DEFINITIONS

As used in this policy manual, the terms set forth below shallhave the following meanings.

"Board" shall mean the Board of Directors of Trillium CharterSchool.

"Trillium" or "School" shall mean Trillium Charter School

"District" shall mean Portland Public School District

"Member" shall mean a member of the Trillium CharterSchool Board

"School Director" shall mean the program director of Tril-lium Charter School

"Parent" means parent or legal guardian of a student enrolledat Trillium Charter School.

"Student" means a student currently enrolled at or on the cur-rent waiting list of the Trillium Charter School.

"Mentor" shall apply to any person officially serving as a Men-tor to a student of Trillium Charter School.

"Site", "Campus", and "School Building" shall mean the offi-cial Trillium Charter School location of 5420 N interstate, Portland,Oregon unless specifically indicated.

"Community" shall mean the Portland Community exceptwhere specifically indicated.

"School Community" shall mean students, staff, parents,board members, mentors, and other community membersactively involved in meeting the vision and mission of theschool.

SECTION 1

POLICY 1.1 VISION AND MISSION STATEMENT

a. Mission Statement---Trillium Charter School is a public school that nurtureseach child’s inherent curiosity, creativity and connection to community. Wesupport diverse learning styles and use democratic processes to help studentsgrow fully as human beings and contribute to and enhance the world.

b. Vision Statement—Trillium Charter School’s vision is to bridge the gapbetween the school and community with a K-12 program where children andadults, school and community work together to understand and interpret outrelationship with the world around us. We educate the whole child, recognizingthat intellectual, emotional, and social needs must be met for the healthydevelopment of a successful individual.

Students graduate from Trillium Charter School meeting or exceeding statestandards; prepared for adult life, including the possibility of post secondaryeducation; possessing critical thinking skills; and with a desire to be life-longlearners.

POLICY 1.2 SCHOOL LEGAL STATUS

a. Trillium is an Oregon charter school organized pursuant tothe 1999 Oregon Charter Schools Act, Oregon Revised Statute(ORS) 338.005-185 et. seq. Trillium operates pursuant to a

charter granted by the Board of Education of the District onJune 14th, 2002. On May 15th, 2001 Trillium incorporated asa nonprofit corporation under Chapter 65 of the OregonRevised Statutes and Section 501(c)(3) of the InternalRevenue Code, and on (what date) the Internal RevenueService issued a determination letter recognizing Trillium'stax-exempt status under Section 501(c)(3) of the InternalRevenue Code of 1986. Under the Charter School Act of 1999,Trillium is a public school within the District, and its status, asa nonprofit corporation does not affect its status as a publicschool. However, for governance and administrative purposes,Trillium operates as an Oregon nonprofit corporation.

POLICY 1.3 NONDISCRIMINATION

a. Trillium affirms that no person shall, on the basis of race,color, age, national origin, religious belief, gender, sexualorientation, or disability, be excluded from participating in, bedenied the benefit of, or be subjected to discrimination underany educational program or activity.

POLICY 1.4 BACKGROUND CHECKS

a. All adults working with children at Trillium Charter Schoolmay be required to undergo background checks. Thisincludes, but is not limited to, teachers, staff, contractemployees, mentors, and parent classroom volunteers.

SECTION 2

POLICY 2.1 ARTICLES OF INCORPORATION

POLICY 2.3 DECISION MAKING

a. Though it is the board's responsibility to uphold the Trilliumcharter, the charter exists to serve the entire schoolcommunity. All decisions by the Board, the program director,the staff, parents, and students need to be made within theparameters of the vision and the mission statements.Decisions shall be made first considering the vision andmission statements, and then the stakeholders (being theentire school community), always keeping in mind thatstudents and parents should have a meaningful voice in theirown and their child's education.

POLICY 2.4 BOARD SELF-EVALUATION

a. The Board will conduct written annual self-evaluation,including consideration of whether the Board and itscommittees are independently knowledgeable concerningschool matters or is relying too heavily upon the programdirector and other staff for guidance.

b. The following guidelines will apply to the board self-evaluation:

(i) The evaluation shall be a positive, constructiveprocess, aimed at improvement rather thancriticism.

(ii) The evaluation shall be conducted using a formalwritten evaluation tool. Additionally, the board willevaluate its progress on the strategic plan.

(iii) Board members shall evaluate the board as a wholeand not as individuals on the board.

(iv) Board self-evaluation forms shall be distributed atthe April board meeting for use at the annual meeting.The board shall not be limited in its discussion tothose items that appear on the form. Free discussionand informal comments are valuable.

c. Trillium students will create and execute an internalevaluation of the school as a whole. An evaluation of theboard will be a part of this process, which will provide avehicle for students, parents and staff to provide feedback tothe board regarding its work.

POLICY 2.5 PUBLIC ATTENDANCE AT BOARD MEETINGS

a. The board of Trillium serves at the pleasure of, andrepresents, the school community. Therefore, it desires to

provide opportunities for any member of the schoolcommunity to express interest in, and concern for, the school.Accordingly, all members of the school community arewelcome to attend all open meetings of the board. A time forpublic comment shall be a part of every regular boardmeeting.

b. Meetings are closed to the public only when the board is inexecutive session. An executive session may be called todiscuss matters not appropriate for public discussion,including, but not exclusive to, personnel issues regardingtermination, disciplinary actions regarding employees andstudents and confidential student information. An executivesession may be called only upon the affirmative vote of two-thirds of a quorum present.

c. Although the board wishes to encourage everyone to attendits open meetings, it must be remembered that boardmeetings are conducted to carry on the business of the school.Board meetings are not "public meetings," but meetings heldin public, and accordingly public participation must becontrolled to some extent so that the board may deal with itsagenda within a reasonable time.

d. Persons who wish to make requests, presentations, orproposals to the board should direct any inquiry to theprogram director, who will respond according to the followingprocess:

(i) The board will receive in their packet for the nextregularly scheduled meeting, written informationdirectly from the petitioner.

(ii) The petitioner may also present their informationorally to the board when that agenda item isdiscussed.

(iii) If the board will be requested to take a particularaction, the specific action being requested should be

in the written document submitted to the board bythe petitioner.

e. Parents are free to address comments or concerns to anyboard member at any time. However, if there is a specificremedy or other action being requested it is usually best forthe parent to utilize the procedure set forth above.

f. Notice of meetings of the Trillium board shall be posted in theschool office at least ten days prior to the meeting.

