Ngā Mana Whenua o Tāmaki Makaurau Collective Redress Act 2014
109 Functions and powers (1) The Maunga Authority has the powers and functions conferred on it by or under
this Act or any other enactment. (2) In exercising its powers and carrying out its functions in relation to the maunga,
the Maunga Authority must have regard to— (a) the spiritual, ancestral, cultural, customary, and historical significance of
the maunga to Ngā Mana Whenua o Tāmaki Makaurau; and (b) section 41(2).
(3) In exercising its powers and carrying out its functions in relation to the adminis-tered lands, the Maunga Authority must have regard to the spiritual, ancestral, cultural, customary, and historical significance of the administered lands to Ngā Mana Whenua o Tāmaki Makaurau. [Emphasis added]
41 Maunga must remain as reserves vested in trustee (1) This section applies to each maunga once the maunga is—
(a) vested in the trustee under subpart 1, 2, or 3 of this Part; and (b) declared a reserve under any of sections 18 to 29, 33, and 39.
(2) The maunga is held by the trustee for the common benefit of Ngā Mana Whenua o Tāmaki Makaurau and the other people of Auckland. … [Emphasis added]

4. Pakuranga Tennis Club Incorporated Lease
Moved: H Rawiri, Seconded: K Parkinson, That the Tūpuna Maunga o Tāmaki Makaurau Authority a. resolves to publicly notify pursuant to s119 of the Reserves Act 1977 an inten-
tion to grant a lease to the Pakuranga Tennis Club Incorporated for a term begin-ning at the expiry of their present lease and ending on 30 June 2019 with a right of renewal of a further one year until 30 June 2020. This resolution is made to meet the directives within the Tūpuna Maunga o Tāmaki Makaurau Integrated Management Plan and aligns with the values and pathways set out in the Plan. The intention is to place the health and well-being of the Tūpuna Maunga at the heart of this decision.
b. recognises there may be submissions, in response to the public notice, and a hearing pursuant to s120 of the Reserves Act 1977;
c. delegates to the Chair and Deputy Chair the power to execute a lease, including a Maunga Outcomes Plan, with the Pakuranga Tennis Club Incorporated on the standard terms and conditions. The Chair and Deputy Chair are delegated to confirm a lease rental (being a market rental as determined by a registered valuer with due consideration for any contribution to the health and wellbeing of the Tūpuna Maunga) ; and
d. delegates to the Chair and Deputy Chair the power to agree to terms governing the withdrawal of the Pakuranga Tennis Club should the Club decide not to ac-cept the lease.

a term beginning at the expiry of their present lease and ending on 30 June 2019 with a right of renewal by the Trust of a further one year until 30 June 2020. This resolution is made to meet the directives within the Tūpuna Maunga o Tāmaki Makaurau Integrated Management Plan and aligns with the values and pathways set out in the Plan. The intention is to place the health and well-being of the Tūpuna Maunga at the heart of this decision.

7 Auckland Kindergarten Association Lease
8 Northern Sports Car Club Incorporated Lease Renewal
Moved: Deputy Chair A Filipaina, Seconded: K Wilson, That the Tūpuna Maunga o Tāmaki Makaurau Authority a. resolves to grant a lease to the Auckland Kindergarten Association Incorporated
(AKA) for a term beginning at the expiry of their present lease and ending on 30 June 2019 with a right of renewal by AKA of a further one year until 30 June 2020. This resolution is made to meet the directives within the Tūpuna Maunga o Tāmaki Makaurau Integrated Management Plan and aligns with the values and pathways set out in the Plan. The intention is to place the health and well-being of the Tūpuna Maunga at the heart of this decision.
b. delegates to the Chair and Deputy Chair the power to execute a lease with the Auckland Kindergarten Association at a market rental (to be determined by a reg-istered valuer), including a Maunga Outcomes Plan, and otherwise on the stand-ard terms and conditions. The Chair and Deputy Chair are delegated to confirm a lease rental (being a market rental as determined by a registered valuer with due consideration for any contribution to the health and well-being of the Tūpuna Maunga).
c delegates to the Chair and Deputy Chair the power to negotiate transition terms if the Auckland Kindergarten Association Incorporated decides not to accept the lease.

