The PresidenT’s Message

I hope that everyone is doing well and looking forward to summer. Enjoy your vacations with family and friends and make sure to stay safe. As we head into the summer months we are currently involved with Acme negotiations. The big issue with the Acme negotiations is, as always, healthcare. I have been visiting Acme locations and talking with our members who have been telling me what they feel is important in these negotiations. Local 1360 has heard our members and will continue to fight to maintain the current benefits that our members currently hold near and dear to their heart, along with across-the-board increases and not bonuses. We are working hard and hope to have a fair deal wrapped up within the next month.

In July, we will be starting with Shop-Rite negotiations. All of our Shop-Rite contracts’ are up at the end of August. I’m sure, as with Acme Markets, healthcare will be at the center of the conversation.

As you are aware, Tri-State Pension Fund has been struggling since the A&P bankruptcy due to the fact that we no longer receive contributions for those former Pathmark, A&P and SuperFresh members. We believe we have a plan that can fix the Tri-State Pension problem. It is currently being vetted by the Tri-State Trustees. I will keep you informed if and when the Trustees finalize the plan.

Next, on the state level, I’m sure everyone has read about the minimum wage bill that has been introduced. Local 1360 is in support of this bill which would see the minimum wage raised to $15.00 an hour plus cost of living.

The country is gearing up for one of the biggest Presidential elections in history. As we go to press it looks as if the two candidates will be Hillary Clinton and Donald Trump. As you vote you should support those candidates who represent the values of our union and the working class men and women of this country. Don’t fall for

the rhetoric that one of the candidates is presenting. He is using anger and fear to promote his agenda and has no clear answer for the problems that are confronting our country. He has shown that he does not support the working class in this country and will only feather the nests of the upper class.

The presidential race is not the only one that will be on the ballot this year. There are many state, county and local races and as with the presidential race we should support the candidates who share the same beliefs as the working class man and woman of this great country. If you do not know what a candidate’s platform is please take the time to find out so you can make an informed decision.

Hopefully everyone is planning their vacations and heading into a fun-filled, relaxing summer. We ask that all of you follow your company policies and rules to stay out of trouble. Let’s see if we can get through this summer without making bad choices when it comes to our jobs. You know you must get to work on time and that you cannot keep

calling out without consequences. You also know that you must work while on the clock and not work while off the clock.

None of this should be new to anyone. As a matter of fact, it is simply common sense. Just like stealing will get you fired, so will stealing time. Harassing fellow workers in any way will also have serious consequences. Do not threaten anyone, do not touch anyone, and do not make comments that could be offensive. The world has changed and we must all change with it. Simply go to work, do your job, and leave. Do not worry about what anyone else is doing, just worry about yourself and doing your job.

For those in retail, do not take Catalina coupons for your own use. Do not take anything that you have not earned yourself. These

are easy traps to fall into and seem harmless at the time. Make no mistake about it, the company will terminate you for theft and failure to follow policy if you receive anything that you have not earned and are not entitled to.

On another note, make sure you know your contract and understand it. Know what management can do and what they cannot do. In most cases, management cannot do bargaining unit work. If they are and you let them, then you could stand the risk of losing that work. This may not affect you today, but no one knows what tomorrow holds and that manager doing your work today may very well put you out of work tomorrow.

Make sure that you understand your rights and what you need to do to protect them. If you are called into a meeting with management or loss prevention, you need to ask for Union Representation. The questioning must end at that time and should not resume until a Steward or Representative is available. Do not fall for the line, “If you didn’t do anything then you don’t need the Union”. That is a mind game and some of the employers play it well. DO NOT ever write a statement! Contrary to what some loss prevention people will tell you, you do not have to write a statement. DO NOT ever sign anything such as an agreement to restitution or a statement. Once again, THINK BEFORE YOU ACT!

It Is Your Right And Responsibility To Make Sure You Are Enrolled In Our Union

Weingarten Rights: Know Your Rights at Work!

One of the Union Shop Steward’s most important jobs is to prevent threats and intimidation by management. Nowhere is this more important than in closed-door meetings where supervisors or guards, often trained in interrogation techniques, will try to scare or intimidate employees, or force them to confess to wrongdoing.

In a case called NLRB v. J Weingarten Inc., the U.S. Supreme Court ruled that employees have the right to have a Union Representative present during investigatory interviews. These “Weingarten Rights” or Weingarten Rules”, named after the Supreme Court Case, are among the most valuable protections Union employees have.

Weingarten Rules

Under the Weingarten case, all employees have the right to Union representation when they reasonably believe that an investigatory interview is about to take place. ‘Investigatory interviews’ occur when a supervisor, guard, or other company official questions a worker to try and obtain information which could be used by the company to discipline the worker, or when

employees are asked to defend their conduct. If the company breaks any of the following rules, it breaks the law.