POLICY 2.6 BOARD ELECTION PROCEDURE

a. The Trillium School Board will, at any given time, consist of aminimum of three and a maximum of fifteen directors. Thedirectors of the board shall be representative of the schoolcommunity and provide professional expertise from thebroader community. The duration of the terms for theDirectors varies for each type of position (see also TrilliumBylaws Article III, Section 3).

The terms of office for directors shall be seven positions at 2 years and 3 positionsat 3 years with the remaining positions at one-yearcommitments. All directors' terms shall begin in May of eachyear and run for the appointed term limit. The currentmembers of the board shall approve all newly recommendeddirectors at the board retreat meeting in May. There is a twoconsecutive term limit for individual directors with theexception of the Administrative position. After twoconsecutive terms have been completed, individual directorsmay be appointed, selected, recommended or elected (as thepositions' selection process describes) for another twoconsecutive terms only after not filling a directorship positionfor one immediately previous term.

Composition, selection and term limits of the board directors:

(i) Parents: parents from different households ofcurrently enrolled students and at least one year of experience atTrillium charter school selected from among the parent body andrecommended to the board forapproval. Beginning in April of 2003, the parentbody shall select 2-3 representatives to recommendto the board for approval for Directorship at theannual meeting in May. The board shall determinethe quantity of positions available (from 1-3) in thatcategory by April 1st and will convey the number ofvacancies to the parents at that time. Parents fill a 2-yeardirectorship term. These terms are staggeredannually among different parent directors. There isa two consecutive term limitation for any individualparent director.

(ii) Teachers: 2-3 full or part time current staff teachers with at leastone year experience at Trillium charter schoolselected from among the teaching staff andrecommended to the board for approval by theteaching staff. The selection process shall bedetermined and conducted by the teaching staff.

Teachers shall recommend a candidate to the boardfor approval at the annual meeting. Eachyear, one teacher position will become available fora two year, staggered term on the board.

(iii) Students: 2 currently enrolled students with at least one yearexperience at Trillium charter school will be selectedfrom among the current student body by the studentbody and recommended to the board for approval.Recommended students must be in high school. Studentscan take part in all discussions, suggest policy, bringitems to the agenda and participate as a full votingmember on all content that is not of a legal nature.Minor students under the age of 18 years areprohibited from voting on legal issues. Beginning inthe Fall 2002, the student body shall select tworepresentatives to recommend to the board forapproval for directorship. The student body - viaJudiciary Committee and under the guidance ofadults - shall determine and conduct the selectionprocess. The recommendation shall be made theboard before October 15th for approval at theNovember board meeting. Student term fordirectorship is one year.

(iv) Community Professionals: 1-3 members recruitedand approved by the board for an undeterminedterm, up to a five-year maximum.

(v) Neighborhood Association Representative: 1individual recommended by the neighborhoodassociation and approved by the board for anundetermined term, up to a five year maximum.

(vi) Administrator: 1 Current program director, hired bythe board, standing and continuous position.

(vii) Support Staff: 1 currently employed, half time orfull time, selected from among and by the support

staff and recommended to the board for approval.The position's term runs for one year or more inorder to provide continuous and standingrepresentation of staff when there is only onesupport staff position at Trillium.

(viii) Officers: Officers of the board are elected for a one-year term by the current board from among theboard. The terms shall run from May to May andelections will be held at the annual board retreat each year.Officers can server for multiple terms, until their directorship isexpired. They shall server until their successor is chosen.

b. The board is also charged with the duty of creating eitherstanding committees or ad hoc committees to conduct thework of the board as it sees fit. A committee may be composedof as little as two directors.

POLICY 2.7 POLICY MAKING

a. The board shall be solely responsible for adopting, repealing,or amending policies for Trillium. Action by the board shall beaccomplished as set forth in the bylaws.

b. Proposals for adopting, repealing, or amending policies forTrillium may be made in writing by any member of the boardor by any member of the school community.

c. Except in cases of emergencies, the board shall follow thefollowing procedures in adopting, repealing, or amendingpolicies for Trillium.

(i) First Reading. The proposed policy shall besubmitted for approval on first reading at a regularor special meeting of the board called for thatpurpose. The proposed policy shall be contained inthe board packet distributed prior to the meeting. Atfirst reading the board will receive public commentand comments from the sponsor of the proposedpolicy.

(ii) Second Reading. If the proposed policy is approvedon the first reading as set forth in the previous sub-section, it will be placed on the agenda andconsidered at the next ensuing regular or specialmeeting called for that purpose. No amendmentshall be adopted at the second reading unless theamendment receives a two-thirds vote of the entireboard. If two-thirds of the board is not available forthe second reading, the reading shall be postponeduntil the following meeting. If the proposed policy isadopted upon second reading it shall become apolicy of Trillium, and the Policy Manual shall beamended accordingly.

(iii) Emergencies. Upon a two-thirds vote of the directorspresent at a regular or special meeting called forthat purpose, an emergency may be declared. If anemergency is declared, a policy may be adopted onfirst reading.

d. Proposed policies should reference the policy provision it willbe amending. New policies should include the proposed tableof contents policy title and code number.

POLICY 2.8 BOARD MEMBER CONFLICTS OF INTEREST

a. Board members will serve without compensation, but may bereimbursed for any necessary expenses incurred by them inperforming their duties as members of the board uponapproval of the expenditure by two-thirds vote of the board.

b. Any contract with the school involving a member of theboard, or the board member's family, shall be approved by thefull board with the interested member abstaining. Each boardmember is responsible to make known to the board anycircumstances that could involve a potential conflict ofinterest.

c. Salary and other remuneration received from the school byboard members employed as staff by Trillium shall not beconsidered a conflict of interest for the purposes of this policy.

However, members employed by the school shall abstain fromvotes involving the level or such remuneration.

POLICY 2.9 BOARD REVIEW OF ADMINISTRATIVE PROCEDURES

a. Administrative policies and regulations and policies need notbe reviewed by the board in advance of issuance except asrequired by law. However, when there is a potential for strongparental, student, or staff reaction, the policy or regulationshould be approved by the board in advance.

b. Administrative policies and regulations should referenceexisting board policy.

c. The board reserves the right to review administrativeregulations at its discretion. However, the board may revise orveto such regulations only when, in its judgment, suchregulations are inconsistent with the board's policies.

