In the July-August 2017 edition of the MSBA Journal magazine, MSBA announced that it would make available a document titled, “Outside Organizations Supporting School Districts.” This document provides recommendations and guidance for school districts when they work with a booster club, a PTO, a foundation, or other outside organizations that provide support for a school district.

The Minnesota State High School League collaborated with MSBA in the development of this document and distributed copies at their regional meetings in September. MSBA also wants to thank the Farmington Area School District administration and school board for their work in establishing some of the framework to get this process

The Building a High-Performance School Board Team: Phase III workshop focuses on methods of decision-making, stages of board development, navigating board dynamics and small-group interactions with video school board scenarios, and the MSBA School Board Self-Evaluation.

Regional offerings will be Saturday, October 14, in St. Cloud; and Friday, October 27, in St. Peter.

The Representing Your Community Through Policy and Engagement: Phase IV workshop focuses on in-depth discussions and examples of a board member’s role as a policymaker and interactive small group sessions that walk through an actual community engagement activity. There will also be a segment on dealing with the media and public forums.

Given the fact that the Tiered Licensure System is scheduled to become effective July 1, 2018, school districts that have not settled should consider designing salary schedules and Master Agreement language to provide incentives for teachers to move to Tier 4.

Keep in mind that the Tiered Licensure System is new legislation and questions may arise that will be resolved in arbitration or court decisions, resulting in additional interpretation of the law. The following are MSBA’s recommendations based on our current understanding and interpretation of the law.

First, Tier 1 teachers do not have continuing contract rights and are not part of the bargaining unit. This essentially makes Tier 1 teachers at-will employees, who must be non-renewed in the spring, and, thus, the resulting vacant position must be posted on an approved statewide job board for a minimum of sixty days before the school district can request the terminated teacher’s Tier 1 license be renewed and the teacher rehired. Given these facts, the compensation package for a Tier 1 teacher is negotiable; however, the school district must take into consideration what, if any, potential impact paying a Tier 1 teacher more than what is provided for in the teachers’ negotiated salary schedule would have on the rest of the teaching staff.

Secondly, Tier 2 teachers are in the teacher bargaining unit but do not have continuing contract rights. Because

these teachers are in the bargaining unit, they must be paid according to the existing salary schedule unless specific language in the Master Agreement states something different. Items school districts may want to consider in their teachers’ Master Agreements relative to Tier 2 teachers include:

1. Placing Tier 2 teachers on thefirst step in the appropriateeducational lane the first year;

2. Placing Tier 2 CTE teacherswith less than a bachelor’s degreeon the BA lane and negotiatinghow the number of yearsof experience and/or professionalcertification equates to potentiallane changes;

3. Limiting the number of stepsa Tier 2 teacher may advance toencourage the teacher to move toTier 3;

4. Determining whether to grantlane change credits to Tier 2teachers. (Note: School districtsmay want to limit suchadvancement to Tier 2 teachers atthe MA lane or higher.)

Thirdly, Tier 3 teachers are in the bargaining unit and have continuing contract rights granted after successfully completing the appropriate probationary period provided for in M.S. 122A.40 or M.S. 122A.41. (Note:

A Tier 3 teacher who was a Tier 2 teacher in the same school district and has no break in service will see the last two years of successful teaching count when computing his/her probationary experience.) Items school districts may want to consider in their Master Agreements relative to Tier 3 teachers include:

1. Placing Tier 3 CTE teacherswith less than a bachelor’s degreeon the BA lane and negotiatinghow the number of yearsof experience and/or professionalcertification equates to potentiallane changes;

2. Placing former Tier 2 teacherson the appropriate step (for priorexperience) and educational lane;

3. Limiting the number of steps aTier 3 teacher may advanceto encourage the teacher to moveto Tier 4;

4. Limiting the credits to beconsidered for lane changes tograduate credits. (Note: Theschool district must decide if itis willing to grant credit forcourses necessary for theTier 3 teacher to complete his/herteacher preparation program ifhe/she has not already done so.)

School districts are encouraged to tailor language on this subject to meet the needs of the district. MSBA is working on options for model language and will be communicating additional information as it becomes available. Please contact MSBA if you have questions on this subject.

Superintendent Evaluation

Effective school boards hire a superintendent to lead and manage the school district. Effective school boards delegate authority and hold the superintendent accountable for results by setting clear expectations for the superintendent’s performance that align with the school district’s strategic goals and priorities. MSBA staff have long stressed the importance of setting clear expectations for superintendents and conducting annual performance evaluations to identify the superintendent’s strengths and opportunities for improvement. This article is an updated version of two previously published Management Services Newsletters from June 2011 and June 25, 2012. This article reviews evaluation basics, setting expectations, 360-degree evaluations, and provides a process for handling differences that emerge relative to performance.

Evaluation BasicsThe superintendent’s evaluation

should be based on his/her performance (as defined in the superintendent’s job description) and on previously established expectations and/or performance goals. Superintendents, like other employees, need direction and feedback from their supervisors about (1) what is most important; (2) what they are doing that is going well and should be continued; (3) what is not going so well; and (4) how performance-related concerns are to be addressed. If a school board fails

to set expectations, its superintendent will have to “guess” what is important, or he/she will attempt to satisfy the different expectations of six or seven board members resulting in confusion, discord, and lack of clarity.

