TOWN OF SEABROOK ISLAND DECLARATION OF STATE OF EMERGENCY

ISSUED MARCH 17, 2020 – 12:00 PM WHEREAS, in December 2019, an outbreak of respiratory illness due to a novel coronavirus (COVID–19), was first identified in Wuhan City, Hubei Province, China, and has spread outside of China, across the world, including the United States; and

WHEREAS, on January 23, 2020, the U.S Centers for Disease Control (“CDC”) activated its Emergency Response System to provide ongoing support for the response to COVID–19; and

WHEREAS, on March 13, 2020, President Donald Trump declared a national emergency to assist with combating the coronavirus, and

WHEREAS, on March 13, 2020, Governor Henry McMaster declared a state of emergency in the State of South Carolina, and

WHEREAS, the total number of cases in the United States now exceeds 3,800, with twenty-eight positive cases in the State of South Carolina and an additional seven cases being monitored by the South Carolina Department of Health and Environmental Control (“SCDHEC”) as of March 15, 2020; and

WHEREAS, SCDHEC has confirmed the localized person-to-person spread of COVID–19 in South Carolina, which indicates a significantly increasing risk of exposure and infection to residents of the Town of Seabrook Island and creating an extreme public health risk; and,

WHEREAS, the Town of Seabrook Island attracts visitors from all over the world, including Europe and Asia, and the number of confirmed COVID–19 cases in the United States is continuing to grow daily; and

WHEREAS, if COVID–19 spreads in the Town of Seabrook Island and Charleston County at a rate comparable to the rate of spread in other countries, the number of persons relying on medical, pharmaceutical, and general cleaning supplies will increase, the private and public sector work force will be negatively impacted by absenteeism, and the demand for medical facilities may exceed locally available resources; and

WHEREAS, it is imperative that the Town prepare for and be ready to respond to suspected and confirmed COVID–19 cases in the Town of Seabrook Island, to implement measures to mitigate the spread of COVID–19, and to prepare to respond to an increasing number of individuals requiring medical care, hospitalization, and medications; and

WHEREAS, by taking measures to control outbreaks minimizes the risk to the public, maintains the health and safety of the people of Seabrook Island, and limits the spread of infection in our communities and within the health care delivery system; and

WHEREAS, in order to protect, preserve, and promote the general health, safety and welfare and the peace and order of the community, the Town of Seabrook Island is promoting and advising safe practices for residents and visitors, consistent with CDC and SCDHEC guidelines, and is taking steps to try to protect the citizens and employees of the Town from increased risk of exposure; and

WHEREAS, the Town is authorized to undertake and coordinate all necessary and reasonable

activities for this emergency response, to take all appropriate action required to alleviate the effects of the COVID-19 public health emergency, including action following the guidelines of the CDC and SCDHEC, to aid in the delivery of essential public services, and to take any other lawful emergency response or action deemed necessary to protect the public health, safety and welfare of the Town of Seabrook Island;

NOW, THEREFORE, I, John Gregg, as Mayor of the Town of Seabrook Island, South Carolina, in consultation with the Town Council for the Town of Seabrook Island, and in furtherance of the public health, safety and welfare of residents and visitors to the Town, do hereby declare a state of emergency to exist in

the Town of Seabrook Island, effective immediately, and hereby invoke the provisions of Section 2-27 of the Town Code for the Town of Seabrook Island. This declaration shall remain in effect until repealed by the Mayor or a majority of Town Council.

As Municipal Judge, you may hear and determine all cases within the jurisdiction of municipal court under state law, including violations of municipal ordinances. Town Council has authorized the payment of Three Hundred and Fifty dollars ($350.00) per month to you as Chief Administrative Judge in order to compensate you for the responsibilities that you are undertaking. If due to conflict of interest or other reasons you must assign cases to another judge, you will be responsible for his or her compensation. MEMORANDUM

TO: Mayor Gregg and Members of Town Council

SUBJECT: Appointment of Code Enforcement Officers (Beach Patrol)

MEETING DATE: March 17, 2020

Council is asked to review and approve the appointment of the following individuals as Code Enforcement Officers of the town, effective April 1, 2020:

• Maxwell Kastenholz• Nicholas Larson (*)• Andrew Mappus (*)• Michael Sosnowski (*)• Malek Varner (*)• Alex Wall

Each of the above-named individuals are employed by Island Beach Services, LLC, d/b/a Barrier Island Ocean Rescue, which will provide beach patrol services to the town under Contract No. 2018-01. Contract No. 2018-01 was executed by the town and Island Beach Services on March 8, 2018. The original contract received two one-year extensions, to include the 2019 and 2020 beach patrol seasons.