POLICY 2.10 ADVISORY COMMITTEES TO THE BOARD

a. The primary purpose of all advisory committees to the boardis to contribute to the educational program of the school byconducting studies, identifying problems, or developingrecommendations to assist the board in making decisions. Theultimate authority to make those decisions, however, willcontinue to be the board's as required by law.

Advisory committees will be formed by the board at suchtimes and for such purposes as the board may deem necessary.In such cases, the advisory committee will be given a clearcharge and will be dissolved upon completion of that charge.

Membership in advisory committees will be broadlyrepresentative of the school community population, and willbe appointed by the board from among those in the schoolcommunity who show interest or who have special knowledgeor expertise relating to the committee's purpose. Onceappointed, an advisory committee will report directly to the

board as often as is deemed necessary.

POLICY 2.11 STANDING COMMITTEES

a. The board reserves the right to appoint standing committeesat some point in the future if they are deemed necessary.

SECTION 3

POLICY 3.1 ADMINISTRATIVE STRUCTURE

a. The board shall rely on the School director to provideprofessional administrative leadership at Trillium. Theprogram director shall be hired by, and report directly to, theTrillium Board of Directors. The entire school, K-12, shall beviewed as a single school system subject to the policies setforth by the board and implemented through a singleadministrator, the School director.

The board will evaluate the School director's performanceannually. The evaluation will contain a measurement ofperformance to evaluate the effectiveness and oversight of theprogram director. The School director will develop annualperformance objectives by September 1st that will bepresented to the board at the October board meeting. TheSchool director is employed at-will; no right of continuedemployment is created by the provision of a regular orperiodic evaluation of performance.

POLICY 3.2 JOB DESCRIPTION – EDUCATION DIRECTOR

a. Scope of Responsibilities—The Education Director (ED) is the leader of theschool and works to ensure that Trillium Charter School programs and curriculumare implemented according to the intention and spirit of the mission, pertinentCharter School laws, and State and Federal Education standards. The Director isultimately responsible for assisting in the overall design of the school’scurriculum. The Director is responsible for the implementation of the school’scurriculum incorporating all grade levels in a dynamic learning environment. TheED supervises all teachers, staff, and oversees volunteers. The management and

school climate are the responsibility of the ED. The ED is subject to thegoverning authority of Trillium Charter School Board and will adhere to theBoard’s directives and evaluations according to the school’s assessment andevaluation policies. The ED is responsible for the completion and submission ofrequired documents as requested by the Board, DOE, and appropriate agenciesand institutions.

b. Minimum Qualifications

• Extensive professional experience in Administration or Education

• Classroom experience

• Experience with Constructivist Teaching Methodologies

• Demonstrated ability to develop, administer and refine and educationprogram

• Extensive budgetary experience, preferably within Oregon

• Experience working with school districts, preferably Portland PublicSchools

• Excellent communication skills and community relations abilities

• Experience in supervising and evaluating the performance of staff

• Computer and technological literacy

• Ability to facilitate creative group processes and consensus building,conflict resolution, planning , and decision-making

• Demonstrate Leadership skills

c. Desired Qualifications

• Masters degree in Education, Administration or related field, orcomparable practical experience

• Ability to create and maintain a safe, orderly, positive, and effectivelearning environment

• Knowledge of federal and state school compliance laws and guidelines

• Knowledge of the natural and cultural resources of the Portland, OR metroarea

• Demonstrated experience in developing or working within an educationprogram similar to that described in the Trillium Charter School PolicyManual

d. Major Duties and Responsibilities

(i) Administer the school in any and areas necessary for the school’sdevelopment, maintenance, and success.

• Act to organize work in a manner that is ethical, prudent, andfair.

• Supervise, support, and evaluate all staff according to schoolpolicies.

• Maintain a school-wide discipline policy.

- Draft and communicate a school-wide discipline policy.

- Ensure disciplinary proceedings are followed.

- Communicate and carry out disciplinary action.

• Include teachers, staff, students, and volunteers in decision-making processes.

• Assure that the school climate promotes a safe learningenvironment consistent with the school philosophy.

• Ensure policies and procedures are fair an consistent for all.

POLICY 3.3 JOB DESCRIPTION—COMMUNITY DEVELOPMENTCOORDINATOR

a. Scope of Responsibilities—The Community Development Coordinatortakes the lead in ensuring that Trillium Charter School builds andmaintains proactive, supportive relationships with vendors, regulators, andfinancial supporters, as well as with numerous businesses and associationswithin the metro area. The community Development Coordinator alsotakes the lead in drafting and implementing the school’s issues that arise,and makes recommendations on the course of action. The CommunityDevelopment takes the lead in the completion and submission of requireddocuments as requested by the Board, DOE, and appropriate agencies andinstitiutions.

(i) Minimum Qualifications

• Extensive professional experience in Administration orEducation

• Experience with regulatory agencies, businesses andassociation in the Portland, Oregon metropolitan area.

• Experience working with school districts, preferablyPortland Public Schools.

• Excellent, proactive communication skills and publicrelations experience.

• Marketing experience.

POLICY 3.4 ELECTIONS - NOT SCHOOL BASED

a. Trillium will not expend any of its resources in connectionwith supporting or opposing any candidate for political office,

nor shall it expend resources in connection with supporting oropposing an issue in an election.

b. In the interest of broadening public participation in andawareness of the political process, the school may, on anonpartisan basis, invite candidates or sponsors andopponents of issues to appear at school functions and addressthe school community. The board shall decide whether toinvite candidates and sponsors/opponents of issues on a case-by-case basis. Any time candidates and/or sponsors oropponents are invited to speak; the school will ensure thatboth sides are given an equal opportunity to participate.

SECTION 4

POLICY 4.1 STAFF HIRING

a. All permanent half time and full time staff will be hired by theSchool Director. The School Director will make the finalhiring decision based on the consensus-drivenrecommendation of the hiring committee, which hasrepresentation from students, parents, staff, and othermembers of the school community. The School Director isresponsible for the construction of the hiring committee.

b. Contract employees may be hired at the discretion of theSchool Director for less than half time and a period not toexceed one year.

