AVOIDING LITIGATION

• Most effective way to avoid litigation is to prevent the injuries in the first place – Create a culture of safety

» Require proper training and periodic refreshers and/or certifications for any inherently dangerous job functions

» Conduct regular site surveys and safety inspections to identify and correct/minimize any hazards

» Regular reports and dashboards showing injury rates and safety records

Understand what leads to litigation! • Legitimate vs. unwarranted lawsuits • Consistent factors found in 2010 WCRI Study (WC-

10-18), related to unnecessary litigation – Poor communication or flawed processes in responding to

claims – Fear of denial of claim – Fear of punishment or of retribution – Aggressive Personal Injury Attorneys
