With all the Sturm und Drangall the sound and furysurrounding
the Penn
State Sandusky debacle, it is vital to remember to hear the cry
of the child.

Politicians are reasonably expected to act politically; thats
why they are called
politicians. So, what was Tom Corbetts political calculation? I
have to infer falling
re-elect polling numbers, the prospect of an independent,
Democratic Attorney
General after 32 years of one party Republican rule reviewing a
three year, slow
rolling Grand Jury Sandusky investigation, and a viable primary
challenge from
Republican Establishment outsider Bruce Castor, that Tom
Corbetts campaign
team needed a distraction. So they conjured up the idea of
refashioning Tom
Corbett as champion of Penn State football against the monopoly
Leviathan
NCAA.

monopoly-Leviathan NCAA. But Penn State is not a David
confronting an NCAA
Goliath.; it is a private $4 billion Leviathan, itself, with a
football program that,
alone, annually grosses $60 million. Penn State entered into a
settlement
agreement, voluntarily, with the advice of expensive and
highly-competent legal
counsel, after lengthy deliberations by Board and
Administration, and made its
own independent assessment of its own best interests in light of
the
circumstances. Given the$6,500,000 Freeh report (July 12,
2012)commissioned
and paid for by Penn State, and the impending trials of Tim
Curley, Gary Schultz
and Graham Spanier, as well as the civil suits from Sanduskys
victims, it seems
that Penn State made a reasonable and defensible decision to
settle on terms of
the agreement the Governor is now contesting.

In Penn States press release of January 2, 2013 in response to
the Governors
lawsuit,Penn State reaffirmed its commitmentto this agreement
and that it is not
a party to the Governors lawsuit.
Tom Corbett was for it before he was against it.
The Governor has made inexplicably contradictory statements
about the Penn
State-NCAA settlement and his belated epiphany that the
agreement he thought
was a good idea in July is a bad idea six months later, and the
inexplicably
contradictions between his vocal recommendation toPenn States
board to fire
Joe Paterno in November2011, after a 61 year career with Penn
State and withtwo games left in the season before Joe Paternos
self-imposed retirement. And
the Governor was silent when Joe Paternos Penn Statute was taken
down.
Tom Corbetts Worst Nightmare
As Bruce Castor, an experienced trial attorney and prosecutor,
recently saidThe
delay in acting in the first instance, and the rush to get in
under the wire before
an elected, independent Attorney General takes office in the
second, smacks of
political gamesmanship and too little too late.
