ARTICLE ITraffic Control

§ 240-1. Definitions; interpretations.

In this article, any terms or definitions used, other than thosespecified in § 240-1A, shall conform to the definitions specifiedin the Highway Traffic Act.

A. As used in this article, the following terms shall have themeanings indicated:

AUTHORIZED SIGN — Any sign or other deviceapproved by the Director of Traffic, Transportation andDevelopment Engineering.

BICYCLE — Includes a tricycle having a wheel orwheels of more than 61.0 centimetres in diameter.

BOULEV RD — The area within the public right-of-wayAextending between the limit of the municipal roadallowance and the travelled portion of the street. Thetravelled portion of the public street includes anyadjoining areas specifically authorized or licensed by themunicipality for on-street parking purposes. [Added2001-06-01 by By-Law No. 367-2001]

HEA Y TRUCK — A commercial vehicle having aVweight, when unloaded, of three tonnes or more or, whenloaded, of five tonnes or more, and includes a school buslonger than eight metres and a road building machine,but does not include a passenger vehicle, an ambulanceor any vehicle of a police or fire department. (1) Where visible, the size as stamped by the tiremanufacturer on the outside wall of the rubber tire;or

(2) Where no size stamped on the outside wall of therubber tire is visible, then the diameter of the tire,as measured from the outside edge of one side of therubber tire (mounted on a metal or other rim)straight across to the opposite outside edge of thesame tire.

TRANSIT STOP ZONE — A location on a highway,designated by the T ronto Transit Commission, GooTransit or any other municipal transit agency authorizedto operate within Metropolitan T ronto for the loadingoa n d u n l o a d i n g o f passengers , m a r k e d w i t h t h eappropriate transit identification and bounded by “nostanding” signage.

B. Where any expression of time occurs or where any houror other period of time is stated, the time referred toshall be standard time except in periods when daylightsaving time is in effect, in which periods it shall bedaylight saving time.

§ 240-2. Traffic signs and signals.

A. The Director of Traffic, Transportation and DevelopmentEngineering is authorized to place or erect and tomaintain such authorized signs and traffic controlsignals as are required to give effect to the provisions ofthis article or as are required to warn or guide traffic forthe safety or convenience of the public.

B. No person shall place, maintain or display upon or inview of any highway any sign, signal, marking or devicewhich purports to be or is an imitation of or resemblesan authorized sign or traffic control signal, or whichconceals from view or interferes with the effectiveness ofan authorized sign or traffic control signal.

§ 240-3. Miscellaneous driving rules.

A. No person shall operate a vehicle or streetcar emergingfrom a driveway, laneway, front yard parking area,boulevard parking area, building, streetcar or bus looponto a highway until bringing the vehicle or streetcar toa full stop immediately before driving onto a sidewalk orfootpath, and upon proceeding shall yield the right-of-way to pedestrians upon the sidewalk or footpath.

B. Where U-turns are not prohibited under the provisions of§ 240-15, no person shall while operating a vehicle makesuch a turn in an unsafe manner and so as to interferewith other traffic.

C. No person shall, except under the direction of a policeofficer, drive a vehicle on a highway between the vehiclescomprising a funeral or other procession recognizable assuch by the display of pennants or other identifyinginsignia while the vehicles in such a procession are inmotion.

D. Sidewalks and curbs.

(1) No person shall drive a motor vehicle upon asidewalk or footpath on a highway except for thepurpose of directly crossing the sidewalk or footpath;

(2) No person shall drive a motor vehicle over a raisedcurb except at a place where there is a ramp orauthorized front yard or boulevard parking.

E. No person shall while operating a vehicle proceeding ona streetcar track on a highway in front of a streetcarremain on the track longer than practicable after asignal from the streetcar operator.

§ 240-4. P destrians’ rights and duties.e

A. Except when a safety zone is provided, no personintending to board a streetcar on a highway shall enter

the roadway until the streetcar has come to a stop for thepurpose of taking on passengers.

