This list contains several tables that represent communities with municipal laws or Housing Authority policies that restrict or prohibit smoking to various degrees in private units of specified types of multi-unit housing.

Additionally, communities that are not on this list may have municipal laws or Housing Authority policies that do not address smoking in private units, but otherwise restrict smoking in multi-unit housing, such as by prohibiting smoking in indoor common areas or on patios and balconies. Note: The jurisdiction(s) affected by county-level laws vary widely. Look for a + symbol next to each county with a law that includes both incorporated and unincorporated areas. Municipalities with Laws that Restrict Smoking in Multi-Unit Housing:

This table represents communities that have municipal laws at the city or county level that do not currently prohibit smoking in all units of all multi-unit residential buildings in the community. Most of these laws restrict smoking in private units of some specified types of multi-unit buildings. These laws apply to both privately-owned and publicly-owned multi-unit housing. Additionally, municipalities marked with # will require all multi-unit buildings to be 100% smokefree when the law is in full effect on a future date, at which time the municipality will move to the 100% smokefree chart above. Municipalities marked Some under “All Units Currently Smokefree?” have some buildings that are currently required to be 100% smokefree. Often, these laws prohibit smoking in all newly occupied buildings or newly leased units, but either do not address smoking in existing buildings or only apply to a certain percent of units in existing buildings. Municipalities marked with # means that the law will require all multi-unit buildings to be 100% smokefree as of a future date, but currently the law is not yet in effect or provides partial coverage. Municipalities marked No under “All Units Currently Smokefree?” have no buildings required to be 100% smokefree now or in the future. These laws may apply to only a certain percent of units in existing and future buildings, or permit current residents to continue smoking in the building (“grandfathering” clause).

Publicly-Owned Multi-Unit Housing

This table lists communities that have smokefree policies for Publicly-Owned Multi-Unit Housing, the majority of which are adopted by a Public Housing Authority to restrict or prohibit smoking in private units of the buildings it owns and manages. Public Housing Authority policies cover all or specified buildings that are owned and managed by the Housing Authority, but these policies do not regulate smoking in other types of subsidized housing in the community that are privately-owned. The table also lists some communities that have adopted smokefree laws/resolutions that cover other types of affordable housing owned by the municipality.

State Laws and Policies Prohibiting Smoking in Private Units of Multi-Unit Housing

Delaware: The Delaware State Housing Authority prohibits smoking in all units of all buildings it owns and manages as of 10/1/2013.

Hawaii: Hawaii prohibits smoking in all units of all buildings under the jurisdiction of the Hawaii Public Housing Authority as of 6/16/2014. The Hawaii Housing Finance and Development Corporation requires that all new and sold/renovated properties that receive tax credits through their program have a smokefree policy as of 2015.

Maine: MaineHousing, the State Housing Authority, requires that smoking be prohibited in all units of all buildings built and financed by the state’s Low Income Housing Tax Credit program as of 2013.

Montana: The Montana Board of Housing requires buildings that receive tax credits through their program have a smokefree policy as of 2016.

New Hampshire: The New Hampshire Housing Finance Authority requires buildings that receive tax credits through their program have a

smokefree policy as of 2017.

North Carolina: The North Carolina Housing Finance Agency requires buildings that receive tax credits through their program have a smokefree policy as of 2015. Washington: The Washington State Housing Trust Fund requires that affordable housing projects receiving funding must adhere to the Evergreen Sustainable Development Standard, which requires all properties to have a smokefree policy as of 2016.

For example, Baldwin Park, CA (marked as Some for All Units Currently Smokefree) requires that all newly occupied buildings must be 100% smokefree as of 6/21/2012, which is the Initial Effective Date. Baldwin Park also requires that at least 80% of units in all existing buildings be smokefree. Because existing buildings may never be fully smokefree, the Final Effective Date is “Not Specified.”
