    How to Legally Change a Name A court order is required in order to change your name on documents such as a driver’s license, passport, social security card, and birth certificate. In Contra Costa County, a name change is done through the Wakefield Taylor Courthouse located at 752 Court Street, Martinez, California. Name changes are done Mondays through Fridays from 9:30 a.m. to 11:00 a.m. in room 210, Probe Examiners. All of the forms in the Name Change Packet are needed and make sure to bring the following: For adults:

    An Order to Show Cause to be issued by the Court - Judicial Council form NC-120

    Photo identification (California driver’s license or California ID card, or similar)

    Proof of residency in Contra Costa County (e.g., recent utility or tax bill)

    Civil Case Cover Sheet - Judicial Council form CM-010 (Form NC-120 and CM-010 are included in the Name Change Packet)

    For minors:

    Birth certificate

    The parent’s photo ID and proof of residency in Contra Costa County (e.g., recent utility or tax bill)

    Civil Case Cover Sheet - Judicial Council form CM-010 (included in the Name Change Packet)

    Instructions on how to legally change a name can be found at the link for the Name Change Packet below. Keep in mind that if a name is being changed for the purpose of changing gender identity, publishing the “Order to Show Cause” does not need to be completed. This means a publication in a local newspaper is not required. This can be found under item #7 on page 2 of the form NC-100, which is included in the Name Change Packet.     How to Change a Name on Identity Documents

    Social Security Card: Changing your name on your social security card is required before being able to change it on a driver’s license or California identification card.

    1. After receiving a Court Ordered Name Change, deliver the Court Order to the local Social Security Administration office in person or through mail. There are Social Security Offices located in Antioch, Fremont, Hayward, Oakland, Richmond, San Leandro, and Walnut Creek. Find your local Social Security office at https://secure.ssa.gov/ICON/main.jsp

    2. Fill out the “Application for Social Security Card” form SS-5. Form SS-5 can be found at the following link: https://www.ssa.gov/forms/ss-5.pdf

    3. Show Proof of U.S. citizenship or immigration status, age, legal name change, and identity. U.S citizenship can be proven by providing your U.S birth certificate or U.S. passport. You could also provide a Consular Report of Birth, Certification of Citizenship, or Certification of Naturalization. Proving age can be done by providing your birth certificate, U.S. hospital record of your birth, religious record established before age 5 showing your age or date of birth, passport or final adoption decree. A legal name change can be proven by providing the Court Ordered Name Change. Identity can be proven by providing a U.S. driver license or identification card, or passport.

    U.S. Passport: If you have received a passport within the past year:

    1. Complete and submit the “U.S. Passport Re-Application” form DS-5504. The link for form DS-5504 can be found below along with detailed instructions on applying for a passport with your new name.

    2. Send form DS-5504, your current U.S. passport, a recent colored photo, and a certified copy of the court order for name change to:

    National Passport Processing Center Post Office Box 90107 Philadelphia, PA 19190-0107 The application takes about 4-6 weeks to process. There is no application fee.

    3. If you wish to expedite the application process to about 2-3 weeks, you will be required to pay a $60 fee. Expedited application should be sent to: National Passport Processing Center Post Office Box 90907 Philadelphia, PA 19190-0907 Form DS-5504: https://eforms.state.gov/Forms/ds5504.pdf If you have a U.S. passport issued more than 1 year ago but less than 15 years ago:

    1. Complete and submit the “Application for Passport Renewal by Mail” form DS-82. The link for form DS-82 can be found below, along with detailed instructions on applying for a passport with your new name.

    2. Send form DS-82, your current U.S. passport, a recent colored photo, the processing fee, and a certified copy of the Court Ordered Name Change to: National Passport Processing Center Post Office Box 90155 Philadelphia, PA 19190-0155 The processing fee should be in the form of a check made payable to U.S Department of State. The check should include your full name and date of birth. The fee is $110 for the passport book, $30 for the passport card, or $140 for the passport book and card.

    2. Bring form DS-11, a recent colored photo, the processing fee, a certified copy of the Court Ordered Name Change, proof of citizenship, and proof of identity. Take these documents to a clerk of a federal or state court of record, a judge or clerk of a probate court accepting applications, a designated municipal or county official, a designated postal employee at an authorized post office, or an agent at a passport agency. Find an acceptable location near you by entering your zip code or city at the following link: https://iafdb.travel.state.gov or call the National Passport Information center at (877) 487-2778.

    3. The processing fee should be in the form of a check or money order made payable to U.S Department of State. The check should include your full name and date of birth.     California Birth Certificate:

    1. Order and fill out the “Amendment of Birth Record” form VS-23. The link to order form VS-23 can be found below. You can also order the form by calling the California Department of Public Health’s customer service line (916) 445-2684 or from the County Recorder or County Health Department in your local county.     2. Petition for a new birth certificate reflecting your new name by filing through the Office of Vital Records. Mail your petition to:

    California Department of Public Health Vital Records - M.S. 5103 P.O. Box 997410 Sacramento, CA 95899-7410 The petition should include:

    A completed VS-23 form.

    A certified copy of your Court Ordered Name Change. When you receive the Court Ordered Name Change, ask the court to make a copy and certify it. A copy where the certified court seal is not copied will not be accepted.

    A photocopy of your birth certificate.

    $23 by check or money order payable to CDPH Vital Records for a copy of the new birth certificate.