POLICY 4.2 TERMINATION OF EMPLOYMENT

a. All employees of Trillium acknowledge, by signed contract,that he or she is hired on an at-will basis and that there havebeen no promises of continued employment at Trillium fromany of its agents or representatives. Violation of any federal,state or local laws is grounds for termination of employment

b. In cases where a teacher has breached the law, all legal stepsmust be followed before termination. However, mandatoryreporting of the violation must be completed, as required byOregon State Law.

In the event that a staff member is failing to meet theobligations of the job assigned and/or is not practicing withinthe scope of Trillium's vision and mission statements, all stepswill be taken to give the staff member the opportunity toimprove through further education and mediation. If suchsteps are not successful, termination may be recommended.

POLICY 4.4 EQUAL OPPORTUNITY EMPLOYMENT

a. It is the policy of Trillium that all decisions about staffassignments, promotion, demotion, transfer, determination ofsalaries, benefits, and selection for training shall be madewithout regard to race, color, religion, national origin, gender,sexual orientation, or disability.

b. Staff evaluations should not be conducted by a relative orperson with a potential for conflict of interest.

POLICY 4.7 SEXUAL HARASSMENT OF OR BY EMPLOYEES

a. It is the policy of the board to maintain an environment forthe members of the school community that is free from sexualharassment. The board will not tolerate any form of sexualharassment of its employees in accordance with the governingrules stated in the school's stand-alone document entitled"Trillium Charter School Sexual Harassment Policy".Complaints of sexual harassment will be handled withoutdelay in a manner that considers the interests of both thecomplainant and the respondent (see Trillium Charter SchoolSexual Harassment Policy Document for further details).

b. Definition. Sexual harassment means unwelcome sexualadvances, requests for sexual favors and other verbal orphysical conduct of a sexual nature. The Equal EmploymentOpportunity Commission (EEOC) outlines two types of sexualharassment and defines them as follows:

(i) Quid Pro Quo

When submission to such conduct (1) is made aterm or condition of employment or (2) forms abasis for employment decisions affecting thatindividual.

(ii) Hostile Environment

When conduct has purpose or effect of (1)unreasonably interfering with work performance or

(2) creating an intimidating, hostile, or offensiveenvironment.

c. Reporting. Any employee witnessing or suffering sexualharassment should immediately report the matter. Ideally thisreport would be made to the program director however, ifreporting to the program director is not possible, or isuncomfortable, the employee should feel free to report tosomeone where a level of comfort for full disclosure isassured. A board member may accept the report of any sexualmisconduct. The person receiving the report will initiate aninvestigation process. Retaliation is prohibited for reportsmade in good faith. All sexual harassment complaints andpersonnel actions will be kept confidential.

d. Notice. Notice of and training on this policy shall occurannually. In addition, written notices shall be posted in theschool workroom.

e. Investigation. The program director will initiate andinvestigative process according to the guidelines set by theTrillium Charter School Sexual Harassment Policy.

f. Penalties. Following a prompt investigation considering bothparties, the Trillium board of directors will take action that isreasonably calculated to end the harassment. Such action willbe directed toward the harasser, and may include verbalwarnings, written warnings, job transfers, suspension ofemployment, and, if necessary, termination.

POLICY 4.8 STAFF QUALIFICATIONS

a. The board will develop selection criteria for the programdirector. The program director will develop selection criteriafor the staff and administrative support staff. Minimumqualifications for the following positions shall apply to staff.

(i) School director. Qualifications for the position of

School director will be decided upon andcommunicated by the board at such time as itbecomes necessary to begin a search for acandidate. The position requires commitment to thevision and mission of Trillium and knowledge ofOregon charter school law.

(ii) Teachers. Any teacher hired by the school shall haveeither prior experience or training that woulddemonstrate competence appropriate for the gradelevel he or she will be teaching. In accordance withOregon charter school law, at least fifty percent ofTrillium's teachers must hold a valid Oregonteaching license. The position requires acommitment to the vision and mission of TrilliumCharter School.

(iii) Educational Assistants. Any educational assistanthired by the school shall have education, training,or demonstrated ability as the program director orhiring committee deem necessary for him or her toeffectively assist in the school. The position requiresdedication to the vision and mission of the school.

(iv) Other Positions. The School director shalldetermine minimum qualifications, with theassistance of staff and/or the board, for otherpositions including, but not limited to, bookkeepingand clerical positions.

POLICY 4.9 SUPPORT STAFF

a. The School director shall institute and maintain a process

for hiring and evaluating support staff. The program directorshall evaluate support staff annually. This formal evaluationwill include, but not be limited to: job skills, parent, student,and staff input, expertise, and dedication to the vision andmission of the school. This evaluation should not be construedas a right to continued employment.

SECTION 5

POLICY 5.1 STUDENT RIGHTS AND RESPONSIBILITIES

a. Students enrolled at Trillium Charter School have the right to:

• Speak freely, but not offensively

• Participate equally in all Trillium programs• A safe school environment, physically, mentally and emo-

tionally

• Freedom from physical and emotional harassment con-cerning, but not limited to ethnicity, sexual orientation,and religious affiliation.

• View their personal files, unless parents deny access inwriting

b. Students must file a request to view their files with theTrillium school office and it may take up to two weeks toprocess the request.

c. Trillium will follow state and local laws regarding mandatoryprocedures (including suspension and expulsion) for severeoffenses, such as drug possession and distribution, weaponspossession, physical violence and sexual harassment. Trilliumwill investigate any threats or concerns regarding the safety ofstudents, staff, and others at the school.

POLICY 5.2 STUDENT CONDUCT

a. Trillium Charter School follows the guidelines for studentconduct and discipline as set forth in the Portland PublicSchools Handbook on Student Responsibilities, Rights andDiscipline.

