    Lamps:Mustuniversalwastelampsbeshippedasahazardousmaterial?No.Lampsdonotmeetthefollowingcriteriaforahazardousmaterial:

    (1) HazardousSubstancesTheaverage4footfluorescentlampcontains8.3mgofmercuryaccordingtoastudypublishedbyNEMA.TomeettheRQandmakeacontaineroflampsahazardoussubstanceyouwouldneedover50,000lampsinasinglecontainer.

    (2) HazardousWastesAslistedabove,DOTdoesnotviewuniversalwasteasahazardouswaste.

    (3) MarinePollutantsMercuryandmercurycontainedinmanufacturedarticlesarenotlistedasamarinepollutant.

    (4) ElevatedTemperatureMaterialLampsarenotanelevatedtemperaturematerial

    (5) Materialsidentifiedin172.101LampswouldmeetthelistingMercurycontainedinmanufacturedarticles.However,thisshippingnameisonlyusedwhentransportingmercurycontainingdevicesbyair(asdenotedbytheAincolumn1ofthehazardousmaterialstable.)

    (6) MaterialsmeetingthedefinitionscontainedinPart173.LampsdonotmeetanyofthehazardclassdefinitionslistedinPart173.Inparticularlampsdonotmeettheclass9definitioncontainedin49CFRPart173.140(a) Anymaterialwhichhasan

    anesthetic,noxiousorothersimilarpropertywhichcouldcauseextremeannoyanceordiscomforttoaflightcrewmembersoastopreventthecorrectperformanceofassignedduties;or

    (b) Anymaterialthatmeetsthedefinitionin171.8ofthissubchapterforanelevatedtemperaturematerial,ahazardoussubstance,ahazardouswaste,oramarinepollutant.

    Mycompanywantstoshipintactlampsasahazardouswaste.Howdotheyneedtobepackaged?49CFR173.164(b)statesthat(m)anufacturedarticlesorapparatuses,eachcontainingnotmorethan100mg(0.0035ounce)ofmercuryandpackagedsothatthequantityofmercuryperpackagedoesnotexceed1g(0.035ounce)arenotsubjecttotherequirementsofthissubchapter.Basedonthismostlampsareexemptfrompackagingrequirementsprovidedthetotalmercuryinthepackagedoesnotexceed1g.Lampspackagedinoriginallampcontainerswouldmeetthisexemption.In2001,theaverage4fluorescentlampcontainedaround8mgofmercury.Basedonthattotal,lampcontainersholdingover1004lampscouldbesubjecttotherequirementsin49CFR173.164.

    EPARequirements[40CFR273.13(c)&273.33(c)]:Themercurycontainingequipmentmustbeplacedinacontainerasfollows:(t)hecontainermustbeclosed,structurallysound,compatiblewiththecontentsofthedevice,mustlackevidenceofleakage,spillage,ordamagethatcouldcauseleakageunderreasonablyforeseeableconditions,andmustbereasonablydesignedtopreventtheescapeofmercuryintotheenvironmentbyvolatilizationoranyothermeans.Mercuryampulesmustbestoredinclosed,nonleakingcontainersthatareingoodcondition;andmust(p)ack(s)removedampulesinthecontainerwithpackingmaterialsadequatetopreventbreakageduringstorage,handling,andtransportation.DOTRequirementsMercurycontainingequipmentholdinglessthan1lbofmercuryandthataremanagedasauniversalwasteandarenotshippedviaairorwaterareexemptfromDOTrequirements.[49CFR

    173.164(e)]Therefore,theuniversalwastepackagingrequirementswouldbetheonlyrequirementsapplicable.

    Howmustmercurycontainingequipmentcontaininggreaterthan1lbofmercuryorthatarebeingmanagedashazardouswastebepackaged?Manufacturedarticlesorapparatusescontainingmercuryareexceptedfromthespecificationpackagingrequirementswhenpackagedasfollows:

    EPARequirementsContainermustmeetEPAmarkingandlabelingrequirementsandmeetDOTpackagingrequirements.DOTRequirements[see49CFR173.164(c)]Manometers,pumps,thermometers,switches,etc.Mustbeinstrongouterpackagings,havingsealedinnerlinersorbagsofstrongleakproofandpunctureresistantmaterialimpervioustomercury,whichwillpreventtheescapeofmercuryfromthepackageirrespectiveofitsposition.MercurySwitchesandRelaysExemptwheninametalorplasticcontainerthatistotallyenclosedandleakproof.Thermometers,SwitchesandRelaysInstalledInAMachineorApparatusExemptifthetotalquantityofmercurydoesnotexceed15g(0.53ounces)andisfittedthatshockofimpactdamage,leadingtoleakageofmercury,isunlikelytooccurundernormaltransportationconditions.

    Inthisrule,forelementalmercurytobeintegraltothefunctionofequipment,themercurymustbepartofthefunctionofthedevice.Ifthemercuryisinthedeviceaccidentally,orthedevicehasbeencontaminatedbyanexternalsourceofmercury,

    thedevicewouldnotbeeligibleformanagementasauniversalwaste.

    Areconditionallyexemptsmallquantitygenerators(CESQGs)thataccumulateuniversalwasterequiredtomanagethewasteinaccordancewithPart273,orcanthegeneratormanagethewasteasaCESQGinaccordancewith261.5?

    TheuniversalwastemanagementstandardsinPart273areanalternativesetofstandardstoParts260through272(273.1(b)).CESQGshavetheoptionofhandlingtheirwasteunderthereducedgeneratorrequirementscodifiedin261.5orasuniversalwaste(273.8).ThisoptionallowsCESQGstheabilitytochooseamanagementmethodthatislesscostlyandmoresensiblefromabusinessstandpoint.However,ifuniversalwastesgeneratedfromCESQGsarecommingledwithuniversalwastesproducedbysmallquantityorlargequantitygenerators,andthecommingledwasteisahazardouswastedefinedby261.3(i.e.,becauseitislistedorexhibitsacharacteristic),thenitmustbemanagedasauniversalwasteinaccordancewithPart273(60FR25492,2550910;May11,1995).