Cyclist had a near miss with the exit chain while biking down the Clive Road exit.
2 There are 2 reflective sleeves that cover most of this chain when it is up.
The sleeves are regularly checked to ensure they are in working condition.
Management are looking at options to slow cyclists down when they are riding downhill

Maungakiekie
Reported that an assault took place up near the tihi on the 14th of June at midday. It was reported by the police that it was an attempted aggravated robbery and two couples were involved.
Police are currently working on the case.
Cornwall Park Trust informed of incident, however there has been no contact with Cornwall Park Trust from the Police.
On-going prompt communica-tion between police and the Tūpuna Maunga team for fu-ture incidents.
Police informed of connecting with Cornwall Park Trust around accessing entrance way camera footage.
Police are investigating and victim has been spoken to by Tupuna Maunga team. On-going correspondence with Police, Cornwall Park Trust
and the victim until the case is resolved.

Bare footed visitor identified rusty spike of an old waratah (redundant and partially re-moved farming infrastructure) poking approximately 6cm out of the ground at the point near a track as a puncture wound hazard for walkers.

Cyclist did not see exit chain that was still up at the Clive Rd carpark exit. (5.45 am) They rode into the chain causing damage to himself and his bicycle.
1 Staff assessed the chain and worked with our contractor to find a better solution.
Reflective tape on the chain gets worn out periodically from being dragged across the road during gate lock/un-locks.
Re-applied high visibility tape across this chain. Mainte-
nance contractors will monitor the chain and re-apply as re-
quired. Hi visibility chain sleeves will also be put on.

While walking near the ar-chery club a visitors foot fell into a small sunken hole that was covered by kikuyu
1 Contractors located the hole and filled it in. Hole has been filled.
Hui 26 Puketāpapa
Quarry face exposed follow-ing removal of weedy vegeta-tion that was blocking views from the carpark below the tihi.

A section of mesh fence was put up and flax were planted previously to create a barrier for people.
Increased current fall risk as more weed trees were re-moved, the natural barrier was also being removed
Additional temporary fencing installed
Hui 25 Otahuhu Large pine tree fell across ring road leaving a hanging branch on a nearby tree

Aborist and contractors re-sponded within 2 hours to tape off the area and made the area safe by removing the branch and cleared the debris blocking the road.

Hui 25 Maungawhau Received feedback that some visitors have been seen slip-ping on sections of badly eroded track.
2 Exposed roots and pipes are spray painted to make visitors aware of the hazard.

Dangerous tree reported by staff near track after recent storm event. Track was used by pedestrians to access the tihi.

Had arborist inspect the tree for safety, recommended maintenance work to be car-ried out to ensure safety of public. Area has been cor-doned off to restrict access.

Management received a fire report relating to the Bunker on Takarunga. The report identified a number of issues with the building that needed to be addressed to ensure

A young male injured his foot when a spike from an old warratah post went through his shoe.

Management have located the section of track where this oc-curred and have laid matting down to prevent further inju-ries. Physical work to upgrade this track begins in late March.
Potential risk to visitors ac-cessing the maunga.
Spike buried in ground again and covered over by matting. This section of track will be re-routed in the track up-
grade.
Hui 22 Takarunga
Concerns raised by man-agement regarding the fire place in the Bunker. The fire is used to heat and keep the building dry during the winter months. Concerns were raised when the guard on the chimney heated up when the fire was in use, potentially resulting in members of the public burning themselves.

Management spoke to the Bunker operators and asked that not more fires be lit until we have completed a safety & fire inspection.
Potential risk to visitors touch-ing the chimney guard and risk to guests of the Bunker
Safety and fire inspection has been actioned to review all
aspects of the Bunker opera-tions in regards to fire and
associated risks.
Hui 20 Otahuhu
Complaint received regarding an injury received (twisted ankle) due to the lack of sport field lighting on the training field on Otahuhu.