POLICY 5.3 STUDENT HEALTH

a. Immunizations. In accordance with Oregon state law, Trilliummust adhere to Oregon Revised Statutes (ORS) 93 433.235,240, 267, 269, 273, 282, 284, which states that "As acondition of attendance in any school or children's facility inthis state, every child through grade 12 shall submit to theadministrator one of the following statements" ORS &433.267(1): A doctor signed statement of immunizations ORS3 433.267(1) (a). a medical exemption ORT g 433.267(1) (b). a religious exemption ORS 9 433.267(1)(c)., or a 30 dayconditional attendance statement allowing the parent tocollect existing immunization records. ORT g 433.267(1) (d).

b. Exceptions. The two exceptions are:

(i) "A statement signed by a physician or arepresentative of the local health department thatthe child should be exempted from receivingspecified immunization because of indicatedmedical diagnosis." ORS g 433.267(1) (a).

(ii) "A statement signed by the parent that the child hasnot been immunized," "because the child is beingreared as an adherent to a religion the teachings ofwhich are opposed to such immunization." ORT g433.267(1) (c).

c. Reporting. The local health department and all schools andchildren's facilities shall report annually to the HealthDivision,' 'on the number of children in the area served andthose children who are susceptible to restrictable disease.'ORS 9 433.269(2).

d. Exclusion. In accordance with ORS 433.273, exclusion ofpersons exposed to or having restrictable disease from schoolmay occur when:

(i) Whenever any administrator has reason to suspectthat any child or employee has or has been exposedto any restrictable disease as prescribed by rules ofthe Health Services pursuant to ORS 433.273required by the rules of the Health Services to beexcluded from a school or children's facility, theadministrator shall send such person home and, ifthe disease is one that must be reported to theHealth Services, report the occurrence to the localhealth department by the most direct meansavailable.

(ii) Any person excluded under subsection (1) of thissection shall not be permitted to be in the school orfacility until the person presents a certificate from aphysician, local health department nurse or schoolnurse stating that the person does not have or is nota carrier of any restrictable disease. [Amended by1973 c.259 s.19; 1979 c.731 s.7; 1981 c.78 s.3;1989 c.224 s.89; 1991 c.255 s.5]

e. Students requiring health care beyond the scope of theTrillium staff will be referred to an appropriate facility oragency and parents will be contacted.

POLICY 5.4 STUDENT SAFETY

a. Trillium shall provide a safe environment for all studentsthrough close supervision during all school-related activitiesand through special attention to the following:

(i) Maintaining safe facilities

(ii) Emphasizing safe practices on the part of the schoolcommunity, particularly in those areas of instruction

or extracurricular activities that offer specifichazards.

(iii) Providing first-aid care for students in case ofaccident or sudden illness.

(iv) Responding promptly and responsibly to emergencysituations.

(v) Maintaining accurate records of student healthproblems and incidents.

POLICY 5.5 STUDENT PRIVACY

a. It is the policy of Trillium to respect and protect the privacy ofstudents and families. Therefore, written parental consentmust be obtained before students participate in any survey,analysis, evaluation, or test (student initiated or otherwise)that reveals information about the student and/or thestudent's family concerning political affiliations, religiousbeliefs, income, mental or psychological condition, sexualbehavior and attitudes, parenting styles, substance abuse, orany other information that could be potentially embarrassingto the student and/or the student's family.

b. School staff will make every reasonable effort to notifyparents prior to permitting any person from outside theschool, including law enforcement officials, to question ordetain a student. Under no circumstances will a student bequestioned or detained without presence of either a parent orschool official; the school having legal custody of the studentduring the school day and during approved school activities.

c. Searches of a student's personal possessions may beconducted if there is sufficient reason to believe that thestudent poses a threat to the health and safety of the schoolcommunity. In the event this action is necessary, the searchwill be conducted under the rules of permissibility granted aschool authority by Oregon State Law.

d. Permission to take pictures of students and to identify thosestudents may be granted to the media (newspapers andtelevision) only with parental approval for all students under18 years of age. Parental permission is also required beforepictures of students may be used in any non-schoolpublication or posted on the Internet.

POLICY 5.6 STUDENT FUNDS

a. Student activity funds must be deposited in specific accountsor investments authorized by law. Funds must be expended inaccordance with Trillium financial procedures for thepurposes authorized by the student organization or group.Student activity funds are subject to annual audit as part ofthe school's annual audit. The board will establish supervisionof all funds raised by any student group or studentorganization using the schools name. The School directorwill establish administrative policies regarding studentactivity funds.

POLICY 5.7 SEXUAL HARASSMENT OF OR BY STUDENTS

a. It is the policy of Trillium Charter School to maintain anenvironment for its students that is free from sexualharassment. The board will not tolerate any form of sexualharassment of students and, to ensure these rights, TrilliumCharter School has created a separate Document entitled"Trillium Charter School Sexual Harassment Policy". Pleaserefer to that stated document for definitions, reporting, andprocedures regarding any sexual harassment. Trillium willmake its Sexual Harassment Policy available to students,parents, and staff.

POLICY 5.8 DISCIPLINE

a. Trillium believes strongly that students and staff perform bestin a safe environment and will work to ensure continuousemotional and physical safety. Speech that causes harm to

others, such as racist, sexist, or homophobic language will beaddressed. Aggression in its many forms, including physical,verbal, non-verbal, and relational will be addressed in avariety of ways. Students and adults will receive training onaggressive behavior including identification of the behavior,ways to address it, and the effects aggressive behavior has onpeople. Through the school's judicial system, students will begiven a legitimate process to deal with aggression and otherproblematic behavior.

POLICY 5.9 Academic Probation

a. Trillium Charter School administration will place a student on academicprobation should s/he fail to earn the credits required to complete the high schooldiploma program. Performance prompting probation includes, but is not limitedto, a student failing to participate in one or maore classes, or a student failing toundertake and complete the required expert project. Trillium Charter Schooladministration will meet with the student, parent or guardian, and appropriatestaff to review and engage the academic probation contract. Should the parent orguardian fail to attend the probation meeting, Trillium Charter Schooladministration will engage the probation contract without parental/custodialpresence, and a copy of the probation contract will be sent to the parent orguardian via registered mail.

POLICY 5.10 STUDENT SEARCHES

a. A student, their property or their locker may be searched by school employeesshould any school employee have probable cause to suspect the student to be inpossession of contraband. The search shall be conducted by at least two schoolemployees and an employee of the same sex will search the student’s person.Contraband is defined as: alcohol, illegal drugs, any explosive device, firearms,pornography, knives (including pocket knoves and steak knives), cutting blades(including razor blades and box cutters that have not been permitted to be used bya Trillium staff member for the purpose of school work), spears, arrows, billyclubs, brass knuckles, nunchucks and any other object that the school staff deemscontraband.

