Completed November 18, 2015 Convened at 5:30 P.M. Call to Order Board President Jason Redd called the meeting to order at 5:30 p.m. Pledge of Allegiance President Redd led the salute to the flag. Graham Fiah Gussin Interim Superintendent of Schools – Lucy Feria - Present Business Administrator/Board Secretary – Jayne Howard - Present In the absence of a quorum, President Redd called for the Performance of Excellence at this time. PERFORMANCE OF EXCELLENCE Dunn Middle School’s Music and Art Departments were highlighted this evening. Under the direction of Art Teachers Mrs. Erin Rodenbaugh and Miss Hughes, students displayed art projects centered on the elements of Visual Arts, entitled Values, Lines, Colors and Shapes. Additionally, the Dunn Middle School Jazz Ensemble was recently the featured performers in October at Rider University for the John F. Kennedy Center for the Visual and Performing Arts Initiative – Spotlight on Any Given Child. This evening, under the baton of Music Teacher Mr. Nathan Cohen, Eighth Grader Jacob McGill performed an alto sax solo in the Ensemble’s performance of Killer Joe by Benny Golson. Jacob has also served as the Guest Conductor with the Philadelphia Pops Symphony Orchestra. Additionally, Seventh Grade trumpeter Alberto Jimenez performed tenor sax to the tune of Mercy Mercy Mercy. Superintendent Feria expressed appreciation for the joy on the parents’ faces as they watch their students perform. A quorum was achieved at 5:42 p.m.

New Jersey Sunshine Law - Read by Board President Redd
The New Jersey Public Meetings Law was enacted to ensure the right to the public to have advanced notice of and to attend the meetings of public bodies at which any business affecting their interest is discussed or acted on. On the rules of this act, the Trenton Board of Education has caused notice of this meeting by publicizing the date, time and place, therefore posted in the Central Services Building, 108 North Clinton Avenue, City Clerk’s Office, City Hall and the Times. Anyone whose name is on the mailing list should receive a notice. Formal action will take place at this meeting.
Adoption Of Agenda President Redd advised of the following changes to tonight’s agenda:
• PULL the presentation on Green Schools Initiative • PULL Finance Item P • PULL HR Item S – Head Coach and Assistant Coach Job Descriptions • Add Finance Addendum – including travel for coaches clinic
Motion was made by Mr. Gomez and seconded by Ms. Vandenberg to adopt the agenda with the above changes. Agenda was adopted by all Board Members present.

PUBLIC PARTICIPATION At this time, Board Counsel Perry Lattiboudere read the following statement:
While public education can be an emotional issue, the Board will strive to maintain a certain level of decorum at the meeting. Students often attend or participate in the meetings; as such, citizens are expected to maintain a tone of courtesy and civility. The Board President is responsible for the orderly conduct of all Board Meetings and is charged with enforcing the Board Policies related to the conduct of meetings. Board Policy recognizes the value of public comment, and this meeting permits the fair and orderly expression of such comment. District Policy 0167 states that the presiding officer may interrupt or terminate any participant’s statement when the

statement is too lengthy, abusive, obscene or irrelevant; may request any individual leave the meeting when that person does not observe reasonable decorum; request the assistance of law enforcement officers in the removal of a disorderly person when that person’s conduct interferes with the orderly progress of the meeting; call for a recess or adjournment to another time when the lack of public decorum so interferes with the orderly conduct of the meeting as to warrant such action. The Board will use the public comment period as an opportunity to listen to concerns, but not to debate issues or enter into a question and answer session or cross examination between the public and any individual member. Be aware that not all issues brought before the Board tonight will be resolved this evening. The Board may respond to public comment by seeking additional information or by delegating the authority to investigate the issue to the Superintendent or his/her designee(s).
President Redd advised that the Attorney’s statement was added to the Board agenda to be read before each public session. He spoke of its relevance, particularly after an incident at the last SDA Committee meeting, which is being investigated by the Board, where a member of the public spoke to a member of our Trenton family in an inappropriate manner. President Redd stated that if that were to occur, the individual’s right to speak could be curtailed in the interest of civility and courtesy to District staff and partners. Ms. Rose Dawkins spoke about outsourcing services, stating that it is not working in the schools. She particularly expressed concern with security, food services and 1:1 aides. She also felt that Principals should be selected from the current staff when replacements are hired, stating that these individuals have earned the right to be promoted. Mr. Tom Pollizzi, Science Teacher at the Ninth Grade Academy, suggested that outsourcing home instruction is counterproductive to efforts the Board has made to improve instruction in our schools. He stated that the District is ahead of many others in STEM and the Science programs due to the partnership between TEA and the NJEA for the Progressive Science Initiative, which has trained and certified Teachers to teach high level Science classes. He asked the Board to reconsider this outsourcing and stated it would not save the District money. Ms. Crystal Smith, Guidance Counselor at the Ninth Grade Academy, said that progress has been made but there is still room for improvement, and cuts to direct student services should not be the solution to funding issues. Mr. Billie Hayes felt that the October 28 SDA Committee meeting should have been cancelled because no Board Members were in attendance. He discussed differences between the conduct of Regular Board Meetings and Board Committee Meetings. He felt that environmental issues exist at 400 Chambers Street, but they are not being addressed by the District. Ms. Naomi Johnson-Lafleur, President of the Trenton Education Association, said the TEA should not have to review the agenda at the eleventh hour for items seeking to outsource

