AGREEMENT Section1

1.1 ThisAgreement ismadeandentered intothis14thdayofMarch,2011byandbetweentheBoardofEducationoftheTraverseCityAreaPublicSchool District, hereinafter called the “Board”, and the Traverse CityTransportationAssociation/MEA/NEA,hereinaftercalledthe“Association”.

1.2 Exercise of the powers of the Board is limited only by the expressagreements contained in this contract. Policiesorpractices in conflictwiththisAgreementaresupersededbythiscontract.

RECOGNITION Section2

2.1 The Employer recognizes the Association as the sole and exclusivebargainingagent for thepurposeofestablishingwages,workinghours,safety, and other conditions of employment for all regularly assignedbus drivers employed by the Traverse City Area Public Schools, butexcluding temporary, retired (except those retired employees who arere-hired) employees in permanent positions and substitute employees,maintenanceandcustodialpersonnel,busmechanicsandbusmechanichelpers,secretarialandclericalemployees,directors,assistantdirectors,managers,supervisors,andallotheremployeesemployedbytheTraverseCityAreaPublicSchoolDistrict.

a. A supervisor shall be defined as any person who is chargedwithresponsibilityforselection,evaluation,and/ordirectionofpersonnel.

RESPONSIBILITIESOFMANAGEMENT Section3

3.1 The Employer is vested legally and exclusively with certain powers,duties,andresponsibilities,whichitmaynot,byanymeans,sharewithordelegatetoanyotherbodyororganization.Amongthesepowers,duties,andresponsibilitiesare,butnotlimitedto:

a. Theexecutivemanagementandadministrativecontrolofallaspectsof the transportation systemof the district and the activities of itsemployeesincludingtherighttosubcontractsuchservices.

b. The hiring and firing of employees and the determination of quali-ficationsandconditionsofemployment,includingtrainingprograms,standardsofperformance,assignments,promotions,transfers,dis-chargeanddisciplineofpersonnel,andofthesize,compositionandstructureoftheworkingforce.

c. Theestablishmentofpoliciesandprocedureswhichdetermine theoperation of the transportation program and responsibilities of itspersonnel,andexecutivemanagementandadministrativecontrolofthepropertiesoftheschooldistrict.

3.2 n establishing policies and procedures to carry out the above respon-sibilities,theEmployer,oritsdesignatedrepresentatives,mayconsultwiththeemployeesinvolved.

COMMUNICATIONSCHANNELS Section4

4.1 The Employer and its designated representatives bear the responsibil-ity for formulating policies and programs relating to the TransportationDepartment.TheEmployerwillmakeeveryattempttoinformandconsultwiththeAssociationwhenconsideringpoliciesandprograms,whichmayaffecttheTransportationDepartment.

4.2 RepresentativesoftheEmployerandtheAssociationwillmeetatleastonceeachmonthbymutualagreement for thepurposeofsuchconsultationaswellasreviewingtheinterpretationofthisagreementandcompliancetherewithonthepartofboththeAdministrationandtheAssociation.

4.3 Eachmeetingshallbenomorethantwo(2)hoursinduration.Ifrequested,anagendashallbesubmittedbyeachpartytwenty-four(24)hourspriortothemeeting.

4.4 No more than three (3) Association representatives shall be paid forattendingmeetingscalledforbytheEmployer,andwillbecompensatedattheirregularhourlyrate.

CLASSIFICATIONOFTRANSPORTATIONSTAFF Section5

5.1 REGULARBUSDRIVER

A regular driver is an employeewho has been awarded or assigned aregularscheduledrun.

a. Theregulardrivershallbepaidinaccordancewiththeregularsalaryschedule,andiseligibleforallcontractualbenefits.

5.2 ALTERNATEBUSDRIVER

Analternatebusdriver isonewhorelieves foranabsent regulardriver,ordoesotherdriver-relateddutiesasassignedbytheDirectorofTrans-portationorhis/herdesignated representative,and isavailable forsuchassignmentonadailybasis.

a. The alternate bus driver shall be paid in accordancewith the busdriversalaryscheduleandiseligibleforthesamecontractualbenefitsaccordedtheregulardriver.

b. Anattemptwillbemadetomaintainaratioof1alternatebusdriverforevery8bidruns.Goodfaithefforttosecureadequatealternatebusdriverswillcommencewhentheratiodropsto1alternatebusdriverforevery7bidruns.

1. Alternatepositionscreatedaftertheannualrunselectionwillbetwohoursandwillnotbesubjecttothebidprocess.

c. AlternatebusdriversshallreportinaccordancewithschedulesdrawnupbytheEmployeratbidtimewitheachpositiontobeaminimumoftwohours.AlternatebusdriverswhoarenotassignedarunmaybeassignedtocompleteextraworkasdefinedinSection28.

d. Analternatebusdrivermaybeutilizedtoassistonanyotherbusrunasrequiredatthediscretionoftheemployer.

e. Alternatebusdriversmustbeutilizedonasenioritybasiswhentheirbidstartingandendingtimesarethesame.Whenmorethanonerunassignmentisavailable,aseniordrivermayselecttherunofhis/herchoice.

5.3 DRIVERUTILIZATION

a. To relieve absent regular a.m. and p.m. drivers, after all alternatedrivers,thefollowingprogressionwillbefollowed:

1. One-a-daydriverswillbeutilizedonasenioritybasis.Aone-a-daydriverisaregularbusdriverwithatleastone(1)regularbusrunand/oralternatepositionandisavailableforassignment.

2. Probationarydrivers

3. Retired/occasionaldrivers

b. Torelieveforabsentregularnoondrivers,thefollowingprogressionwillbefollowed:

1. Noonalternates

2. Regulardriversandregularalternatedrivers

3. Probationarydrivers

4. Retired/occasionaldrivers

5.4 BUSTRAINER

Abusdrivertrainerisanemployeewhohasappliedfor,interviewedandbeenselectedbasedonqualifications,experienceandseniority to trainbusdrivers.ThispositionfollowsthenegotiatedwagescaleforbusdriversinSection38.2butwillnotbebidfollowingSection28.3andwillconsistof varying hours which shall not count as accrued time for insurancepurposes.

TRANSPORTATIONSTAFFQUALIFICATIONSANDTRAINING Section6

6.1 All classifications will have job descriptions that include basic jobrequirementsandqualifications.

6.2 Eachdrivershallpassandpay foraphysicalexaminationaccording toFederal,Michigan,andTraverseCityAreaPublicSchoolDistrictstandards.

a. Drivers must provide proof of successfully passing the MichiganDepartmentofEducationphysicalbyAugust1ofeachyearpriortothebidselectionoftheschoolyear.

6.3 Eachdrivershallpasswrittenandphysicalskilltestexaminationsbasedon Federal, Michigan, and Traverse City Area Public School Districtstandards.DriversshallalsoattendMichiganSchoolBusSafetyEducationclassesasrequiredbytheMichiganDepartmentofEducation.

6.4 Allemployeesshallattend,unlessexcusedbytheDirectorofTranspor-tation,aone-daytrainingprogram.

6.5 All employees will be offered an opportunity to participate in other in-servicetrainingprograms.Specialtrainingprogramsmayberequired.

PROBATIONARYPERIOD-DRIVER Section7

7.1 Anemployeewillbeplacedonthepayrollthefirstdayhe/shereportsfortraining.ThefirstpayrollcheckwillbeissuedasscheduledbythePayrollDepartment,providingthedriverhascompletedallthenecessaryforms.

7.2 AppointmentasaregularstaffmemberoftheTransportationDepartmentshallrequireaprobationaryperiodofuptoninety(90)workingdays.

7.3 Aprocedureforperformancereviewofprobationarydriverswillbemutually

developedbytheAssociationandtheDirectorofTransportation.

7.4 The Association will be notified when an employee completes his/herprobationaryperiod.

7.5 Aprobationaryemployeewillaccumulatebutwillnotbeeligible tousecontractual leave benefits until he/she has successfully completed his/her probationary period. A probationary employee will be eligible forcontractualhealthinsuranceorcashinlieuofinsurancebenefitsbeginningthefirstofthemonthfollowingcompletionoftheprobationaryperiod.