POLICY 5.11 RANDOM STUDENT SEARCHES AFTER INITIAL SEARCH

a. A student who has been searched or has had their property or locker searchedpursuant to probable cause by a school staff employee, and who has been found tobe in possession of contraband after the initial search, shall be subject to randomsearches and or inquiries by school employees for the remainder of the currentschool year, as well as the following school year. A student who has been foundto be in possession of contraband, and who has exhausted all school remedies incontesting the finding of contraband, shall thereafter be subjected to randomsearches. Both initial and subsequent searhes shall be conducted by at least twoschool employees and an employee of the same sex will search the student’sperson.

Contraband is defined as: Contraband is defined as: alcohol, illegal drugs, anyexplosive device, firearms, pornography, knives (including pocket knoves andsteak knives), cutting blades (including razor blades and box cutters that have notbeen permitted to be used by a Trillium staff member for the purpose of schoolwork), spears, arrows, billy clubs, brass knuckles, nunchucks and any other objectthat the school staff deems contraband.

POLICY 5.12 ASSIGNMENT OF NEW STUDENTS TO CLASSES

a. New students enrolling at Trillium will be assigned to a particular class by thestaff with thought given to the balance of the class by the staff with thought givento the balance of the class for gender, age, and needs. It is a goal of TrilliumCharter School to maintain small class sizes to ensure quality of education andcontact between each student and the staff. As such, care will be given to assurethat students are equally dispersed among classes in their age group and that noclass shall exceed the ability of the teacher assigned to that class.

POLICY 5.13 OFF CAMPUS PRIVILIGES

a. No student shall leave Trillium during free time in a student driven vehicle.High School and Middle School students have limited off-campus priviliges of athree block walking distance, which includes Dishman Community Center, theneighborhood grocery on Williams, and the park at Harriet Tubman MiddleSchool. All students must have written permission from their parents orguardians to access off campus priviliges.

POLICY 5.14 STUDENT AUTOMOBILE USE AND PARKING

a. The administration will establish regulations for the use of student automobilesused for transport to and from Trillium. Trillium will assume no responsibility fordamage to cars or for theft of vehicles or articles from vehicles.

POLICY 5.15 GRANTING OF DIPLOMAS

a. An official Portland Public Schools diploma will be awarded Trillium studentswho have completed the academic requirements of Trillium Charter Schoolincluding Portland Public School District and Oregon State requirements. Thispolicy is subject to change as the school seeks accreditation in two years time.

POLICY 5.16 STUDENT TRAVEL

a. Student travel is a valuable part of Trillium’s curriculum and students will

experience a wide variety of travel opportunities from exchange programs toschool travel, international and local. Trillium will make every effort to assurethe safety of students during school sponsored travel, following local, state,national, and international laws. No student shall participate in any school-sponsored travel without written permission from a parent. All health and safetyprecautions must be met and the school will maintain files of the appropriate andnecessary paperwork.

POLICY 5.17 FOREIGN EXCHANGE STUDENTS

a. Trillium gladly accepts foreign exchange students from around the world,seeing it as a tool to strengthen the school’s international curriculum and providea unique experience to foreign students. Foreign exchange students will beexpected to participate actively in the school’s program, including the democraticdecision-making process. Every effort will be made to accommodate a foreignstudent’s needs where Trillium is incapable of meeting that ned. The regulationsof the exchange program through which the student arrived, and the Districtpolicies are in full affect.

POLICY 5.18 ATTENDANCE

a. Trillium students are subject to the attendance policies of Portland PublicSchools. An absence of 10 consecutive days will result in the removal of the studentfrom the school roster. Academic support will be provided upon written request forstudents who must miss school for an extended period.

a. Trillium Charter School will pursue school accreditationthrough the Northwest Association of Schools and Colleges assoon as their procedure allows.

POLICY 6.2 INSTRUCTIONAL GOALS AND OBJECTIVES

a. Trillium will utilize a customized curriculum steeped in realexperiences and community service, and fosters each student'sown interest. Our curriculum is based upon self-determinationtheory that supports the belief that students will be moremotivated and successful when they have choices in theirlearning. Our goals for the educational framework of Trilliuminclude:

• Make more explicit the connections between theory andpractice

• Support the construction of knowledge for both studentsand teachers

• Address the physical and interpersonal environment thatsupports the learning goals

• Inform families how they can be more fully involved aspartners with the school

• Address the ongoing assessment that strengthens learningand teaching

• Small class sizes with multi-age groupings

POLICY 6.3 COLLEGE GUIDANCE COUNSELING AND ADVANCEDPLACEMENT CLASSES

a. College guidance counseling will be offered to studentsenrolled at the high school level. Staff members and mentorswill provide and/or direct students to these services whenappropriate. College counseling and testing services will beprovided as needed.

Trillium Charter School will not provide separate AdvancedPlacement High School classes. The curriculum is tailored toindividual student needs. However, AP credit may be earned

and recorded as such on individual student records.Individual students must demonstrate to the high schoolteaching staff evidence of exemplary work in a particularsubject. It is the final judgment of the staff to determine APcredit, according to state guidelines and subject to testing atthe AP standard level.

POLICY 6.4 EQUAL EDUCATIONAL OPPORTUNITY

a. It is the policy of Trillium to make all educational services thatare currently part of the Trillium educational programavailable to currently enrolled students without regard torace, color, religion, national origin, gender, sexualorientation, or disability. Where Trillium is unable to meet aspecified need of a child in attendance, Portland Public Schoolpolicy concerning Equal Educational Opportunity will apply.

POLICY 6.5 EMERGENCY CLOSINGS

a. Generally, Trillium will follow district emergency closings dueto weather. Trillium maintains the right to call an emergencyclosing when necessary whether the district is closed or not.The program director and the Administrative Assistant areresponsible for contacting the local reporting stations, thedistrict, and beginning a family phone tree as soon as thedecision has been made to assure as many families as possibleare aware of the closing before arrival.