Set ExpectationsEvery year, a fairly large number

of school boards conduct searches for new district leaders. Minnesota superintendents typically work for a contract year extending from July 1 through June 30. A school board should meet with its newly hired superintendent as soon as possible after the superintendent has been hired in order to set expectations for his/her performance. Setting expectations for the superintendent’s performance early on will ensure that everyone will be “reading off the same page,” and this need exists even though the school board and superintendent will likely have discussed expectations during the actual selection process.

All superintendents need clear performance expectations and feedback

— even those who have been employed in the same school district for many years. Ultimately, things change; as a result, expectations and priorities typically also change, and the new expectations need to be determined and clearly communicated to all involved.

Many school boards schedule a special meeting to establish mutual expectations with their superintendents, while others address the issue during their regular meetings. Regardless, the conversation must take place in an open meeting because no exception to Minnesota’s Open Meeting Law (OML) exists that allows school boards to close board meetings for purposes of establishing the evaluation criteria. However, a school board may close a meeting to review the superintendent’s performance, and, when doing so, the school board must comply with the all the requirements of M.S. 13D.05, Subd. 3(a). Hold Mid-Year (Formative) and End-of-Year (Summative) Evaluations:

Minnesota law does not require school boards to evaluate their superintendent’s performance; however, MSBA has long held that evaluation is an important activity that should be conducted at least annually as a best practice. MSBA suggests school boards schedule and hold both a mid-year (formative) and an end-of-year (summative) evaluation. According to the Minnesota Department of Education, a formative evaluation is an evaluation that provides feedback designed to improve performance, and a summative evaluation should result in a performance rating for each of the agreed-upon goals/expectations and include a final overall rating for the superintendent’s performance. The benefits of this approach include improved communication and feedback, collaboration, and clarity resulting in a “no surprises” attitude. Good communication and feedback should eliminate surprises that can negatively impact an otherwise great summative evaluation. Additional information can be found in MSBA/Minnesota Association of School Administrators (MASA)-created document titled, “Superintendent Evaluation: A Resource for School Board Members and Superintendent.” A copy is available on MSBA’s website in the Member’s Area.

Developing the Evaluation ProcessThe process and procedures

used to plan for and conduct the superintendent’s evaluation are determined by the school board; however, the process and procedures

to be used must still comply with Minnesota’s OML and Government Data Practices Act. Some of the questions school boards consider when developing a superintendent evaluation process and procedures are provided below.

■ What is most important and, thus, should be evaluated?

■ What can the school board expect to see next year as a result of the superintendent’s work that is not seen now?

■ What documentation must the superintendent provide to show progress and/or accomplishment?

■ What evaluation format will be used?

■ When will the actual evaluation meeting be held?

■ Who will distribute the evaluation forms to the board members for their completion?

■ Who will compile the results of the completed evaluations in preparation for the actual evaluation meeting?

■ Who will be responsible for placing the superintendent’s evaluation on the meeting agenda?

■ Who will run the evaluation meeting?

As a best practice, the school board’s answers to the questions above provide the basis for the evaluation process and procedures. The process and procedures developed are documented and can be used to facilitate subsequent evaluations.

The process most school boards follow is provided below.

■ Approximately a year prior to the evaluation, the school board, in consultation with the superintendent, sets and agrees on the performance expectations and/or goals for the coming year, what tool(s) will be used to gather information from the school board members and superintendent, when updates will be provided to the school board, and when the final, summative evaluation meeting will take place.

■ Approximately a month prior to the evaluation, the school board schedules a closed meeting for purpose of discussing the superintendent’s performance evaluation in compliance with M.S. 13D.05, Subd. 3(a).

■ Approximately one or two weeks prior to the closed evaluation meeting, the school board chairperson distributes the evaluation form to the other school board members for their completion.

■ The board members’ completed evaluation forms are kept confidential and are returned to the school board chairperson who then prepares a single evaluation summary document compiled using each school board member’s ratings and comments.

■ The school board chairperson brings the evaluation summary document to the closed evaluation meeting, and the document forms the basis for the board’s discussion.

■ The school board chairperson ensures that the school board complies with all of the requirements of M.S. 13D.05, Subd. 3(a).

Submitted by Marsh & McLennan AgencyTemporary workers, just like other employees, need safety training. Workers’ compensation insurance often covers temporary workers, so keeping them safe should be a big priority for your district.

Give your temporary workers and volunteers the same safety training you give your regular employees. Don’t ignore the importance of keeping everyone on the school grounds safe, regardless of how long they will be working for you.

Claims statistics show that new employees are the most susceptible to injury. That’s why it is recommended that new employees receive job-specific safety training as soon as they start a

new job and that you check in with them every three months to ensure they understand safety risks involved with the position and don’t have any questions. Consider a formal mentoring program where supervisors or other experienced employees look out for the new employees and check in with them regularly.

Volunteers may qualify for workers’ compensation benefits too. If the person volunteering is established as an employee — for example, he or she is receiving some form or payment

from the district for his or her services — then he or she would qualify for workers’ compensation benefits if injured while volunteering for your district. Someone who is being paid in kind for their services — through free meals or lodging when chaperoning a school trip, for example — could be considered an employee too.