7.6 Aftercompletingprobation,employeesareeligibletobidforallpostings.

7.7 Whileonprobation,employeesmaysignpostingsforashowofinterest.

ASSIGNMENTANDTRANSFER Section8

8.1 a. Abusrunwillconsistoftimetoconductactualrunasdeterminedby DirectorofTransportationbasedonacomputerizedroutingsystem.

b. Employeeswillclockin,clockout,andbepaidaccordingtoactualworkhours.

c. Driverswillbeguaranteedaminimumof2hoursforeachrun.d. The duties/responsibilities of a driver are listed below by way of

exampleandnotlimitationandmaybechangedbymutualagreementwiththeAssociation.

1. “PrepTime”duties/responsibilitiesare:a. checkin/reporttimeb.pre-tripc. “seeme”/checkmailboxd. fuelifnecessary

2. “RoadTime”duties/responsibilitiesare:a. leaveondeparturetimeb.followleft/rightsheetsaswrittenc.maintainstudentdisciplined. followproperradioprocedurese. load/unloadinasafemannerf. operatingvehicleincompliancewithfederal,state,andlocal

lawsandregulationsg.maintainaprofessionaldemeanorwithparentsandpublich. cooldownbusintheparkingloti. followpoliciesand/orproceduresasrequiredj. restroombreakforrunswithoutdowntime

3. “PostTime”duties/responsibilitiesare:

a. updateleft/rightsheetswhenchangesareauthorizedb.referrals/incidentreportsc. flasherpassersd.“seeme”meetingse. inclementweatherf. vehiclemaintenanceform/mechanicg.unscheduledmeetingswithprincipalsorotherstaffh. followpoliciesandproceduresasrequired

8.2 Employeesshallbenotifiedofthetentativebusrunselectionday(s)priortotheendofschool,barringunforeseencircumstances.AchangemaybemadebymutualagreementbetweentheEmployerandtheAssociation.SelectionwilltakeplacenolaterthanthefourthFridayofthenewschoolyear.CertifieddriversshallmaketheirselectiononthebasisofseniorityasoutlinedinSubsection11.2.b.(1).EmployeesnotattendingthescheduledselectiondayshallbeassignedbytheEmployerafterconferringwiththeAssociationunlessanotheremployeereportsatthedesignatedbidtimewithauthorizationtobidfortheemployee.

a. Allemployeesshallbenotifiedbymailat least20calendardays inadvanceastotheirbusrunselectiontimeanddayattheirlastaddressonfileintheTransportationOffice.DuetounforeseencircumstancesthistimemaybeadjustedbymutualagreementbetweentheEmployerandtheAssociation.

b. Employees on leave shall be notified at least 20 calendar days inadvanceoftheirbidtime,bycertifiedmail,mailedtotheirlastaddressonfileintheTransportationOffice.DuetounforeseencircumstancesthistimemaybeadjustedbymutualagreementbetweentheEmployerandtheAssociation.

c. Runsshallbemadeknownastothelengthoftheruninhoursandminutes and rounded to the nearest one-quarter hour. SpecificcriterialistedontheBusDriverDailyTimeSchedulewillbedevelopedbymutual agreement between the Employer and the Association.The check-in and check-out times of bid runsmay vary by up to20minutes.Thecriteriawillbeavailable in theStandardOperatingProceduresManual.Runsshallbepostedandleft/rightsheetsmadeavailableforreviewfive(5)workdayspriortothesenioritybiddingofruns.

d. Bidrunsmaybecombinedinblockedtime.Therewillbenolimitonthepercentageofbidrunscombinedinblockedtime.Blockedtimewillbeinaminimumoffive(5)hours.TheDirectorofTransportationmaygetinputfromtheAssociationonthecompositionoftheblockedtime.

8.3 JobSharing/FlexHours

a. Employeesmaysubmitanapplication for jobsharing/flexhours totheDirectorofTransportation.Anemployee’srequestmayonlyaffectonea.m.run,onenoonrun,oronep.m.run.

b. TheDirectorofTransportationwillapprovetherequestprovidingallspecificcriteriahavebeenmet.ThecriteriawillbemutuallydevelopedbytheEmployerandtheAssociation.

c. Priortodenyingtherequest,theDirectorofTransportationwilladvisetheAssociationPresidentorhis/herdesigneeofthereasonfordenial.

d. Anemployeewithanapprovedapplicationforflextimeshallbeusedasanalternateondaysavailable(foranamountnot lessthantheirbidruntime).Thisalternatepositionwilllastuntilexpirationoftheirflex time, atwhich timehe/shewould resumehis/her bid run. Analternatewillbeassignedperthecontracttocovertheoriginalrunforthelengthofthescheduledflextime.

e. Thenumberofemployeesexercisingjobsharing/flexhoursshallnotbeusedincalculatingtheemployeeratioinSubsections5.2.b.

8.4 BusRunSelectionProcedures

a. All runsshallbeselectedonasenioritybasis frombidssubmitted,beginningwiththeemployeewiththegreatestseniority.Employeesnotsuccessfulinsecuringrunsatbid-timeshallbegiventhechoiceto be substitutes or “laid-off” consistent with Section 13 of thisAgreement.

b. Probationary employeesmay be assigned runs by the Director ofTransportation.

c. Newrunsorrunvacanciesthatoccuraftertheannualrunselectiontimewillbepostedandfilledonasenioritybasis.Employeeswillnotbepermittedtooverlapruntimes.

d. Newrunsorrunvacancieswillbepostedwithinfive(5)drivingdaysunlessnoticeofextenuatingcircumstancesisgiventotheAssociation.

e. Open runs shall be posted three driving days prior to filling thevacancy.AcopyofthelistofemployeesbiddingontheopeningshallbesenttotheAssociation.

f. Iftheopenrunisnotbidonafterbeingpostedthree(3)drivingdays,theDirectorofTransportationwillassignaprobationaryemployeetofillthevacancy.However,asubstitutedrivermaybeassigneduntilaprobationaryemployeeisavailable.

g. Ifanemployeefailstoinitialthebidsheetinthepresenceofdispatchby11:00a.m.onthedrivingdayfollowingthedateoftheclosing,theemployeewillnotbeeligibleforthevacancy.Absentemployeesmaydesignateanotherco-workerormanagementpersonneltosigntheirnamestopostingsviaverbalarrangementsorwrittenpermission.

h. Intheeventanemployeelocksinonmorethanonerunthatresultsin conflicting times or total hours, the employee must make theirselectionatthetimenotifiedbydispatch.

8.5 Aftertheseniorityassignmentofruns,ifanemployeeisunabletocontinueoneormoreofhis/herregularscheduledrunshe/sheshallnotbeabletoselectanewruncoveredbyanemployeewithlessseniority.He/ShemaybeassignedbytheDirectorofTransportationarunoralternatepositionifeitherisavailable.He/Shealsoshallnotbeabletoregainhis/herlostrunifasubsequentchangewouldpermitit.He/Shecouldreturn,providingavacancyoccursforwhichhe/sheisqualified.

8.6 AfterconsultationwiththeAssociation,ifconditionswarrant,employeeswillbesubjecttotransferbytheDirectorofTransportation.TheAssociationwillbenotifiedofthetransfer.

8.7 AcopyofalljobopeningswithintheschooldistrictwillbepostedintheTransportationDepartment.

8.8 BusRunChanges

a. ForanybusrunchangeoraccumulationofchangesaftertheAnnualRunselection,whichshalltakeplacenolaterthanthefirstcountdateof the new school year,where the change shall increase/decreasethereporttimeorchangethecheckouttimeoftheoriginalrun,theemployeeshallbecompensatedup/downtothenearestone-tenthofthehourforthetotalchangeintimeandsetatthetimeoftheaddition(subjecttoSection8.10).

b. Bus run time changes will be retroactive to the date of the initialchange.Ifnotdeniedwithinfive(5)workingdaysoftherequest,thechangewillbeapproved(subjecttoSection8.10).

c. TimefromthestarttoendoftheassignedrunshallbepaidtimeandusedatthediscretionoftheDirectorofTransportation.

d. Bus run changes that result in an increase of run time shall bediscussedwiththeemployeepriortoaffectingthechange.Employeeswillbepaidtothetenthofthehour.Iftheemployee’sscheduledoesnotpermitassumptionoftherevisedrun,theemployeemayassumetherunofanyprobationarydriver/aide/assistant.Ifaprobationaryrundoesnotfithis/herschedule,he/sheshallbeeligible fora leaveofabsenceuntilthenextrunselectiondate,withoutlossofseniority.

8.9 Should an original run change that isn’t in blocked time because of asubstitutionofroutesorrestructuringoftheroute,thedrivermayselectanyportionoftherunorhe/shemaybumpanyprobationaryemployee.

