(To be added to and made part of the Tender Documents) The following changes or modifications shall be made to the Tender Documents: TO THE SPECIFICATIONS SECTION 01 00 00 – GENERAL REQUIREMENTS Page 2, add new subsection 1.6.1.5.11 as follows: .11 Safety review and Town’s site safety orientation. Pages 3-4, delete subsection 1.8.3 and replace with the following: .3 Each tank must be fully drained and cleaned of debris, gravel, grit, and aeration equipment

before installation work may start in that area. All tanks where work is required can be physically isolated using existing WWTP equipment. .1 The Equalization tank may be partially drained using the effluent pipe, but all

wastewater below EL 15.6’ will not drain by gravity and must be pumped out and removed for disposal at an approved septic receiving facility.

.2 Train “A” and Train “B” cannot physically be drained using existing process equipment, and must be pumped out. All wastewater from Train “A” or Train “B” may be pumped into the other Train or the Equalization tank, but all sludge and grit must be pumped out for disposal at an approved septic receiving facility. Each train is designed for a peak flow of 1000 gpm, and the average flow to the plant is approximately 520 gpm. All flow transfers must be carried out respecting the actual flow and level conditions at the time of draindown.

.3 Train “A” and Train “B” each contain approximately 2000 cu.ft. per train of floating plastic media which must be carefully removed from the tanks and retained on-site for reinstallation. The media must not be allowed to dry out. The media may be transferred to the remaining operational train for storage if an equivalent amount can be returned to each tank at the end of the work (e.g., from Train “A” to Train “B” when Train “B” is still operating and Train “A” is undergoing aeration equipment installation). In each Train, Cell 1 and Cell 2 each contain 1/3 of the media, and Cell 3 and 4 each contain 1/6 of the media. No specific methods of transfer are required.


The type of media is shown on the Bio-Ring Product Data Sheet in Appendix A, For Information Only.

.4 The existing aeration equipment is shown in drawing 98001-P7 Aeration Building Plan in Appendix A, For Information Only.

Page 4, delete subsection 1.8.5.2 and replace with the following: .2 Work may be performed outside these hours upon approval by the Owner. Request

approval in writing at least 48 hours in advance.

SECTION 02 41 10 - DEMOLITION, REMOVALS AND MODIFICATIONS Page 4, delete subsection 3.7.1 and replace with the following: .1 Restore areas and existing works outside areas of demolition to match condition of

adjacent, undisturbed areas. Patching the existing surfaces of underwater concrete, if found to be in poor condition upon tank draindown, is not included.

.5 Undertakes, in the event of your acceptance of the Tender, to achieve

Substantial Performance of the Work within the number of weeks of written notification of Award indicated above.

.6 Upon request, provide evidence of ability and experience within seven

(7) calendar days of request, including experience in similar work, work currently in progress, senior supervisory staff available for the Work, equipment available for the Work, and financial resources.


.7 Agrees that in the event of failing or neglecting either to provide the Contract Security and Insurance and/or to execute the Agreement in the manner herein before undertaken, then the Tender Security shall be forfeited.

.8 Agrees that unless and until a formal agreement is prepared and executed, this tender together with your written acceptance thereof shall constitute a binding Contract between us.

.9 Understands and agrees that the Owner is not bound to accept the lowest or any tender which they may receive.

.10 Agrees to provide, maintain and pay for the insurance coverages

specified in the Contract Documents. One copy of all insurance policies of the Contractor and two copies of certificates of insurance, certifying to the issuance of all insurance policies, shall be furnished to the Owner. Each and every insurance policy shall name the Contractor, Owner and Consultant as being insured in the full amount of the insurance.

.11 Declares to have personal knowledge of the location of the proposed Work and is informed as to the actual conditions and requirements, including labour conditions and labour rules and shall not claim at any time after execution of the Agreement that there was any misunderstanding in regard to such conditions and requirements.

.12 Declares to have carefully examined the documents and Addenda No. to referred to in the first paragraph of this Tender Form, and the Tenderer hereby accepts and agrees to the same as forming a part of the Contract.

.13 Understands that in the event that the tendered Contract Price is not

within the project budget, the Owner has the right to negotiate the Contract with the low bidder or reject all tenders received.

.14 Agrees that the Warranty Period defined in the Contract Documents

shall be for a period of one (1) year from the date of Substantial Performance of the Work.

.15 Understands that Substantial Performance of the Work will be

established in accordance with General Conditions of the Contract and applicable lien legislation.

.16 Understands that after the issuance of the certificate of Substantial

Performance of the Work by the Consultant, provided that the Contractor has relieved the Owner from any and all claims, demands and lien claims for and in respect of the Contract, and has completed all outstanding items and corrected all deficiencies, the Contractor shall submit an application for Final Payment and the Consultant will thereafter prepare the Final Certificate for payment in accordance with the General Conditions of the Contract and applicable lien legislation


.17 Understands that the payment of holdback will be in accordance with the General Conditions of the Contract and subject to the provisions of the lien legislation applicable to the Place of Work.

.18 Understands the occupational Health and Safety Legislation and any

Workers or Workplace compensation legislation applicable to the Place of the Work and declares that they are in good standing and have all necessary certification as required by such legislation.

.19 Agrees that time shall be construed as being of the essence of the

Contract.

Sealed tenders must be clearly marked “Town of Lunenburg, Wastewater Treatment Plant Upgrade to Aeration System” and must be submitted by exclusively by email to [email protected] before 2:00 p.m. on Thursday March 26, 2020 (the “Closing Time”). Tenders submitted by any other method may be rejected unopened in the sole and absolute unfettered discretion of the Town of Lunenburg (the “Town”). Bidders who submit their tenders by email are deemed to have accepted any and all risks (including, but not limited to, mechanical failure or inadvertence on the part of the Town or its staff) that said tenders are not received by the Town prior to the Closing Time. The Town shall have the right in its absolute and unfettered discretion to determine whether a tender has been received prior to the Closing Time. Tender prices must remain open and available for acceptance by the Town for 60 days after the Closing Time. 3. Tender opening will occur immediately following tender closing. Tender opening will not be public. The opening will be private.
