WtiEREAS, the Commission on Elections by virtue of the powers vested in it by

the constitution, the Omnib~ls Election Code and other election laws, determines and

allocates the number of seats for elective public, officials in connection with the May 13,

2013 blational ancl Local Elections;

WtiEREAS, at present, the Pliilippines has two hundred and thirty-two (232)

legislative clistricts, eighty (80) provinces, one hundred and forty three (,143) cities ancl

one tllousantl foul- hundred and ninety-one (-1,491) municipalities;

WI-IEREAS, the number of Menibers of the I-iouse of Representatives to be

elected is based on the number of legislative districts created by law;

Wt.IEREAS, after the May 10, 2010 Naliorlal ancl Local electior~s, the legislative

distl-icts of tlle city of Quezon and the pr-ovinces of. Palawan and I\lorlh Cotabato were

rea(-~porlioned as follows:

Cotabato (North Cotabato)

WHEREAS, the municipality of Biiian, faguna was converted into a city 011

February 2, 2010 with K.A. 9740 as its legal basis, entitling it to ten (10) Sangg~~niang

Panliingsod but only eight (8) were elected in the 2010 Natio~ial and Local Elections

since the configuration of the PCOS machines were already completed at the time of

ratifying ils conversion into a city;

WHEREAS, Sec. 3 (a) and (b) of Republic Act No.

"Sec. 3. Election of Members of the Sanggrniang Panlalawigan, Sangguniar-ig Panlungsod' ancl' Sangguniang Bayan - The elestive members of the Sangg~~r~iang Panlalawigan, Sanggi~niang Panl~rngsod ancl Sangguniang Bayan shall be elected as follows:

(a) For provinces with two (2) or more legislative districts, the elective members of the Sanggi~niang Par~lalawigan shall t ~ e elected by legislative districts. For this pclrpose, the nurnber of seats shall be apportioned equitably: Provided, That, if e t l ~ ~ a l division isl not possible, the remaining meml~er or rnen-hers sliall be elected in the district or cjistiicts with the greater number of population or, if they be tha same, with the greater nurnber of voters. Providecl, ftrrtlier, 'That, if a legislative district include a city that does not vote I the election of provincial officials, the Commission on Elections, shall allocate the nurnber of sets among the clistricts in propoltion to the population of the constit~reiicies voting for the Sanggrrniang

(b) For provinces with orlly one ( 1 ) legislalive district, the Cor~lmission shall divided them into two (2) rlistricts for pclrposes of electing the members of the Sanyglrniang Panlalawigan, as nearly as practicable accorcling to the nc~niber of inhabitants, each district co~nprising a compact, contiguous ancl adjacent territory, .and the number of seats of elective members of their respective sangg~rnian sliall Ile equilably appo~tioned between the districts in accorclance with 11.1e immediately preceding paragraph;"

WI-IEREAS, R e p ~ l b l i ~ Act No. 8553 entitled "An Act Amending Section 41 (I)) of

Kep~l l~ l ic Act No. 7160, Otherwise Known as the Local Government Code of 1991",

provicles, aniolig others, that i1.1 provinces having more than five (5) legislative districts, . .

Wl-EREAS; the latest income classification for provinces pursuant to Department

Order No. 23-08 of the 13~1-eau of I-ocal Government Finance (DOF) dated July 29, 2008

was used in allocating seats .for'the 2010 election of members of the sanggilniang

jmnlalawigan; . .

WCIEREAS, the Burea1.1 of Local Government Finance has not yet officially

'issued a new income classification; for purposes of the May 13, 201 3 national and local . .

elections,

WI-IEREAS, Sec. 3 (c) of f3epirl~lic Act blo. 7166, states that:

"(c) 'The number and election of elective members of the Sanygiiniang Panlungsod and Sanggur~iang Bayan in the Metro Manila Area, City of Cebu, City of Davao and any other city with two (2) o r more legislative clistricts shall coi~tinue to be governed by the provisions of Section 2 and 3 of Republic Act No. 6636: Providecl, That, the municipalities of Malabon, Navotas, San Juan, Manclaluyong, Muntinlupa, Las Piiias and Taguig shall have twelve (12) councilors, and Pateros, ten (I): Provicled, further, That, the Commission shall divide each of the municipalilies in Metro Manila into Iwo (2) districts by barangay for purposes of representation in the Sanyguniang Bayan as nearly as practica1)le according' to' t l ~ e number of inhabitants, each district colnprisirlg a compact, contiguous ant1 adjacent territory; and"

WI-EREAS, Secs. 2 ancl 3 of Hepcrblic Act No. 6636, mandates that;

"Sec. 2. Metro Manila Area. - For pul-poses of the Local Elections or1 January 18, '1988, the City of Manila, Quezol-I City, and the City of Caloocan shall have six (6) ~ouncilors for each of their representative districts who shall be residents thereof to be elected by the qualified voters therein. The City of Pasay and tlie Municipalities of Maltati; ParaAaqtre, Pasig, Ivlaril<ina, and Valenzuela, each of which co~nprises a representative district, s l~al l have twelve (1 2) councilors each to be elected at large by Ihe qualified voters of the saicl city or munic;ipality. All the otter ~ncrnicipalities within the Metropolitan Manila area shall have ten (10) cocrncilors each, ~ i 1 1 1 the exception of the Municipality of Pateros which sllall have eight (8) cot~ncilors to be elected at large by their respective qtlalified voters.

Sec.3. Other Cilies. - The provision of ariy law to the central-y notwistancling, the City of Cebu, City of Davao, and any other city with more than one representative district shall have eiglit (8) councilors for each district who sliall be residents thereof to be elected by the qualified voters therein, pi-ovided that the Cities of Cagayan de Oro, Zamboanga, Bacolod, lloilo ancl other cities conlprising a representative district shall have twelve (12) councilors each and all cities shall have ten (10) councilors to be elected at large by the qualified voters of the said cities: Provicled, 'Tl~at in no case shall the present number of coi~ncilors according to their cllarters be reduced."

WI-IEREAS, in Republic Act No. 10153 entitled "An Act Providing for the '

Synchronization of the Elections in the Autonomous Region In Muslim Mindanao

(ARMM) With the National and Local Elections and For Other Purposes", syr~ctironized

the regular elections for the Regional Governor, Regional Vice-Governor, and Members

of the Regional I-egislalive Assembly of tlie Airtonornous Region In Muslim Mindanao

(ARMM) witti tl.ie national and local elections;

- NOW, THEREFORE, the Co~nrnission RESOLVED, as it hereby RESOLVES, to

I fix the nu~nbel- and allocation of seats as shown in the ANNEXES hereof, which shall

forrn as an integral part of this r-esolution to wit:
