NOTICE IS HEREBY GIVEN that Commissioner Mark J. Ferron will be holding an All-Party Meeting regarding the Proposed Decision of ALJ Wong on the General Rate Cases of San Diego Gas & Electric Company (SDG&E) and Southern California Gas Company (SoCalGas.) The Proposed Decision addresses the general rate case applications of SDG&E and SoCalGas to establish a revenue requirement and rates for the provision of electric and natural gas service to its customers. The Proposed Decision adopts a combined gas and electric Test Year 2012 revenue requirement of $1,749,376,000 for SDG&E, and a Test Year 2012 revenue requirement of $1,951,712,000 for SoCalGas, as well as a mechanism for the post-test years of 2013 through 2015. The All-Party Meeting will last 2 hours and take place on April 24, 2013 from 1:30 p.m. to 3:30 p.m. in Hearing Room A of the California Public Utilities Commission, 505 Van Ness Avenue, San Francisco, California, 94102. NOTICE OF DRAFT RESOLUTIONS(Pursuant to PU Code § 311(g))

The ALJ Division has prepared Resolution ALJ-287 for the April 18, 2013, Commission Meeting. This resolution adopts intervenor rates for 2013 and addressing related matters.  It also approves a 2% cost-of-living adjustment (COLA), which we will use in calculating intervenor awards of compensation for work performed in calendar year 2013.   The COLA is part of the Commission’s on-going implementation of the statutory directive that computation of intervenor compensation “take into consideration the market rates paid to persons of comparable training and experience who offer similar services.”  Pub. Util. Code § 1806.  The table attached to this resolution shows the approved hourly rate ranges for work performed in 2013.  With rounding, the COLA results in an increase of $5-10/hour for most intervenor representatives. This Resolution resolves the Appeal of Revocation of Escapade Transportation LLC’s Charter-Party Carrier Permit. This Resolution resolves the Appeal from Revocation of Escapade Transportation (Escapade) LLC’s Charter-Party Carrier Permit (PSG 26678) issued on January 17, 2013 by the Commission’s Safety and Enforcement Division (SED) pursuant to its authority under Pub. Util. Code § 5387(c) and Resolution TL-19099. SED permanently revoked Appellant Escapade’s authority to operate under Pub. Util. Code § 5387(c)(1)(E) on the basis that Appellant Escapade had knowingly hired a driver without a required Student Pupil Activity Bus (SPAB) or school bus certificate for an SPAB charter. (Vehicle Code § 546.) Undisputed evidence presented at the Appeal Hearing demonstrated that the charter in question was not conducted under contract with a school. Vehicle Code § 546 is only applicable to charters conducted pursuant to a contract between a charter-party carrier and a school. We find that the charter giving rise to the revocation was not “an SPAB charter” as a matter of law. Consequently, we find no violation of Pub. Util. Code § 5387(c)(1)(E) occurred. Accordingly, we refer the record in this case to the Executive Director for review to determine the need for further Commission action, including but not limited to, formal investigation, revocation or suspension of operating authority or referral to law enforcement with relevant jurisdiction over public safety and consumer protection concerns with DZ Transportation Inc. and related dba’s operating as a charter-party carrier.