The field is a ‘soil field’ which means it is unsuitable to be used outside daylight hours. There are currently no lights installed. The arrangement with the sports club is that they book hours during which the field will be used – in this case the field was being used out-side the ‘bookable hours’.
One injury (twisted ankle) has been reported with the poten-tial for further accidents if the field is continued to be used after hours.
Management will meet with the Otahuhu League Club to discuss the use of the field in the evenings and health and safety obligations. The club are responsible for ensuring their members use the field within the specified limits.

Male forced into vehicle and driven to Mt Roskill where he was robbed and shot in the leg.
The incident occurred within gate opening times.

Management have reviewed the Police information and will wait for the Police investigation to be completed.
Management assessment is that this was a rare and iso-lated incident. There is little further we can do to prevent such behaviour however we will review this with NZ Police.

Hui 20 Mt Roskill
Male taxi driver assaulted in the lower car park of Mt Ros-kill. Incident occurred within park opening times.
1 Taxi driver admitted to hospital, NZ Police are investigating the incident.
Management assessment is that this was a rare and iso-lated incident. There is little further we can do to prevent such incidents however we will review this with NZ Police.

Hui 19 Maungakiekie Pedestrian and vehicle relat-ed incident on the access road to the tihi

The road alignment and lack of footpaths to the tihi has result-ed in the potential risk to pe-destrians walking to the tihi. The road is increasingly popu-lar for walkers and runners and will increase due to the plant-ing of the trees.
Potential health & safety risk to pedestrians.
Have reviewed speed signs and will install a shared sign
to indicate to drivers the need to comply with speed limits
and other users. .
Hui 19 Maungakiekie Visitor tripped on path and fell injuring himself 1
Staff assessed the area and path and although the path is in good condition there is a capacity issue with the number of visitors using this path dur-ing high use times.
Potential further issues relat-ing to the volume of traffic and design of the asset.
Hui19 Maungakiekie Pest control contractor felling into hole while undertaking a night shoot.

Request to consider fencing the area around the play-ground because of safety concerns for children playing near a busy road. Note there has not been any recorded incident relating to this re-quest.

There are no specifications regarding the installation of fences around playgrounds. Advice received is if the play-ground is within 5 meters of a road, fencing should be con-sidered. The Maungawhau playground is positioned on average 10 metres from the road. The assessment consid-ered the location and provided the following recommendation:
The play space is located well back from the road (average 10m) and there is planting, a footpath and a low post and rail fence between the playground and the road; all providing a sense of enclosure for the play space.

Management have discussed the issue with the resident and adjusted the mowing schedule to delay the mowing around the site until later in the morning.

Ōwāiraka Vandalism Toilet on Ōwāiraka was set fire and caused extensive damage to one cubicle and fire damage to the exterior of the building and second cubicle.
NZ Fire Service was notified and extin-guished the fire; NZ Police were also noti-fied of the incident. Toilet has been closed and repairs are due to be completed by October 2016. Port-a-loos have been placed in car park to cater for visitors.

The automatic entry/exit gate was dam-aged (mechanical ram was broken off at the weld), and at the same time the gate to the tunnels at the summit was dam-aged (padlock cage and padlock broken off).
The entry/exit gate is being manually locked while it's being fixed. The padlock on the gate to the tunnels has been re-placed.

Cyclist speed Numerous complaints have been re-ceived about the speed of cyclists on Maungawhau, in particular their failure to adhere to speed restrictions and stop signs.
Addressed the speed issue near the bus car park by placing additional signs and installing speed humps at the stop sign. Engaging with AT on speed calming measures (such as shared spaces) in the context of vehicle restrictions from the tihi of Maungawhau as well as cycleways on the maunga more generally.

Tennis court fenc-ing
Question received regarding the re-placement program for the tennis court fencing; concern expressed that this should be addressed earlier than planned. Individual expressed a desire to look at fundraising through the local board or community to address the is-sue.
Staff spoke to the individual and explained the asset renewal programme in place and the current prioritisation system.
Public expectation regarding asset renewal will be an on-going challenge. Staff will continue to explain this to members of the public while taking their feedback on board.