8.10 The Employer reserves the right to make run and route changes asnecessary for increased efficiency, and in the best interest of studentstransported. All such changes shall be subject to the compensationdescribedinthissection.

8.11 Employeeswillnotbepermittedtobidanycombinationofrunsthatwouldcausethemtoaccumulatemorethanforty(40)hoursperweekforalljobsinthedistrict.

8.12 Employeesreturningtothebusgaragemorethan15minutesbeforetheend of their road time shall notify the dispatch office unless otherwisenotifiedbytheDirectorofTransportationordesignee.TheemployeemaybeassignedextraworkconsistentwithSection28tofulfilltheirscheduledpaidtime.

8.13 Employeesdroppinganybidrunwillgiveaten(10)workdaynoticetotheDirectorofTransportation.

LEAVEOFABSENCE Section9

9.1 If an employee will not be available for driving for five (5) or moreconsecutivedrivingdaysforreasonsotherthanillness,he/sheshallapplyto theDirectorofTransportation fora leaveofabsenceat leastone (1)week but notmore than forty-five calendar days prior to the expectedleave.

Verbalarrangementsmaybemadeif, inthejudgmentoftheDirectorofTransportation, emergency circumstances do not permit application inwriting.Writtenapplicationsmustbesubmitteduponreturn.

9.2 AtthediscretionoftheDirectorofTransportation,anemployeemaybegranted a leave of absence without pay or fringe benefits, but not toexceedone(1)year.Toqualifyforthisleaveanemployeemusthaveatleasttwo(2)yearsseniority.

9.3 Iftheemployee’sleaveofabsenceextendsbeyondfifteen(15)consecutivedrivingdays,his/herrunmaybedeclaredvacantandopenforbid.Iftherunisreassignedduringanauthorizedleave,theemployeeonleavewillbeeligible to return toemploymentasanalternatedriver/aide/assistantandmustbeavailableonadailybasisforanyvacancyforwhichhe/shequalifies.

9.4 Ifanemployee’sleaveofabsencegrantedbytheEmployerextendsforaperiodoftwenty(20)cumulativedrivingdaysormore,thelossoftimeshallbesubtractedfromhis/hersenioritydate.

9.5 Effort will bemade to grant up to six (6) leaves of absence to regularemployeesduringthelasttwenty(20)workdaysoftheschoolyearforthepurposeofobtainingothersummeremployment. Grantingsuch leaveswillbesubjecttotheavailabilityofqualifieddrivers.

9.6 A leave of absence request for deer hunting shall be forwarded to theDirectorofTransportationatleastseven(7),butnotmorethanfifteen(15),workdayspriortoNovember15. Deerhuntingleavesofabsenceshallbesubjecttotheavailabilityofqualifieddrivers,andwillbegrantedonasenioritybasis.Morning(a.m.),noon,andafternoon(p.m.)runsthatmustbefilledduetodeerhuntingleavesshallbefilledbygivingpreferencetosenioritydriverswhofollowestablishedproceduresinmakingthemselvesavailableforthoseruns.

LOSSOFTIMEAFFECTINGSENIORITYRATINGANDANNIVERSARYPAYDAY Section10

10.1 Shouldanemployeepresentaphysician’scertificateof illnessor injury,whichwouldpreventhim/herfromdriving/aiding,thefollowingshallapply:

a. Theemployeeshallretainhis/herseniorityrankandrunassignmentuntilbusrunselectiontimethefollowingschoolyear.

b. Intheeventoftheabove,theDirectorofTransportationshallassignanalternatedriver/aide/assistant,orprobationarydriver/aide/assistanttofill the runona temporarybasis until bus run selection time. Thevacancyshallnotbesubjecttothebidprocess.

c. Shouldtheabsenceforillnessextendbeyondthebusrunselectiontime,thefollowingschoolyear,theemployee,whencertifiedavailableforwork,willbeappointedtothefirstavailablevacancyforwhichhe/shequalifies.

10.2 Ifanewemployeeoranemployeeingoodstandingquitsandissubse-quentlyrehiredwithinaperiodofthree(3)years,he/sheshallstartatthesalarystephe/shepreviouslyheldorshallbegrantedcreditforeachyearofadditionalpublicschoolsbusdrivingand/oraideexperienceobtainedwhileemployedatanotherdistrict.

SENIORITY Section11

11.1 Newemployeesshallbeenteredonthesenioritylistoftheunitandshallrankforseniorityfromthedateofhire.Thedateofhirewillbethefirstdayinwhichemployeesreportfortraining.Whenmorethanonepersonreports for training on the same date, then all individuals so effectedwillparticipate inadrawing todeterminepositionson theseniority list.Seniorityshallbeonajobclassificationbasis.

11.2 SeniorityLists

a. The seniority listwill show the names, job titles, dates of hire andsenioritydatesofallemployeesintheAssociation.

b. The Employer shall furnish the Association with five (5) currentcompletesenioritylistsatthebeginningoftheschoolyearandattheendofthefirstsemester.AcurrentsenioritylistwillalsobeprovidedtotheAssociationpriortotheannualbusrunselection.

1. Thesenioritylistshallbemergedforthepurposeoftheannualbusrunselection.Employeeswillbidwithinclassificationonthebasisofthemergedsenioritylist.

c. The Employer shall notify, in writing, the Association when anemployeeishired,laid-off,recalled,terminatesemployment,startsanauthorizedleaveorreturnsfromanauthorizedleave.

11.3 If an employee transfers to another position under the Employer, notincludedinthebargainingunit,andthereafter,withinone(1)year,returnstothebargainingunit,he/shewillbeentitledtoretainhis/herseniorityashe/shemayhavehadunderthisagreementpriortosuchtransfer.Duringthistransferperiodtheemployeewillnotaccumulateseniorityinthebargainingunit.

11.4 LossofSeniority

Anemployeeshalllosehis/herseniorityforthefollowingreasons:

a. He/shequits.

b. He/sheisdischarged.

c. He/she is absent for three (3) working days without notifying theEmployer.

d. He/sheisonaleaveofabsenceforillness,injuryordisability(paidorunpaid)inexcessofthree(3)years.

EMPLOYMENTDISCIPLINE/TERMINATION Section12

12.1 Employeesmaybedisciplinedand/ordischargedforjustcauseforanyofthefollowingoffenses,bywayofexampleandnotlimitation:

a. Unsatisfactorywork.

b. Unlawfulconduct.

c. Failuretoperformdutiesproperly.

12.2 For violation of policies, rules, procedures, or failure to perform dutiesproperlycorrectivedisciplinemayincludeanyofthefollowing:

a. WrittenWarning.b. WrittenReprimand.c. Suspension.d. Termination.

First violations resulting in suspension or termination will be made inaccordancewithSubsection12.3.

12.3 Inthecaseofallegedon-the-jobunlawfulconduct,violationofthedrugand alcohol policy or other serious violations, the employee may besuspendedimmediately,withpay,pendingafullinvestigationoftheallega-tion(s)bytheDirectorofTransportationordesignatedrepresentative.Aftertheinvestigation,correctivediscipline,ifimposed,mayincludeanyofthestepsmentionedin12.2uptoandincludingtermination.

12.4 In the event of a chargeable accident involving a school vehicle, thefollowingproceduremaybefollowed:

a. Accidentswillbeinvestigatedascompletelyaspossible.Thedrivermayberequestednottodrive(withpay)duringtheinvestigation.

b. Correctivedisciplinewillbeasoutlinedin12.2.

12.5 Thedismissalofanemployeeshallbeprecededbyawrittennoticewhichshallcontainaspecificstatementorstatementsof thereason(s) for thetermination.

12.6 A terminated employeemaybe given an opportunity to submit his/herwrittenresignation.

12.7 UseofPastRecord

a. Inimposinganysuspensionordisciplinaryactiononacurrentcharge,theEmployerwillnottakeintoaccountanyinfractionswhichoccurred:

1. Morethantwo(2)yearspreviouslyonwrittenwarnings.

2. Morethanthree(3)yearspreviouslyonwrittenreprimands.

3. More than five (5) years previously on infractions greater thanwrittenwarningsandwrittenreprimands.

12.8 InspectionandChallengingRecords

a. Anemployeecanreviewhis/herrecordwithEmployerrepresentativespresent andwith orwithout anAssociation representativepresent,upontherequestoftheemployee.

b. Disputed entries in the record may have a letter of clarificationattachedasprovidedbytheemployee.