POLICY 6.6 RELIGIOUS AND POLITICAL EXPRESSION

a. Trillium recognizes and celebrates the diverse backgrounds ofthe members of its school community. The board valuesfreedom of expression and open and free discussion in the

school community and encourages all to express theirpolitical, religious, and personal beliefs while rememberingthe school's vision and mission. Freedom of expression comeswith the responsibility of assuring a safe forum for suchdiscussion and the board delegates the responsibility ofdeveloping such a forum to the school community.Federal and State laws prohibit the mixing of Church andState. Trillium affirms the right of religious expression withinthe bounds of these laws.

POLICY 6.7 OFF-CAMPUS LEARNING EXPERIENCES

a. Trillium not only encourages off-campus learning experiencesbut also believes that they are an invaluable tool for meetingthe vision and mission of the school.

b. No student under 18 shall participate without parentalpermission.

c. Arrangements and schedules should be shared with theprogram director in advance.

d. No student shall be transported in unauthorized vehicles.

e. An "authorized vehicle" is a vehicle the program director hasapproved for student transportation during a schoolsponsored off-campus learning experience. Demonstration ofvalid insurance, valid licensure, valid vehicle registration mustbe on file at the school and a DMV check may be conducted.

f. All students and drivers must wear seatbelts, or be buckled ina properly installed and approved child safety seat asmandated by law.

g. No student should be placed in a seat with an active air bag inaccordance with Oregon highway Patrol recommendations forsafety.

POLICY 6.8 INTERNET USE

a. The use of the Internet is available to all students and staff,unless a parent or guardian explicitly denies a child'sauthorization to use the technology. Trillium Charter School isnot responsible for content viewed. We do not have a systemfor monitoring use nor have the Internet filters in place.

SECTION 7

POLICY 7.1 ENROLLMENT AND WAITING LIST

a. To be placed on the Trillium enrollment/waiting list, a childmust have reached school age, according to the districtguidelines. Applications are available after January 1st for thefollowing school year and the application and enrollmentprocess is as follows:

(i) A parent may request an application at any timethough the deadline for the lottery is April 15th ofeach year for the following school year's enrollment.

(ii) Priority will be given to siblings of currentlyenrolled students.

(iii) If space is limited, admission of eligible candidateswill be determined by state-required lottery.

(iv) The lottery process will begin in the spring of thepreceding year, to align with district timelines, andpotential applicants will be offered informationsessions and published material. A random number

chart will be used to select numbers for admission toensure fairness without regard to ethnicity, nationalorigin, disability, gender, sexual orientation, incomelevel, proficiency in English, athletic ability, or pastacademic performance.

(v) The board will perform the lottery the last week ofApril and it will become part of the school record.

(vi) Written notification of the lottery results will occurby May 15th and families shall be given ten daysfrom the date of mailing to respond. Failure torespond may result in the student losing theirposition at Trillium.

(vii) Students applying after the deadline will beadmitted on a space-available basis.

(viii) A waiting list will be established for those notselected. Position on the waiting list will bedetermined during the initial lottery process forapplications received before the deadline.Applications received after the deadline will beplaced on the waiting list according to date ofapplication received.

(ix) Those on the waiting list not admitted during thegiven academic year must reapply through thegeneral lottery for the next school year.

(x) If a space becomes available, the next family on thewaiting list will be contacted by mail and will haveten days from the date of mailing to respond. Failureto respond may result in the student losing theirposition on the waiting list at Trillium. It is thefamily's responsibility to inform Trillium of any

changes of address.

(xi) Families wishing to apply must attend at least oneinformation session in order to have theirapplications submitted for processing. Thisrequirement ensures that families understand theenvironment, the philosophy, and the expectationsthey will encounter at Trillium Charter School. Sincethe school cannot select students, it is importantthat families have adequate information beforeselecting the school. Families with specialcircumstances that prevent them from attending aninformation session may be given specialaccommodation.

POLICY 7.2 RESIDENCY FOR ENROLLMENT

a. Out of district families wishing to enroll a student at Trilliummay do so only after all in- district students have been placedin accordance with Oregon Charter School Law. No more than20% of the school's total student population may reside out ofdistrict. No student from out of state may be admitted toTrillium in accordance with State Law. All out of districtfamilies are responsible for their student's transportation.

POLICY 8.1 FINANCES AND ACCOUNTING

a. Fiscal Accounting and Reporting. The School director shallbe responsible for the proper accounting of all funds receivedand all expenses incurred in the operation of Trillium. TheSchool director shall exercise the highest ethical standardsand shall conform to generally accepted principles foraccounting. Such accounting shall be done in a manner easilyreviewed by the board and which lends itself to auditing.Financial statements shall be prepared for presentation andreporting upon request of the board and at least biannually.Financial statements will be made available to board membersin the board packets prior to the scheduled meeting wherereporting will occur.

b. Preparation and Adoption of Annual Operating Budget. Theannual budget is the financial plan for the operation ofTrillium. The annual operating budget will be based on afiscal year that runs from July 1 to June 30. It provides theframework for both expenditures and revenues for the fiscalyear and translates into financial terms the educationalprograms and the goals of the school. The operating budgetshould ultimately support the vision and mission of Trillium.The board assigns to the program director the overallresponsibility for the preparation and administration of thebudget. The annual budget shall contain the followingsections and corresponding detail: Revenues, OperatingExpenses broken down by staff salaries, employee benefits,purchased services, supplies and materials, capital outlays,and facility costs, and Revenues over Expenses, and Transfersto Capital Reserves. The annual budget for the upcomingfiscal year shall be submitted for review by the board duringthe April board meeting with approval to be granted by theJune meeting.

c. Financial Accounting Audits. In accordance with state law, allfinds and accounts of Trillium shall be audited annually at theclose of each fiscal year. The board shall appoint anindependent auditor licensed to practice in Oregon andknowledgeable in government/non-profit accounting toconduct the audit. The independent auditor shall submit areport to the board that includes the audited financialstatements and an opinion regarding those financialstatements. The auditor will also include in the report anyinformation and documentation required by the district and adistrict report shall be made by July 31st.

POLICY 8.2 FUNDRAISING

a. The Parent Volunteer Organization (PVO) will develop its ownexpectations for fundraising using the school's mission andvision as a guide. Fundraising for large projects including, butnot limited to, capitol improvements, community outreach,facilities, and technical equipment should be sent to theSchool director for approval to assure the most effective useof fundraising money and alignment with vision and missionstatements. Fundraising for school community events,classrooms, and field trips may be undertaken at thediscretion of the PVO.