B. No person shall, except where traffic control signals arein operation, or where traffic is being controlled by apolice officer, or at a pedestrian crossover, proceed so asnot to yield the right-of-way to vehicles and streetcars onthe roadway; however, nothing in the section shallrelieve the driver of a vehicle or streetcar from theobligation of taking all due care to avoid an accident.

C. No pedestrian shall proceed over or go under a barrierpermanently installed at a safety zone or on a sidewalk.

D. No person shall play or take part in any game or sportupon a roadway and, where there are sidewalks, noperson upon roller-skates, or riding in or by means ofany coaster, toy vehicle or similar device, shall go upon aroadway except for the purpose of crossing the road, andwhen so crossing such person shall have the rights andbe subject to the obligations of a pedestrian.

§ 240-5. P destrians prohibited on certain highways.e

A. Subject to Subsection B, pedestrians are prohibited fromusing those parts of the highways set out in Column 1 ofSchedule I to this article between the limits set out in

2Column 2 of said schedule.

B. Subsection A does not apply to pedestrians engaged inpolice duties, highway maintenance or constructionduties or where, owing to an emergency, it is necessaryto make use of a highway.

§ 240-6. Regulations for bicycles.

A. No person shall park a bicycle on a highway except insuch a manner as to cause the least possible obstructionto pedestrian or vehicular traffic.

B. No person shall ride a bicycle on a sidewalk of anyhighway.

C. No person shall ride a bicycle or motor-assisted bicycleon the highways set out in Column 1 of Schedule II tothis article between the limits set out in Column 2 of

1said schedule.

§ 240-7. General stopping and parking regulations.

A. Manner of parking.

(1) No person shall park or stop any vehicle on anyhighway or portion thereof except as follows:

(a) Where there is a raised curb, on the right sideof the roadway, having regard to the directionsuch vehicle was proceeding, with its right frontand rear wheels parallel to and not more than30 centimetres out from such curb;

(b) Where there is no curb or a rolled curb, with theright front and rear wheels parallel to and asnear to the right limit of the highway as ispracticable without stopping or parking over asidewalk or footpath or over any part of thehighway where grass is grown or which is notintended for the use of vehicles.

(2) The provisions of Subsection A(1) do not applywhere angle parking is permitted under § 240-11hereof or to parking or stopping a vehicle on the left

side of the roadway of a highway designated forone-way traffic.

(3) Where angle parking is permitted on a highway, noperson shall stop or park any vehicle except at anangle of 45° from the curb or boundary of theroadway, with the front end of the vehicle at suchcurb or boundary.

(3.1) Where angle parking is permitted on a highway,despite the provisions of Subsection A(3), a motorcyclemay be parked at an angle, provided that no personshall park a motorcycle at an angle less than 45° orgreater than 60° to the curb. (4) Where angle parking spaces are designated by linespainted on the roadway, no person shall stop or parkany vehicle except within an area designated as aparking space.

(5) Where parking is permitted on the left side of ahighway designated for one-way traffic, no personshall park or stop any vehicle on the left side of thehighway or portion thereof except as follows:

(a) Where there is a raised curb, on the roadway,having regard to the direction such vehicle wasproceeding, with its left front and rear wheelsparallel to and not more than 30.0 centimetresout from such curb;

(b) Where there is no curb or rolled curb, with theleft front and rear wheels parallel to and asnear to the left limit of the highway as ispracticable without stopping or parking over asidewalk or footpath or over any part of thehighway where grass is grown or which is notintended for the use of vehicles.

(6) No person shall, without specific authorization fromthe municipality, park any vehicle on any boulevard.

This prohibition does not apply to any motor vehicleparked in the driveway of a single-family residentialdwelling where such a driveway leads to an attachedgarage, carport, rear yard parking stall, or front orside yard parking pad that has been authorized bythe municipality. [Added 2001-06-01 by By-LawNo. 366-2001]

(7) Despite the provisions of Subsections A(1) and A(5),a motorcycle may be parked at an angle, providedthat no person shall park a motorcycle at an angleless than 45° or greater than 60° to the curb.[Added 2005-10-28 by By-Law No. 935-2005;amended 2007-06-22 by By-Law No. 658-2007]

B. No person shall on any highway stop any vehicle:

(1) On or over a sidewalk or footpath;