the work of its members. She felt that this is a disrespectful lack of transparency from some members of the Leadership Team. She expressed appreciation that Finance Item P has been pulled, and she stated that TEA is in strong opposition to the Board awarding home instruction services as written in the original Request for Proposals to Inspire Educational Group, Inc. Ms. Johnson-Lafleur said that failure to negotiate terms for outsourcing home instruction is a violation of the bargaining agreement between TEA and the Board. Ms. Janice Williams, Grievance Chair for TEA, discussed the history of home instruction in the District. She also spoke as a taxpayer, stating that she has received complaints from members of the public who feel the Board is unresponsive to their concerns. Ms. Williams stated that some topics discussed in Executive Session should be matters for public discussion. She also felt that the Board Attorney should not hold a position on the Leadership Team. SUPERINTENDENT’S REMARKS Superintendent Feria acknowledged Ms. Hope Grant, Principal at TCHS Main, along with all staff, for providing a safe and caring learning environment for all students. She commended them for their support of Jae Irizarry and her mother, and she asked all staff to continue the great work on behalf of all students. Ms. Feria advised that Mr. DeJesus and Mr. Ortiz will be available at all Board Meetings to address concerns. She encouraged parents to continue contacting the offices, stating that the District is committed to serving them. She added that on December 1, there will be a trial link on the webpage for stakeholders to sign up for public participation. The District is testing a new online system for this purpose. Ms. Feria reported that on November 11, through a collaborative project including TEA, TBTA, PTO, the FACE Department, Social Studies and Music Departments, Trenton NAACP sponsored a Veterans Recognition Luncheon hosted at Kilmer Middle School. Fifty eight veterans were honored at this event, with our students performing and providing a well-deserved tribute. On November 12, an Abbott Leadership Summit was hosted at the Board. Over 30 parents and over 30 students and community members participated in this event, sponsored by NJEA, TEA and Rutgers University. Ms. Feria said she had the opportunity to participate, and she appreciates the partnership on behalf of the parents and students. She thanked Ms. Johnson-Lafleur for her leadership in bringing the project to Trenton. The Superintendent said the Bilingual Department showcased the talents of our students and teachers at two recent evening activities, themed Proud to be Bilingual. She thanked Ms. Sandra Iturbides for organizing the event, and Principals Mark Hoppe and Talaya Wilson for hosting.

Ms. Feria said that a reception was hosted today to recognize and thank the many parents and community volunteers who are supporting our mission of educating Trenton students. She said the District celebrates this week the National Parent and Community Volunteer Day, and approximately 60 people received a certificate of recognition and gratitude. She thanked Ms. Everene Downing for her leadership in organizing this project. Ms. Feria thanked all the parents, community and staff for attending four different community meetings last week. She said their ideas, contributions and commitment on behalf of the students is welcome and appreciated. Lastly, the Superintendent reported that the student average daily attendance is at 93%, an increase of 3% from last year. At this time, Ms. Feria introduced Mr. Doug Peters from Voya Financial. Mr. Peters presented the Voya Unsung Heroes Award to Ms. Jordana Scheer, Art Teacher at P.J. Hill Elementary School. Ms. Feria congratulated Ms. Scheer and all the teachers she represents, stating they are all unsung heroes. Mr. Peters spoke briefly about Voya and the Unsung Heroes Award. BOARD MEMBER COMMENTS Mr. Truehart congratulated Ms. Scheer on her award. He also addressed the Board’s commitment to the community of students, teachers, parents, etc. He said he does not take his appointment lightly, and the Board is committed to the education of the students. He added that the Board entrusts the resolution of individual problems to the Superintendent and her staff, and that silence is not indicative of their hearts and their care for the community. He also attested to the transparency of the Board regarding matters of discussion for the public. Mr. Truehart expressed his disappointment at the resignation of Kilmer School Principal Ms. Paula Bethea. He also recognized and congratulated Robeson School Vice Principal Mr. Alex Bethea, who is retiring after 40 years of service. Lastly, Mr. Truehart recognized the many community partners of the District, specifically Minding Our Business, Mercer Street Friends, Campfire New Jersey, Inc., Trenton African American Fire Fighters Association, UIH Family Partners, Union Baptist Church and Shiloh Baptist Church, among many others. He said there are churches, non-profits and other partners who are involved with our students, and this shows collaboration and communication. President Redd echoed Mr. Truehart’s comments regarding the Board’s service to the residents of Trenton. He said that although there will be disagreements, the contention that the Board doesn’t care about the students or about advancing the District forward is not true. He added that the members who serve on the Board have made a conscious effort to move forward because they believe they have something valuable to offer. He invited anyone who feels he or she has something to offer or that the Board is not doing its job, to contact the Mayor’s office with their resume and ask to fill the vacant seat on the Board. He also felt that the concerns raised tonight were not student-centered but rather focused on the adults’ issues.

