on worked for inmates

It was also reported and documented that Officer Barrington communicated with inmates via his personal cell phone Consequently Your Affiant initiated a criminal investigation into the defendant and his unlawful activity Your Affiant obtained evidence via subpoenaed financial records documentation sworn recorded statements and other evidence that Officer Barrington did in fact smuggle contraband accept six (6) unlawful payments from inmate relatives or friends communicate with inmates via his personal cell phone to a contraband cell phone and engage in official misconduct while employed with the FDC The evidence showed

I December 31st 2017 - Officer Barrington received Western Union Money Transfer (MTCN 7976967831) in the amount of $15000 from Michelle Hunt the wife of Inmate Terranton Hunt [524637] an inmate under his custody care and control

II January 11 th 2018 - Officer Barrington received Money Gram (transfer reference number 49614505) in the amount of $5000 from Shavonna Clark the sister of Inmate Raesean Poole [T78632] an inmate under his custody care and control

III January 22nd 2018 - Officer Barrington received Money Gram (transfer reference number 99820433) in the amount of $4500 from Sophia Claire cousin of Inmate David Poole [K54567] an inmate under his custody care and control

IV January 24th 2018 -Officer Barrington received Money Gram (transfer reference number 29794960) in the amount of$10000 from Randall Connor a personal friend of Inmate John Abbott [707052] an inmate under his custody care and control

V January 25th 2018 -Officer Barrington received Western Union Money Transfer (MTCN 135136533) in the amount of$10000 from Catrina Shantrell Simmons a personal friend of Inmate Devante Carthers [C05165] an inmate under his custody care and control

VI January 29th 2018 - Officer Barrington received Money Gram (transfer reference number 93331072) in the amount of $10000 from Misty Calligan the girlfriend of Inmate Edgar Lowery [K50136] an inmate under his custody care and control

The evidence showed Officer Barrington collected the monetary payments as his identity was confirmed upon collection of the payments when he provided the Western Union and Money Gram vendors with his name date of birth home address and Florida drivers license as identification Officer Barringtons acceptance the payments from inmates via third parties was not authorized by the FDC and the payments were not part of his normal wages Digitally recorded testimony collected during this investigation revealed the payments accepted by Officer Barrington were sent to him by inmates via their relatives friends or visitors as payment for the introduction of contraband items into the institution There was no evidence that the payment remitters (inmate friends and relatives) had any knowledge that the defendant was an officer with the FDC Therefore Officer Barrington violated FS 838016 (1) unlawful compensation or reward for Official Behavior (6 CNTS)- when he accepted a total of $54500 in unlawful compensation from friends and family members of inmates under his custody

Based on my training and experience coupled with the testimony and evidence I Your Affiant recognized the methodology of paying for contraband via third party monetary transfers as one commonly used by inmates to pay for the introduction of contraband items into a state correctional institution or used by corrupt staff in order to profit for their unlawful conduct while on duty

During this investigation several inmates were identified as contact Barringtons introduction of contraband and unlawful activity Inmate was one of the inmates identifie~ rtner to Officer Barrington On March 16 2018 security staff discovered Inmate - in possession of a contraband cell phone He was disciplined via the FDC internal administrative process for possession of the contraband cell phone

Your Affiant interviewed Inmate as part of this investigation During a sworn digitally recorded interview Inmate advised the following

He understood he was under oath and could be charged with the crime of Perjury if he lied during his statement Inmate - stated his property was searched by two officers The officers recovered a Posh cell phone in a red folder concealed in his property The Posh cell phone was considered a contraband cell phone to which he admitted ownership Inmate llllllllllllfurther stated the cell phone was linked to Officer Barrington because he used it to call text and message Officer Barrington to request contraband He received contraband tobacco directly from Officer Barrington on at least two occasions Officer Barringtons personal cell phone number was saved on his (Inmate contraband cell phone as contact 111111 Inmate -indicated he (Inmate Cameron Dawes C04~ d Officer Barrington to conduct contraband business Additionally Inmate - explained

that in all he paid Officer Barrington approximately $25000 for contraband tobacco He paid Officer Barrington via Western Union and Money Gram money transfers