Rule 1: If you think you will be asked questions that will lead to discipline, and if the company automatically let the Union Shop Steward attend the meeting, you must make a clear request for Union representation before or during the interview. You cannot be punished for making this request.

However, the company does not have to inform employees of their ‘Weingarten rights.’ You may be familiar with ‘Miranda warnings’ police have to give in criminal cases. This is different - employees have ‘Miranda’ rights on the job.

Be sure to ask for a Shop Steward or Union Representative if one isn’t there at the meeting already.

Rule 2: After you make a request for Union representation, the company can do one of the following things:

• Grant the request and delay questioning until the Union representative arrives and has a chance to consult privately with the employee; or

• Deny the request and end the interview immediately; or

• Give the employee a chance of (a) having the interview without representation or (b) ending the interview.

Rule 3: If the company denies the request for Union representation, but continues to ask questions, it commits an unfair labor practice and you have the right to refuse to answer. The company cannot discipline you for refusing to answer under these circumstances. (You cannot get up and leave the meeting though until the employer permits you to leave.)

Weingarten rights apply to all employees represented by the Union, whether probationary or permanent. If you do not request representation, the company has the right to do the interview without the Shop Steward present, and to use the information it obtains in any way it sees fit.

Your request to be represented by the Union should be in the following form:

“If this discussion could in any way lead to my being disciplined or terminated, or affect my personal working conditions, I request that my Union Representative, officer, or Shop Steward be present at the meeting. Without representation, I choose not to answer any questions.”

Union Representative Maryann Oswald Reports

At the time of writing this article, we are preparing for negotiations with Acme Markets. We hope this process will move quickly and we get a good contract.

Warm weather is upon us and everyone will begin to think about vacations and personal holiday time. Please make sure you know what your entitlements are. It is not the company's responsibility to inform you of these entitlements. It is your responsibility to know what you have earned. If you're not sure, please seek out your shop steward or call me (856-767-4001 ext. 307) so you have a clear understanding of how much vacation and PH time you have worked to earn. Your vacation and PH entitlements increase the longer you are with your employer. Make sure you submit your request to the manager in writing and ask for written confirmation or denial of your request. If management does not give you written confirmation in two weeks, ask again. If you still don't get confirmation, call your union representative. Far too many times we get frantic calls from our members telling us that they just found out that the vacation they wanted to take and most of the time already paid for, has been denied. To avoid this happening to you, get the vacation request confirmation in writing!!

Each year we get calls at the end of the year from our members who have been denied their vacations in November and December. Do not wait until this late in the year to request time off. Many think that by waiting until the end of the year, their employer will be forced to give them time off. We must realize that in retail, from right before Thanksgiving to the end of the year, the stores are very busy. Your employer will more than likely deny your request. When your union representative calls the company to appeal to them to give you your time off, we get the same answer time and time again "Why did they wait so late in the year to ask for time off, they had all year to put their request in? Request denied". Do not let this happen to you. If you have plans

for that time of the year, put your request in early in the year and if your request is denied, call your representative and we will address this with your manager to see if we will be able to get your request granted.

We have recently had many members terminated for theft of time. Remember, this is theft and you will be terminated with good cause. With the nice weather upon us, there is always the temptation to take just a few extra minutes on break or “sneak outside for a cigarette”. If caught, you will be disciplined. Do not lose your job for this.

Another issue that has recently come to light is the “seven minute” rule for punching in or out. This is NOT the case when punching the clock. Most of our employers consider three minutes or more as being late. Seven minutes comes in to play only so a manager does not have to be called to “red card” or override your punch. Avoid this problem by being on time.

get yourself in trouble at work. Come to work on time, do your job correctly, and go home. If you follow those 3 simple rules, you should not have any problems. That way if you are calling me, it is just to say hello.

Union Representative Helen Polizzi Ireland Reports

BRIDGETON ACME: I am so sorry to see you guys go. It has been nice coming to your island and making visits. We at Local 1360 wish all of

you that chose to transfer and those of you deciding not to continue on good luck. We wish you all well and if you have issues, please let us know. Thank you.

BORO OF GLASSBORO, HIGHWAY DEPARTMENT, MECHANICS AND RECORD CLERKS: For all of you, especially our drivers and members with a CDLC license, please make sure all of your paperwork is legal and up to date. Sometimes, we may not be aware of something, so check periodically. Also, your contract is going to be up at the end of the year so start thinking now on what you would like to add or change in your contract. Keep it in mind. Another important point, not all of you may like each other for whatever reasons you may have and that is not an issue. We do not come to work to make friends. However, when you start telling on each other or gossiping it can affect someone’s work or may cost someone their job. Do you really want that to be on you? Think before you talk or write anything about your co-worker.

MEADOWVIEW/GENESIS: Welcome to the dietary department who is now back into the main contract. We are glad to have you. At this time, all of you in dietary have the right to use the Union stewards that are CNA’s. They are Kim Bateman, Denise Price, and Jonnette Smith. Anyone of these ladies will be glad to help you with issues. They are great people and great

at their position. Also, all of you can call me when you need information or help.

MEADOWVIEW HEALTH CARE SERVICES: It is important to know that you have a Union contract and need to use it whenever necessary. I know most of you may not have issues, but when you do, please call me at 856-767-4001-ext. 312. We will help you with any issues.

MURPHY’S MARKET: I am sure all of you survived another Saint Patty’s day at Murphy’s. I heard it was festive and a lot of fun. All wore the proud color of green. There are not many issues at this time going on in your stores. If you need to contact me for any reason, please call 856-767-4001 ext. 312.

RAVITz SHOPRITE: The time is getting closer for negotiations on your contract. Hopefully by summer time you should be getting contract proposal papers to fill out. I ask that you fill it out once you get it and give them back as soon as possible to your shop steward. Also if you have any issues or questions, please feel free to ask the stewards or contact me at 856-767-4001 ext. 312.

RITE AID MEMBERS: For all our Route 9 members, this is the busy season for you. Keep smiling as the summer visitors come in and spend their money. For all of you, next year (2017) is the end of your Union contract. It expires so please start thinking of what you would like to see added in the contract or changed. Remember to take interest in your contract and your Union. It could be the difference between a good or bad contract.

MONROE TOWNSHIP: Congratulations on your new contract. Hopefully by now all of you received your retro and if you have any problems or issues, please give me a call 856-767-4001 ext. 312. Also, thank you to the negotiating committee for all the hours and hard work you did on the contract.

An issue that has come back up is improper conduct in the workplace. This can occur in different ways. It can come from what you say to someone

or if you come into physical contact with another person. First let’s talk about verbal improper conduct. You may make a comment or tell a joke to a person one day, and they are fine with it. You may say the same thing or something similar another day and that same person may be offended. They could then file a complaint with the company, and now you are in trouble. Depending on what you said, you could be terminated. When you are making comments or telling certain jokes in the workplace, you don’t know who may overhear you, take offense, or file a complaint and again you are in trouble. It could be another employee or a customer.

If you wouldn’t make the comment or tell the joke to your mother or child, don’t say it to anyone else while you are at work. A very simple rule to follow is do not discuss politics, religion, or any type of sexual issues while at work. Next, I will discuss physical contact. Putting your hands on someone in the workplace is absolutely unacceptable! You may think just putting your arm around someone or giving them a playful hug is okay. Some people may think it is while other people are offended or scared. Do not take the chance. Is your job worth losing over something like a hug or a handhold? Some people like to give people a little kiss on the cheek as a sign of friendship. Again, this is unacceptable! You may think it is harmless, but someone else may not. Remember, everyone has their own personal space. Respect it and stay out of it. If you wouldn’t want someone to do it to your family member, what makes you think it is okay for you to do it to someone else?

I also wanted to review employee purchase policies. Check your handbooks. Learn the policy and follow it exactly! If you haven’t paid for it, do not eat it or drink it. If it seems like something is too good to be true, it usually is. Finally, there are many ways to

SHOP RITE:It is a contract year and we hope to get it done on time. Your contract expires on August 27th. We will be handing out surveys soon, so you can give us feedback on your priorities for us to negotiate. Some other issues we have been dealing with in the past six months have been being respectful to each other at the workplace.

We have had members verbally abusing other members and gossiping about other members and their personal life issues. Let us remind you that the companies will discipline you if you are caught doing this. Please refrain from talking disrespectfully to or about each other. You are all working to earn a paycheck to support yourself and maybe a family. If someone wants to spread gossip, please tell the person you do not wish to hear or be involved in such and tell them they need to stop.

Attention all new and old members: Please make sure you read the policy books you sign for at orientation. Saying in a griev-ance meeting, "I did not know that was the Policy" does not hold water when you signed for it stating you understood it. Also, read your Union Contract when you receive it from the Union. If you have any questions, please ask you Union Representative or Shop Steward.

RITE AID:At the time of writing this article (April 1), we are continuing business as usual. There has been no news on the pending deal with Walgreens.

ARISTA CARE:Congratulations to the CNA's on their new five-year contract. Also, we would like to welcome the dietary workers of Health Care Services at Arista Care who ratified their first contract on March 24th.

AVISTA HC &CMS:AVISTA members: Hopefully by the time you read this article, you will have a new contract. Your owners tell us how much they value their employees, but their actions do not reflect what they say when it comes to the contract. We have told them this during negotiations and that you see the same thing!

CMS: Your contract has one more year to go.

LIONS GATE:By time you read this article, we will be in negotiations for your new contract. There

have been issues lately concerning a Super-visor in the non-nursing area that is border line unprofessional. If you think this person is acting disrespectful towards you or other members, please document the date, time, place, and what was said so we may address this issue.

FLIK (Morrison’s)Dietary:Your company will be negotiating a separate but similar contract to Lions Gate. We had started one back when they first took over, but then they decided it would be better to wait until the current contract with Lions Gate expired. Also, I know there have been issues with supervision in the kitchen and how the Chef speaks to people. We have addressed it when notified, but if you call us to complain about this issue be prepared to stand behind your complaint. We will document this through the grievance process! Also, your first step should be to discuss this with the Dining Services Director so he can try to correct the issue first.

MT LAUREL CENTER:LPN's: Attention all nurses that are in your first four years as a Union Member, your raises are based on your Union Anniversary date each year, not your non-union hire date! When that date comes close, please inform your Human Resource/payroll person so they know to put you in for your yearly increase. Corporate pay-roll states they do not do anything unless the facility sends them the information! We have had major issues with this in the past. Do not wait months after you were due a raise to contact the Union. We need to address this as soon as possible.

Laundry & HousekeepingWe are having the same issues with payroll raises or PTO time and Union dues.

It is very important to know that your seniority accounts for so much in a Union environment. It needs to be addressed with your stewards if it is not being followed. Union Representative Terri Dunnet Reports

Let me start by wishing everyone a happy summer. I want to tell you of an incident that happened at one of my Rite Aid stores. My Shop Steward noticed that two members of loss prevention were in her store.

A little while later, she was told that another member had been taken in the office by them. She called me to see what she should do. I told her to go knock on the door to see if he needed Union representation. She called me back and told me they refused her access to him. I told her to go knock again and make sure they knew she was his Shop Steward. Well, lo and behold, I got another call saying that they still refused her. After hearing this, I got in my car and drove to the store and as you could guess, they refused me access to him as well. They continued refusing until I threatened to go to the Labor Board and file charges against them. It seems that they were not allowing the Union access because they were badgering him into writing and signing a statement and threatened to call the police. The reason I tell you this story is to make you all aware that it is against the law for management, LP, or HR to refuse Union representation to any of you. I cannot stress to you enough that if you are called in to the office and accused of something, you need to utilize your Weingarten Rights. Ask for Union representation no matter what company you work for. It is important that you request union representation; otherwise they are not required to provide you with any representation.

For the members at Acme, be aware that the reset teams that are coming into your stores are to have a Local 1360 member working with them. They cannot fill the shelves, only front them and then the 1360 members can fill them. If the reset team comes to your store without a Local 1360 member working with them, the Union needs to know right away. We can file a grievance and have our members paid. I know department managers do not have all the help they need and think of this as free help. We cannot let this happen to our part-timers who are having their hours cut. Our own Union brothers and sisters could use the extra hours and money.

For all other members, no matter what location you work at; remember that

management and non-union workers cannot do your work. It is not allowed contractually. Do not let management or any non-union workers take hours that rightfully belong to you. If this happens, contact your shop stewards or me immediately so we can file a grievance.

Just remember that your Union is here to fight for your rights and to help protect your job. We here at UFCW Local 1360 can be very effective advocates on your behalf, but only if we know that your employer has done something to violate the contract and your rights. If you don't tell us, we will never know. Make sure you do not leave important issues hanging out there.

On behalf of UFCW Local 1360, I want to send my thoughts and prayers to all of our members who have lost a loved one. If someone in your workplace suffers a loss, please let me know.

Union Representative Tom Zola ReportsGreetings everyone! After a long winter, I would like to wish you all a safe and a

fun filled summer! Fire up the BBQ, go down the shore, but most of all be safe in all you do! As you all know, 2016 is a presidential election year. Your right to vote is a precious one, and should not be taken for granted! Local 1360 has begun its 2016 voter registration drive. If you are not a registered voter and would like to become one, simply seek out your shop steward or union representative and we will give you a registration form to fill out.

The Union will then submit the form for you. Let your voice be heard! If you are already a registered voter and have recently changed your address, or if you wish to declare or change your party affiliation, you should also fill out a new form. Exercise your right to vote. Remember, if you don’t vote, you shouldn’t complain.

This summer will be a very busy one, with the Acme contract expiring March 25th and the Shoprite contracts expiring the end of August. The Union will be circulating contract survey forms to the members via your stewards to find out what issues are most important to you, the members. Please be assured that the Union will work very hard to keep your best interests at the forefront of the negotiations. Please be sure to see your shop steward if you have not received a survey.

Lastly, I want to stress the protocol for when we have a member versus member issue. Please understand that we must represent all of our members equally, therefore we must stay neutral in such disputes! I suggest that if you have a problem with another member, see if it can be worked out between the two of you, and your steward or union representative if possible. If not, you must go to management and let them know. Management should then take the appropriate steps to investigate and react accordingly. Again, we as the Union cannot take sides and must remain neutral. If any sort of discipline arises from a complaint, the Union will be there to represent its members!

Organizing Directors Report

The Organizing department is presently working on a large healthcare facility in South Jersey. By the time this article is printed, we will have filed a petition for these 50 plus workers. There are 2 more facilities in Camden County that are also showing interest in becoming members of Local 1360.

We would like to welcome the 25 Washington Township MUA members who voted 17-0 on April 27th to become Local 1360’s members. We look forward to fighting alongside this great group of workers in their effort to get a contract that they truly deserve.

We are continuing to hit retail sites hard, as these workers still find themselves left behind when it comes to wages, scheduling, and having a voice in the workplace.

Congratulations Bill Robertson!Bill has been a member of Local 1360 since 1979 with Acme Markets. As a Shop Steward, Bill has always helped during contract negotiation and whenever called upon to help our Union.

Along with his loyalty to Local 1360, Bill has served his community as a volunteer firefighter for the last 40 years, most recently 17 years in Washington Township. Like many of our members who face challenges in our communities, Bill saw an opportunity to run for an elected office in the Washington Township Fire Department. He ran for the elected position of Fire Commissioner of Washington Township.

Election Day was Saturday, February 20th, and with a well-coordinated campaign, Bill was able to win big on Election Day. We here at Local 1360 want to congratulate Bill for stepping up to the challenge of running for an elected position. In addition to Bill's victory, the amount of votes Bill received broke all past voting records.

Bill challenges every one of our members to get involved as he did. Help your community by running for an elected office, get appointed to boards, or just volunteer to help your community be the best it could be. Bill now joins the long list of Union members who took the same challenge as he did in running for an elected office. He has become the 357th Union member to join the ranks of the New Jersey AFL-CIO Labor Candidates program.

A Personal Message from Newly Elected Bill Robertson:

I would like to thank Local 1360, the staff and leadership, and President Sam Ferraino for all their guidance and help with my recent election to the

office of Fire Commissioner of Washington Township. My message to our members is if you are thinking of running for any elected position in your

community, look to the support and experience of Local 1360. If it is running for your township council, school board, or fire commissioner, Local

1360 has the experience and knowledge to help in your road to victory.

I received a lot of help from E-Board member VP Paul Prosser, who walked door to door with handouts asking for support for my election and a

"yes" vote on the Washington Township Fire Budget. UFCW 1776 member Cindy Leary (a Washington Township resident) was also out campaigning

for me and for the budget. Political Director Gregory Quagliato coordinated letters and blast calls and messages were sent out to our Local 1360

members who reside in Washington Township.

My election had history making results. I received 547 votes (45% of the votes cast) while the closest competitor only received 261 votes and the

budget passed with 609 in favor and 390 against. With Union brothers and sisters working together, and the leadership of Local 1360, I was able to

achieve my elected position and enhance the positive vote for the Township Fire budget.

My message to our members is to get UFCW Local 1360 engaged in your election if you decide to run for any elected position in your community.

Our Union not only gives us power and strength in our contracts, but also extends that expertise in the political world from our townships to the

largest office of the land. The Union makes the difference.

FLASH!The UFCW Local 1360’s Women’s Network is back! By: Helen Ireland

We are looking for women that are interested in getting involved with Local 1360’s Women’s Network. Everyone is welcome! We do both rewarding and fun things at the same time. One of the goals is to help the less fortunate. I can tell you from my personal

experience of being involved with the Women’s Network that the reward of helping others cannot be compared to any other feeling.

We are looking for women that like to have fun while helping others. During the year, we sponsor a fall fundraiser, usually a Halloween Beef and Beer. Other events consist of making sack lunches for the homeless shelters, coat drives (including hats, scarves, and gloves), and toiletry collections for the less fortunate.

Our meetings will be held at different locations in Burlington County and also right here at our Union Hall, located at 400 Commerce Lane, West Berlin NJ 08091 (Camden County). We would like to make ourselves accessible for all that want to join. I hope to hear from you shortly!

We also meet up with other UFCW Women’s Network groups throughout the East Coast. During these meetings, we exchange ideas and information. This organization helps women grow as we grow ourselves. Please call and become part of our network.

There is no limit to how many people can join. There is no out of pocket cost to join. The more members we have, the more we can accomplish! There will be more information to follow. Please give me a call if you are interested.

Ron Pugh – Ravitz Family ShopRiteRon Pugh has worked for the Ravitz Family ShopRite in Marlton for fifteen years. Ron's friendly and helpful attitude is appreciated by all of the customers.

Ron enjoys going to Disney with his family. Ron has three brothers, who are married and have children. Ron looks forward to the large family gatherings they have. Ron's parents will celebrate their 50th wedding anniversary later this year. We wish them the best.

Dot Valianti – Ravitz Cherry Hill ShopRiteDot Valianti is an amazing person. She works for Ravitz ShopRite in Cherry Hill. She has been there for thirty-two years. Dot has been married to Mike for twenty-nine years and has four children. Nichole, who is twenty-six, gave a kidney to her sister Krystal, who is twenty-two, about a year ago. She also has a son, Michael, who is twenty-three, and another daughter, Rene, who is twenty. Dot works full-time and when she is not at work, she is coaching girls’ softball at Collingswood Middle School. This is her second year coaching softball. The other activity she does selflessly is volunteering. She volunteers during her spring vacation to work with APEX experience. She goes with thirty students from Saint Joseph’s and they are sent to places in the Appalachian Mountain area like West Virginia, South Carolina, or Tennessee, where they build homes alongside habitat for humanity. The world could use more people like Dot.

Bill Robertson – Acme 7998We would like to congratulate Bill for being elected as Commissioner of the Washington Township Fire Department on February 27, 2016. Bill has been serving his community in the Washington Township Fire Department for the past seventeen years and he served in the Lindenwold Fire Department before that.

Bill is a full-time Produce Clerk at the Runnemede Acme and also serves as the Shop Steward for 1360. Bill was instrumental in getting language in the Contract back in 2009, which got members approved leave for Fire and EMT training to better serve the communities our members live in.

UFCW Local 1360 Fourteenth Annual Scholarship & Leukemia Charity Golf Outing

Mark your calendars! UFCW Local 1360 will hold our Fourteenth Annual Golf Outing on Wednesday, May 10, 2017.

Come and join us for a day of fun. All of the outing proceeds that come from the registration fees, sponsorships and raffle income are donated to the UFCW International Leukemia Society for continuing research and to the UFCW Local 1360 Scholarship Fund which benefits our members.

The cost for a UFCW member is $80.00 per golfer. At least one member of a foursome must be a Local 1360 member. The cost for non-members is $200.00 per golfer. Payment must accompany all registrations.

UFCW Local 1360’s Thirteenth Annual Scholarship & Leukemia Charity Golf Outing UFCW Local 1360 held their Thirteenth Annual Charity Golf Outing on May 4th. President, Sam Ferraino, stated that over 90 golfers (many Union members) and others who made direct donations to our Charity Golf Outing helped to make this year’s outing one of the best since we started twelve years ago. The money raised at this event goes directly to higher education and a contribution to the UFCW International Leukemia & Lymphoma Society.

This year’s outing started with signing in for golfers and a breakfast. The golfers took to the course at 8:30am to begin what was a day full of rewards and challenges. Once the golfing was over, everyone enjoyed a delicious luncheon.

If you or someone you know is or was the victim of domestic violence, please know that there are agencies that offer hotline services, emergency shelter, safety planning, and counseling. There are laws intended to assist victims with remaining safe from future acts of domestic violence. If you are presently in danger or suffering from violence at this moment, please call 9-1-1 to report it and get to safety as quickly as possible. Each county in New Jersey has a domestic violence program that provides services to victims. These are excellent agencies that are a good place for an individual to start if they are seeking emergency shelter, counseling for themselves or children, safety planning, or to explore their legal options. In addition, the hotlines for these county domestic violence agencies are confidential for callers. Anyone who needs to reach out for domestic violence assistance is encouraged to utilize these agencies, at a minimum, to gather information.

New Jersey’s Law Against Domestic Violence makes it possible for intimate partners, people who are in a dating relationship together, and certain family relationships to obtain a Restraining Order against the other party if certain requirements under the law are met. In order to have jurisdiction and authority to hear a restraining order case, the incident must have occurred in that county or the plaintiff must reside in the county where he/she is seeking a Restraining Order. This gives the Court jurisdiction to hear the Restraining Order case. The next step is to determine if the plaintiff and defendant have the requisite relationship. As stated above, the parties must be intimate partners, in a dating relationship, household members, parents of a child together, spouses, or other immediate family members. For example, unrelated neighbors, co-workers, and acquaintances/friends do not have the necessary relationship to obtain a Restraining Order against each other under the law.

If a person wishes to file for a Restraining Order against another party, he/she can file for one through the local police if it is after business hours in the evening or weekend. They can file through the Court if it is during business hours on a weekday. Since

Restraining Orders can involve emergency situations, a Judge will review your petition seeking a Restraining Order on the same day that you file it and will decide if he/she is granting a Temporary Restraining Order on that same date. The Court will schedule a hearing on your petition seeking a Restraining Order within ten days of the date that you filed it and frequently issue a Temporary Restraining Order. Under the domestic violence laws, the Judge has the authority to exclude one party from the residence and grant exclusion of possession of the residence to the filing party or victim. In a Temporary Restraining Order, this would be pending further order of Court, which means until the next hearing. The filing party can also be granted temporary custody of the parties’ children, and frequently, custody and parenting time are addressed at the Final Restraining Order hearing if the Court grants a Restraining Order. The Court also has the authority to enter a Temporary Child Support Order and various evaluations of the defendant (allegedly the abusive party). Evaluations that can be ordered include parenting classes, substance abuse evaluation, anger management/batterers’ intervention programs, etc.

If you have a Restraining Order entered against you, you should know that Restraining Orders in New Jersey do not automatically expire at any time. Restraining Orders are in effect permanently or until such time as one party petitions the Court to open the case and either modify or vacate the Final Restraining Order. Unless a Judge makes a change to the Order at some point in the future, a Final Restraining Order remains in effect on a permanent basis.

In order to obtain a Final Restraining Order, the Court will hold a trial where the victim must prove by a preponderance of the evidence that there was a recent act of domestic violence and a past history of controlling and abusive behavior. When a person files for a Restraining Order, it is important to be very specific in your petition with describing the recent incident and a past history. When you appear before the Judge for a trial, you are only permitted to testify about the incidents that were listed in your petition. If you want to add

DOMESTIC VIOLENCE LAWSany information to your petition after you first file it and before the hearing, you need to go to the Domestic Violence Unit at your County Court and file an amended petition.

Domestic violence is a serious topic that can range from harassment to terroristic threats to assault. There is no way to generalize it because each individual situation is unique and must be assessed on an individual basis. THE ZIKA VIRUSThe zika virus was discovered in 1947 in the zika forest of Uganda and remained virtually unknown for sixty years. The virus is spread through the bite of a female mosquito of the species –Aedes Aegypti. This mosquito also can carry West Nile Virus, Dengue Fever, Yellow Fever, or Chikungunya. There is no vaccine to prevent the zika virus. The most common symptoms of the zika virus are fever, rash, joint pain, and conjunctivitis (red eyes). In recent months, the zika virus has been prompting worldwide concern due to the alarming connection to a neurological birth disorder and the rapid spread of the virus across the globe. The World Health Organization has declared a public health emergency due to the casual link to brain damage in babies. This is only the fourth public health emergency ever announced and paves the way for more funding and manpower to fight this mosquito born pathogen.

How Can We Help

Eliminate any standing water in and around your home or community. Female mosquitoes lay several hundred eggs on the walls of water-filled containers. Eggs stick to the containers and stay attached until they are scrubbed off. When water covers the eggs, they hatch and become adults in about a week.

Once a week, drain, dump, and scrub out any container holding stagnant water to reduce the number of mosquitoes. These mosquitoes live inside and outside and prefer to bite during the day. Keep screens in good condition and use air conditioning when possible. To prevent bites, use an Environmental Protection Agency registered insect repellent.

Do your part to prevent further spread of zika virus. It is already estimated that this virus will infect up to 4 million people by the end of the year.

INJECTABLE MEDICATIONSInsulin and Imitrex are the only injectable medications covered under the Prescription Drug Benefit administered by Express Scripts. Therefore, these are the only injectables that you can obtain at the pharmacy level. If your physician gives you a prescription for an injectable drug other than Insulin or Imitrex, your prescription may be covered as a Major Medical Benefit through the Fund Office with prior approval by the Managed Care Department. After you satisfy your deductible, the plan will pay 80% of the cost and you will be responsible for 20% of the remaining fees. Contact the Managed Care Office at 1-800-228-7484 for information and approval of any injectable drug that is ordered through a prescription given to you by your Doctor.

If approved, the Case Manager will direct the prescription to the appropriate Specialty Pharmacy. The medication will be shipped to either the patient’s home or the doctor’s office, as requested. The medication is usually received twenty-four hours after the Fund sends the request to the Specialty Pharmacy. All necessary ancillary supplies including, needles, syringes, alcohol wipes, and sharp containers are included in each shipment.

WHERE TO RENT OR PURCHASE DURABLE MEDICAL EqUIPMENT (DME)

Very frequently fund participants make the mistake of purchasing medical equipment at their local pharmacy or through their physicians office, and otherwise. As a result of using a provider who is not in the network, reimbursement is greatly limited and the participant is expected to pay the additional costs.

Durable Medical Equipment can include, but is not limited to the following:

• Diabetic Supplies such as glucometers, syringes, lancets, and strips

• Nebulizers and other in-home respiratory supplies

• C-Pap for Sleep Apnea disorders

• Prosthetics, braces, wheelchairs, rehabilitation and orthopedic equipment

• Home care equipment such as hospital beds, etc.

Pre-certification is necessary for the rental of any Durable Medical Equipment and for the purchase of items with a billed amount that exceeds $100.

In order to obtain approval for Durable Medical Equipment, a healthcare provider must prescribe the item and specific criteria must be met. For example, the prescribed item must be medically necessary and used to serve a medical purpose. It must be appropriate for use in the home and able to withstand repeated use.

A preferred DME provider will call your insurance carrier in order to obtain the pre-certification required.

Risk factors that can contribute to the development of cataracts at an accelerated rate include heredity, trauma to the eye, regular use of tobacco, alcohol or steroids, exposure to radiation, and x-rays or ultraviolet light. There are also certain diseases including diabetes, glaucoma, and hypothyroidism that increase the risk of developing cataracts.

Cataracts normally develop slowly and without pain, as part of the natural aging process. Cataracts occur when proteins in the lens begin to clump together. Over time, these protein clumps cloud over the lens and less light rays pass through the lens to the retina (the retina sits in the back of your eye and forms the visual image you see).

According to the Eye Institute, more than 20 million Americans have a developing cataract. Symptoms can include blurred vision, faded or dull colors, poor night vision, and sensitivity to light. Cataracts are one of the most common causes of vision loss in the United States.

Cataract surgery has existed for many years, but recent advances have transformed this procedure to one of the safest and most effective outpatient procedures. Although cataract surgery is generally a safe procedure, it still has risks. Discuss all risks and considerations with your physician to find out what is best for you.

• Get the forms needed to apply for your particular leave. Your employer should provide you with the proper paperwork to apply for either Short Term Disability or Family Leave. Ask all the questions you have pertaining to these applications directly to your employer or someone designated by your employer who has knowledge of the process you need to follow.

If you are having difficulty with your employer providing the proper paperwork, or they are unable to answer all of your questions, please contact your Union Representative to assist you.

Adult Dependent BenefitsOnce an adult dependent has turned age 19, a cobra notice will be sent. An Adult 26 form is included with the cobra notice. If you would like continued coverage, please complete and return the form to the Fund office as soon as possible so there is no break in coverage. If you have any questions, please contact the enrollment/eligibility department at 1-800-228-7484, prompt #6.

*If at any time the adult dependent child obtains other insurance, it is your responsibility to notify the Fund office immediately.

The PresidenT’s Message

I hope that everyone is doing well and looking forward to summer. Enjoy your vacations with family and friends and make sure to stay safe. As we head into the summer months we are currently involved with Acme negotiations. The big issue with the Acme negotiations is, as always, healthcare. I have been visiting Acme locations and talking with our members who have been telling me what they feel is important in these negotiations. Local 1360 has heard our members and will continue to fight to maintain the current benefits that our members currently hold near and dear to their heart, along with across-the-board increases and not bonuses. We are working hard and hope to have a fair deal wrapped up within the next month.

In July, we will be starting with Shop-Rite negotiations. All of our Shop-Rite contracts’ are up at the end of August. I’m sure, as with Acme Markets, healthcare will be at the center of the conversation.

As you are aware, Tri-State Pension Fund has been struggling since the A&P bankruptcy due to the fact that we no longer receive contributions for those former Pathmark, A&P and SuperFresh members. We believe we have a plan that can fix the Tri-State Pension problem. It is currently being vetted by the Tri-State Trustees. I will keep you informed if and when the Trustees finalize the plan.

Next, on the state level, I’m sure everyone has read about the minimum wage bill that has been introduced. Local 1360 is in support of this bill which would see the minimum wage raised to $15.00 an hour plus cost of living.

The country is gearing up for one of the biggest Presidential elections in history. As we go to press it looks as if the two candidates will be Hillary Clinton and Donald Trump. As you vote you should support those candidates who represent the values of our union and the working class men and women of this country. Don’t fall for

the rhetoric that one of the candidates is presenting. He is using anger and fear to promote his agenda and has no clear answer for the problems that are confronting our country. He has shown that he does not support the working class in this country and will only feather the nests of the upper class.

The presidential race is not the only one that will be on the ballot this year. There are many state, county and local races and as with the presidential race we should support the candidates who share the same beliefs as the working class man and woman of this great country. If you do not know what a candidate’s platform is please take the time to find out so you can make an informed decision.