LAYOFFANDRECALL Section13

13.1 In the event the Employer determines it necessary to reduce theworkforce,suchreductionshall takeplaceonthebasisof leastseniority. AcopyofanylayoffnoticesenttoanemployeewillconcurrentlybesenttotheAssociation.

13.2 OrderofReduction

a. Subject to theprovisionsofSubsection13.1above, thenumberofpersonnelshallbereducedinthefollowingorder:

1. Probationaryemployees.2. Otheremployeesaccordingtotheirseniority.

13.3 Bumping

a. Seniority employees may only bump within classification in thefollowingorder:

1. Employeeswiththelowestprobationaryperiodfirst.2. Whennoprobationaryemployeeremains,theemployeewiththe

lowestseniority.

b. Nomore than one (1) bumpper employee can bemade during areduction-in-force, unless another reduction takes place, in whichcase,theprocedurebeginningin“a.”above,shallbefollowed.How-ever,onlythoseemployeeswhoaredirectlyinvolvedinthereduction-in-forcemaybumpagain.

13.4 ReductionProcedures

a. TheEmployerwillprovideemployeeswithnoticeten(10)weekdays(MondaythroughFriday)priortoanylayoff.

b. Employees bumped to substitute status due to the run selectionprocessshallnotbeconsideredaslaid-off.

13.5 OrderofRecall

Personnel shall be recalled to work in the inverse order of the abovereduction.

a. TheEmployershallgivewrittennoticeofrecallfromlayoffbymailingaregisteredorcertifiedlettertotheemployeeathis/herlastknownaddressfive(5)weekdayspriortothedateofreturntowork.

b. The employee shall report towork upon thedate specifiedby theEmployer and failure to report on that date shall terminate his/heremployment,unlesspriorapprovalhasbeengivenbytheDirectorofTransportationtoreportatalaterdate.

c. Ifanemployee isunable tocontinuehis/her regularscheduled runbecauseofalayoff,andisforcedtobumpalowerseniorityemployee,thedriver/aidewillmaintainruntimethatisnolessthanthedriver’s/aide’slastregularbidrun.

Thisruntimeshallbemaintaineduntiltheemployeehastheopportunitytobidatannualrunselection. Employeesmaybeassigneddutiesequaltotheregularruntimepaidwhileassignedtoarunwithlesstimethantherunheldpriortolayoff.

13.6 OtherConditions

Any layoffunder thisarticle shall suspend for thedurationof the layofftheEmployerobligationtopaysalaryorfringebenefitsunderthisMasterAgreement,exceptasmaybenotedinthelifeinsuranceandhealthcarebenefitssectionofthiscontract(Section39).

SICKLEAVE Section14

14.1 Eachemployeeshallbegrantedsickleaveasfollows:

1daypermonthtoamaximumof10daysperschoolyear,accumulativetoamaximumof140days.

14.2 Employeesmaybepaidsicktimeinincrementsofonetenthofanhour.

14.3 Employeeswhoworksummerbidrunswithoutanywithoutpaydayswillbe awarded two additional sick days upon completion of the summerprograms.

14.4 Sickleaveallowanceshallbeusedwhenanemployeeisabsentfromdutybecause of illness, injury, or an anticipated prolonged absence includ-ing scheduled surgery, pregnancy/childbirth related disabilities. AnyemployeewhoanticipatesaprolongedillnessshallsupplytheEmployerwithnotificationfromhis/herphysician.

14.5 Ifaprobationaryemployeeisabsentduetoinjuryonthejob,sickleavebenefitsareeffectiveasofthefirstdayofhire.

14.6 Ifanemployeeisabsentduetoillnessformorethanfive(5)consecutivedays,adoctor’slettermayberequiredtoqualifyforadditionalsickdays.

14.7 Anemployeewhobecomes illduring thesummervacationandcannotassumehis/herdutiesatthebeginningoftheschoolyearwillbeeligibleforbenefitsunderhis/heraccumulatedsickleavecommencingthefirstdayofschool,uponpresentationofaphysician’scertificateofillnessorinjury.

14.8 TheEmployershallfurnisheachemployeewithacopyofhis/heraccumu-latedsickleavebyJune30annually.

14.9 SickLeaveReserve

1. Whenanemployee’ssick leavehasbeenexhausted,anemployeemaybegrantedtheequivalentofuptothirty(30)additionalleavedaysasavailableandapprovedfromthesickleavereserve.Thefollowingguidelineswillgovernutilizationofthesickleavereserve.

a. Inordertobeeligibletodrawfromthereserve,thedriver/aide/assistantmustbeeligibleforsickleaveandmusthavecontributedtothesickleavereserve.

b. Eachemployeewillbeinvitedtocontributehoursequivalenttoone(1)ofhis/heraccumulatedsickleavedaystothesickleavereserve.Aconsent formfor thedeductionwillbesent toeachemployee. Additional hours shall be requested of employeesonlywhenthereserveisdepletedtofivehundred(500)hoursorfewer.Ifthereserveisdepletedtofivehundredhoursorfewer,allemployeeswillbeinvitedtocontributeone(1)sickdaytothesickleavereserveandmustdosoinordertoremaineligibleforthesickleavereservebenefit.Anemployeewhohaspreviouslydonatedone(1)ofhis/hersickleavedaysduringtheschoolyearwhentherequest foradditionalhours ismadewillnothavetodonateagaintoremaineligibleforthesickleavereserveduringthatschoolyear.

c. Thesickleavereserveshallbeavailableonlyformajorpersonalillnessesandinjuriesoften(10)ormoreworkdaysandnotonadailybasis.Acertificateofinjuryorillnessformfromalicensed

physicianmustaccompanytherequestforuseofthesickleavereserve.TherequestmustbereceivedintheHumanResourcesoffice(ifpossible)priortotheeffectivedateofdrawingfromthesickleavereserve.

d. Anemployeemaynotdrawinexcessofthirty(30)daysfromthesickleavereserveinanyone(1)schoolyear.

e. An employee who has used the equivalent of thirty (30) sickleavedaysshallnotdrawadditionalhours from thesick leavebankinasubsequentyearunlesstheemployeehascontributedtheequivalentofatleastone(1)additionaldaytothesickleavereserveforthesubsequentschoolyear.

f. Anemployeewillnotaccruesickleavewhileutilizingsickleavereserve.

2. Inordertobeeligibletodrawfromthesickleavereserve,theemployeemustpresentadoctor’scertificateof injuryor illnesstotheHumanResourcesofficewiththerequesttousethesickleavereserve.

3. ThesickleavereserveshallbeadministeredbytheHumanResourcesoffice,subjecttoperiodicreviewbytwo(2)personsdesignatedbytheSuperintendentorhis/herdesigneeandtwo(2)personsdesignatedbytheTCTA.Uponrequest,theAssociationpresidentwillbeprovidedanannualreportontheutilizationofthesickleavereserve.

CHILD-CARELEAVE Section15

15.1 An unpaid leave of absence up to one (1) yearmay be granted to anemployeeforthepurposeofprovidingchildcareforanewbornoradoptedinfantunderthefollowingconditions:

15.2 TheapplicationforsuchleaveshallbereceivedbytheDirectorofTrans-portationnolaterthanfifteen(15)calendardayspriortotheeffectivedateofthecommencementoftheleave.

15.3 Thechild-careleaveshallcommenceonthedatetheemployeehasbeenreleasedfromherdisabilitybytheattendingphysicianandshallterminatenotlaterthanone(1)calendaryearfromthedatetheleavecommences.

15.4 Inthecaseofanadoptedinfant,thechild-careleaveshallcommenceonthedateofadoptionandshall terminatenot later thanone (1)calendaryearfromthedatetheleavecommences.

15.5 Thechild-care leaveshall begrantedwithout salaryorother economicbenefitsexceptasprovidedundertheFamilyMedicalLeaveAct.

15.6 Ifanemployee’sunpaidchild-careleavegrantedbytheEmployerextendsforaperiodoftwenty(20)consecutivedrivingdaysormore,thelossoftimeshallbesubtractedfromhis/hersenioritydate.

ILLNESSINIMMEDIATEFAMILY-ABSENCEFROMDUTY Section16

16.1 Absencewithoutlossofsalaryshallbeallowedforillnessintheimmediatefamilyasfollows:

Six(6)daysperyear,notaccumulative.