    After 6-10 weeks, you will either receive a postcard accepting the request to change your birth certificate, or if your application was rejected, they will return it to you with corrections.     California ID and Driver’s License:

    1. Fill out Form DL-44. Form DL-44 is not available online and needs to be requested by either calling the DMV at (800) 777-0133 or requesting a form in person at the DMV. Local DMV offices can be found by typing your city or zip code at the following link: http://www.dmv.org/ca-california/dmv-office-finder.php

    2. You may be asked to prove your identity and name change by providing the DMV with the Court Ordered Name Change as well as either a birth certificate, passport, U.S citizenship card, military I.D, U.S. naturalization certificate, or American Indian card stating your current legal name.     How to Legally Change Gender In California, it is no longer necessary to have a Court Ordered Gender Change to change gender on California driver's licenses, social security cards, U.S. passports, or California birth certificates. If you have a birth certificate from outside California, a Court Ordered Gender Change may be required to legally change the gender of your birth certificate. In order to request a Court Ordered Gender Change for those 18 or older, you will need to do the following:

    1. Fill out the “Petition for Change of Gender and Issuance of New Birth Certificate” form NC-300, “Setting for Hearing on the Petition for Change of Gender and Issuance of New Birth Certificate” form NC-320, and “Civil Case Cover Sheet” form CM-010. The link for forms NC-300, NC-320, CM-010 can be found below.

    2. Have your licensed physician fill out the “Declaration of Physician” form NC-310 stating that you have had appropriate treatment for gender change. What this means can be decided between you and your doctor. The link for form NC-310 can be found below.

    3. File the forms at a superior court where you would like your hearing to be held. There are superior courts of California located in Martinez, Pittsburg, Walnut Creek, Alameda, San Leandro, and Richmond. A clerk at the superior court will stamp all forms as “filed” and select a date for your hearing. The cost of filing the petition can be found at http://www.courts.ca.gov/documents/filingfees.pdf. If you cannot afford to pay the fee, you can ask to have it waived at http://www.courts.ca.gov/selfhelp-feewaiver.htm. If you currently receive public benefits such as food stamps, Supplemental Security income, cash assistance, or Medi-Cal, you automatically qualify for a fee-waiver.

    4. On your court date, bring all the forms, required documents, as well as the “Order for Change of Gender and Issuance of New Birth Certificate” form NC-330 for the judge to sign. Form NC-330 can be found below.

    5. If your petition is approved, the judge will sign form NC-330. Once the form is signed, get a certified copy from the court clerk.     How to Change Gender on Identity Documents

    Social Security Card: Social security cards do not actually state gender; the gender marker can be changed on the social security records. Other agencies, such as the DMV, may check the Social Security record to confirm your gender.

    1. Show proof of U.S citizenship or immigration status, gender, and identity. U.S citizenship can be proven by providing your U.S birth certificate or U.S. passport. You could also provide a Consular Report of Birth, Certificate of Citizenship, or Certificate of Naturalization. Gender can be proven by providing U.S. passport showing the new gender, birth certificate showing the new gender, court order directing legal recognition of change of gender, or medical certification of appropriate clinical treatment for gender transition in the form of an original letter from a licensed physician. Identity can be proven by providing a U.S. driver license, state issued identification card, or U.S. passport.     3. Mail or deliver in person the completed application and required documents to the local Social Security Administration Office. There are Social Security Offices located in Walnut Creek, Antioch, Richmond, Oakland, San Leandro, Hayward, and Fremont.     3. You will also be required to bring a statement written on office letterhead from a licensed physician stating that appropriate clinical treatment is either in process or completed. Reassignment surgery is not required. The letter needs to include the physician’s full name, address, phone number, and medical license or certificate number. In the letter, the physician should state their relationship to you, that they have treated you or reviewed your medical history, and that you have had, or are in process of appropriate clinical treatment for gender transition.     A licensed physician's affidavit stating you have undergone “clinically appropriate treatment for the purpose of gender transition.” The affidavit should include the doctor’s full name and medical license or certificate number.

    $23 by check or money order payable to CDPH Vital Records for a copy of the new birth certificate.

    A photocopy of your birth certificate.

    A notarized Sworn Statement. If simultaneously applying to have your name changed on the birth certificate, the certified copy of the Court Order Name Change is required instead of the Sworn Statement. When you receive the Court Ordered Name Change, ask the court to make a copy and certify it. They will not accept a copy where the certified court seal is copied.

    After 6-10 weeks, you will either receive a postcard accepting the request to change your birth certificate, or if your application was rejected, they will return it to you with corrections.     California Driver’s License and Identification Card: 1. Fill the “DMV Medical Certification and Authorization (Gender Change)” form DL-329. The link for form DL-329 can be found below. Have the form completed and signed by a licensed physician or psychologist. Do not leave any line on the form blank. If one of the questions cannot be answered or is irrelevant, answer N/A. 2. Submit the form to your local DMV along with the application fee of $31. Local DMV offices can be found by typing your city or zip code at the following link: http://www.dmv.org/ca-california/dmv-office-finder.php If the DMV approves the application, they will stamp and sign the form. Make sure this is done before it is sent to the processing center in Sacramento. If you application is approved, they may ask for your old ID or driver’s license and give you a paper record of your application. The new driver’s license or ID will be sent in the mail about 2 weeks after it is processed.

    Gender Neutral Bathrooms Gender neutral bathrooms are restrooms that are not specifically designated to the use of one gender; anyone of any gender is free to use a gender neutral restrooms.
