SUMMARY**

Nevada Insurance Law

The panel reversed and remanded to the district court forentry of summary judgment in favor of Progressive GulfInsurance Company after the Nevada Supreme Courtanswered a certified question concerning choice-of-law in aninsurance contract.

The panel certified a question to the Nevada SupremeCourt, and the Nevada Supreme Court rephrased the question.The Nevada Supreme Court held that Nevada public policydid not “preclude giving effect to a household exclusionclause in an automobile liability insurance policy delivered inMississippi to Mississippi residents and choosing Mississippilaw as controlling, where Mississippi law permits householdexclusions but the effect of the exclusion is to deny Nevadaresidents who were injured in Nevada recovery of theminimum coverages specified in NRS 485.3091.”

The panel held that because Mississippi law applied,summary judgment should have been granted in favor ofProgressive Gulf Insurance Company where the partiesstipulated that if Mississippi law applied, there was nocoverage under the Progressive Gulf Insurance Company policy.

OPINION

PER CURIAM:

Progressive Gulf Insurance Company seeks review of thedistrict court’s order denying its motion for summaryjudgment and of a later order entering judgment in favor ofthe defendants. The sole issue before us is whether Nevadaor Mississippi law applies to the parties’ insurance contract. Because Mississippi law applies, we reverse the judgment ofthe district court.

Randall and Toni Faehnrich lived in Mississippi with theirtwo minor children. They contracted with Progressive Gulffor automobile insurance. The policy was delivered inMississippi. It covered cars garaged in Mississippi, bearingMississippi license plates, driven by Mississippi-licenseddrivers. The policy specified that it was governed byMississippi law.

The Faehnrichs divorced and, in 2003, Toni Faehnrichmoved to Nevada. On June 8, 2003, Toni Faehnrich wasinvolved in a rollover vehicle accident while the two childrenwere passengers in her car. Randall Faehnrich presented abodily injury claim to Progressive Gulf on behalf of the

children, which Progressive Gulf denied, citing the policy’sfamily-member exclusion.

The parties stipulated that, “if Mississippi law isapplicable, there is no coverage under the terms andconditions of the Progressive policy.” We certified thefollowing question to the Nevada Supreme Court:1

Does Nevada’s public policy precludegiving effect to a choice-of-law provision inan insurance contract that was negotiated,executed, and delivered while the partiesresided outside of Nevada, when that effectwould deny any recovery under NevadaRevised Statutes section 485.3091 to Nevadaresidents who were injured in Nevada?

The Nevada Supreme Court chose to rephrase thequestion, as is its prerogative. Rephrased, the question theNevada Supreme Court answered was:2

were injured in Nevada recovery of theminimum coverages specified in NRS485.3091?

The Nevada Supreme Court answered this question in thenegative, holding that “giving effect to the choice-of-lawprovision in the parties’ automobile insurance policy does notviolate Nevada’s public policy.”3 Because Mississippi lawapplies, summary judgment should have been granted infavor of Progressive Gulf. The facts and reasoning are fullyset out in the Nevada Supreme Court’s decision, ProgressiveGulf Ins. Co. v. Faehnrich, No. 57324, 2014 WL 1258808(Nev. March 27, 2014), which we attach as an appendix.

REVERSED AND REMANDED for entry of summaryjudgment in favor of Progressive Gulf Insurance Company.