16.2 Immediatefamilyisdefinedashusband,wife,spouse,parent,brother,sister,child, child-in-law, parent-in-law, immediate step-parent, grandparents,immediatestep-child,orapersonlivingandmakinghis/herhomeintheemployee’shousehold.

16.3 Suchabsencesshallbededucted from theemployee’ssick leave,anditbecomestheresponsibilityoftheemployeetocompletea“RecordofAbsence”formuponhis/herreturntowork.

FUNERALLEAVE-ABSENCEFROMDUTY Section17

17.1 Anemployeeshallbealloweduptoeight(8)dayswithpayasfuneralleavenotbeingdeductedfromsickleaveforadeathintheimmediatefamily.Immediate family shall be defined as follows: husband, wife spouse,parent,brother,sister,orchild.

17.2 Anemployeeshallbealloweduptofive(5)daysasfuneralleaveforthedeathofaparent-in-law,immediatestep-parent,brother-in-law,sister-in-law,grandparent,grandchild, immediatestep-child,oramemberof theemployee’shousehold.Three(3)daysshallbewithpayandtwodaysaretobedeductedfromtheemployee’ssickleave.

17.3 Theleavegrantedbytheprovisionsofthissectionshallbeusedforthepurposeofattendingthefuneralorformakingnecessaryarrangementsforfamilyaffairsbothpriorandsubsequenttothefuneralifrequired.

17.4 Upon receipt of a request from the employee, accompanied by aphysician’s recommendation, additional days may be granted by theDirectorofTransportation.Theadditionaldaysshallbesubtractedfromtheemployee’ssickleave.

17.5 Itistheresponsibilityoftheemployeetocompletea“RecordofAbsence”formuponhis/herreturntowork.

WORKERS’COMPENSATION Section19

19.1 AllemployeesshallbecoveredbyWorkers’CompensationInsuranceundertheMichiganWorkers’CompensationLaw.AnyemployeewhoisabsentbecauseofaninjuryordiseasecompensableundertheMichiganWorkers’CompensationLaw,shallnothavehis/heraccumulatedsick leavedaysreducedwhilereceivingpaythroughMichiganWorkers’Compensation.

PERSONALDAYLEAVE Section20

20.1 Absencemaybegrantedduringtheschoolyearwithoutlossofsalaryforattendingtoaffairsofapersonalnaturewhichcouldnotbeconductedonaweekendoroutsidetheschoolday.

20.2 Anemployeeplanningtouseapersonalleavedayshallobtainapprovalfrom the Director of Transportation in writing in advance. In cases ofemergency,priorapprovalmustbeobtainedandwrittenapplicationmustbesubmitteduponreturn.

20.3 Onedayshallbeallowedperyear-notaccumulative.Thisdayshallnotbegrantedforvacationorrecreationalactivities,norimmediatelybeforeorafteraholidayorvacationexceptat thediscretionof theDirectorofTransportation.

20.4 At the end of the school year, any unused day will be added to theemployee’saccumulatedsickleave.

JURYDUTY Section21

21.1 Anemployeesummonedtojurydutyorsubpoenaedasawitness,wherefailuretoappearwouldresultinpunishmentunderthelaw,shallbepaidhis/herfullsalary,exceptthat:

a. Shouldsaiddutyconstitutelessthanone-halfday,he/sheshallreportforhis/herassignmentuponterminationofduty.

b. Ifanemployeeissummonedtosaidduty,andserves,he/shewillbepaidhis/hernormalrateofpaylesstheamountreceivedforjurydutyserviceexcludingtheamountfortravelormealexpenses.

c. Anemployeeshallreportforworkifcaseisdismissedorsettledpriortohis/herdrivingshift.

d. Thistimeisnotchargedasapersonalleavedayorsickleaveandwillnotaffectanemployee’sincentivepay.

21.2 Anemployeewhoplanstoparticipateinahearingorjudicialmattermaydosowithpriorsupervisorapprovalandwithoutpayunlesstheemployeechoosestouseapaidpersonalbusinessday.

WORKSHOPS/CONFERENCESANDPARENTMEETINGS Section22

22.1 Workshop:Ameetinginwhichemployeesarerequiredtoattendtrainingprograms.

a. EmployeesshallbepaidattheirestablishedrateofpayforattendingworkshopsscheduledbytheEmployer.

1. For workshops held prior to or immediately after their runassignment,paymentshallbetothenearestone-tenth(1/10)ofthehour.

2. Forworkshopsheldduringruntime,noruntimewillbelost.Anyadditionaltimewillbepaidtothenearestone-tenth(1/10)ofthehour.

3. For workshops scheduledmore than one hour outside of theassignedruntime,theemployeewillreceivethetwo(2)hourcall-outpay.Paymentbeyondthetwo(2)hourcall-outshallbeasstipulatedin“a.(1)”above.

EmployeesshallbereimbursedmileageattheschooldistrictrateifitisrequiredbytheDirectorofTransportationtousepersonalvehiclestoattendemployeeworkshopsscheduledoutsidetheschooldistrict.Only one driver of each authorized vehicle shall receive mileagereimbursement.Mileageisfiguredfromthebusgaragetothemeetingandreturntothebusgarage.

d. Employeesshallbereimbursedformealswhenattendingarequiredout-of-townworkshop,asscheduledbytheDirectorofTransportation.

22.2 Conference:AscheduledmeetingwiththeDirectorofTransportationand/orhisdesignatedrepresentative.IftheDirectorofTransportationorhis/herdesignatedrepresentativerequiresanemployeetoattendascheduledmeeting,saidemployeewillbecompensatedasfollows:

a. Forconferencesheldpriortoorimmediatelyaftertheirrunassignment,paymentshallbetothenearestone-tenth(1/10)ofthehour.

b. Forconferencesheldduringruntime,noruntimewillbelost.Anyadditionaltimewillbepaidtothenearestone-tenth(1/10)ofthehour.

c. For conferences scheduled more than one hour outside of theassignedruntime,theemployeewillreceivethetwo(2)hourcall-outpay.Paymentbeyondthetwo(2)hourcall-outshallbeasstipulatedin“a.”above.

d. A request to see a supervisor, when convenient, does not alwaysconstituteascheduledmeeting.

22.3 ParentMeeting: A scheduledmeetingwith theDirector of Transporta-tion and/or his/her designated representative and/or a parent(s). If anemployeeisrequestedtobepresentforaparentmeeting,he/sheshallbecompensatedasfollows:

a. Formeetingsheldpriortoorimmediatelyafterhis/herrunassignment,paymentshallbetothenearestone-tenth(1/10)ofthehour.

b. For meetings held during run time, no run time will be lost. Anyadditionaltimewillbepaidtothenearestone-tenth(1/10)ofthehour.

c. Formeetingsscheduledmorethanonehouroutsideoftheassignedruntime,theemployeewillreceivethetwo(2)hourcall-outpay.Paymentbeyondthetwo(2)hourcall-outshallbeasstipulatedin“a.”above.

d. Wheneverpossible,theEmployerwillschedulemeetingswithparentsinamannerthatwillnotcreateaproblemfortheemployeetoattend.

23.1 To qualify for retirement pay, the individual retiring must have beenemployedbytheTraverseCityAreaPublicSchoolDistrictforaminimumoften(10)consecutiveyears.Inaddition,theemployeemustbequalifiedfor retirement (includingdisability retirement)under theMichiganPublicSchoolEmployeesRetirementSystem(MPSERS)unlesstheemployeehasbeenemployedforaminimumoften(10)consecutiveyearsbyTraverseCityAreaPublicSchoolsandhasreachedtheageofsixty(60)years.Theemployeemust submit evidence froma state retirementoffice that theprocessingofher/hisapplicationforretirementhasbeencompleted.Theemployeemustbeeligibletobegindrawingwithinthirty(30)daysofthetimeofterminatingemploymentwiththeTraverseCityAreaPublicSchoolDistrict.

IfanemployeeisnoteligibleforretirementordisabilityretirementunderMPSERS,but the employee hasbeen employed for aminimumof ten(10)consecutiveyearsbyTraverseCityAreaPublicSchoolsandqualifiesand is eligible to draw within thirty (30) days of retirement throughanotherMichigan state employees retirement systemwhich allows theindividual to transfer retirementcreditearnedwhileworking for theTra-verseCityAreaPublicSchoolDistrictfromMPSERStotheMichiganstateretirementsystemunderwhichtheemployeeiseligibletodrawbenefits.Theemployeewillberequiredtosubmitevidenceofsucheligibilityandtransferofretirementcredit.