(2) Within an intersection or pedestrian crossover,excluding tee-type intersections;

(3) Within 9.0 metres of a pedestrian crossover;

(4) Between a safety zone and the adjacent side of theroadway or within 15.0 metres of the points on suchside opposite the ends of the safety zone;

(5) A l o n gside or acros s t h e h i g h w a y f r o m a n yexcavation or obstruction in the roadway when thefree flow of traffic would thereby be impeded;

(6) On the roadway side of any stopped or parkedvehicle;

(7) Upon any bridge or elevated structure or within any tunnel or underpass;

(8) On any middle boulevard or centre strip separating two (2) roadways or adjacent to either side or ends of such middle boulevard or centre strip;

(9) Within a school bus loading zone, unless that vehicle is a school bus as defined in the Highway Traffic Act.

C. Sales from vehicles.

(1) No person who sells, offers for sale or takes orders for goods, wares, merchandise, produce, refreshments, beverages or other food from a vehicle shall, for the purpose of carrying on business, stop the vehicle on any part of the highway lying between two (2) intersecting highways for more than three (3) hours of any day or for more than one (1) hour within the said three-hour period at any one (1) location;

(2) Nothing in this section shall be deemed to permit the stopping or parking of a vehicle where stopping or parking is prohibited.

D. No person shall on any highway park any vehicle:

(1) In front of or within sixty and zero-tenths (60.0) centimetres of a driveway or laneway or so as to obstruct vehicles in the use of a driveway or laneway;

(2) Within three and zero-tenths (3.0) metres of a point on the curb or edge of the roadway opposite any fire hydrant;

(3) Within nine and zero-tenths (9.0) metres of an intersecting roadway;

(4) Alongside or within fifteen and zero-tenths (15.0) metres of the face of a rail or any level crossing of a railway other than a street railway;

(5) For a period longer than three (3) hours;

(6) For the purpose of displaying the vehicle for sale;

(7) For the purpose of washing, greasing or repairing the vehicle, except for such repairs as have been necessitated by an emergency;

(8) In such position as will prevent the removal of any other vehicle previously parked.

E. Loading zones.

(1) No person shall park any vehicle on a highway at a place marked by an authorized sign as a passenger or freight loading zone during the time shown on such sign;

(2) Signs referred to in Subsection E(1) shall not be displayed except with the approval of the Council of the City of Etobicoke.

F. Width of vehicles.

(1) The highways set out in Column 1 of Schedule III to this Article, between the limits set out in Column 2 of said schedule, are hereby designated pursuant to R.S.O. 1990, c. M.45, s. 210, par. 128, of the Municipal Act, and no person shall drive a vehicle therein having a greater width than that set out in Column 3 of said schedule.4

(2) Each designation made hereunder shall be effective upon the erection of authorized signs at each entrance to the highway indicating the limitations on the width of vehicle permitted on the highway.

G. Where official signs to that effect are displayed, no person shall on any highway park any vehicle:

(1) Within fifteen and zero-tenths (15.0) metres of an intersection;

(2) Within thirty and five-tenths (30.5) metres of an intersection controlled by traffic control signals;

(3) In front of an entrance to or exit from any building or enclosed space in which persons may be expected to congregate in large numbers;

(4) Within seven and five-tenths (7.5) metres of any Fire Hall on the side of the highway on which the Fire Hall is located or within thirty and five-tenths (30.5) metres of such Fire Hall on the opposite side of the highway;

(5) Within the following distance of a crosswalk controlled by traffic control signals and located other than at an intersection:

(a) Fifteen and zero-tenths (15.0) metres of the crosswalk measured on each side of the highway in the direction of travel of vehicles on that side of the highway; and

(b) Thirty and five-tenths (30.5) metres of the crosswalk measured on each side of the highway in the direction opposite to the direction of travel of vehicles on that side of the highway;

(6) Within a turning basin;

(7) So as to interfere with the formation of a funeral procession;

(8) Within fifteen and zero-tenths (15.0) metres of the termination of a dead-end street;

(9) Within a tee-type intersection.