Inmate - further advised that Officer Barrington dealt with multiple inmates including Inmate Dawes

Post-Interview Inmate - signed an FDC Office of Inspector General Consent to or Notification of Search form (DCl-804) thereby providing written consent for a search of his contraband Posh cell phone

Inmate Dawes refused to cooperate with this investigation

The contraband Posh cell phone was processed as evidence and submitted to the Florida Department of Law Enforcement (FDLE) laboratory for forensic analysisextraction The FDLE completed its forensic analysis of the contraband cell phone recovered from Inmate -The contraband cell phone analysis report (extraction report) was documented on FDLE report number 201880507566 The FDLE cell phone analysis extraction report showed the following

bull Officer Barrington used a two-way communication device (his personal cell phone) to communicate with Inmate - m the Posh contraband cell phone

bull The contraband cell phone contacts list had Officer Barringtons personal cell phone listed as contact 111111just as Inmate - indicated in his statement

bull The extraction report showed 2778 incoming and outgoing calls on the contraband cell phone call log The call log listed 29 incomingoutgoing phone calls between the contraband cell phone and Officer Barrington s personal cell phone ( The calls were between 01232018 and 02252018 The length of the calls varied from a few seconds to a 1605 minute call on 02232018

bull The call log listed 8827 SMS Messages (text messages) on the contraband cell phone There were 18 text messages between Officer Barrington s cell phone and the contraband cell phone from 02152018 through 02252018 The text messages were

The contraband cell phone extraction report showed Officer Barrington communicated with Inmate- as he indicated durin~ ent via the two-way communication devices Officer Barrington also called Inmate --regularly and exchanged text messages with him The content of the text messages showed Officer Barrington used the commination devices to further the introduction of contraband and profit from said activity Officer Barrington knew his activity was a violation of Florida statutes as demonstrated by his request that all his information be deleted from the contraband cell phone on February 15th 2018 which was an attempt to conceal his activity Consequently Officer Barrington violated FS 934215 -Unlawful use of a two-way communication device (his personal cell phone) to facilitate a felony (acceptance ofunlawful compensationintroduction ofcontraband)

Additionally Officer Barrington also violated FS 838022(1)(c) - Official Misconduct - When he obstructed delayed or prevented the communication of information r~ the commission of a felony (Possession of a contraband cell phone by Inmates - and Dawes FS 94447 (J)(c)) which directly affected the government entity (the FDC) which he served as a Correctional Officer

Inmate Johny Bonheur [T48091] was identified as another inmate involved with Officer Barringtons unlawful activity

Your Affiant conducted a sworn digitally recorded interview of Inmate Johny Bonheur [T48091] _

Several other inmates were identified as points of contact for Officer Barringtons unlawful activity However they too denied involvement with Officer Barrington

13th 2019 at 0855 AM Officer Barrington called me from his personal cell phone to my office number 407-208-8160 Initially he agreed to provide a statement and

meet with me February 14th 2019 at 1000 AM in Miami for an interview He stated I could contact him at his cell phone when I was in the area He inquired as to the nature of this investigation and I informed Officer Barrington that this investigation was criminal explained to him that he was entitled to representation from a lawyer and that he was not required to answer questions or provide a statement Officer Barrington then indicated he did not wish to provide a statement This investigation concluded without Officer Barringtons input

V January 25th 2018 -Officer Barrington received Western Union Money Transfer (MTCN 135136533) in the amount of$10000 from Catrina Shantrell Simmons a personal friend of Inmate Devante Carthers [C05165] an inmate under his custody care and control

VI January 29th 2018 - Officer Barrington received Money Gram (transfer reference number 93331072) in the amount of $10000 from Misty Calligan the girlfriend of Inmate Edgar Lowery [K50136] an inmate under his custody care and control

