TRADEMARKS(AMENDMENT)REGULATIONS2011

Preamble

INexerciseofthepowersconferredbysection83oftheTradeMarksAct1976[Act175],theMinistermakesthefollowingregulations:

1. CitationandCommencement

(1)TheseregulationsmaybecitedastheTradeMarks(Amendment)Regulations2011.

(2)TheseRegulationscomeintooperationon15February2011.

2. AmendmentofRegulation8

The TradeMarks Regulations 1997[P.U. (A) 460/1997], which are referred to as the"principalRegulations"intheseRegulations,areamendedbysubstitutingforregulation8thefollowingregulation:

"8.Filingandserviceofdocumentsandthings.

(1)AnydocumentorthingrequiredorauthorizedbytheActortheseRegulationstobefiled,shallbedeliveredbyhandtotheOfficeduringitsnormalbusinesshoursorsenttotheRegistrarbypost.

(2)Sendingbypostshallbedeemedtobeeffectedbyproperlyaddressing,preparingandpostingalettercontainingthedocumentorthing,withtheprepaidpostageonit,totheRegistrarattheOfficeandthedocumentorthingshallbedeemedtohavebeenreceivedatthetimewhenthedocumentorthingisactuallyreceivedattheOffice.

(3)ThefilingofadocumentorthingwiththeOfficeshallbedeemedtobeeffectedatsuchtimeasitisreceivedattheOfficeandisrecordedasreceived.".

3. NewRegulations8Aand8B

The principal Regulations are amended by inserting after regulation 8 the followingregulations:

"8A.Electronicfilingofdocumentsandthings.

(1)TheRegistrarmayprovideaservicefortheelectronicfilingofthedocumentorthingrequiredorauthorizedbytheActortheseRegulationstobefiledattheOffice.

(2)Apersonwhointendstousetheserviceprovidedundersubregulation(1)shallcomplywith the termsandconditionsasmaybespecifiedby theRegistrar,eithergenerally by notice published in the officialwebsite or, in any particular case, bynotice,includingthroughelectronicmeans,tothepersondesiringtousesuchservice.

(3)Adocumentorthingwhichiselectronicallyfiledunderthisregulationshallbedeemed to be effected at such time as that document or thing is accepted by theelectronicfilingsystem.

(4) Where any accompanying document or thing is not capable of being filedelectronically,suchaccompanyingdocumentorthingmaybedeliveredorsenttotheRegistrarinthemannerspecifiedinregulation8,subjecttosuchtermsandconditionsastheRegistrarmayspecify.

8B.Termsandconditionsforelectronicfiling.

(1)Withoutlimitingthegeneralityofsubregulation8A(2),thetermsandconditionsforelectronicfilingshallincludethefollowing:

(a)theproceduretobecompliedwithfortheelectronicfilingofdocumentsandthings;

(b) the formatormedia inwhichadocumentor thing is tobe recordedorstoredforpurposesofelectronicfiling;

(c)themannerofauthenticatingadocumentorthingwhichisrequiredtobestamped, signed, sealedor certified, including the requirement for adigitalsignatureofthepersonfilingthedocumentorthing;and

(d) theactions tobe taken in theeventofan interruption in theprocessofperforminganelectronicfiling.

(2)Notwithstandingregulation8A,theRegistrarmayrefusetoacceptortoregisteranydocumentorthingwhichisfiledelectronicallyif‐

(a) the information contained in such document or thing is not capable ofbeingdisplayedinalegibleform;

(b) theelectronic recordof suchdocumentor thing isnot capableofbeingstoredintheelectronicfilingsystem;

(c)theelectronicrecordofsuchdocumentorthingappearstotheRegistrartobealtered,damaged,incompleteorforged;or

(d)anyofthetermsorconditionsonelectronicfilingspecifiedbytheRegistrarisnotcompliedwith.".

4. AmendmentofRegulation12

Paragraph12(3)(d)oftheprincipalRegulationsisamendedbysubstitutingforthewords"sevenyears"thewords"threeyears".

5. AmendmentofRegulation17

Subregulation17(1)oftheprincipalRegulationsisamendedbysubstitutingforthewords"section11"thewords"section10".

6. NewRegulation18A

The principal Regulations are amended by inserting after regulation 18 the followingregulations:

"18A.Expeditedexamination.

(1)Anapplicantwhoappliesorhasappliedfortheregistrationofatrademarkunderregulation18mayrequesttheRegistrartoundertakeanexpeditedexaminationoftheapplicationwithinfourmonthsfromthedateoffilingoftheapplication.

(2)ArequestforexpeditedexaminationshallbemadetotheRegistrarbyfilingFormTM5A,andshallbeaccompaniedwith‐

(a) a statutorydeclaration stating the reasons for requesting theexpeditedexamination;and

(b)theprescribedfee.

(3)Ifanapplicanthasrequestedforanexpeditedexamination,theRegistrarmaydosoiftheRegistrarisreasonablysatisfiedthat‐

(a)therequestisinthenationalorpublicinterest;

(b) there are infringement proceedings taking place or evidence showingpotential infringement in respect of the trade mark applied for underregulation18;

(c)registrationofthetrademarkisaconditiontoobtainmonetarybenefitsfromtheGovernmentorinstitutionsrecognisedbytheRegistrar;or

(d)thereareotherreasonablegroundswhichsupporttherequest.

(4)TheRegistrar shallnotify theapplicant inwriting,as soonaspracticableaftermakinghisdecision,whethertheexpeditedexaminationshallbeconductedornot.

(5) If the Registrar is satisfied that a request for an expedited examination iswarranted,theapplicantshall,withinfiveworkingdaysfromthedateofreceiptoftheRegistrar'sdecisioninsubregulation(4),fileFormTM5Bandpaytheprescribedfee.

(6)Eachrequestundersubregulation(1)shallbeinrespectofgoodsorservicesinonlyoneclassintheThirdScheduleandapplicationsfortheregistrationofthesamemarkindifferentclassesshallbetreatedasseparateanddistinctapplications.".

7. AmendmentofRegulation22

Regulation22oftheprincipalRegulationsisamendedbysubstitutingregulation22withthefollowingregulation:

"22.Seriesoftrademarks.

Whereanapplicationismadefortheregistrationofaseriesoftrademarksundersection24oftheAct‐

(a) a representation of each mark of the series shall be affixed to theapplicationforminaccordancewithregulation19;and

(b) if the application contains three trade marks or more, the third andsubsequentmarksshallbesubjecttothepaymentoftheprescribedfee.".

8. AmendmentofRegulation27

Regulation27oftheprincipalRegulationsisamendedbyinsertingaftersubregulation(3)thefollowingsubregulation:

"(4)Anapplicationforhearingundersubregulation(3)shallbemadebyfilingFormTM9Aandshallbeaccompaniedwiththeprescribedfee.".

9. AmendmentofRegulation28

Regulation28oftheprincipalRegulationsisamendedbyinsertingaftersubregulation(4)thefollowingsubregulation:

"(5)Anapplicationforhearingundersubregulation(4)shallbemadebyfilingFormTM9Aandshallbeaccompaniedwiththeprescribedfee.".

10. AmendmentofRegulation33

Subregulation33(2)oftheprincipalRegulationsisamended‐

(a)bysubstitutingforthewords"FormTM29"thewords"FormTM31";and

(b)bysubstitutingforthewords"Registrarshallnotify"thewords"Registrarshallgivewrittennoticeto".

11. AmendmentofRegulation64