(10) On a public lane.

H. Where official signs to that effect are displayed, no person shall on any highway stand a vehicle within a transit stop zone.

0 240-G. Stands for taxi-cabs.

A. Use.

(1) No person shall park a taxi-cab, while waiting for hire or engagement, on any highway except at a stand authorized and assigned for taxi-cabs by 9 240~8B and marked as a taxi-cab stand by an authorized sign;

(2) No person shall stand a vehicle, other than a taxi- cab waiting for hire or engagement, at any location referred to in Subsection A(1) and marked as a taxi- cab stand by an authorized sign.

B. Stands for taxi-cabs are hereby authorized and assigned on the highways at the sides and at the locations set out respectively in Columns 1, 2 and 3 of Schedule IV to this Article for the number of taxi-cabs set out in Column 4 of said schedule, for use between the hours set out in Column 5 of said schedule.5

C. For the purpose of Subsection A(2) and Subsection B of this section, “taxi-cab” means a cab, the owner of which is licensed by the Metropolitan Licensing Commission under a by-law enacted by the Metropolitan Council pursuant to R.S.O. 1990, c. M.45, s, 232, par. l(b), of the Municipal Act.

2and 2 of Schedule V to this article are hereby set aside anddesignated as safety zones within the meaning of R.S.O. 1990, c.H.8, s. 166, of the Highway Traffic Act.

§ 240-10. Prohibited pedestrian crossing.

Where an official sign to that effect is displayed, nopedestrian shall enter on or cross the roadway of the highwaysset out in Column 1 of Schedule VI to this article at the

3locations set out in Column 2 of said schedule.

§ 240-11. P rmitted angle parking. [Amended 2005-10-28eby By-Law No. 935-2005]

Angle parking in accordance with the provisions of §§ 240-7A(3), 240-7A(3.1) and 240-7A(4) is permitted on the

highways at the sides and between the limits set outrespectively in Columns 1, 2 and 3 of Schedule VII to this

4article.

§ 240-12. Stopping, standing and parking restrictionsand prohibitions on certain highways.

A. Where official signs to that effect are displayed, noperson shall park a vehicle on any highway at the sideand between the limits set out respectively in Columns1, 2 and 3 of Schedule VIII to this article during the

prohibited times or days set out in Column 4 of said5schedule.

B. Where official signs to that effect are displayed, noperson shall stop a vehicle on any highway at the sideand between the limits set out respectively in Columns1, 2 and 3 of Schedule IX to this article during theprohibited times or days set out in Column 4 of said

6schedule, provided that this subsection shall not bedeemed to prohibit a taxicab from stopping whileactually engaged in loading or unloading passengers onany highway.

C. Limited time parking.

(1) Where official signs to that effect are displayed, noperson shall park a vehicle on any highway at theside and between the limits set out respectively inColumns 1, 2 and 3 of Schedule X to this articleduring the times or days set out in Column 4 of theschedule for a longer period than that set out in

7Column 5 of said schedule.

(2) Nothing in this section shall be deemed to permitparking at any location where or at any time whenparking is otherwise prohibited.

D. Where official signs to that effect are displayed, noperson shall stand a vehicle on any highway at the sideand between the limits set out respectively in Columns1, 2 and 3 of Schedule XI to this article during theprohibited times or days set out in Column 4 of said

§ 240-13. One-way traffic.

A. The highways set out in Column 1 of Schedule XII to thisarticle between the limits set out in Column 2 of saidschedule, during the times or days set out in Column 3 ofsaid schedule, are hereby designated for one-way trafficonly in the direction set out in Column 4 of said

B. The highways set out in Column 1 of Schedule XIII tothis article, having been divided into clearly markedlanes for traffic between the limits set out in Column 2 of

said schedule, each of said lanes indicated in Column 3 of said schedule, during the times or days set out in Column 4 of said schedule, are hereby designated for traffic moving in the particular direction set out in Column 5 of said schedule.s

C. Each designation made under Subsection A and B shall be effective upon the erection of official signs indicating such designation.