The evidence showed Officer Barrington collected the monetary payments as his identity was confirmed upon collection of the payments when he provided the Western Union and Money Gram vendors with his name date of birth home address and Florida drivers license as identification Officer Barringtons acceptance the payments from inmates via third parties was not authorized by the FDC and the payments were not part of his normal wages Digitally recorded testimony collected during this investigation revealed the payments accepted by Officer Barrington were sent to him by inmates via their relatives friends or visitors as payment for the introduction of contraband items into the institution There was no evidence that the payment remitters (inmate friends and relatives) had any knowledge that the defendant was an officer with the FDC Therefore Officer Barrington violated FS 838016 (1) unlawful compensation or reward for Official Behavior (6 CNTS)- when he accepted a total of $54500 in unlawful compensation from friends and family members of inmates under his custody

Based on my training and experience coupled with the testimony and evidence I Your Affiant recognized the methodology of paying for contraband via third party monetary transfers as one commonly used by inmates to pay for the introduction of contraband items into a state correctional institution or used by corrupt staff in order to profit for their unlawful conduct while on duty

During this investigation several inmates were identified as contact Barringtons introduction of contraband and unlawful activity Inmate was one of the inmates identifie~ rtner to Officer Barrington On March 16 2018 security staff discovered Inmate - in possession of a contraband cell phone He was disciplined via the FDC internal administrative process for possession of the contraband cell phone

Your Affiant interviewed Inmate as part of this investigation During a sworn digitally recorded interview Inmate advised the following

He understood he was under oath and could be charged with the crime of Perjury if he lied during his statement Inmate - stated his property was searched by two officers The officers recovered a Posh cell phone in a red folder concealed in his property The Posh cell phone was considered a contraband cell phone to which he admitted ownership Inmate llllllllllllfurther stated the cell phone was linked to Officer Barrington because he used it to call text and message Officer Barrington to request contraband He received contraband tobacco directly from Officer Barrington on at least two occasions Officer Barringtons personal cell phone number was saved on his (Inmate contraband cell phone as contact 111111 Inmate -indicated he (Inmate Cameron Dawes C04~ d Officer Barrington to conduct contraband business Additionally Inmate - explained

that in all he paid Officer Barrington approximately $25000 for contraband tobacco He paid Officer Barrington via Western Union and Money Gram money transfers

Inmate - further advised that Officer Barrington dealt with multiple inmates including Inmate Dawes

Post-Interview Inmate - signed an FDC Office of Inspector General Consent to or Notification of Search form (DCl-804) thereby providing written consent for a search of his contraband Posh cell phone

Inmate Dawes refused to cooperate with this investigation

The contraband Posh cell phone was processed as evidence and submitted to the Florida Department of Law Enforcement (FDLE) laboratory for forensic analysisextraction The FDLE completed its forensic analysis of the contraband cell phone recovered from Inmate -The contraband cell phone analysis report (extraction report) was documented on FDLE report number 201880507566 The FDLE cell phone analysis extraction report showed the following

bull Officer Barrington used a two-way communication device (his personal cell phone) to communicate with Inmate - m the Posh contraband cell phone

bull The contraband cell phone contacts list had Officer Barringtons personal cell phone listed as contact 111111just as Inmate - indicated in his statement

bull The extraction report showed 2778 incoming and outgoing calls on the contraband cell phone call log The call log listed 29 incomingoutgoing phone calls between the contraband cell phone and Officer Barrington s personal cell phone ( The calls were between 01232018 and 02252018 The length of the calls varied from a few seconds to a 1605 minute call on 02232018

bull The call log listed 8827 SMS Messages (text messages) on the contraband cell phone There were 18 text messages between Officer Barrington s cell phone and the contraband cell phone from 02152018 through 02252018 The text messages were

The contraband cell phone extraction report showed Officer Barrington communicated with Inmate- as he indicated durin~ ent via the two-way communication devices Officer Barrington also called Inmate --regularly and exchanged text messages with him The content of the text messages showed Officer Barrington used the commination devices to further the introduction of contraband and profit from said activity Officer Barrington knew his activity was a violation of Florida statutes as demonstrated by his request that all his information be deleted from the contraband cell phone on February 15th 2018 which was an attempt to conceal his activity Consequently Officer Barrington violated FS 934215 -Unlawful use of a two-way communication device (his personal cell phone) to facilitate a felony (acceptance ofunlawful compensationintroduction ofcontraband)
