Application by Sohail Muzaffar as a Chairman, Transparency International-Pakistan

pertaining to Corruption in Zakat Fund.

****** Comments on behalf of Transparency International-Pakistan on the report submitted

by the Secretary Auqaf & Religious Affairs, Zakat & Usher Department, Government

of Sindh, Karachi .

In Compliance with the Order of the Honorable Apex Court regarding the reply to the

report submitted by the Secretary Auqaf & Religious Affairs (Zakat & Usher Department) .

Government of Sindh, the Transparency International-Pakistan through its Chairman Sohail

Muzaffar submits the following comments:

I. That a letter dated 4th May. 2017 was sent to the Honorable Court after acquiring the

knowledge through a news publication of 4th May, 2017 regarding the discussions

held in the meeting of the Standing Committee of Auqaf & Religious Affairs (Zakat

& Usher Department) Government of Sindh which was held on 3rd May. 2017.

2. That the reply of the Religious Affairs, Zakat & Usher. Government of Sindh has

been received after two reminders were sent by the Honorable Court to the

Government of Sindh.

3. The Honorable Court may be graciously pleased to observe that from the reply of

Sindh Government it appears that allegations have been denied by the Assistant

Audit & Account on dated 2 November 2017, It can be seen that the case of Sindh

Government is one of total denial. They have categorically stated that no such

discussions were held in the Committee meeting held on 3rd May. 2017. It is pertinent

to point out that the minutes of the meeting signed by the Chairperson Standing

Committee on Auqaf, Religious Affairs. Zakat & Usher, attached with the letter has

no date of signing of the minutes ofthe meeting and as such it can be said that such

minutes were subsequently prepared to fill the pages after the Notice by the

Honorable Court was received. It can therefore be safely assumed that the minutes of

the meeting of 3 May 2017 were not available when the Honorable Court sought the

clarification on 12 May 2017, as the clarification should have been given to

Honorable Court in May 2017; it was not given for the simple reason that the minutes

were not recorded nor were available with Sindh Government.

4. Respectfully submitted that the perusal of the undated minutes will prove the

haphazard manner in which the minutes were prepared. The plain reading of the

minutes will show that the name of Mr. Shafi Muhammad Jamote MPA. appears

twice as a member who attended the meeting. Mr. Jamote's name appears at Serial

No: 5 & 6. This very fact raises the suspicion that the minutes were prepared after the

Honorable Court sought the explanation. It is respectfully submitted that such

minutes have been filed to deceive the Honorable Court after a reminder on 25 111 July.

5. On the page No.3&5, the illegal continuation of Chairman Zakat Committee, has

been discussed . A question, raised by Mr. Waryam Fakir, MPA/member of the

committee, who pointed out that funds are not being distributed transparently.

supports the allegation that even committee members suspected the foul play in

distribution of funds with connivance of some departmental officials.

6. The comments do not disclose anything pertaining to NAB not completing inquiry

against Mr. Dost Mohammad, Minister of Usher pending since October 2015. It has

been intentionally ignored and no light has been thrown on this issue.

7. In addition to what has been stated above, it is respectfully submitted that it has been

reported in Daily DAWN of 91h September, 2017 that another matter pertaining to

corruption in distribution of funds against Chairman Sindh Zakat Council is pending

in the Honorable High Court of Sindh at Karachi. Copy of News report of Daily

DAWN of 9th September, 2017 is being enclosed for the kind perusal of the

Honorable Court. It has been reported in Daily DAWN that the meeting held by

Standing Committee on Auqaf, Religious Affairs, Zakat & Usher are numbered. and

the matter before the Honorable High Court of Sindh is based on the decisions taken

by them on the 191h meeting of the CounciL where as in the meetings of 3'u May.

there is no reference number of this meeting, which supports suspicion that the

minutes may have been tampered. However, audio recording of the meeting may

reveal the facts.

8. It is respectfully submitted that the main issue pertains to corruption 111 the Zakat

fund, which can be verified by the accounts of the disbursement of Sindh Government

or by getting the accounts audited by a reputable independent firm of Chartered

accountants and if it is established that Zakat funds are distributed by retired

Chairpersons, in cash, the Sindh Government should explain as it amounts to

corruption and corrupt practice.

9. The Honourable Court may be graciously pleased to take necessary action as the

Honorable Court may deem fit in the circumstances of the matter.

An indulgence ofthe Honorable Court in the matter is prayed for.

DA\VN Sindh Zakat Council chairman to get contempt notice for terming SHC order illegal

HYDERABAD: The Hyderabad circuit bench of the Sindh High Court on Thursday ordered issuance of contempt of court notice to chairman ofSindh Zakat Council (SZC) for terming its order illegal. The division bench comprising Justices Salahuddin Panhwar and Fahim Ahmed Siddiqui referred the matter of zakat distribution to director general of National Accountabi I ity Bureau (NAB) to conduct probe into irregularities in the fund's distribution. It said the inquiry would cover distribution ofzakat fund received by the SZC from the federal pool and ordered if any iiTegularity was found the delinquent officer be dealt with in accordance with law. The court passed the order on identical petitions filed by representatives of Sufism and Modern Sciences University, Bhitshah, and Karachi University complaining that they had not received even a single penny of zakat from the SZC for distribution among deserving students since 2012.

Deputy administrator of zakat informed the bench that following previous court orders, they had sent a summary to the SZC chairman, which he turned down with a note that "high cou11 has no jurisdiction to take suo motu action" and then the matter was placed before the 19th meeting of the council. The cou11 referred to its order passed on Dec 22, 2016, in which Kashif Siddiqui, district zakat officer at Karachi headquarters had claimed that stipend for 2011-16 came to about Rs400 mill ion out of which Rs230m were utilised and Rsl70m were deposited accordingly. He had admitted that no such record was available at the head office. The court observed that in view of Mr Siddiqui's statement a lion's share of Rs 170m out of Rs400m remained unutilised and neither the SZC chairman nor anyone else could claim that no deserving student had left education during that period because of lack of money. It said it failed to understand what prevented the council, including its chairman, from letting people know the criteria of claiming zakat and disclosing details of record of stipend paid along with names of respective institutions and universities. It took serious notice ofthe note written by the SZC chairman, mentioning "order ofSindh High Court is not legal. Court has no jurisdiction to take suo motu notice of the matter." The bench observed the chairman was not competent to declare the court's order as not legal or illegal nor compliance of a lawful order could be declined. It said: ''Incompetent rather illegal assertion by the SZC chainnan is quite strange, particularly (as it appeared) to avoid disclosure of criteria for distribution of such amount not to blue eyed boys but to the deserving ones." The court said that it did not take suo motu notice of the case because a petition filed by Roshan Ali Azeem Mallah advocate in person was already pending before the cou11 about the zakat system. The secretary ofzakat and ushr was a respondent in this petition yet the chairman challenged the jurisdiction and competence ofthe court without checking facts. Prima facie this was a case of contempt and as such contempt notice was issued to SZC chairman and council members who attended the 19th meeting.