23.2 An employee qualifying for retirement pay under this section of thecontract shall receive as retirement pay an amount equal to one-half(1/2)oftheemployee’sregulardailybasepayatretirementforeachdayof accumulatedsick leave,butnot toexceeda total of $1,750andanadditional$500iftheemployeehashadperfectattendanceasdefinedinSection18.1duringthe12monthspriortotheemployee’sretirementdate.

23.3 Incaseofthedeathoftheemployee,retirementpayinanamountequaltoone-half(1/2)oftheemployee’sregulardailybasepayforeachdayofaccumulatedsickleaveshallbepaidtotheemployee’sbeneficiary,butnottoexceedatotalof$1,750andanadditional$500iftheemployeehashadperfectattendanceasdefinedinSection18.1duringthe12monthspriortotheemployee’sdeath.

SUMMERRUNS Section25

25.1 Summerrunswillbebidandawardedbyseniorityrankwithinclassification.Employeesmaynotbidorbeawardedrunsresultinginmorethan40hoursofworkperweekforalljobsinthedistrict.Notificationoftheavailabilityofsummerrunswillbepostedwhenknown.AcopyofthelistofdriversawardedrunsshallbesenttotheAssociationPresident,priortocloseofschool,ifknown.

CHAUFFEUR’SLICENSE/COMMERCIALDRIVER’SLICENSE(CDL) Section26

26.1 Thecostofthechauffeur’slicense/commercialdriver’slicenseandfeesfortheschoolbusdriverandpassengercarryingendorsementswillbepaidbytheEmployee.

SPECIALTRIPS Section27

27.1 Specialtripsaredefinedasanyscheduledtripotherthantheregularbusrun,whichinvolvesthetransportationofpassengers.Specialtripswillbepaidatarateof$12.00perhourforbusdrivers.

a. Driverswillbepermittedtodrivetheirregularrunsandaspecialtripevenifthecombinationofhoursexceedseighthoursaday.

b. Regionally merged trips with TCAPS and/or other school districtswill follow the provisions of this section unless altered by mutualagreement.

27.2 SelectionofbusdriversforspecialtripsshallbebasedonasenioritylistperiodicallypreparedbytheDirectorofTransportation.Bidswillbebasedboth on the seniority and on the number of trip hours, beginningwiththedriverwith themostseniorityandcontinuingdown to theonewithminimumservice. Only inanemergencyshallbusmechanics,and thebusgaragemaintenanceemployeesberequiredtodriveaschoolbustotransportstudents.

27.3 Thefollowingareguidelinesforspecialtrips:

a. Tripsshallbepostedthreeworkingdayspriortothedayofthetripandwilllock-inat11:00a.m.onedaypriortodeparture.Shouldatripbepostedlessthan48hourspriortodeparturetime,saidtripwouldbeopenforbidupto5:30p.m.thenightbeforethetrip.ASaturday/SundaytripwillbetreatedthesameasaFridaytrip.Holidayswillnotbeusedforcomputationofthelock-inperiod.

b. Anewemployeebecomeseligibleforspecialtripsuponcompletionof probation. He/shemust be chargedwith the same number ofhourstohis/hercreditasthedriveroraide/assistantwiththehighestnumberofhoursonthelistatthattime.

c. Employeeswhoreceivepostedemergencytripswillbechargedforspecialtriphoursatarateofone-half(1/2)time.Employeeswillnotbechargedforspecialtriphoursforassistinginemergencysituationsthatarenotposted.

d. Triphoursshallbeaccumulativefromthefirstdayofschoolthroughthedaypriortothestartofschoolthenextyear.

e. Should a trip be canceledwithin the lock-in period, the employeeshallbecompensatedforatwo-hourcall-inifthetripwaspostedforeight(8)orfewerhoursandforfour(4)hoursifthetripwaspostedformorethaneight(8)hoursexceptwhencancelledduetoweather.Thecall-incompensationshallnotbecharged to theaccumulativetriphours.Thecall-inshallnotapplywhenTraverseCityschoolsareclosedduetoanemergencyandthetripiscanceledasaresultofsaidemergency.

f. Employeesthatlockinonmorethanonetripthatresultsinconflictingtimes,theemployeemustchooseoneofthetripsatthetimenotifiedbydispatch.Iftheemployeerefusesalltrips,theemployeewillbechargedwiththehoursofthelongesttrip.

g. Employeesabsentthedaybeforeaspecialtripshallcallthedispatcherby1:00p.m.ofthedayofabsencetoinformthedispatcherofhis/heravailabilityforthetrip.

h. Employeesthatcanceloutwithinthelock-inperiodshallbechargedwiththenumberofhoursofthattrip.

i. Employeesreturningfromleave,wherelossofseniorityoccurs,shallbe chargedwith the same number of hours as the driver or aide/assistantwiththehighestnumberofhoursonthelistatthattime.

27.4 OvernightSpecialTrips

a. Theemployee’stimewillstartatthetimeestablishedbythedailytripitinerary,andshallbepaidno less than theactual time involved indrivingresponsibilitieseachday,butnotlessthaneighthourseachday.

b. Employee’sshallnotberequiredtosupervisestudentsexceptinanemergencysituation.

c. Onedrivermaybeusedfortripscoveredina.andb.ofthissubsectionandsleepingaccommodationsmaybeprovidedifnecessary.

27.6 NoticeTimePriortoSpecialTrips

IntheeventtheTransportationOfficeisnotifiedthesamedaytheneedexistsforatripassignment,theDirectorofTransportationorhisdesignatedrepresentative shall select an employee. If an employee is notifiedconcerning a special trip twenty-four hours or less from the departuretime,andhe/shedoesaccept ithe/sheshallbechargedwith the trip’sresultingtriphours.

27.7 ShuttleTrips

a. Localshuttlesmustoccurbetween thea.m.andp.m.bus runandbe attachedtoaregularbusrun.

b. Shuttleattachmentdriverswillbepaidattheregularratetothenextone-tenthof thehour for timethatexceedsthatdriversregular runtime.Thehoursfortheseattachmentswillbechargedtothedriversshuttlehourlogseparatefromextraworkortriphours.

c. Driversmayrefuselocalshuttlesiftheyconflictwithotherworkresponsibilitiesorothercommitments.

27.8 AdditionalcontractualservicesbywayofexamplebutnotlimitedtotheMigrantProgram,HeadStart,Vantrips,etc.maybeaccommodatedbymutualagreement.

EXTRAWORK Section28

28.1 Extraworkshallbedefinedasanyandallworkperformedoutsideadriver’sassignedclassification.Extraworkbywayofexampleandnotlimitationmayincludebuswashing,StatePoliceInspectionand“Halloweenwatch.”

28.2 Employeesmaynotbidorbeawardedextraworkresultinginmorethan40hoursofworkperweekforalljobsinthedistrictunlessapprovedbytheDirectorofTransportation.

28.5 Employees will not be charged for extra work hours for assisting inemergencysituations.

28.6 Drivers returning from leave,where a loss of seniority occurs, shall bechargedwith the samenumber of hours as thedriverwith the highestnumberofhoursonthelistatthattime.

28.7 Intheeventanemployeelocksinonmorethanoneextraworkassignmentthatresultsinconflictingtimes,theemployeemustchooseoneoftheextraworkassignmentsatthetimenotifiedbydispatch.Iftheemployeerefusesallextraworkassignments,theemployeewillbechargedwitheighthoursofextrawork.

CALL-INS/EXTRAASSIGNMENTS/EMERGENCYEXTRARUNS Section29

29.1 Busemployeesshallnotbepaidlessthantwo(2)hourswhencalledin.For an assignment immediately preceding or following a regular run orspecialtriptheemployeeshallbepaidtothenearestone-tenthofthehour.

29.2 Emergency extra runs shall be defined as runs that occur after anemployee’sreturntime.Foremergencyextrarunsofone(1)hourorless,theemployeeshallreceiveone(1)hour’spay.Forrunsinexcessofone(1)hour,theemployeeshallbepaidtothenearestone-tenthofthehour.

BULLETINBOARDS Section30

30.1 TheEmployershallfurnishtwo(2)bulletinboards(notlessthan2’x4’)forusebytheAssociation.

MEETINGPLACES Section31

31.1 TheAssociationshallbegrantedtheuseofschoolfacilitiesasassignedbytheAdministrationforconductingmeetings,providingspaceisavailablewithoutinterferingwiththeschool.

