Main Principals guided Transnet position

• The purpose of the guideline: Establish a common approach for

the implementation and enforcement of the SOLAS requirements

The main principles of the guidelines are:

• The shipper is responsible for providing the verified gross mass

of a packed container.

• As the terminal representative need to have obtained, in advance

of a vessel loading, the verified actual gross mass of the container.

• The SOLAS VGM requirements enter into force 1 July

What Information is required to comply with SOLAS and what are the

weighing methods?

Information which SAMSA have confirmed terminal operators are to

receive sufficiently in advance of loading include:

Verified gross mass (VGM)

Indication of Weight Verification Method(1 or 2)

SAMSA accreditation number if applicable

Duly Authorised Person

Method 1:

Upon the conclusion of packing and sealing a container, the shipper

may weigh, or have arranged that a third party weighs, the packed

container.

E.g. Using a weighbridge

Method 1 DOES NOT require the approval of SAMSA

Uncertainty with regard to whether your weighing practices meet the

requirements of method 1 can be clarified with SAMSA

What Information is required to comply with SOLAS?

Method 2:

The shipper (or, by arrangement of the shipper, a third party), may

weigh all packages and cargo items, including the mass of pallets,

dunnage and other packing and securing material to be packed in

the container, and add the tare mass of the container to the sum of

the single masses using a certified method.

Irrespective of method, weighing equipment is subject to the

requirements of the Legal Metrology Act, 2014 which falls under the

auspices of the National Regulator for Compulsory Specifications

(NRCS).

*Competent Authority = SAMSA MN 25 2016 indicated 5 accredited

by SAMSA to approve

IMO guideline principles adopted by TRANSNET -TPT and shared

with industry \CIRC\MSC\01\1475

• In terms of the Regulation, ultimately the responsibility of the verified

weight lies with the shipper. It is however the intention of Transnet to find

an efficient method on the flow of the information (electronic) in order to

enable compliance and where possible to assist industry with the

provision of the VGM.

• Pre-advise of export containers is the current TPT & TFR process and

SOLAS compliance will NOT deviate from this process – TPT will ‘tweek’

the current mandatory requirements of the pre-advise message (critical

fields) to accommodate regulation. – i.e., Verified weight.

• All endeavors should be made by all parties ( shipper/agent/ freight

companies/terminal) that no truck carrying containers exceeding

allowed weight enters the ports’ boundaries.

• TNPA expects full compliance by all parties to the process outlined

under the Guidelines Regarding the Verified Gross Mass of a Container

Carrying Cargo’ (MSC.1/Circ.1475) dated 9 June 2014 and the

implementation process outlined by SAMSA in the Marine Notice No 25

of 2016, Guidelines on the implementation of SOLAS VI Regulation 2

Amendment: Verification of the Gross Mass of Packed Containers

• The Ports Authority does not become involved in the commercial

relationships between the terminal operator and its clients

• TNPA will play a role as a facilitator/ oversight aligned to its mandate

outlined in the National Ports Act and support and require compliance

to the legal requirements placed on all Port Users

• TFR is currently weighing full export containers at terminals equipped with

containers which are railed from the said terminals using Method 1.

How do customers pre-advise their containers?

• In keeping business requirements all EXPORT containers need to

be pre-advised prior to entering the terminal.

• Currently about 5 mandatory fields captured.

• New SOLAS regulations requires additional data – NAVIS

development required.

Practical Implications of 1 July VGM requirements

• At the various national SAMSA engagements FAQ extension

• SOLAS is a global regulation impacting all vessels to which the

SOLAS Convention applies. SAMSA position - no extension

• Position reiterated by a joint communique from 13 carriers to all

global terminal operators (24th May) ‘All container vessels operated by

us are regulated by SOLAS. The SOLAS regulation requires effective 1st July 2016 the

existence of a Verified Gross Mass’

• Prerequisite for terminal entry = SOLAS compliant CTO

documents (non Navis) Pre-advice (NAVIS)

Practical Implications of 1 July VGM requirements

TRANSNET and Joint line communique (24th May 2016)

• Nonconforming containers – Containers which do not have the

correct CTO/ are not pre-advised will systematically (at the gate)

not be permitted entry into the terminal. This is the current

practice and this will be maintained.

• ‘Neither shipping lines nor container terminals will re-verify a

container with an already verified weight (VGM).’ TPT position and

joint line communique

• TPT terminals are not endowed with legal, type approved

equipment capable of providing a VGM on behalf of shippers.

Some TFR facilities are however – providing a VGM free of charge.

• ‘Carriers strongly recommend to shippers and other supply chain

partners to provide the VGM in an early stage of the supply chain,

for example before the container leaves the premises of the

Who is the Shipper?

MSC1/Circ1475:

• “Shipper” means a legal entity or person named on the

bill of lading or seaway bill or equivalent multimodal

transport document as shipper and/or who(or in

whose name or on whose behalf) a contract of carriage

has been concluded with a shipping company.

Carriage of Cargo Regulations, 2004:

• “Shipper“ means any person who, whether as

principal or as agent for another, consigns goods for

carriage by sea