0 240-14. Left turn only lanes. A. The highways set out in Column 1 of Schedule XIV of

this Article, having been divided into clearly marked lanes for traffic between the limits set out in Column 2 of said Schedule,8 the centre lanes of which are hereby designated for left turns only.

B. Each designation made under Subsection A hereof shall be effective upon the erection of official signs indicating such designation.

0 240-15. ‘lhrning movements.

A. When an official sign to that effect is displayed, no person shall in any intersection or portion of highway set out in Column 1 of Schedule XV of this Article, while proceeding in the direction or emerging from a property set out in Column 2 of said schedule, turn a vehicle in the direction set out in Column 3 of said schedule, during the times or days set out in Column 4 of said schedule.8

B. When an official sign to the effect is displayed, no person operating a vehicle shall upon entering a highway set out in Column 1 of Schedule XVI of this Article from a highway set out in Column 2 of said schedule proceed

across the highway set out in said Column 1 into the road set out in Column 3 of said schedule.9

0 240-16. Entry prohibited.

Where official signs to that effect are displayed, no person operating a vehicle shall enter the highway or roadway set out in Column 1 of Schedule XVII to this Article from the highway or roadway set out in Column 2 of said schedule during the times or days set out in Column 3 of said schedule.g

0 240-17. Through highways, stop signs and yield signs.

A. Through highways.

(1) The highways set out in Column 1 of Schedule XVIII to this Article between the limits set out in Column 2 of said Schedule,g except as provided in Subsection A(2) of this section, are hereby designated as through highways for the purposes of the Highway Traffic Act.

(2) The designation in Subsection A(1) of this section of a highway or portion of highway as a through highway shall not include any intersection therein where the highway intersected is a King’s Highway or where traffic control signals are installed.

B. The erection of stop signs is hereby authorized at each of the intersections set out in Column 1 of Schedule XIX of this Article for the control of traffic entering the intersection from the highway or portion of highway set out in Column 2 of said schedule.g

C. The erection of yield signs is hereby authorized at each of the intersections set out in Column 1 of Schedule XXII of this Article for the control of traffic entering the

intersection from the highway or portion of highway set out in Column 2 of said schedule.‘O

0 240-18. Heavy vehicles.

A. Except as provided in Subsection B, when official signs to that effect are displayed, no person shall move, drive, park or operate a heavy truck on the highways set out in Column 1 of Schedule XX to this Article between the limits set out in Column 2 of said schedule during the times or days set out in Column 3 of said schedule.1°

B. Subsection A shall not apply to any vehicle actually engaged in making a delivery to, a collection from or providing a service to premises which cannot be reached except by way of a highway or a portion of highway referred to in said section or to prohibit the use of such vehicles for such purpose, provided that in making such delivery, collection or providing the service, said highway or portion of highway is travelled only insofar as is unavoidable in getting to and from such premises.

0 240-19. Loads and speeds on bridges.

A. When official signs to that effect are displayed, no person shall drive, move or operate any vehicle over any bridge, set out in Column 1 of Schedule XXI to this Article that exceeds the gross weight prescribed for such bridge in Column 2 of said schedule.1°

0 240-20. Issuance of permits, exemptions, applicability.

A. The Director of Traffic, Transportation and Development Engineering is hereby appointed as the officer of the City of Etobicoke to issue permits on behalf of the municipality under R.S.O. 1990, c. H.8, s. 110, of the Highway Traffic Act or any amendment or reenactment thereof.

B. This Article applies only to roads under the jurisdiction of the City of Etobicoke.

C. Sections 240-3D and E, §Q 240-7A, B and D through H, § 240-8A and 00 240-12A through D shall not, if compliance therewith would be impracticable, apply to:

(1) Ambulances, police or fire department vehicles or public utility emergency vehicles; or

(2) Vehicles actually engaged in works undertaken for or on behalf of the City of Etobicoke or any municipal corporation or the Toronto Transit Commission.

D. The schedules referred to in this Article shall form part of this Article, and each entry in a column of such a schedule shall be read in conjunction with the entry or entries across therefrom and not otherwise.

