NOTICE OF EXAMINATION (SITE VISIT) AND PUBLIC HEARING FOR CONSIDERATION OF RECLASSIFICATION OF DANA HILL ROAD

The Waitsfield Selectboard, on its own motion on June 11, 2018, voted to consider reclassifying a section of Dana Hill Road (TH#29)1 from a Class 4 Town road to a legally established trail. The Class 4 section of Dana Hill Road is approximately 1.8 miles in length and begins approximately 300' from Vermont Route 17. The section of Dana Hill Road that connected to Butternut Hill Road was reclassified as a trail in 1973; the road dead-ends at this time. The Selectboard is required by Title 19 of Vermont law to hold an examination, or site visit, 2 and a public hearing when considering the reclassification of a road. Notice of the site visit and hearing will be by certified mail to those persons owning or interested in lands through which the road passes or abuts.3 Additional public notice will be provided in accordance with Title 19 of Vermont statute. The site visit and hearing notice will also appear in the June 28, 2018 edition of the Valley Reporter newspaper. The site visit will be held on Wednesday, July 18, 2018, at 4:30 p.m., with a rain date of July 19, 2018, at 4:30 p.m. Due to the limited availability of parking on Dana Hill Road, the site visit will formally begin at the Town Offices (4144 Main Street). No discussion of reclassification is scheduled to occur at the Town Offices; the goal is to facilitate parking and ride sharing. The site visit will begin, in earnest, once the Selectboard arrives at the top of the first hill connecting Dana Hill Road to Vermont Route 17.4 Those wishing to attend and/or participate may also join the site visit on Dana Hill Road at the designated starting point. The site visit will likely require participants to walk substantial lengths of the road. Please let the Town know if transportation along the route, or other assistance, is required or desired. The public hearing will be held Monday, July 23, 2018, at 6:30 p.m. in the second floor conference room of the Town Offices (4144 Main Street). Following the close of the public hearing, the Selectboard will deliberate and discuss whether or not the reclassification of the Class 4 section of Dana Hill Road as a legally established trail is required by and for the, “public good, necessity, and convenience of the inhabitants.”5 Within 60 days of the close of the public hearing, the Selectboard is required to file a report with its findings and decision regarding reclassification. Discussion and deliberation is tentatively scheduled to occur at the Selectboard’s August 13th and 27th meetings. Additional meeting dates may be added, if necessary. Additional information will be available on the Town’s website (www.waitsfieldvt.us) or at the Town Offices, as will the minutes of any Selectboard site visits, hearings, or meetings.