ASSOCIATIONBUSINESS/WORKSHOPS Section32

32.1a. An employee selected to attend Association Business or anAssociationWorkshopshallbeallowedtimeoffwithpaytoattend.TheEmployer shall bill theAssociation for thecostof a substituteif one is needed. Total time allocated to the Association shall notexceedtwenty(20)workingdaysperyear.TheAssociationwillnotifythe employer inwriting aminimumof three (3)working days priorto the leave. Requestssubmitted less than three (3)workingdayspriortotheleavemaybeapprovedatthediscretionoftheDirectorofTransportation.Thenumberofemployeesattendingshallbelimitedtotwo(2)atanyonetime.

b. Additionaldaysoremployeesmaybeapprovedby theDirectorofTransportation.

c. An additional employee may be allowed to attend AssociationBusinessoranAssociationWorkshopwithoutpayatthediscretionoftheDirectorofTransportation.

d. Meetings where attendance is requested by the Director ofTransportation will not be charged toward Association Business/Workshops.

REPRESENTATION Section33

33.1 Ifanemployeeistobesubjecttoareprimand,theEmployershallinformtheemployeeoftheirrightstoAssociationrepresentation.Foranyemployeereceivingareprimand,theEmployershallprovideacopyofthereprimandtotheAssociationPresidentandChiefStewardortheirdesignee.

ASSOCIATIONDUESANDREPRESENTATIONFEESBYPAYROLLDEDUCTION Section34

34.1 Aslongasanauthorizationcard,signedbyanemployeeisonfileinatimelyfashion,Associationdueswillbedeductedinequalinstallmentsfromhis/herpayrollcheckbytheBusinessOfficeeverypayperiodabargainingunitmemberreceivesapaycheck.ItshallbetheAssociation’sdutytopresenttheBusinessOfficewithauthorizationcardsforrepresentationandpayrolldeduction.

34.2 EmployeescoveredbythisAgreementshallberequired,asaconditionofcontinuedemployment,tobecomemembersoftheAssociationorpayarepresentationfeeasdeterminedbytheAssociationonorbeforethirty(30)daysfromthedateofcommencementofdutiesortheeffectivedateofthisAgreement,whicheverislater.

34.3 It is further understood between the parties that membership in theAssociation is not a condition of employment and neither party to thisagreementshalldiscriminateagainst,intimidate,orotherwiseinfluenceanemployeeregardinghis/herindividualdecisionwithrespecttoAssociationmembership.

34.4 TheAssociationassumesfullresponsibilityforthevalidityandlegalityoftheprovisionshereinset forth. In theevent theEmployer,actingupontherequestoftheAssociation,dischargesorattemptstodischargeanyemployee for failure to comply with these provisions, the AssociationexpresslyagreestoindemnifyandholdtheEmployerharmlessforanyandalldamages,claims,suits,includingallcostsofwitnessesandattorney’sfees,orotherformsof liabilitythatmayariseoutoforbyreasonoftheprovisionshereinsetforth.TheAssociationalsoassumestheright,afterconsultationwiththeEmployer,toselectcounseltoactonbehalfoftheEmployer and the Association, and to compromise or settle any claimmadeasaresultofthisaction.IntheeventtheEmployerinsistsonitsowncounsel,suchcounselshallbeattheEmployer’ssoleexpense.

34.5 TheEmployerassumesnoresponsibilitiesforerrorsofanykindinmakingdues/representation fees deductions other than to correct such errorswhensucherrorsaremadeknown.IntheeventofoverpaymenttotheAssociation,theAssociationagreestorefundsuchmoniesforthwith.

GRIEVANCEPROCEDURE Section35

35.1 Definitions

a. A“grievance”isawrittenclaimbyanemployeethattherehasbeenaviolation,misinterpretation,oramisapplicationofthetermsofthisagreement.

b. A“day”isaweekday(MondaythroughFriday)exclusiveofSaturday,Sunday,orholidaywhenthedistrictisinoperation.

35.2 InformalLevel

Anemployeewithanallegedgrievanceshallfirstdiscussthematterwithhis/herimmediatesupervisor.Ifrequestedbytheemployee,he/shemayhaveastewardpresent.Ifthecomplaintisnotsatisfactorilysettled,itmaybeadvancedtoStepI.

35.3 StepI

If,asaresultoftheinformaldiscussionwithhis/herimmediatesupervisor,thematter isnotsatisfactorily resolved,a formalizedgrievanceshallbe

e. Thedateonwhichtheallegedgrievanceoccurred.

f. Thedateonwhichthegrievanceisfiled.

g. Asignatureattestingtothefactsaspresented.

TheDirectorofTransportationwillrespondinwritingtothegrievantwithinten(10)daysfollowingreceiptofthewrittengrievance.

35.4 StepII

IfthegrievancehasnotbeensatisfactorilyresolvedatStepI, itmaybeappealedinwritingtotheDirectorofHumanResourcesorhis/herdesigneewithinfive(5)daysafterthewrittenresponseatStepI.Ahearingwillbearrangedwithinfive(5)daysofreceiptofsaidappeal.Withinten(10)daysafterthehearing,theDirectorforHumanResourcesorhis/herdesigneewillissueawrittenreplytotheAssociationandthegrievant.

35.5 StepIII

If the grievance is not resolved under the procedures set forth in theprevioussteps,eitherpartymayreferthegrievancetotheMichiganBureauofEmploymentRelationsformediation,saidsubmissiontobemadenotlaterthanfifteen(15)daysfollowingreceiptoftheanswertothegrievancefiledbytheEmployerinStepII.

35.6 StepIV

Withinfifteen(15)daysafterStepIII,ifthegrievancehasnotbeenresolvedatStepIII,uponwrittennoticetotheother,eitherpartymaysubmitthegrievance to arbitration under and in accordancewith the rules of theAmericanArbitrationAssociation.

a. He/sheshallhavenopowertoaddto,subtractfrom,alterormodifyanyofthetermsoftheagreement.

b. He/sheshallhavenopowertoestablishsalarystructuresorchangeinsalary.

c. He/sheshallhavenopowertoruleonanyofthefollowing:Terminationofservicesorfailuretore-employanyprobationaryemployee.

d. He/sheshallhavenopower tochangeanypractice,policy,or ruleoftheBoardnortosubstitutehis/herjudgmentforthatoftheBoardas to the reasonableness of any such practice, policy, rule or anyactiontakenbytheBoard,notinconflictwiththeprovisionsofthisagreement.

e. He/sheshallhavenopowertodecideanyquestionwhich,underthisagreement,iswithintheresponsibilityoftheBoardtodecide.

f. There shall be no appeal froman arbitrator’s decision ifwithin thescopeof his/her authority as set forthabove. It shall befinal andbindingontheAssociation,itsmembers,theemployeeoremployeesinvolved,andtheBoard.

g. Losersshallpay the feesandexpensesof thearbitrator. Allotherexpensesshallbebornebythepartyincurringthemandneitherpartyshallberesponsiblefortheexpenseofwitnessescalledbytheother.

h. Thearbitrator’sfindingsandrecommendationsshallbeforwardedtothepartiesandtheadversepartyshallissueitsdecisionwithrespecttoimplementationofsaidfindingsnolaterthanfifteen(15)daysfromthedateofreceipt.

35.9 General

a. No grievance may be advanced through the procedure hereinestablished, later than fifteen (15) workdays after the occurrenceortheawarenessoftheoccurrence,whichgaverisetotheallegedgrievance. Thetime limitsestablishedby thisgrievanceprocedure

b. IntheeventtheEmployerfailstorespondtoagrievancewithinthetime limits specified, said grievance shall be deemed denied andsubjecttoadvancementtothenextstepofthegrievanceprocedure.

c. TheGrievanceChairpersonshallbeprovidedaplacetomeetontheEmployer’spropertyimmediatelyprecedingmeetingsinvolvingStepsIthroughIV,providingtherequestismadeinadvance.

d. ThegrievanceformtobeutilizedintheformalgrievanceprocedurewillbedevelopedbytheEmployerandtheAssociation.ThegrievanceformswillbeprovidedbytheEmployer.

STORMDAYS Section36

36.1 CancellationDays

Anydrivingdays lostbecauseschool isclosedorcanceled,bywayofexampleandnotlimitation,duetoweatherconditions,epidemic,powerfailure,etc.,willberescheduledasrequiredbyStateStatute.

