“ACT ON WELFARE OF PERSONS WITH DISABILITIES” Revision
• Revised by ACT ON WELFARE OF PERSONS WITH DISABILITIES in 1989
• Article 33 (amenities for persons with disabilities) Newly Inserted
• This Act stipulated that the government and local governments should have facilities or facilities for
the disabled to use in the event of the installation of roads, transportation facilities and public
facilities.
Characteristics and Limitations
• Difficult to apply in actual field

conveniently and access information in daily life• Target facilities: parks, public buildings and public facilities, apartment houses, transportation, etc.(*
Transportation was transferred to ACTD in 2008)
Characteristics and Limitations
• Act applicable to the permission of facilities• However, there are some inconveniences that persons with disabilities use the facility due to
the limitation of installation of facilities in compliance with the minimum legal requirements (quantitative installation).
• Penalties of less than 5 million won for non-installed, imposition of a forced transfer of 30 million won or less
• Conducted an annual survey of 5 years

“ACT ON PROMOTION OF THE TRANSPORTATION CONVENIENCE OF
MOBILITY DISADVANTAGED PERSONS (ATCD) ” enactment
• Enacted in January 2005 and enforced since January 2006• The purpose of this Act is to establish human-oriented transportation systems by expanding convenient
mobility equipment in means of transportation, passenger facilities, and on the roads, and by improving the pedestrian environment, so that the mobility disadvantaged persons may travel safely and conveniently, thereby contributing to the promotion of social participation of mobility disadvantaged persons and of their welfare.
• Target facilities: transportation, passenger facilities, roads
• Mandatory introduction of special transportation and low-floor buses• Separation of transportation means from ACT, Ministry of Land, infrastructure and Transport• There are some difference between ACT • not taken Orders to Take Corrective Action
A new law was enacted to separate transportation from ACD

“ACT ON THE PROHIBITION OF DISCRIMINATION AGAINST PERSONS
WITH DISABILITIES, REMEDY AGAINST INFRINGEMENT OF THEIR RIGHTS,
ETC. (APDD) ” enactment
• Enacted in April 2007 and enforced in April 2008• The purpose of this Act is to prohibit discrimination on the basis of disability in all aspects of life, and to
effectively safeguard the rights and interests of individuals discriminated against on the ground of disability, thus enabling them to fully participate in society and establish their right to equality which will ensure their human dignity and sense of value.
• it may be accepted to the National Human Rights Commission of korea, if it is judged that there are discriminatory factors for the use.
• Proceed through measures for remedy of rights through investigation and decision after recommendation of National Human Rights Commission about matters received. (In case of default, the Minister of Justice imposes a penalty charge.)
• Consumer-oriented change that allows consumers who use the facility to directly evaluate facilities accessibility

• In 2005, Discussion on introducing BF certification(private-sector)
• In 2006, official discussions on the introduction of BF certification system (government and
private)
• April 2007, Notice of Ordinance of BF Certification (Implemented by the government)

Land, Infrastructure and Transport
- Guidelines for Ordinance of an Barrier Free Certification (Ministry of Land, Infrastructure and
Transport No. 2007-001)
• September 2007, Designated as institutions(Korea Disabled Persons Development Institute,
Korea Land & Housing Corporation) for operation of BF certification

(ACD enactment)
• Amendment of ACD (2015.1.28)
- Article 10-2
(3) In cases of facilities prescribed by Presidential Decree among public buildings and public
facilities, such as government office buildings and cultural facilities built by the State or a local
government, the State or the local government shall mandatorily obtain certification for such
facilities. (This Article Newly Inserted by Act No. 13109, Jan. 28, 2015)

• · Restriction on installation of inclined wheelchair lifts in new buildings (vertical lift only)
• · To install a ramp on the stage of a seats for disabled people or seats with a height difference
(Within 2 years (2021) after implementation of public facilities)
· The ratio of the rooms available for the disabled such as dormitories and accommodation
facilities to 1% of the total number of bedrooms (from 0.5% to 3% for tourist accommodation)
• Expansion of passable doorway (gate) from 0.8 meter to over 0.9 meter (Not applicable if
already installed under Article 3 of the Addenda)

<Amendment of ACD>
· Enlargement of the passage width (0.8m to 0.9m) of toilet doorway (doors) and enlargement of
the floor area of the toilet (1.6 x 2.0 meters or more from 1.4 x 1.8 meters) considering persons
using electric wheelchairs.
* Toilet floor area by year
- 1998.4.1.~2015.12.29. : Width 1.0m or more, depth 1.8m or more
- 2005.12.30.~2018.8.9 . : Width 1.4m or more, depth 1.8m or more
- 2018.8.10.~ : Width 1.6m or more, depth 2.0m or more

A system that evaluates and certifies the installation and management of amenities by a public designated institution in order to make the use of various facilities more comfortable and secure for all facilities users, including the disabled, the elderly, and the pregnant women.