A. Any person who contravenes any of the provisions of this Article is guilty of an offence and, pursuant to the Provincial Offences Act, R.S.O. 1990, as amended, on

conviction is liable to a penalty not exceeding $5,000 foreach offence;

B. The owner of a vehicle may be charged with andconvicted of a parking offence under this article forwhich the driver of the vehicle is subject to be chargedunless, at the time of the offence, the vehicle was in thepossession of some person other than the owner withoutthe owner’s consent, and, on conviction, the owner isliable to the penalty prescribed or provided therefor.

A police officer, police cadet, municipal law enforcementofficer, constable or an officer appointed for the carryingout of the provisions of the Highway Traffic Act ofOntario, upon discovery of any vehicle parked or left incontravention of this article, may cause it to be moved ortaken to and placed or stored in a suitable place and allcosts and charges for removing, care and storage thereof,if any, are a lien upon the vehicle which may be enforcedin the manner provided by the Repair and Storage LiensAct, R.S.O. 1990, as amended.

ARTICLE VI1 Bicycle Lanes

§ 240-35. Definitions; interpretations.

In this article, any terms or definitions used, other than those specified in 0 240-35A, shall conform to the definitions specified in the Highway Traffic Act.

A. As used in this article, the following terms shall have the meanings indicated:

AUTHORIZED SIGN - Any sign or roadway, curb or sidewalk marking or other device placed or erected on a highway under the authority of this article.

BICYCLE - Includes a tricycle having a wheel or wheels of more than 61.0 centimetres in diameter.

DIRECTOR - The Director of the Transportation and Engineering Planning Division of the Works Department in the City of Etobicoke.

TIRE SIZE - For the purpose of this article:

(1) Where visible, the size as stamped by the tire manufacturer on the outside edge of one side of the rubber tire; or

(2) Where no size stamped on the outside wall of the rubber tire is visible, then the diameter of the tire, as measured from the outside edge of one side of the rubber tire (mounted on a metal or other rim) straight across to the opposite outside edge of the same tire.

§ 240-36. Traffic signs and signals.

A. The Director is authorized to place or erect and to maintain such authorized signs and traffic control signals as are required to give effect to the provisions of this article or as are required to warn or guide traffic for the safety or convenience of the public.

B. Except as provided in Subsection A, no person shall place, maintain or display upon or in view of any highway any sign, signal, marking or device which purports to be or is an imitation of or resembles an authorized sign or traffic control signal, or which conceals from view or interferes with the effectiveness of an authorized sign or traffic control signal.

§ 240-37. Traffic regulation by police.

The lawful directions of a police officer for the regulation of traffic on a road shall be obeyed notwithstanding any provisions of this article, and nothing in this article shall affect the powers to regulate traffic held by the Metropolitan Toronto Police Service.

0 240-38. Lane designated principally for use of bicycles.

A. Where authorized signs to that effect are displayed, no person shall operate a vehicle other than a bicycle in any

lane or portion of lane designated under 0 240-41, Schedule A, except:

(1) For the purpose of ingress to or egress from a private lane or driveway adjacent to the designated lane.

(2) For the purpose of making a turn at a highway intersecting the designated lane.

(3) For the purpose of entering or exiting a curb lane used for parking.

(4) For the purpose of actually being engaged in the loading or unloading of disabled persons as defined in the Highway Traffic Act and its regulations.2

B. A person operating a vehicle in a designated lane for the purposes set out in Subsection A(l), (21, (3) and (4) shall not operate the vehicle in the lane for a distance exceeding 45 metres.

§ 240-39. Exemptions.

Section 0 240-38 shall not, if compliance therewith would be impracticable, apply to:

A. Ambulances, police or fire department vehicles or public utility emergency vehicles.

B. Public transit motor vehicles owned and operated by the Toronto Transit Commission as part of its regular public transportation service.

C. Vehicles actually engaged in works undertaken for or on behalf of the City of Etobicoke or any municipal corporation.

§ 240-40. Locations.

The lanes or portions of lanes on Etobicoke highways set outin Schedule A, Column 1, of this article, at the side and locationset out in Column 2 and between the limits set out in Column 3,are designated as lanes principally for the use of bicycles.