Compared to 2019, the total number of days on which one or more beach patrol officers will be present will increase from 173 (2019) to 183 (2020). The 2020 contract will ensure daily coverage during the “peak” season, which runs from April 1st through September 30th. Beach patrol officers will be present on the following dates in 2020:

Of the 12 individuals recommended for appointment, 8 previously served as code enforcement officers during the 2018 and/or 2019 beach patrol seasons. The Beach Patrol contract stipulates the following:

“One or more of the Contractor’s employees will be designated by Town council as Code Enforcement Officers. At least one Code Enforcement Officer shall be present on the beach at all times. Such employees shall be responsible for informing beachgoers not observing the Town’s ordinance of their responsibility to do so, and for the issuance of citations in appropriate circumstances. Code Enforcement Officers shall be authorized to issue citations for violations of the Town’s beach ordinance, consistent with the written policies adopted by the Town and communicated to the Contractor from time to time.”

Further, Sec. 18-3 of the Town Code states:

“[T]he mayor, with the concurrence of the town council, may appoint such other code enforcement officers as is necessary for the proper security, general welfare and convenience of the town. All code enforcement officers shall have the power and authority set forth in S.C. Code 1976, § 5-7-32.”

Draft resolutions have been prepared for each individual. Upon appointment by the Mayor and Town Council, each code enforcement officer will be sworn in by the Mayor, or his designee, prior to commencing work on the beach during the 2020 beach patrol season. Staff Recommendation Staff recommends in favor of APPROVAL of the appointment of the above-named individuals as Code Enforcement Officers of the town. Respectfully submitted,

WHEREAS, the Seabrook Island Town Council, in the exercise of its general police power, is

empowered to protect the health and safety of residents and visitors of the Town; and

WHEREAS, the Seabrook Island Town Council is further authorized by Section 5-7-32 of the Code of Laws of South Carolina 1976, as amended, to appoint and commission as many Code Enforcement Officers as may be necessary for the proper security, general welfare, and convenience of the Town; and

WHEREAS, pursuant to Sec. 18-3 of the Town Code, the Mayor of the Town of Seabrook Island

has recommended the appointment of Ian Butler as a Code Enforcement Officer of the Town;

NOW, THEREFORE, BE IT RESOLVED that Ian Butler is hereby appointed and commissioned as a Code Enforcement Officer of the Town of Seabrook Island for the purpose of providing for the proper security, general welfare, and convenience of the Town, replete with all the powers and duties conferred by law upon constables, in addition to such duties as may be imposed upon him by the governing body of this Town, including the enforcement of the Town's beach regulations and restrictions, and the use of an ordinance summons, and with all the powers and duties conferred pursuant to the provisions of Section 5-7-32 of the Code of Laws of South Carolina 1976, as amended.

BE IT FURTHER RESOLVED that this appointment shall remain in effect until the earlier of 1)

December 31, 2020; 2) The termination of the contract between the Town of Seabrook Island and Island Beach Services, LLC, d/b/a Barrier Island Ocean Rescue, for the provision of Beach Patrol Services in the Town of Seabrook Island; or 3) at such time as Ian Butler is no longer employed by Island Beach Services, LLC, d/b/a Barrier Island Ocean Rescue, for the provision of Beach Patrol Services in the Town of Seabrook Island.

A RESOLUTION TO APPOINT AND COMMISSION ALEXANDER HUSS AS A CODE ENFORCEMENT OFFICER FOR THE PROPER SECURITY AND GENERAL WELFARE FOR THE TOWN OF SEABROOK

ISLAND

WHEREAS, the Seabrook Island Town Council, in the exercise of its general police power, is empowered to protect the health and safety of residents and visitors of the Town; and

WHEREAS, the Seabrook Island Town Council is further authorized by Section 5-7-32 of the Code of Laws of South Carolina 1976, as amended, to appoint and commission as many Code Enforcement Officers as may be necessary for the proper security, general welfare, and convenience of the Town; and

WHEREAS, pursuant to Sec. 18-3 of the Town Code, the Mayor of the Town of Seabrook Island

has recommended the appointment of Alexander Huss as a Code Enforcement Officer of the Town;

NOW, THEREFORE, BE IT RESOLVED that Alexander Huss is hereby appointed and commissioned as a Code Enforcement Officer of the Town of Seabrook Island for the purpose of providing for the proper security, general welfare, and convenience of the Town, replete with all the powers and duties conferred by law upon constables, in addition to such duties as may be imposed upon him by the governing body of this Town, including the enforcement of the Town's beach regulations and restrictions, and the use of an ordinance summons, and with all the powers and duties conferred pursuant to the provisions of Section 5-7-32 of the Code of Laws of South Carolina 1976, as amended.

BE IT FURTHER RESOLVED that this appointment shall remain in effect until the earlier of 1)

December 31, 2020; 2) The termination of the contract between the Town of Seabrook Island and Island Beach Services, LLC, d/b/a Barrier Island Ocean Rescue, for the provision of Beach Patrol Services in the Town of Seabrook Island; or 3) at such time as Alexander Huss is no longer employed by Island Beach Services, LLC, d/b/a Barrier Island Ocean Rescue, for the provision of Beach Patrol Services in the Town of Seabrook Island.