POLICY 8.3 SUSTAINING FUND

a. The Non-profit Corporation of Trillium Charter School shallestablish The Trillium Charter School Sustaining Fund for thereceipt and distribution of charitable contributions, grants,and monies received through fundraising.

b. The purpose of the Sustaining Fund is to provide a source offunds for additional program needs and unanticipated andextraordinary expenses. These may include, but are notlimited to, capital expenditures that cannot be paid for by thePublic Funds or where Public Funds are either unavailable orinadequate for fulfilling the purposes of the Corporation setforth in Article 1, Section 1 of the bylaws. This fund shall bethe repository of all gifts of money, assists, and property,which shall be accounted for and kept separate from Public

Funds. There shall be no commingling of the balances of thisFund and Public Funds.

c. All earnings from the principle balance of the Fund shall beaccumulated and added to the Fund. Upon affirmative vote oftwo-thirds of the then directors of the Corporation, earningsand principal may be used for the purpose set forth above.

SECTION 9

POLICY 9.1 PROPERTY AND BUILDING FACILITIES USE

a. It is the board's policy to make the school-owned property,buildings, and facilities available to associated school groupsand the community when not in use for school activities.While it is Trillium policy to lend the building only to thosegroups and activities that do not violate the vision andmission of the school, permission for the use of schoolproperty does not constitute a board or school endorsement ofany organization or the beliefs of an organization or group.The board reserves and delegates to the administration, theright to refuse approval or to cancel any and all activities forthe use of school property when it is deemed necessary in thebest interests of the school.

POLICY 9.2 SUB-LEASE AGREEMENTS

a. School property may be sub-leased so long as the usage of thebuilding by the sub-lessor does not interfere with theeducational activities of the school community. The programdirector and board chairperson may make the joint decision togrant a sub-lease, keeping in mind the vision and mission ofTrillium, to organizations or groups desiring a lease of lessthan one year. Terms of lease longer than one year shall bebrought to the board for approval.

SECTION 10

POLICY 10.1 CONFIDENTIAL SURVEYS

a. The opinions and suggestions of the Trillium schoolcommunity are highly valued. In order to garner thatinformation in an orderly manner, confidential surveys will bedistributed to the members of the school community by theadministration or their appointed representative in April ofeach year. The majority of the questions contained in thesurvey will remain consistent for the purpose of longitudinaltracking.Results of the confidential surveys will be provided to theboard in a standard format by June of each year and will beavailable for public review after the June board meeting.

POLICY 10.2 NON-ENROLLMENT SURVEYS

a. In an effort to continue to provide the best educationalexperience to its students and parents, the Trilliumadministration, or their appointed representative, willconduct surveys of all Trillium parents and students choosingnot to re-enroll at Trillium. The survey will be sent within 30days of notice of the decision not to re-enroll seekinginformation about the decision. The survey may be respondedto anonymously. The results of the survey shall be provided tothe board. The purpose of the surveys is for quality assuranceand improvement.

SECTION 11

POLICY 11.1 COMMUNITY RELATIONS

a. It is Trillium's desire to be seen not just as a resident of thelocal community, but a vital part of it. We hope to cultivatestrong relations with our neighbors and practice good-neighbor attributes. The school will work closely with theElliot Neighborhood Association on issues such as mitigationof problems that arise, community service to theneighborhood, student representation in the neighborhoodassociation, and planning and livability issues. Anycommunity feedback should be directed to the programdirector. Media requests for interviews or stories should bedirected to the School director.

POLICY 11.2 SERVICE LEARNING

a. Service learning is a core component of our curriculum and isexpected of every student. Students will be off campus whenengaged in the majority of service learning projects. In someinstances, staff or other adults will not be supervisingstudents. If a particular service learning project is notacceptable to a parent or guardian, then it will be the parentor guardian's responsibility to find an alternative servicelearning project for their student.

Transportation to and from such experiential learningsituations will include a combination of private vehicles, citybuses, MAX lines or walking.

POLICY 11.3 MENTORS

a. In order to provide the maximum amount of support andacademic assistance to students, Trillium will utilize volunteermentors who will meet regularly with students to planschedules, solve problems, provide one-on-one academicguidance, and hopefully develop a strong connection with thestudent to provide emotional support. Mentors, as withanyone working closely with children, may be required tosubmit to a background check before assuming a mentoringrelationship. Mentors will also complete a training programprovided by Trillium and undergo periodic performancereviews.

Students and/or parents may decline or cease participation inthe mentoring program, so long as these parties havediscussed their decision with the School Director.

POLICY 11.4 PARENT INVOLVEMENT

a. Parents and caregivers are encouraged to become activemembers of the school community in the classroom and smallgroup activities, on the board, and as volunteers. Trillium willconduct on-going orientations and training for volunteersworking in the classroom and provide outside support andenrichment activities. Anyone working with children may be

SECTION 12

POLICY 12.1 ATHLETICS AND EXTRA-CURRICULAR ACTIVITIES

a. Students wishing to participate in organized athletics or extra-curricular activities not available at Trillium are eligible, inaccordance with Oregon State Charter Law to participate inthese activities at any district school offering the desiredactivity.

POLICY 12.2 SCHOOL BUS TRANSPORTATION

a. Trillium students may access existing Portland Public School(PPS) bus routes for transportation to and from TrilliumCharter School. PPS "Hitching" forms will be made availableto parents upon request and need to be processed by thedistrict.

POLICY 12.3 SPECIAL SERVICES AND INDIVIDUAL EDUCATIONPLANS (IEP'S)

a. The Portland Public School District's special educationservices are available to all identified eligible Trilliumstudents. Trillium will use Childfind to help identify students

needing such services. The location and type of servicesneeded by an individual student will be determined accordingto the individual's IEP team and state law.

POLICY 12.4 FREE AND REDUCED LUNCH

a. Those students who are deemed eligible for the PortlandPublic School District's free and reduced lunch program mayreceive lunches provided by the district. Lunch will beprovided on campus via other PPS cafeteria. District formswill be made. available to all students and must be completedand returned to the Trillium Charter School office.