36.2 Delay/Holddays

Anytimeschoolbeginsotherthanthenormalschoolstarttime.

a. OneHourDelay/Hold--Reportonehourlaterthannormalreporttimeunlessspecialcircumstancesrequire,suchasde-icing.Allemployeeswillbepaidonehourplustheirnormalbidtimesforthefulldayiftheyreporttowork.

b. TwoHourDelay/Hold--Reporttwohourslaterthannormalreporttimeunlessspecialcircumstancesrequire,suchasde-icing.Allemployeeswillbepaidonehourplustheirnormalbidtimesforthefulldayiftheyreporttowork.

c. Intheeventschooliscanceledafteradelay/holdaonehourcall-inshallapplytothoseemployeeswhohavereportedtoworkorhavearevisedreporttimetwentyminutesorlessafterthetimeofcancellationunless37.1.a.,37.2.a.or37.2.b.applies.

movement within the salary schedule (e.g. years of service) shall bepermittedonlyduringthespecificschoolyearsexpresslyidentifiedwithinthiscontractualsalary/wagescheduleandonlyduringtheeffectivedatesofthiscontract.Anysuchmovementuponthesalary/wagescheduleforanyschoolyearbeyondthoseyearsforwhichthiscontractisexpresslyeffective is subject to the negotiation process and the parties’ duty tobargainingoodfaith.

38.5 Pay for non-attendance/holidays for non-probationary employees willinclude Labor Day, Thanksgiving Day, Friday following ThanksgivingDay, Christmas Eve, Christmas Day, New Year’s Eve, New Year’s Day,Good Friday, and Memorial Day. a. Tobeeligiblefornon-attendance/holidaypay,employeesmustworkorbeonauthorizedpaidleavethedaybeforeandthedayaftertheholidayunlesswiththepriorapprovaloftheDirectorofTransportation.IfschoolbeginsafterLaborDay,drivers/aideswillbepaidforLaborDayiftheyattendtheone-daytrainingprogramidentifiedinsubsection6.4.

b. Non-attendance/holidaypayshallonlybegrantedtoemployeeswhohaveanofficialbidposition.

38.6 Timeandone-halfshallbepaidforhoursworkedinexcessoffortyhoursinoneworkweek.

38.7 Whenbonafideerrorsinanemployee’spayarediscovered,theemployeewillbenotifiedandimmediatearrangementsforadjustmentwillbemade.Incaseswheretheemployeefailstomakeacceptablearrangements,theemployerwillmakecorrections,notifyingtheemployeeoftheadjustment.

HEALTHANDLIFEINSURANCE Section39

39.1 Group health care insurance will be made available through payrolldeductionfromacarrieravailabletootheremployeesthroughtheemployerasmutuallyagreedtobytheemployerandtheassociation.TheEmployerwillcontributetowardhealthcarepremiumsonamonthlybasisasnotedinsubsection39.2.

a. Authorized deductions for health insurance (if required) will becomputedbasedoncoverageselectedbytheemployee.Anequalamountwillbedeductedeachpayperiodbasedoncoveragebeingprovided throughout a twelve month year, but with deductionsbeingmadeduring the school year. If an employee is not eligibletoreceiveapayrollcheckfromwhichadeductioncanbemade,ortheinsurancepremiumsincreaseduringthesummermonths, itwillbetheresponsibilityoftheemployeetoremitdirectlytotheHumanResourcesOffice the amount of his/her required deduction on thepayrolldate. Failuretotimelyremitwillvoideligibility intheschoolgroup,andwillresultintheemployee’sinsurancebeingcanceled.

b. Transportationemployeesmustassumetheresponsibilityofsigninguptoreceivehealth/hospitalizationbenefits.Employeesmustsignupforthe insurancecoverageduringtheopenenrollmentperiodeachyear as established by the carrier and Employer, except that newemployeesmaysignupforhealth/hospitalizationinsurancebenefitsaftercompletionoftheirprobationaryperiod.Employeeswhodonotenrollduringtheperiodoftimeasoutlinedinthisparagraphwillnotbeeligibletoenrollagainuntilthenextopenenrollmentperiod.

c. Changesincoveragebroughtaboutbymarriage,childbirth,death,oranyotherchangeintheemployee’sfamilyshallbebroughttotheimmediateattentionoftheHumanResourcesOfficeforpurposesofkeepinginsurancecoveragecurrent.

d. IfanemployeefailstonotifytheHumanResourcesOfficewhenhis/herfamilystatuschanges,wherebyitwouldchangethetypeofcontract(persons covered), the employee, because of his/her negligence,willassumetheresponsibilityofrepayingtheEmployerforanyover-paymentsmadeonapolicyinexcessofwhattheemployeeisentitledtoreceive.

e. Health care benefits, for eligible employees, will become effectiveafteranemployeesuccessfullycompletestheprobationaryperiod.

f. Healthcareinsurancecoverageshallbelimitedtoone-person,two-person,orfull-familycoverage,butdualfull-familycoverageforbothhusbandandwifeshallnotbepermitted.

g. EligibilityofhealthcareinsurancepaidbytheEmployerisbasedontheacceptanceofthewrittenapplicationbytheinsurancecarrier.

h. ItisunderstoodthatthecontractyearforinsurancecoveragecurrentlyisOctober1throughSeptember30.

39.2 EmployerContributionTowardHealthCareInsurancePremiums

Beginning June, 2011 the Employer shall provide health coverage foremployeesbiddingandworkingregulara.m.andp.m.runsof22hoursperweekormore.ThehealthcoveragewillbeaPriorityHealthPointofServiceHighDeductiblePlanwithHearingPlan rider,$15/50Rxanda$1,200/$2,400annualdeductiblewithEmployeepaycheckdeductionsaslistedbelow.

Beginning June1, 2012, theEmployerwill pay theEmployer subsidiespaid in 2010/11 plus an additional amount equivalent to the EmployerandEmployeesplittingpremiumincreasesuptoamaximumof20%.TheEmployerandAssociationagreetomeetwithinthirty(30)daysofreceivinginsurancerenewalstoreviewcarrierandbenefitlevelsiftheincreasesareabove20%.

OptionaldentalandvisioninsurancecoveragewillbeavailablewithcarrierandbenefitlevelsmutuallyagreedbytheEmployerandAssociation.

39.4 Employeesworkingregularrunsof22hoursormoreperweek(a.m.andp.m.runs)whoareeligibletoreceiveinsurancebenefitsbutchoosenottoenrollmayreceive$100ingrosswagespermonth. Employeesmaychoose to keep the $100 as additional wages, select a tax-shelteredannuitythroughaSection125planorpurchaseadditionaloptions.Inordertoparticipateinthisoptionalprogram,theemployeemustshowproofofhealthinsuranceunderanotherplan.Employeesassumeresponsibilityofsigningupforthisbenefitduringtheopenenrollmentperiodeachyear.

39.5 LifeInsuranceProtection

A$5,000.00lifeinsurancepolicyshallbeprovidedeachemployee.Lifeinsuranceshallremaininfullforceandeffectforemployeesonpaidsickleaveorduringanapprovedunpaidleaveofabsenceof lessthanthirtycalendardays.

a. Lifeinsuranceforeligibleemployeeswillbecomeeffectivethefirstofthemonthfollowingtheemployee’sdateofhire.

b. Responsibilityforenrollmentintheprogramrestswiththeemployee.Employeeswhodonotenrollduringtheperiodoftimeasoutlinedinthissectionwillnotbeeligibletoenrolluntilthenextopenenrollmentperiod.

c. Eligibility of insurance paid by the Employer is based on theacceptanceofthewrittenapplicationbytheinsurancecarrier.

SCHOOLCALENDAR Section40

40.1 Theworkyearforregularrunsshallconsistofthenumberofdaysassetbytheapprovedschoolcalendarforstudentinstructionduringeachyearofthiscontract.

40.2 Schooldays lostbecauseof a strikeorwithholdingof servicesbyanyorganizationwithintheTraverseCityAreaPublicSchoolswillbescheduledinaccordancewiththelaw.

40.3 It is understood that the number of days as scheduled for studentinstructionwillincludeone-halfdays.TheAssociationwillbenotified,aminimumoftwoweekspriortotheone-halfdaysessions,exceptforthoseone-halfdaysscheduled toendeachsemester that arecoveredunderSection36.

ThisAgreementshalltakeeffectasofMarch14,2011andshallremaininforceandeffectuntilJune30,2012.FollowingFebruary15,2012,eitherparty may initiate negotiations for renewal and modification, or a newAgreement.