The study will facilitate both the planning and the evaluation of education and health programs statewide. The Rutgers University Bloustein Center for Survey Research will conduct the study on behalf of the New Jersey Department of Human Services. a. Appropriation Transfers – September 2015 WHEREAS, N.J.S.A. 18A requires that the Board of Education approve appropriation transfers; and; WHEREAS, the Superintendent has authorized the budget adjusted to reflect the appropriation transfers; NOW, THEREFORE BE IT RESOLVED, that the Trenton Board of Education, does ratify the transfers approved by the Superintendent of Schools. (Attachment 3-A)
b. A-148 Secretary’s Report – September 2015 WHEREAS, pursuant to N.J.S.A. 18A-17-9, the Secretary of the Board of Education shall report to the Board at each regular meeting but no more than once each month, the amount of total appropriations and the cash receipts of each account, and the amount for which warrants have been drawn against

each account and the amount of orders and contractual obligations been drawn against each account and the amount of orders and contractual obligations incurred and chargeable against each account since the date of the last report; and WHEREAS, the Commissioner has prescribed that such reporting take place on Form A-148; WHEREAS, in compliance with N.J.A.C. 6A:23-2.11©3, the secretary has certified that, as of the date of the report(s) no budgetary line item account has obligations and payments (contractual orders) which in total exceed the amount appropriated by the district board of education; NOW, THEREFORE BE IT RESOLVED, that the Trenton Board of Education accepts the above referenced reports and certifications and orders that they be attached to and made part of the record of this meeting; BE IT FURTHER RESOLVED, in compliance with N.J.A.C 6A:23-2.11©4, the Board of Education certifies that, after review of the secretary’s monthly financial reports for September 2015, and upon consultation with the appropriate district officials, to the best of its knowledge, no major account or fund has been over expended in violation of N.J.A.C. 6A:23-2.11(b), and that sufficient funds are available to meet the district’s financial obligations for the remainder of the fiscal year. (Attachment 3-B)
c. A-149 Treasurer’s Report – September 2015 WHEREAS, pursuant to N.J.S.A. 18A-17-31 et seq. boards of education are required to have the appointed position of Treasurer of School Monies; and WHEREAS, the Treasurer shall serve in trust to receive and hold all school monies belonging to the district; and WHEREAS, the Treasurer shall report to the Board of Education on a monthly basis on the Form A-149, which is prescribed by the Commissioner of Education; NOW, THEREFORE BE IT RESOLVED, that the Trenton Board of Education, for the period ending September 30, 2015, upon the recommendation of the Superintendent of Schools, adopt the A-149 and cause it to become a part of the official minutes of this meeting. (Attachment 3-C)
d. Staff Travel BE IT RESOLVED: that the Board of Education, upon the recommendation of the Superintendent of Schools, ratified staff attendance/participation in the following professional conferences, workshops, seminars or trainings with the requirements, that staff turn-key as required by administration those issues addressed at the approved professional development events which have relevance to improving instruction and/or operation of the school district.

EXECUTIVE SESSION RESOLUTION NOVEMBER 16, 2015
WHEREAS, The Open Public Meetings Act, codified as N.J.S.A. § 10:4-6, et seq., permits the exclusion of the public from a meeting under certain circumstances; and, WHEREAS, the Trenton Board of Education is of the opinion that such circumstances presently exist, indicated as follows:
Any pending or anticipated litigation or contract negotiations to which the Board is or may become a party, and any matter falling within the Attorney-Client Privilege, to the extent that confidentiality is required to preserve the Attorney-Client relationship and allow the Attorney to exercise his/her ethical duties as a lawyer; MATTER/CAPTION: Revised Settlement Agreement in the matter of C.D. & J.D. o/b/o D.D.; Settlement Agreement in the matter of John Harris
NOW THEREFORE, BE IT RESOLVED, by the Trenton Board of Education, County of Mercer, State of New Jersey, that an Executive Session will be held on November 16, 2015 for the statutorily permissible purposes indicated in this resolution. BE IT FURTHER RESOLVED that action may be taken by the Board when it reconvenes in Open Session. BE IT FINALLY RESOLVED that the minutes of the Executive Session with regard to the above subject matter shall be disclosed to the public at a later date and to the extent that the same is not prejudicial to the interests of the parties involved, no longer adverse to the public interest, or does not endanger any individual’s right to privacy.
