The BJP, CPI-M andCongress today con-demned chief minis-ter Mamata Baner-

jee’s dharna in protest againstlast night CBI action againstpolice commissioner andquestioned her “motive” to goto rescue of police commis-sioner violating laws and con-stitutional provisions.

While Union minister andsenior BJP leader PrakashJavadekar today claimed thatMiss Banerjee was on a dhar-na to save herself from the CBI,CPI-M central committeemember and MLA SujanChakraborty said that thechief minister was acting outa political drama in a bid tocover the corruption of multi-crore Saradha chit fund scamand evade her arrest.

He said the “Modi-Shahduo was the biggest danger” fac-ing the country and charged thetwo leaders with trying to “mur-der” democracy.

Delhi BJP president ManojTiwari hit back at Kejriwal say-ing he should not talk aboutdemocracy because he has“robbed” it through his “false-hoods and conspiracies” in

the city.In a statement, Kejriwal

said: “The Modi government isbent on murdering democra-cy. Isn’t it illegal and undemo-cratic that a team of 40 CBI offi-cials enters the residence of apolice commissioner?”

“The Modi-Shah duo shouldbe defeated to save the democ-racy,” he said.

Tiwari said that leaders likeMamata Banerjee and Kejriw-al were “betraying” democra-

cy by going against the direc-tives of courts.

“The CBI went to West Ben-gal on directions of the SupremeCourt. Leaders like Kejriwalare supporting Mamata Baner-jee because they are scared ofModi who is dedicated to endcorruption,” he claimed. Thefailed attempt by the CBI to ques-tion Kolkata Police Commis-sioner Rajeev Kumar in con-nection with the Saradha andRose Valley chit fund scams onSunday became the latest flash-point between the BJP-led Cen-tre and West Bengal chief min-ister Mamata Banerjee.

Kejriwal had talked to Baner-jee on Sunday over phone asthe incident blew into a polit-ical slugfest and expressed sol-idarity with her while termingthe action as “completely bizarre

and anti-democratic”. The AAPconvener, who himself is a bit-ter critic of the Modi govern-ment, in his statement on Mon-day drew a parallel between theWest Bengal incident and expe-riences of his own governmentin Delhi. “Just as Modiji triedto beseige the Commissionerof West Bengal yesterday, fouryears ago he snatched away theanti-corruption bureau from usby sending paramilitary forces,”he charged.

He further alleged the PMgot 33 cases registered againsthim and police raided his res-idence and searched his bed-room on his instance.

“If Modi ji misuses Centralagencies to violate the rightsof the state governments, thecountry will not survive,”Kejriwal said.

Leaders of several Oppositionparties petitioned the Elec-tion Commission (EC) onMonday and demanded that50 per cent of EVM resultsshould be cross-checkedwith voter verifiable paperaudit trails (VVPATs) beforedeclaring final Lok Sabhaelection results.

Leaders of 23 politicalparties met Chief ElectionCommissioner Sunil Aroraand Election Commission-er Ashok Lavasa, seekingredressal of the issue ofalleged tampering of elec-tronic voting machines(EVMs) before Lok Sabhapolls.

The leaders told the EC thepeople of the country doubt-ed the efficacy of EVMs andthis issue needs to beredressed.

The EC said it has heardthe concerns of the partieson their demands related tothe counting of VVPAT slipsand assured them that theissues raised would be “delib-erated and examined”.

“While considering theaverments made by the polit-ical parties, the Commis-sion shall also keep in view

the pronouncements madeby the different courts aswell as the report expectedshortly from the Indian Sta-tistical Institute on the sub-ject, besides the overalladministrative and opera-tional feasibility on theground, before firming up anyresponse,” the EC said in astatement.

The Opposition partieshad earlier sought movingback to the ballot paper sys-tem, but after the EC cate-

gorically ruled it out, theychanged their strategy andare now demanding match-ing of results of 50 per centEVMs with VVPATs.

“We are writing to you inmost trying times. The timeswhen each and every insti-tution built and strengthenedover decades, for safe-guarding democracy andthe rule of law, is sought tobe subverted by those whohave scant respect for peo-ple's will.

“In these trying and test-ing times, we are writing toyou as members of an exalt-ed constitutional institu-tion, tasked with the respon-sibility of ensuring free andfair elections, which in turnis the bedrock of democra-cy and has repeatedly beenheld to be part of the una-mendable basic structure ofthe Indian Constitution,”according to a memoran-dum signed by leaders ofall 23 parties, including Con-

gress president Rahul Gand-hi and NCP supremo SharadPawar, to the poll panel.

The memorandum alsosaid if the difference of votesbagged by the winner and hisnearest rival is less than 5 percent, “mandatory countingof paper trail from VVPATshould be carried out ineach polling station...If thereis a difference in counting ofvotes between EVM andVVPAT, then the result incounting from VVPAT shouldprevail.”

After the meeting, Leaderof Opposition in Rajya SabhaGhulam Nabi Azad said, “Ifa vote polled for one partygoes to another party, it isagainst democracy.”

Azad told reporters thatthe parties have demandedthat the EC removes the“shortcomings” in EVMs.

He said parties wanted torevert to the old paper bal-lot system but since there isno time left for Lok Sabhapolls, they have demandedbringing in transparency inthe EVM system.

“We have demanded thatbe it Lok Sabha or assemblyelections, 50 per cent votesbe matched with paper trailof votes and the EC shouldnot destroy the results of

VVPAT machines,” he said.Andhra Pradesh Chief

Minister N ChandrababuNaidu said 23 parties repre-senting 69 per cent of the vot-ers have met the EC.

“Even now they are count-ing only 1 per cent (of VVPAT).We have demanded totaltransparency. Even devel-oped countries are usingballot papers. But since thereis no time we have demand-ed that 50 per cent VVPAT slipsbe counted. For democracy,for creating confidence, theycan do that job. Since every-body is having a doubt it isthe duty of the Election Com-mission to convince peoplethat it is undoubtable,” hesaid.

A plea has been moved inthe Delhi High Court seek-ing directions to the Cen-tre to frame a policy to pro-vide free legal aid to Indi-an citizens living abroad.

NGO Pravasi Legal Cellfiled the public interest lit-igation claiming that Indiahas the world's largest dias-pora according to the Unit-ed Nations.

The petition claimedthat over 17 million peopleborn in India now live else-where in the world and ofthese, many are semi-skilledand low-skilled workers.

“One of the biggest prob-lems faced by such workersis that they do not haveany knowledge about thelocal laws or how their rightsare protected in such coun-tries because of which theyface violation of their basicrights on foreign land dueto lack of any legal aid,” theplea filed through advo-cate Jose Abraham read.

The NGO also said in itspetition that the UnionMinister of State for Exter-nal Affairs, in reply to aquery in the Lok Sabha,had said that around 7,850Indians are lodged in jailsabroad, with over 2,000 inSaudi Arabia.

“Most of them are undertrials or victim of fraud.Most of such cases against

Indian workers abroad couldhave either been avoided orsaved from prosecution hadthere been proper legalassistance at the right time,”the plea claimed.

The NGO said that underArticle 39-A of the Consti-tution of India, the gov-ernment has the duty toprovide free legal aid to itscitizens which would includethose “who cannot accessjustice due to economicand other disabilities whileliving abroad”.

It has said that the objec-tive can be achieved with thesupport and assistance ofthe Indian missions abroad.
